to the mid to upper 70s for the inland valleys and along the coast and oakland up to 71 degrees. more on this and a look ahead to that weekend that looks cooler. mike already tracking a crash in oakland. overall the roadways, the green all over means speeds are great, slow approaching 23rd on northbound 880 where there was a crash being moved off the roadway now. maybe a little traffic break and a construction zone there as well as highway 13. we take a live look outside, should be clearing the last few minutes and another construction zone around the coliseum so everybody is on the move right now. a live look at washington where it is down to the wire. if congress cannot come up with a budget by midnight, the federal government shuts down. >> it could be the second in two months. stanford is petitioning plans. it more than 3,000 units of housing for students, staff, and faculty. the plan is finalizing environmental review with response to public comments some time this summer. the mission district reportedly has a new owner of the armory. $65 million deal closed late last month. it has had several lives when it comes to businesses, an entertainment hall, headquarters to a pornography business. in the past it was a sports venue and once held munitions for the national guard. the new owner is talking about a dual purpose building with manufacturing and office space. new this morning, developers in palo alto may soon reportedly face thieves. the city already charges businesses traffic impact fees for commuter trips. the fees can reach six figures.

i'm landon downey and here are today's top business headlines. wall street could open lower following another volatile session yesterday. stocks swung between positive and negative territory. the dow fell nearly 200 points in the final 30 minutes of trading. it had been up about 380 points at a high and down 127 at its

low. investors should expect more of the same type of action in the coming days as wall street adjusts to a stronger economy leads to higher inflation rates. the dow closing down. the nasdaq falling 63 to 7051. walmart is asking vendors to supply it with more items priced at $10 and up. reports this is part of a major push by the retailer to turn a profit at its online business. suppliers say walmart has started to realize it can't make money if it offers the lowest prices online every item and have to spend a lot to ship those orders to stores or customers. and amazon will start delivering groceries from wholefoods through prime now service. customers in austin, cincinnati, dallas, and virginia beach will be the first to get the new service. amazon will expand it across the country later this year. prime members can get their orders delivered in two hours or free. a one-hour option would cost

700 crashes. they found 10% of drivers were sleep drowsy right before crashes. the cdc reports a third of drivers get less than the recommended seven hours. >> i've been there before and what i've had to do, pull over and go to sleep. >> which they say to do, that you really should. you might see marcus on the side of the road. now you know. coming up, we're going to have a way to wake you up. kari's forecast is very sunny out there. >> it is going to be a really nice day. wake up. you know it's going to be a good one. we're going to start out with cool temperatures that will slap you right in the face as soon as you walk out the door. 52 degrees at 8:00. our temperatures making it into the mid-70s again today. we'll talk about how long this stretch of record high temperatures will last coming up. kari just scared folks staying inside a little bit longer. check out the tri-valley commute. it looks good but there is a crash in livermore.

we're still wait to go hear if he will play in the tournament. a lot of people excited about it. >> it's always fun to see. >> you know what? >> driving around with a bunch of cop cars i don't look for a celebrity. i get worried. they have some great weather this weekend in monterey. it is going to be so nice and a lot of people go there and celebrity watch. a great weekend for that. let's get a look at our high temperatures and where we're headed today and more records that may be set. now as we look at napa, san jose, livermore. 76 degrees is our forecast high but the record is 78 so we may not set records here. if we go a degree or two above where we're expecting we may set a new record. san francisco looks to stay below that high. oakland, the high today will be 71 with a record of 79.

santa rosa may be setting records today. the seven-day forecast is up at the bottom of the screen showing a lot more sunshine in this forecast. but cooler temperatures on the way. we still have some warm temperatures on the way today for oakland, up to 70 degrees by 4:00 and then cooling down nicely by 8:00 this evening. starting out this morning as you're getting dressed you do still need that jacket. every single morning cool temperatures but then later today all about the short sleeves and shorts and sounding really congested right now. not only am i battling a cold but also my allergies and tree pollen will be high today. keep that in mind. do not forget your allergy medication before heading out the door. we still have this area of high pressure. it's been so stubborn. it's just not going to budge. even going into next week it will keep us dry. we may not see rain until the end of the month. gradually cooling down over the

next several days for san francisco. the weekend looking perfect with low to mid-60s. for the inland areas, 76 today. mike, how is it looking for the drivers heading out in livermore? a new crash. you're fighting the cold and allergies, you're leading by example for all of our viewers. one new issue for westbound 580. we'll take you out to the tri-valley. slowing out of the altamont and a little slowing as you pass between north livermore and spring town. there may be a traffic break. mild slowing right now and a light volume of traffic to the dublin interchange. i see a little flowing and that's the construction crew that had the two left lanes blocked. highway 13, that closure has cleared from the road work as well. getting over across the bay bridge the south bay shows no

delays. a live shot of the emeryville camera. no backup at the toll plaza. >> a san francisco attorney is being accused of a bizarre scene. >> a dead woman and a construction company. >> reporter: good morning. the state bar of california which investigates attorney misconduct is including attorney bradshaw of defrauding an elderly client out of $157,000. bradshaw built his career in the courtroom, but now his own trial could leave him barred from practicing law in california. according to the charges bradshaw is accused of funneling money from the woman's trust account into a con vux company he helped create. bradshaw says he hasn't taken a dime from that woman's trust and tells us he doesn't even own a construction company. so is the state bar just making

now this is video from the dublin courtroom on monday. several chp officers were there as well as officer cammalleri's mother. cammalleri was in a chp car on christmas eve when ali allegedly crashed his cadillac into that suv. 4:51. now to continuing coverage of school closures in san jose. tonight the oak grove school district board of trustees will discuss where to draw the new neighborhood boundary lines that will determine the schools a child will go to. those lines need to be redrawn after the district closed del roble. you can see where those schools are on the map right there. those closures are due to declining enrollment, fiscal challenges and increasing costs. coming up on "today in the bay," nbc bay area responds. you buy a product from store a but you're told to return it to store b. we see a problem. i'm consumer investigator chris

chmura. nbc bay area responds next. at 4:51 happening now a san francisco man is in custody after allegedly assaulting an officer during a foot pursuit last night. 19-year-old oliver knocked an officer to the ground in the tenderloin. he was arrested a short time later and was wanted for -- an officer was treated and released. the international report investigating the philippines and whether the country's president committed crimes against humanity during his anti-drugs crusade. some say 4,000 people have been killed by police. live picture -

a very good thursday morning to you. a live look outside. this is the san mateo bridge. folks up and about already on your thursday morning. a good looking day in the forecast. we'll check in with kari coming up in just moments. 4:55 right now. nbc bay area responds to a newark family that purchased shoes at one store but they were told to return them to another store. >> chris chmura stepped in to figure out why. good morning. dan's wife bought a pair of shoes on sears.com. after trying them on, she realized they didn't fit. so she went to the return line at sears, and she said she was told instead to return the shoes to the nearest k-mart store, 12 miles and as much as an hour away depending on how badly 880 is backed up. it's true k-mart is owned by the same store but she was baffled she couldn't return a sears.com purchase to a sears store.

so they turned to us for help. we scratched our heads and then we reached out to sears for comment. in a statement the company said the store should have allowed the return and the situation might have been just a training issue. all right. so she should have been able to return those shoes to the sears store. they said sears.com purchases can be returned to sears. in the end, it ended up refunding the $32 and allowed them to keep the ill-fitting shoes. if you have a consumer complaint please call us 888-996-tips or log on to nbcbayarea.com/responds. right now i want to you listen to this next story. it gives snail mail a whole new meaning. a mexico family -- this is in mexico -- a tiger cub popped out after package. >> a tiger cup. someone tried to ship a tiger cub about 200 miles.
