degrees. it's just going to be brutal over the next several days. that's what we'll be watching. keep in mind all of the spectators will be in an open air stadium there over the next several days. here is a look at our highs today in comparison, up to 76 degrees. 70 in san francisco. more on that coming up. mike, you're tracking something on the peninsula. >> it's not a big deal what the report seems to show. highway 92 over at skyline where it meets with highway 35 and heading over to the half moon bay direction westbound. that's where there's some debris reported in lanes there, so that may be an issue leaving 280 and heading to the coast. we're going to note that we'll update you if chp has to close or clear anything. in oakland they still cleared most of the activity at 23rd but the crash may be a distraction on the right shoulder. don't see a lot of slowing there. we have a little bit at the bay

bridge. pretty traditional about now. they should open the cash lanes and then build again over the next 20. right back to you, laura. this is hard to believe but it's been a month, this month, in fact, marks one year since historic flooding hit san jose. remember when this happened? more than 150 victims will file a lawsuit against the city and santa clara county water district. "today in the bay's" kris sanchez joins us live with more on this lawsuit and what the city is now trying to do to prevent this from happening again. >> reporter: you'll remember when we were here last february the water was up to this point and they are not back to normal. nowhere near it. those were the red tagged buildings where firefighters were rescuing people by boat.

it was a shocking sight when firefighters had to rescue those folks by boat. some say they didn't know they were in danger until the water was up to their doorstep. we asked the same question a lot of those folks did which is why weren't they ordered out sooner? why didn't they know they were in danger? the lawyer for those 150 families planned to file that civil complaint against the city of san jose, santa clara county and the water district. that complaint alleges negligence and breach of duty among other things. the mayor conceded almost immediately there was a failure in the system. he outlined some of the changes that have happened in the year since. now they include an improved warning system that includes a system to send text notifications to anyone in the area without signup. if you're just visiting the area, you will get a text

message. expanded training for people who live in the flood prone area so they are not caught off guard again. also enhanced communication with the water district clarifying who is responsible for what. there was a lot of finger pointing on that day last year. the water district made flood improvements including raising the levee height in anderson reservoir which was part of the problem. and there has been an ongoing clearing of coyote creek to improve water flow. it is unclear whether or not all of this addresses what those residents want to hear but we are going to hear from them. they're going to speak publicly. nbc bay area will be there. in san jose, kris sanchez, "today in the bay." 5:04 right now. all new overnight vice president mike pence arrived in south korea. he spent the early morning hours meeting with dignitaries. meantime, the first competition

of the 2018 olympic games already started. >> we're hearing from one bay area man about his fight with olympic officials. >> "today in the bay's" garvin thomas is live. he has to take the bible story off his helmet here. >> reporter: that's right, marcus. one bible story in particular the story of sampson who destroyed the philippine temple when no one thought he had the strength to do it, about doing the impossible and it's what inspired a.j. edelman so much. he put sampson on his skeleton helmet. a.j. had what he called an early mid-life crisis, quit his job at oracle and began a quest to represent israel even though they didn't have a team and he had never done it. years of practice, pain and sacrifice later he qualified for the 2018 games all the while sliding with sampson painted on his helmet. but after arriving here in

pyeongchang, he got a message from the ioc. >> sampson's too biblical so the ioc has rules and regulations on what's allowed on your equipment and those rules and regulations don't apply in normal competition. all my equipment have been sampson. rule 50 prohibits religious imagery. sampson is a biblical character. i understand the decision and respect it. i will remove the imagery that makes sampson sampson. >> reporter: so as you can see edelman is disappointed but it's not something that will keep him from competing. he says he doesn't have a chance at a medal but representing his country is dream enough for him. we have more coming up this morning with more on the vice

funding, wildfire victims, but not all democrats are onboard with this one including house minority leader nancy pelosi. critics say the deal leaves out immigration reform. >> we will remember who was for us and who was against us. >> it doesn't have everything democrats or republicans want but it has a great deal of what the american people want. >> now the senate is expected to vote today. if it passes it would move to the house and hopefully be passed before midnight, the deadline. it is 5:08. canadian prime minister justin trudeau visits san francisco. he's on a four-day tour. this video is his visit to chicago yesterday. he lands at sfo this morning. today he'll meet with jeff bezos and benoff. tomorrow morning he meets with governor jerry brown and gavin newsom. trudeau was sharing the importance of public service during his trip in america. now trudeau's visit got us at "today in the bay" thinking

when was the last time president trump visited the bay area? after becoming president he's yet to visit us in the golden state. he did make a handful of stops in california during his campaign. this is video when he attended the state's gop two years ago. months away from the amgen bike tour. we're expected to learn how san jose will be involved. the sporting event is the largest in california and travels from long beach all the way to sacramento. what's happening today, kari, a great time for the weather. >> we have some warm weather in the forecast. maybe you'll not be going biking but jogging today and right now at 5:09 we're looking at temperatures that will be heading into the low 50s by 6:00 in the morning and then in the mid-60s for noon today. a nice, cool start. also for your drive through the south bay and that commute it's going to be 44 degrees at 7:00

but look at another warm day and windows down letting in some fresh air and temperatures in the 70s today. and, mike, you were checking in on a crash in livermore. >> because we had two vehicles that had to be removed, we'll take you to the tri-valley. the south bay and peninsula all green. no problems. west 580 the slowing is gone but one vehicle reportedly in the center divide. it took one of them over off the shoulder. a smooth drive out of the altamont. slow down to the spring town exit where the crash has some activity. reports of pipes in the roadway. your right two lanes as you travel westbound from richmond to golden gate field, that's the direction where we have reports of the two left lanes with possibly some pipes in the roadway. i hope no one hits them before they check it out. we're watching that area as you come down off the bridge and down to the bay bridge. despite that report of debris in the roadway i don't see any

we are going to have a nice weekend there, but it's been really warm. good to know if we don't have any more snow on the way temperatures will be cooling down. by saturday the high will be 39 degrees. we still have 49 inches of snow at the base. as we go into the next several days, not only in the sierra but bay area cooler temperatures on the way. more on that coming up in five minutes. and over here we're looking at livermore, dublin westbound coming from livermore with these headlights. a smooth drive right now despite the crash which is still clearing. we'll talk about the peninsula coming up. and we're looking for another volatile day on wall street today. the dow was able to eke out a gain on wednesday up 19 points. amazon in the news. it will start delivering groceries from some whole food stores. not in the bay area yet. it tesla said it's speeding up

deliveries of its model three. they've said that twice before. elon musk said if spacex can manage to launch a car into space you could probably figure out how to build a model three faster. keep in mind tesla has said at least twice before it would speed up production and twice it did not. more than 500,000 people have put down deposits for a car. speaking of numbers, i have some silicon valley stats for you and i know statistics are normally boring. you might like these. they're interesting. the average salary in silicon valley, $130,000. half the people in the bay area speak a language other than english in their homes. most immigrants come from asia. twice as many come from mexico. the number of homes sold continues to fall as it has for five years. people aren't selling. a vast majority of people who retire in silicon valley stay in

their homes instead of downsizing. there are fewer houses available if tech buses were a transportation agency they'd be the seventh largest in the bay area, about the size of cal train. there would be that many people on the roads. >> interesting. a lot of people -- there we go. a lot of people travel up to tahoe from the bay area and the tug of war over short-term rental units in south lake tahoe is heating up. a recent town hall meeting reportedly drew such a massive crowd they had to end the meeting early. full-time residents say the problem is getting out of hand, that despite a new set of rules that took effect in december, residents say tourists and vacationers are leaving behind trash crowding driveways and throwing loud and disruptive parties. now long-term residents are pushing for a ballot measure

cyber attacks. mcafee says you should be wary of e-mails related to the 2018 olympic games. some scammers are using the olympics as part of a phishing scheme. one tip, double-check that url address to make sure it looks legit. 5:24. martinez police warning about a scam involving parking citations. people are asking for a payment for a parking violation. at least one comes from a very official e-mail address. they do use an outside vendor but they never send e-mails. they anticipate more scams as tax season gets under way. san francisco is topping the list of the lowest credit card debt in the nation. the new study by creditcards.com looked at the 25 largest metro areas and compared the debt and median income. texas and florida are among the states with the highest credit card debt. experts recommend dedicating at least 15% of your grossmontly

income to paying off debt. it appears a major development tied to the giants may be ready to move forward. for years the team has been working on a mission rock development that would create 1,300 housing units along with office and retail space. the board of supervisors is expected to vote next week. the state lands commission would have to sign off on that deal. "forbes" is out with the latest estimates on how much each nba team is worth. the warriors got another big bounce. valued at $3.1 billion. that's about 20% higher than one year ago. the warriors rank third overall behind the knicks and l.a. lakers. for the first time all nba teams have a value of $1 billion. >> now that's a lot of confetti. 5:25 right now.

eagles fans will no doubt be flying high this morning. >> that's because the city of philadelphia holds its first ever super bowl victory parade. live pictures this morning. look at that. thousands -- tens of thousands of fans are already gathering right now. pretty exciting. just a huge crowd. >> everyone wants to be a part of it. >> the eagles defeated the new england patriots in sunday's super bowl game in minnesota. this is philadelphia's first nfl championship since 1960. back then there was no such thing as the super bowl. many schools and businesses are even closed today. city leaders believe more than 2 million people will attend. pretty exciting for them. >> i have a friend who works for our sister station in philly and is posting something about it right now so i've been watching. >> probably all they're covering. coming up on "today in the bay," more news for you. the bay area's largest plan for the year ahead.

this thursday. it is 5:30. san mateo looking right there some people walking around. we thank you as well. thank you for being here with us. >> thanks for being alive. good morning to you. i'm laura garcia. >> and i'm marcus washington. right now someone else is alive with a great forecast for us, meteorologist kari hall. kari, i'm liking this forecast. it looks pretty good. we're going to have another really warm day. it starts out cool, though. a live look in san jose, mostly clear skies and then as we go throughout the morning we'll be at 56 degrees at 9:00. normally for early february we're at 61 degrees but look at these temperatures again today heading back into the mid-70s. yesterday we set some records. you know how it goes. it starts out in the upper 40s with highs in the 70s by the time you pick them up from school.

all of us will feel another warm day. it comes just in time for the weekend. so more on that and also we're going to skip right ahead to the weekend coming up in about seven minutes. mike gets us out the door with a crash on the bay bridge. >> i didn't know a clipper could do that, skip right to the weekend. the bay bridge, now you see the taillights westbound. actually the incline and over there is the approach to san francisco. as we look at your map, that's good news. there's a little bit right around as you pass 90. there may be activity on the tail end heading to san francisco. the bay bridge toll plaza has your metering lights on. that's the slowest spot of the bay right now. no delays coming down off the bridge. south bay, peninsula and the tri-valley look great. nice start to the commute. back to you. 5:31.

happening today the mayor of the bay area's largest city will unveil his plan for the year ahead. "today in the bay's" bob redell spoke with the mayor. what does mayor liccardo see as the biggest challenge ahead? >> reporter: good morning to you, marcus. the housing shortage. when i spoke with mayor sam liccardo of san jose in an 18th floor office at city hall he noted while silicon valley in recent years not many people have benefited at all. anybody scraping by paying high-priced rent. the mayor will acknowledge the from degrees made, the rebuilding of the police department, the fast growth, and the opening of b.a.r.t. stations at san jose later this year to name a few but will call attention to the affordability crisis. if you think about it you need to make more than $200,000 a

year just to afford a median priced home. the mayor will focus on his plan to build more than 25,000 housing units over the next five years. 10,000 of which will be priced for lower income households. >> i heard stories of kids whose families were evicted from apartments because they couldn't pay rent. worried they can't go to college, about the widening gap. we have to do more to ensure. >> reporter: mayor sam liccardo will deliver his address at san jose city college. the doors open at 6:00. roaring live outside san jose city hall, bob redell, "today in the bay." >> a lot of people are talking about this one, bob.

it is 5:33. the man accused of driving drunk, then high, killing officer andrew camilleri in hayward returns to court for his arraignment for a third time. the original arraignment for mohammed ali last month didn't happen. monday's hearing was postponed to today. several chp officers were there as well as officer camilleri's mother. camilleri was in a chp when ali allegedly crashed his cadillac into the suv. to our continuing coverage of school closures in san jose. couldn't the oak grove board of trustees will discuss where to draw the new lines to determine which schools a child should go to. you can see where those schools are right there.

new this morning we know how many citizens and local governments weighed in on the stanford expansion. the county is addressing the concerns. the school went on record. santa clara county planning department got 184 comments from private citizens, 1 letters from private agencies and 12 letters from nongovernmental organizations. the groups range from city and county governments, school, water districts and transit agencies. by lausanne at thw santa clara address each one. a sprawling development project over 17 years would include 2.3 million feet of academic space, more than 3,000 units of housing for students, staff and faculty. a planner tells us the plan is to finalize the environmental review some time this summer. also new this morning more

and more americans are not getting enough sleep. they get their day started. the problem of drowsy driving is eight times worse than we thought. >> what we need to know before driving to work this morning or driving the kids to school. sharon? >> reporter: be careful out there. aaa studied drivers over several years and the research is eye opening. >> i got you at ten over. when you changed lanes you didn't signal. is it just because you're tired? how much did you sleep? >> reporter: this is video of an officer pulling over a drowsy driver. aaa put dash cams in more than 3,000 cars and studied about 700 crashes. the study found that 10% of

drivers had been dozing before the crash. aaa says that's much higher than estimates. if you cut that time by two to three hours aaa says the risk of you getting into a crash while tired at the wheel is four times higher, equivalent to the risk of drunk driving. >> drowsy driving affects all of us. the increased awareness and getting out the message people need to try to prioritize sleep. >> reporter: some signs to look for if you're tired while driving, drifting from your lane or forgetting where you just drove minutes ago. take a break if you see those signs. even a quick nap could save your life. >> good to know. i think everyone is a little guilty of that.

richmond down through berkeley. pretty scattered. palo alto. we have more company. the morning commute times. we're planning our weekend and there's a lot going on. we'll have some great weather, 17 degrees for those inland valleys. temperatures will be cooler than recently but still nice and time to get outside, even a beach day. 63 degrees for the coast on sunday. up to 70 inland. this is happening in san jose and campbell on saturday at san jose christian school and a great event for the kids starting out at 62 degrees. bring some sunscreen and lots of drinks, too, in the low 70s.

kari weather tease as we get a look at our current drought monitor we have abnormally dry conditions in the north bay while the rest of the bay area also still not seeing drought conditions yet but that is something we'll have to monitor. more on this in a minute. headlights here on 101 in san jose. a little worse earlier. i'm searching for a reason. it may be the typical pattern. i'll swing that coming up. thanks so much, kari and mike. the race is tightening for governor in california. new statewide polls suggest that gap is narrowing. according to the latest public policy poll, gavin newsom is favored by 23% of voters. former l.a. mayor antonio villaraigosa with 21%, higher

than other recent surveys. after that it's a wide gap back to john chung at 9%. one in four voters are undecided. we're getting a better idea about the numbers of enrollees who signed up for federal health care, nearly 12 million people have enrolled for 2018. about 3% lower than 2017. covered california has been 1.5 million enrollees. 16 states have higher enrollment than one year ago. all this despite gop efforts to eliminate president obama's affordable care act. president trump says he likes the new budget deal and will sign it. >> they have to hurry, right? the government will have to shut down by tonight if they don't. republicans and democrats had a deal and it is a doozy. there's something in it for almost everybody.

it will increase spending even more than donald trump asked for. money for infrastructure and children's health. it gets rid of the sequester. if i could underline this or make this flash i would because this is really important. how do they pay for this? $300 billion added to the budget. they add to the deficit for the second time in just a few weeks. at least a half trillion dollars. you saw nancy pelosi on the record and setting a record as well on the floor of the house yesterday. she's objecting to what is not in the budget deal. a solution for dreamers. she's demanding the speaker of the house, paul ryan, make a promise. he'll allow a debate and a vote. she's demanding the same to the house mitch mcconnell made to

insane. >> what an honor. she is 31 years old, her fourth trip to the olympics. she's the first american athlete to win an olympic singles luge medal. good for her. >> talk about an honor there. not only are you going to the olympics, you're there and get to carry the flag. >> you have to carry it the whole way around. >> good thing they're athletes. >> we're hoping. >> they have arms that we don't. so we're going to be so excited watching all of those games kicking off and the opening ceremony tomorrow. we are going to have some very warm weather here across the bay area. it shows you just a few minutes ago and i wanted to dive deeper into this because this was released just a few minutes ago and we now have abnormally dry conditions across the bay area and also there has been an increase in severe drought for southern california. we've had the lack of rain so we knew this was coming. as we see the yellow outline that shows the areas including

the santa cruz mountains. now in abnormally dry conditions and also for solano county, napa county and also extending into parts of marin county where we are abnormally dry and we are going to continue to possibly have to watch that and also our record high temperatures as we go throughout the day. now we are heading into the mid-70s for napa, san jose and livermore, and we should stay just a couple degrees below that record high but if we go a couple degrees above that we are going to set some new records again today and in oakland we're going to be up to 71 but the record high today is 79. santa rosa, 75 degrees with a look at all of our high temperatures reaching into the low to mid-70s this afternoon. as you get dressed, you do need a jacket as you step out the door because, of course, it is a cool start but then later today some short sleeves and then getting out the door for school this morning in livermore, 44 degrees to start but look at those 70s we're heading to by the time you pick them up from

school. our seven-day forecast shows more temperatures that will be cooling off but still a lot of sunshine as we go into early next week, inland areas cooling off but gusty winds as well. mike, you are checking a slowdown in san jose. >> a little alarming as i looked up and saw a stack of headlights, stopped for just about a second but then things started to move again. someone hit their brakes harder. we expect to see this in the one section approaching our camera right there 680 and 880. that's why we have this funnel. folks coming off 280 and 101 from the south county to morgan hill. a smooth drive there. over to emeryville where we're talking about the other issue out of san francisco, the lower deck. i saw some flashing lights and they have gotten that disabled vehicle cleared over to treasure island. there may be one lane blocked eastbound out of san francisco but westbound only backup is at the toll plaza. up next on "today in the bay" we investigate.

>> worried about potentially facing criminal charges? >> no, not at all. i haven't done anything wrong. >> a san francisco attorney hired to help an elderly woman protect her money is accused of lining his own pockets with it. coming up, we'll tell you about the bizarre scheme he's accused of and explain how the watchdog agency is now attempting to take action. but first, happening now at 5:52, a san francisco man is in custody after allegedly assaulting an officer during a foot pursuit last night. police say dante oliver knocked an officer to the ground in the tenderloin. oliver was arrested a short time later. he was wanted for breaking a store owner's nose. plus the international crimes court is investigating the philippines, whether the country's president has committed crimes against humanity during his anti-drug crusade. some reports say that 4,000 people have been killed by police. music log

athletes. our coverage continues in two minutes. san francisco attorney is being accused of a bizarre scheme, and it involves a dead woman and a construction company. >> we first told you about this yesterday morning on "today in the bay." investigative reporter bigad wraps it up for us today. >> reporter: good morning. the state bar of california which investigates attorney misconduct is accusing lawyer bradshaw of defrauding an elderly kleine oelder ly client out of over $150,000. his own trial could leave him barred from practicing law in california. according to the charges bradshaw is accused of funneling money from the trust account no a construction company he helped create. bradshaw says he hasn't taken a dime from the woman's trust and tells us he doesn't even own a construction company. so is the state bar just making all this up? >> i can't speak to their understanding of the law. they've made an allegation.

it's part of a vision zero campaign which is already in the works here in the bay area. the plan focuses on keeping pedestrians and bicyclists safe by raising public awareness and asking police to crack down on dangerous drivers. the executive director says it's a great plan. >> we realize that in order to create a more economically vibrant community we need more walkable space. >> police say the driver is typically at fault in these crashes, not the pedestrian or cyclist. >> trading stocks via twitter, ameritrade is allowing stock trades on the social media platform. "the wall street journal" says customers can interact with the discount broker asking questions and requesting information on specific stock. they can execute a trade using a direct message after. happening today travis air force base celebrates its 75th

anniversary. it will be held from 2:30 to 4:30 this afternoon in 847. the buildings were built in 1942. it was known as the army air base during world war ii. it was renamed travis air force base in honor of brigadier general robert s. travis who was sadly killed in a plane crash in 1950. as part of the anniversary ceremony a special walk about display and officials will unveil a new 75th anniversary logo. right now at 6:00 after years of planning and preparation the 2018 olympic winter games are about to begin, but the excitement builds. there's also controversy brewing this morning between vice president mike pence and a u.s. olympian. we're live in south korea with a battle already under way. plus, still searching for answers. nearly one year after the historic flooding in the south bay. the plan victims will carry out today against the city of san jose.
