we hope you )ve been enjoying coverage of the 2018 olympic winter games. welcome to "today in the bay." we hope you've been enjoying coverage of the 2018 olympic winter games. you're looking live at the olympic torch on this monday, february 12th. depending on how long you're watching, you might have seen jamie anderson from south lake tahoe, she won her second straight olympic gold medal, you will hear from her throughout the morning. very exciting time. our team of reporters also following this morning big local headlines as well. good morning, i'm laura garcia. >> and i'm marcus washington. first let's get you started with your day with a check of your traffic and weather. last night i slept with the window cracked open just a little bit. >> it was windy and cold. this weekend those winds were gusting and that brought in some cooler temperatures with a cold front that rolled through the

bay area. we're starting out this morning just above freezing in napa, we are at 33 degrees, it's 45, though, in san jose. we're all feeling the cooler temperatures as you get ready to head out the door, a live look at san jose, mostly clear, we will see a few clouds throughout the next couple of hours. temperatures staying in the 40s and a slow warm up today. it's not going to be anything like what we had last week. we will talk more about that coming up. mike, you're starting out with an important road closure. i am. this is not a freeway, but it is a major roadway. bob redell has been reporting about an issue for folks in livermore, it's another major commute route. this is tesla road connecting some folks cutting through between 580 and -- well, 580. they are avoiding the altamonte pass. there has been a closure from 580 along corral hollow to tesla road, it's the continuation of the same roadway past -- well, basically an offroad vehicle particular recreation area. this crash i'm still finding out more details as far as the

injuries go, but whatever is going on its closed that roadway. that's an early start to the early slowing, we will track that is correct also slowing eastbound 580 at grand because of an earlier crash. now to a disturbing investigation in san francisco, this morning police are looking into a heartless killing of a dog. donkey was thrown off of a high-rise garage this weekend. >> "today in the bay's" pete suratos joins us live in san francisco with what led up to this tragedy. i can't remember anybody ever doing something like this, pete. >> reporter: good morning, laura and marcus. truly a disturbing story when you hear the details of all this, but we do know that 35-year-old joaquin best is in custody at san francisco county jail for allegedly throwing that four-year-old chihuahua off the seventh floor behind me on saturday. that's what police are saying at this time. let's show you guys a picture of

that dog, that is the four-year-old chihuahua who went by the name of donkey. san francisco police say officers responded to the 400 block of stockton for the report of a car burglary and a dead dog. this parking structure is in the union square area of san francisco. now, they're saying that the victim returned to the location to find the dog in the hands of another person. the victim felt the dog may have gotten out of the car and fell from the seventh floor of the garage, but police found a trail of evidence showing that the dog was actually thrown off of the ledge by the suspect. they say that they have evidence that including video and audio from a nearby dash camera. now, that suspect was eventually located and arrested on sunday near polk and bush streets. now, the suspect faces several charges including animal cruelty and grand theft and while an arrest has been made, police are saying if you have any information to help out with this case, contact sfpd. live in san francisco, pete suratos for "today in the bay." >> thank you, pete. those poor owners.

just tragic there. it's 4:33 right now. another 49er in trouble with the law. it is just the latest in a string of bad behavior by players. reuben foster is facing domestic violence charges. we have video of foster leaving santa clara jail last night after he was booked and arrested. investigators are not releasing details about exactly what happened but we do know that foster was also booked on suspension of possessing an assault weapon. the 49ers said the team is aware of the situation and are gathering all pertinent information. "today in the bay's" bob redell is looking deeper into the story, he will join us with more details at 5:00 a.m. stanford university that has left a lot of people feeling violated after these acts. palo alto online reports there have been a rash of thefts on buildings on the west side of the campus. expensive items stolen. last week laptops, smart phones and other devices were taken from cubicles in study rooms and

even offices. a ford truck was stolen but later found in loopleasanton. we were talking of those gusty winds just moments ago with meteorologist kari hall. continuing coverage now, a man fighting for his life in san francisco after those gusty winds actually knocked down a fence and construction items on to him and a woman. in the video you can see a man he was getting help from emergency crews. it happened yesterday in the mission. neighbors who ran to help the man say the man had suffered a serious head injury. >> i mean, it wasn't that loud of a -- it was mainly i could just hear them screaming for help. the man his his head on the back, so he was bleeding out the back of his head pretty bad, actually. >> we're still waiting for word on the man's condition this morning. some neighbors tell us the construction company that had fencing up had left the fence and other construction materials unsecured for days.

4:35. live now to pyeongchang as the olympic flame burns bright at this hour. you're looking at it right now. south korea put on a show on friday if you were able to watch the opening ceremony. dozens of medals have been won since friday. >> busy time. check out jamie anderson from south lake tahoe competing in the slope style event last night. she won the gold. she finished first in the same event at the 2014 olympics in sochi. anderson overcame gusty winds they had as well to come out on top. very exciting. here is a look at the medal count so far. norway leading the way with eight medals, canada with six, germany and netherlands are tied in third spot with five medals while team u.s.a. fourth with four medals. business headlines. wall street could open sharply higher this morning as we come off a roller coaster week of training. on friday stocks tested fresh lows before bouncing off the levels to close firmly in positive territory. for just the second time ever the dow was both down and up by 500 points in the same day. the dow, nasdaq and s&p 500 had their worst week in two years on concerns rising inflation could lead the fed to hike interest rates more often this year. another misstep for wells fargo, the bank has been trying to make amends to customers who were forced to buy car insurance that they didn't need, however, wells said 38,000 customers mistakenly received a letter that did not contain a refund, although one non-customer was sent a check. a spokesperson says that wells fargo will work to ensure customers get the appropriate communication. takata has reached a settlement for victims injured by its air bags and that could clear the way for its u.s. business to exit bankruptcy.

the japanese company's air bags which can explode with too much force has been linked to at least 21 deaths and hundreds of injuries prompting the largest recall in automotive history. under the agreement a trust will be created to compensate victims with amounts ranging from $10,000 to $5 million. marcus and laura, back over to you. >> all important to get that replaced. i know i had a recall on mean. >> get that taken care of. >> done. thank you, landon. 4:41. anybody planning a trip to disneyland? you might want to start saving a little bit more. ticket prices have gone up again. starting yesterday a regular price of admission is $117, that's up $7. single day ticket pricing during peak periods is now $135, up $11 there. prices will going up at disney parks in florida. last year disney's 11 parks around the world brought in, get this, $45 billion, yeah, that's

we )re looking live at san francisco this hour. and welcome back. you are watching "today in the bay." as we take a live look out on san francisco right now, a beautiful way to start out your monday. we're here to help you get on your way. the time now is 4:45. i think the winds will help you get on the with a i. >> push you right along. >> yeah. >> i mean, those temperatures, the snap and then it changed and it was so much cooler. that's kind of what we were expecting, but when it actually happens like, wow. >> yep. >> told you. >> it did get a lot cooler. we are going to have a cooler day today, looking at temperatures that will be falling as we go into the

afternoon. i wanted to give you a look at storm ranger this morning standing around the bay area. also wanted to point out how high definition it is. right now we're seeing those wind turbines in those areas, you are always going to see that here on storm ranger, but all clear this morning. i wanted to take you to the sierra, check this out this morning, we have a weak disturbance moving through that's bringing just enough to drop a dusting of snow over parts of lake tahoe, so it's going to be a beautiful morning starting out there. now, we are feeling some temperatures almost cold enough to snow in napa, 33 degrees, it's 48 degrees in oakland and 47 degrees now in palo alto. san jose starts out the morning at 45 degrees, but with our breezy winds throughout the day it's going to feel cooler than this, but this is where we should be for february, right? we're finally going to have some normal temperatures. it's been so warm last week we're going to bring it back to normal with high temperatures in the upper 50s for concord and livermore, san jose 62 degrees

and 59 today in san francisco. so getting dressed this morning you do need the layers, starting out with a coat and also some long sleeves, and as we go throughout the day we will also have maybe the best day to wear some boots. so that would be a good option today because it will gradually warm up as we go through the rest of the week. as we go throughout the rest of that forecast, what's causing those breezy winds will start to slide to the south. we will still have the high pressure but there will be another area of low pressure dropping in by early next week and that could bring us some changes, possibly so many rain in the bay area but still all dry this week. and our temperatures that will gradually warm up from the upper 50s today in san francisco, inland areas up to 61 this afternoon. mike, you are hearing more about that tri-valley road closure. at least a little more, kari. we've been in contact with dublin chp that's their jurisdiction on tesla road. most of the sensors are great but we are talking about this of course an affect on the altamonte pass as well. this closure tesla right around

where it turns to corral hollow, we will call that police activity for now. there's that closure, tesla road is an alternate for these folks travel to or from 580 and 580. basically cutting around the backup at the altamonte. that's going to get a little heavier as folks can't use the alternate this morning. keep that in mind. another alternate for you, ace trains moving smoothly out of that, area, bart no delays on pleasanton and dublin, all the rest of the transit agencies look great. looking at the approach to the bay bridge, no major issues. a very smooth flow. the cash lanes are sorting themselves out as they open all the cash lanes this morning for the takers. i want to give you a quick look further north at the richmond-san rafael bridge bridge, this is a live picture, you see cars coming toward us, just a few. back to you. the next story isn't going to take a victim of a crime feel any safer. a crisis a decade in the making

delaying criminal cases around the bay area. hundreds of those victims and criminal defendants are waiting a year or longer to go to trial. >> it's frustrating. senior investigative reporter stephen stock joins us with the details. >> reporter: a decade ago during the economic downturn the governor and legislature took hundreds of millions of dollars from california's court budget. that money has never been replaced. now that lack of resources is creating a backlog of thousands of criminal cases around the state and the bay area, but some courts such as sacramento county have found a way to keep the system running efficiently. >> there became a culture here in the court in our county with our justice stakeholders of cooperate tichbs. >> david dealba is presiding judge of sacramento county courts where 97% of all criminal cases are disposed of within a year or less.

>> many of the criminal filings are filed in what we call home courts and they stay in those courts unless they can't be resolved and then they're sent to a trial court. >> the state average for clearing criminal cases is 88% within a year but in some courts that do not use the system of home courts, including several here in the bay area, that percentage is much lower and many criminal cases languish for years before they go to trial. >> we think we've learned a lot and gained a lot of the efficiencies that you're probably concerned about because of that design. >> coming up tonight we'll show you exactly which bay area criminal courts are lagging behind and we'll dig into why that's happening and find out what they plan to do about it. that's tonight. i'm stephen stock. if you have a story for our investigative unit you can always give us a call, number 888-996-tips or visit our website nbcbayarea.com/ve

>> a store delivers the wrong mattress over and over and over and over again. so the consumer asks us to put this nightmare to bed. i'm consumer investigator chris chmura. nbc bay area responds next. new files a lawsuit against harvey weinstein and his former company. happening now, new york's attorney general files a lawsuit against harvey weinstein and his former company. the film producer facing dozens of allegations of sexual abuse including rape, but denies nonconsensual sex. the lawsuit alleges he abused female employees and made verbal threats to kill staff members. parts of puerto rico thrown back into darkness, an explosion and fire at an electric substation creating a huge setback to everything to restore power five months after hurricane maria hit that island. several areas without power including san juan.

lots of cases where deliveries go wrong. but, this one stands out. a san jose man called us after lot of cases where deliveries go wrong, but this one stands out. >> so a san jose man called us after four -- four botched attempts to deliver his mattress. here is consumer investigator chris chmura. >> reporter: good morning. robert purchased a california king bed from jcpenney back in september. california king, remember that. when the delivery truck arrived the workers unloaded a standard king. that is not what he ordered so he refused delivery and rescheduled. on the second attempt the same thing happened, as well as the third and the fourth. wrong bed and refused delivery. so robert contacted our team for help. we reached out to jcpenney and

it confirmed with the vendor that it was going to ship the correct mattress, but the fifth delivery in early december, yes, it was wrong again. a total of five wrong deliveries. so what was causing all these mixups? well, in a statement when we contacted jcpenney again the company said there was a coding issue associated with a different size box spring. the store then rescheduled delivery of the bed and we are happy to report attempt number six finally worked. and for the trouble jcpenney also gave robert a full refund, $2,381.53. he also got to keep the mattress. by the way, he told us he plans to donate $1,000 of that refund right there to sacred heart community services. if you get a delivery do exactly what robert did, check the product before its unloaded or installed to make sure it is exactly what you ordered. please call us if you have a
