be a little bit warmer than yesterday so making some improvements here. i know a lot of people are complaining about the cold weather, we are in the low 40s still by 8:00, at noon 60 degrees, mid 60s today which is year, we are looking at highs that will reach into the mid to upper 60s for the south bay, east bay up to 66 degrees in concord and for the peninsula we've got some low to mid 60s there as well and san francisco 61 in the mission district while the north bay reaches into the mid 60s today. as we head over to mike, you've been tracking issues in the east bay. >> we had slowing for oakland, road crews were moving, that is what i suspected. it's not clear from the report, but it is clear from the sensors. i'm going to say that's better between 23 ard nd 29th. a little slowing popped up over at the toll plaza and the incline. we will track that build, but it's right on schedule. so the rest of the bay. over here northbound 280 at magdalena one crash reported.

everything is in the sent tear divide, no slowing coming up from the silicon valley. back to you. now to a developing story we continue to follow this morning. the gruesome killing of a 19-year-old woman is leaving many people baffled. she was stabbed and left for dead on a rural east bay road early yesterday morning. in fact, we brought you that coverage yesterday on "today in the bay." now we're learning more about who she was and who deputies believe might have killed her. >> "today in the bay's" bob redell is live at the santa rita jail where two suspects are behind bars this morning. bob, deputies tell us that the victim's final words helped crack this case. >> reporter: they did. according to law enforcement, law enforcement calls it a dying declaration and in this instance the 19-year-old woman told the alameda county sheriff's office who her attackers were, she identified them by name and both of them a man and woman who also happened to be 19 years old are in the santa

rita jail. unfortunately the victims who friends identifiede/q as liz ana did not survive the attack. she had been beaten, stabbed and left for dead according to investigators. she crawled 100 yards to flag down a driver. that driver does want her family to know that she had the spirit and fight to live. sadly andrea died a couple hours after being lifeflighted. deputies did arrest the two suspects at this home in mow des stowe. the sheriff's office is still trying to figure out the motive, whether this involved a love triangle, revenge or something else. andrea had recently moved from san jose to tracy with her parents and little sister. a friends tell us she was not happy with the move out east and there will be some sort of conflict with a group of girls. they said andrea had been skateboarding with a group of guys. while the share rfs office

slopes. >> garvin thomas caught up with him. you say he's focusing on what's next. >> reporter: that's what you got to do, right, marcus, in this situation? you know, it's one of the cruel facts about the olympics, you spend four years training so hard, doing everything right and then something comes up that is out of your control. for bryce bennett it was the wind. yes, we are talking about the wind once again in pyeongchang. while it wasn't so windy that they had to cancel or postpone the alpine event it was unpredictable and bryce skied right into a head wind on the downhill part of the race. this is in a sport where winners and losers are separated by hundredths of a second, that was enough to keep him in the back of the pack. we talked with bryce right after his race and asked how this might change his plans for his next race, the men's downhill. >> it was good to get on the track and get some time on the track. i'm going to have the same approach and same game plan. i thought i did well and i was in a good place mentally for

5:08. time for a look at weather and traffic together. kari, we are suddenly bundling up. >> yeah, because it's really cold out there in some spots. not all of us are feeling that chill. san francisco is at 53 degrees, that's the warmest spot, but we are here at 34 degrees now in morgan hill, 41 in livermore. we do have a chilly morning and a cool morning commute as you drive through the east bay. mostly clear skies and no issues with fog. so that's good news. even though it is still a little breezy out there and those breezy winds will make it feel a little bit more of a chill to the air with our temperatures at noon at about 60 degrees. so it will be a nice noontime temperature to head outside. highs today reaching into the mid to upper 60s for the south bay. mike, what's happening as those drivers head out? you have no major issues, right? >> nothing right now, no big stuff. a commute and nicing behaving one. a little slowing out of the altamonte pass and that's what we would expect. monitoring that crash in los

it is an all clear morning right now at 5:14 as you get ready to head out the door in san jose. we are going to have a chilly start so make sure you grab those layers before you head out the door. let's go to los gatos, temperatures will be in the low 40s at 9:00 and we will be at 56 degrees at noon, still kind of breezy with highs today reaching into the low 60s. this is where we should be for february. we will talk about where we're heading for the rest of the week and when we could see some rain moving in. that's coming up in about five minutes. here is our live look at the san mateo bridge. those taillights heading west towards foster city over the high-rise. no wind advisory for them this morning. right now we will celebrate the up not minute.

another crazy day for stocks on tuesday, the dow will open just over 24,600 after jumping 410 points yesterday. add monday and tuesday together, you get the biggest two-day gain in more than ten years. nasdaq up 107. we are still off all time highs. news of layoffs, barnes and noble says book sales were not strong over christmas and will downsize. ironically barnes and noble's arch enemy amazon cutting a few hundred people from the seattle headquarters as well. café x will open another location in san francisco, this time in the financial district. this was dreamt up by a college kid from hong kong. the brees at that works without breaks, but uber will start requiring its human drivers to take a break if they've worked 12 hours straight. after 12 howard you can't pick up any more riders for a six-hour period just to make sure you get a rest. more bad news if you're looking

for a house. the california association of realtors said the median price on a bay area home jumped 12% last month. there aren't enough houses for sale particularly under a million bucks. the median price for bay area wide and that's bay area wide, $880,000. i thought you might like this, this is video of the olympics the way the "wall street journal" does it because the "wall street journal" didn't pay for the rights of the broadcast of the olympics like we did, so they're doing -- oh, no, they fell. they're doing the figure skating play by play. >> those are forks. >> yes, forks and spoons. they win the silver. >> wow. they've got a lot of time on their hands over there. >> you can either pay a couple billion or whatever it is for the olympics -- >> or tell an intern to do. >> get an intern. >> 5:16 right now. we have the best coverage right here. san francisco commissioners reportedly raising concerns

about potential security risk in the use of drone technology. according to the examiner port leaders today will set new data storage standards in the event drone contractors are ever hired. now, that's to avoid information getting into the wrong hands. commissioners are concerned because recent security risks have emerged in connection with one drone manufacturer based out of china. north bay fire victims have a new way to get help. today a new office opens up in santa rosa that hopes to help sonoma county fire victims rebuild faster. the resiliency permit center opens this morning on ventura avenue. the goal here to help about 3,000 homeowners. the center can process applications in five business days or less. the county has reduced building permit fees for fire victims. social media can do pretty amazing things for one sacramento area woman, it allowed her almost unthinkable reunion with a dog that she lost nearly a year ago. get this, the dog was found about 300 miles away.

she posted flyers when her siberian husky vanished last april with an outdated microchip information. the reunion only happened because a social media posting was shared tens of thousands of times. on sunday someone in bakersfield spotted champ and went online to look for answers. volunteers then jumped on board to help. >> i love dogs. i love them. they all deserve a great home. >> i believe that someone probably took champ, but i'm not exactly sure. he just wasn't home one day. >> a group of four husky lovers helped shuttle the dog by car back to his owner. thanks again to social media. champ's owner still has no idea what even happened to champ, but whoever had him reportedly, i guess, took pretty good care of him. what a reunion, right? >> yeah. >> husky lovers, lovers of huski huskies. >> there you go.

>> oh, my goodness. just in time for valentine's day, right? >> they keep you warm, too, right? >> and you do need to do that in morning as you get ready to head out because it is a chilly start in parts of the paris. here is a live look outside in san jose with clear skies and it's going to start out cool. seven-day forecast is coming up at the bottom of the screen and you will want to take a look. we will see those temperatures in the mid 60s today and in san jose we are starting out at 44 degrees, we also have 44 right now in palo alto and 47 in oakland. 53 in san francisco. just a degree above freezing in morgan hill. as you head out for a jog this morning in oakland we will be in the mid 40s and throughout the day making it into the mid 50s by around noon. i definitely wait on that sunshine and the slightly milder temperatures. heading up to 63 degrees today in oakland and napa and santa rosa 65 degrees. in san jose 66 degrees and

livermore 63. now, we're going to see m o changes ahead. some times when the winds will pick up. as we go into the weekend we will start to see more clouds moving in as an area of low pressure moves by and this will drop in cooler temperatures. doesn't look like there is a lot of rain associated with this, but this will at least gives you a slight chance heading into early next week and also on tuesday as well as we see a couple disturbances dropping in and bringing in some more normal type weather for this time of year. we're still going to stay in the low 60s in san francisco over the next several days, morning temperatures in the mid 40s and we start to see clouds rolling by on sunday, monday as we will have our chance of rain and we do desperately need that rain because we are really lacking with our rainfall deficit. as we head over to mike, the commute still pretty calm. i would give some of that up if we would get some rain. we're looking over here to the south bay, also not a big deal, but the only incident we have on

our maps, this is los altos hills, tracking this crash northbound 280, not a problem as you're coming up out of the foothill boulevard area and heading up past foothill college. nice smooth flow of traffic over here, the tri-valley this is the only real slowing we have over at the altamonte pass. westbound 580 everything is moving sloil but smoothly. tesla road is open this morning. i will post the article with the details of what happened ned, why they had it closed, really grizzly, but if you want to know what's going on i will send at least the technical details. 580 slowing out of the tri-valley. we are looking at the approach to the bay bridge, really basically at speed as you approach the bay bridge toll plaza. look at the toll plaza, just now over the last five minutes we saw that backup, look like they should turn the metering lights on right about now. coming up on "today in the bay," changes possibly coming to san francisco's waterfront.

hours later. has this ever happened to you, you forget to feed the meter, you find a ticket on your car hours later. a lot of people have been there. >> i've been there myself, but we've been hearing from commuters who say they got ticketed at bart stations even though they paid for their

spots. liz wagner decided to find out what's happening. >> reporter: we talked to seven riders in the east bay all of them new to bart, they paid for parking, turns out, though, their spots weren't really available until after 10:00 a.m., but the parking reason took their money anyway. if you've been to the rockridge station in oakland you know there are plenty of signs am both parking lots. bart says the signs are clear, but to the new riders they are clear as mud. the commuters thought they parked in a daily fee area, instead they parked in a permit zone. naturally they got tickets, but here is their beef, then they entered their stall numbers into the pay machine the machine took their money without warning them those spaces aren't actually valid. >> i paid the $3 for the daily fee and it accepted and i thought, okay, i'm on my way. >> they could reprogram the machines to tell you that what you're doing is wrong. it could refuse your money. >> bart says the old commuters don't offer the flexibility to

mike, you're saying there is a possible problem at fremont. >> i was concerned about that, reports of a disabled vehicle, kari, in the lanes over there southbound 880 over at alvarado. the south bay shows a slight build but nothing different. alvarado niles may see some slowing because of the disabled vehicle that was at alvarado. getting through union city a little slowing but the vehicle moved to the shoulder. you should see recovery there. getting over toward the bay bridge not a major problem. the richmond-san rafael bridge shows a little more traffic as well. the metering lights are on at the bay bridge toll plaza. at 5:31 happening today san jose city leaders and google will talk real estate. mainly the city's selling price for properties the tech giant needs to buy in order to build that massive complex in downtown san jose. in order for it to all move ahead. "today in the bay's" kris sanchez joins us live with a look at the price tag and the ongoing debate about the impact

on this. could affect housing, jobs, commutes, the works. >> reporter: yeah, you said it. i mean, that's pretty much the whole story in a nutshell is that this is going to have a large impact not only in a positive way but a lot of folks say in a negative way as well. now, we know that google has bought a lot of properties around diridon station where we are thisú.r critical parcels to fill in that land in order to come up with that development and2xoñ that be the discussion at city council today. according to a city staff memo we are talking about a price tag of about $67 million for nineá different parcels at six different addresses. i put a link to that agreement in my twitter feed if you want to take a closer look at that city memo. if you work in downtown san jose or you've come to a sharks game or concert at sap center then you have parked on one of those parcels. it's a parking lot for the arena. the san jose city fire department training facility down the street, which you may

have passed as well over by the osh, that's another one and so is patty's that little dive bar down the street. you may know that google is proposing 8 million square feet of office space, enough for up to 20,000 employees. google has already bought 23 properties in the surrounding area from private businesses and also from homeowners as well. today they are talking about the city-owned parcels, those that used to be owned by the city's redevelopment agency before it dissolved. setting the price today would open the door for those nine additional properties from the city. these are six different addresses as i mentioned. mayor sam liccardo said san jose's increasingly vibrant downtown will play a critical role in the city's fiscal future and have an expansive impact on the cultural and social life of the valley, but there is still a lot of public push back as youz$ said, laura, because it could have the potential to drive up

house prices, wills to drive up commute times for a lot of the folks that already live and work here in downtown san jose. also, though, the potential to add jobs. there are a lot of public comments that were attached to this city memo. we will be talk being that coming up at 6:30. i will put those on facebook so you can read what your friends and neighbors and agencies in the city have to say as well. in san jose, kris sanchez, "today in the bay." could really change the face of the south bay. thank you, kris. details now for you new this morning, talk about a scary night for air travelers, they were heading to san jose so just imagine this, on your plane and it fills up with smoke. that's what happened with this jet you see right here on the tarmac at orange county's john wayne airport. the passengers say just before takeoff smoke filled that cabin. i want to show you some video from a passenger. you can see those emergency chutes deployed and people sliding down to safety. you can see looking in the back there. a little after midnight passengers say they arrived at sac on another plane, no word yet on what triggered that

smoke. >> it is 5:34. happening today a 26-year-old dui suspect is expected to be arraigned in connection with a deadly crash last fall. the crash killed 16-year-old pleasanton girl and a 25-year-old livermore woman. it happened the night before thanksgiving on stanley boulevard. in all there were five people inside that car. the suspect lauren davis faces charges of murder and gross vehicular manslaughter. this is a story that created controversy in the bay area and the nation. today the man cleared in the shooting death of kate steinle will be back in court. he is expected to be arraigned on new federal charges. he is facing charges of being a felon with a gun and being an undocumented immigrant in possession of a gun. his lawyers say the charges violate the double jeopardy clause where a person is tried twice for the same crime. in december a san francisco jury convicted garcia zarate of being a felon in possession of a gun

but not for shooting and killing kate steinle. the defense argued that was an accident. the idea of a sanctuary city has always applied to immigration, that's until now. tonight the city of berkeley will debate a sanctuary policy to protect cannabis users. pete suratos is live in berkeley with this new and interesting proposal. how does this work? >> reporter: good morning. yeah, it has a different ring when you hear sanctuary city policy, typically we hear it with undocumented immigrants, but this time around you have the city of berkeley looking to protect those who legally use cannabis or better yet those businesses that sell recreational marijuana. now, they will do a vote later on tonight during the city council meeting and vote on this resolution. what is in this resolution? they want to prohibit local agencies from assisting in enforcing federal marijuana laws as well as turning over information to federal

authorities in this case. officials rely heavily on local agencies for important information. this is all in response to u.s. attorney general jeff sessions marijuana memo that came out which essentially removed bay area era guidelines that directed federal prosecutors to not go after their cannabis businesses an users that are following state laws. i want to point out these protections are still limited since technically marijuana is still illegal under federal law despite many states like california choosing to legalize it at least for adult use. as of january this year people 21 and over can purchase up to an ounce of recreational marijuana or grow six plants at home and businesses must have local approval and a state license in order to sell recreational marijuana. now, if this is passed that resolution would be unprecedented but they will take a vote on this later tonight at the city council meeting said to take place at 6:00 p.m. pete suratos for "today in the bay." >> a lot of people will be following because that's something a lot of people take

part in. all right. so 5:37. of course, when you love someone you want to show them in a special way. valentine's day is tomorrow. how about a trip to one of the most romantic cities in the country. >> you don't have to go far. oakland ranking as the sixth most romantic city in america. yeah, interesting, right, it's according to instacart a san francisco grocery delivery company. the most romantic city was in boston, followed by atlanta, austin, philly and charlotte. the least romantic city according to instacart, indianapolis, raleigh, orlando, seattle, denver and san diego. the company studied valentine's day related searches, i guess, from across the country and that's how they came up with their list. >> what if you don't have a valentine. >> what were people searching in regards to oakland? >> you just made a declaration, your mailbox will fill up really fast. >> you can find me in oakland.

mornings, but fairly mild afternoons. this is what's in store for the weekend and if you want to go out to the park, enjoying some time outside how about some mid to upper 60s on saturday. it will be nice on sunday as well, but a few more clouds starting to move in, but we will keep those same temperatures with some low to mid 60s all around the bay area. as we get a look at our forecast if you will be heading to santa barbara for the weekend, 68 degrees on saturday and sunday, lake shasta will also be nice, but cooling down as the weekend goes along, 60 degrees on friday to 57 degrees on saturday and sunday only 49 degrees for the high and a nice romantic weekend hike in muir woods this weekend. it's going to be nice with those temperatures reaching into the low 60s. overall we will have some breezy winds and some cooler air compared to the last weekend. so let me know what your weekend

slowing. we will show you how it plays out on the maps coming up. 5:44. new this morning an alarming report is showing what would happen if the bay area had an earthquake similar to the one in 1906. if it struck again. we are talking about the san andreas fault which runs from southern california through northern california and san francisco. the 1906 quake left the san francisco bay area in shambles. the usgs predicts there is a 22% of a magnitude 6.7 quake or greater hitting by the year 2043, but are we more prepared now? a new report says nearly 69,000 houses would be uninhabitable if the earthquake struck the san andreas fault line and more than 200,000 people would be displaced. that damage would be massive because a lot of homes are not properly retrofitted and the agency hopes that the study would shoo inn a light on a need

>> this morning you step outside and you might feel like you need all of those layers that they're having to wear in pyeongchang this morning but it's not going to be that bad, especially as we go into this afternoon. here is a look at our live look outside in oakland and it's 47 degrees, it is a cool start. we have had breezy winds and the seven-day forecast coming up in the bottom of the screen, hey, that may warm you up a bit. we will see warmer temperatures on the way and today a high of 65 degrees in santa rosa, napa 63 degrees, also 63 in oakland and 66 in san jose. so as we're starting out this morning with all of these clear skies we do still need the layers. i'm saying a scarf or hat, gloves, whatever you need to stay warm. also light long sleeves will keep you comfortable. i wanted to talk about how much rain we're lacking at this point because we are still not seeing a lot of rain on the way. santa rosa so far has gotten 12

inches of rain but we are still missing 10 inches of rain. so what are we are at 50 to 60% of normal around the bay area and the sierra snow pack is only statewide at 21%. we are doing so bad here in the central sierra at about 24% of normal. and still not a lot happening here in the forecast until we go into early next week. we will have a chance of rain in the forecast on monday but this will not be a very significant system and our temperatures will be cooling down several more degrees. mike, as the drivers head out there what are you seeing on the roads this morning? over your shoulder i saw this shot and saw flashing lights right there so i want to rock that camera back. there are no incidents reported for oakland. we are looking at northbound 880 heading from the coliseum past high street. looks like there is some activity and this might be as a result of clearing the crew which we saw the sign truck over here a few minutes ago. no incidents reported through the area and i don't see a lot of slowing but clearly that

the time now 5:55. i have a story i want you to go to my twitter feed right now and look at it. it's about these school kids, elementary school kids that are being offered $100 not to fight for the remainder of the school year. i want to know your thoughts on that. vote on that right now on my twitter feed @marcusnbc. at 5:56 it's said that justice delayed is justice denied. our investigative unit found justice is being delayed in criminal courts in some case for years. >> here is senior investigative reporter stephen stock. >> reporter: we discovered that throughout the bay area not only are civil court cases now being delayed for years, but now criminal cases are, too. all courts have been underfunded throughout california for a decade and with fewer staff, judges and resources, the effect is now hitting criminal courts. in san francisco county according to state court data only 68% of all criminal cases were disposed of within a year. that same state data shows santa
