a chaotic scene in the city. officers open fire-- killing an armed robbery suspect. covering breaking news in san francisco. very chaotic scene in the city. officers opening fire, killing an armed robbery suspect. we are live at the scene with all the overnight developments. first want to say good now wednesday morning to you, thanks for joining us, i'm laura garcia. >> and i'm marcus washington. we will get to that breaking news in just a moment but first we want to get a check of your forecast with vianey arana. >> yeah, we've definitely got some incoming weather, i can tell you this, though, the temperatures are actually fairly comfortable right now, not too cold, we're fairly mild, the temperatures right now in the 50s for the south bay, 52 degrees. 52 degrees for the peninsula, 46 for the tri-valley. it's a little cloudier in san francisco, we are going to notice an increase in cloud cover because if i show you the doppler radar, yes, that's incoming rain.

as far as the timeline, i will break all of that down for you in just a bit. that rain is coming so is the traffic, but it's not here yet. light traffic all around the bay for our speed sensors. one note for the south bay 280 northbound at wolf be careful there is a minor crash, a car went off the roadway, no major injuries but it's in the trees so they have tow trucks out there and you're likely to see lights. no metering lights here, but you do have some head lights backing up. the cash lanes over at the bay bridge toll plaza pretty typical at this time of morning, they haven't opened all the cash lanes. over on the san francisco side bigger news, we hand it back to you guys. back to that breaking news out of san francisco. it was a violent armed robbery that turned into a deadly officer involved shooting. this was in the heart of the mission district. >> that's right. "today in the bay's" pete suratos live to tell us where the suspect was found before he was shot and killed. good morning, pete. >> reporter: good morning to you, laura and marcus. we're here on 22nd and capp

street. one of the three suspects in this armed robbery is dead following this officer involved shooting. i want to show you the scene behind me. you can see a good police presence here as this investigation continues, but accord to san francisco police they're saying they were flagged down for them by two victims in an armed robbery in this area near 22 and capp. they gave a car description of the suspects which we believe we're showing you that car that they found a few blocks away. they say the driver and a female suspect complied and were detained, then officers noticed in the trunk of that car it was open and in that trunk was another suspect. while trying to detain that suspect the officer involved shooting takes place. they removed the suspect from the trunk to get medical aid but that suspect was pronounced dead on the scene. right now you are taking a live look of exactly what's going on here following this deadly officer involved shooting in san

francisco in the mission district. i want to found out a handgun was located in that trunk where they found that suspect, but it's unclear at this point at least if the suspect pointed that gun at the officer was this whole shooting took place. we will continue to follow this and have more on this developing story in the mission district in the next hour. pete suratos for "today in the bay." 4:33 right now. happening in just a few hours in sacramento just blocks from the state capitol u.s. attorney general jeff sessions expected to address the trump administration's lawsuit against california's sanctuary laws. sessions is speaking at the california peace officers association at 8:00 this morning. the lawsuit is claiming sanctuary laws make it more difficult for federal immigration officers to carry out their responsibilities. the suit names california, governor jerry brown and attorney general xavier becerra as defendants. san francisco acting mayor mark farrell says his city is willing to fight that lawsuit along with

the state. >> we're going to stand by our values and stick by our community here in san francisco and in particular our immigrant community and we will let the chips fall where they may. >> our coverage of sessions expected announcement continues from sacramento. bob redell is there, he will join us with more details on that lawsuit in less than 30 minutes. frustrated over a contract negotiation teachers in pittsburg will make their concerns known today. they plan to rally after school, this is before heading over to tonight's school board meeting. the union representing pittsburg unified schoolteachers is stating that the district is not offering any raises and the talks have stalled. both sides are expected to meet with a state mediator later this month. new details on the search for a missing robot at a south bay high school. good news to report for that robotics team. the robot worth about 50 grand has been found and it's thanks to these people. one of them found the robot in his front yard yesterday which is just a few miles from the hotel parking lot where the

robot and other gear were stolen over the weekend. the robotics team were at a competition in utah when it was taken. they are unaware of the robot's condition but are relieved to have it back. it took the students about 100 hours to build that robot. new this morning, wine country businesses reportedly under federal investigation. this is according to the press democrat. the feds are looking into illegal trade practices involving more than 30 wine-related businesses, specifically illegal consignment sales. that's where the wholesalers or wineries buy back unsold bottles from retailers and distributors. that practice has been bnd ever since the end of prohibition. so far no businesses have been named. new information about an emergency landing involving a united airlines flight from san francisco. a part of the plane's engine detached on the way to hawaii a few weeks ago. you may recall this video a passenger shot, you can see the engine without its protective covering. now the ntsb is saying an engine

blade broke and the en jip lost its cover as a result. more than 360 people were on board. luckily they handed safely in honolulu. investigators are not sure what caused that blade to break away. coming up on "today in the bay," target extending its service outside the building. the new and possibly more convenient way of picking up prescriptions from the retailer's pharmacy. one of the scenes in the "black panther" movie so exciting for one fan it sent her to the doctor's office. what happened and the response from one of the film's stars.

good morning, i'm kate rodgers live at cnbc global headquarters. here are today's top business headlines. wall street is set to open lower this morning, that's because investors are reacting to the he is nation of president trump's top economic advisory gary cohen a former top executive at goldman sachs was viewed as the biggest supporter of free trade in the white house. his exit is raising concerns that president trump will move ahead with tariffs on imports of steel and aluminum potentially sparking a global trade war. traders worry that could threaten the growth of the u.s. economy. asian and european markets are in the red today and the dollar is slumping against the euro and yen ahead of the news of gary cohen's resignation the dow eeked out a 9 point gain yesterday closing at 24,884. target a rolling out curb side pickup service nationwide after testing it in its home

now, the sf gate interviewed sophia rob, she broke her retainer while watching the "black panther." she says that she clinched her jaw so tightly during a scene -- probably that one right there -- when the shirtless michael b. jordan was on the screen. her orthopedist posted the story online then rob tweeted about it. it started trending and jordan saw it. he offered to pay for the retainer. >> she was probably so embarrassed. >> he actually -- she actually tweeting him back and she actually said that she already had it fixed but it would be really nice if he took a picture with her and even her orthodontist the next time he is in town. >> i bet she does it. that's cool. we will continue to follow that one. >> i wonder what would happen if i took my shirt off. >> the ratings would go sky high, my friend. a little early in the morning. 4:41 right now. >> marcus, yeah, marcus and i work out in the same gym. i don't know what marcus got going on, but, hey, look,

let's take a live look outside. what a beautiful view city by the bay in san francisco. look at the lights glistening this morning. it's quarter to 5:00. hoping for a nice day. the rain is going to come in, though, what, later tonight? >> later tonight, yes. >> we can enjoy today. >> exactly. your morning commute, we are not going to have to deal with any rain this morning, tomorrow might be a different story. we will follow that. mike is always on top of it as well. right now the temperatures nice and mild, 52 degrees in the south bay, peninsula also in the 50s, a little chillier as always in the tri-valley, same for the north bay, 44 degrees. check out san francisco, 51 degrees right now, in the east bay also at about 51 degrees. we're actually running several degrees warmer at this hour than we were yesterday in some spots 10 degrees warmer. santa rosa 10 degrees warmer

than yesterday, san jose 9 degrees warmer and even out near san francisco about 7 degrees warmer compared to where we were at this hour. another good news about today even though we're tracking rain is the fact we are going to see another day of upper 60s and 70s in the forecast. if you enjoyed yesterday, which was absolutely stunning, today will be another round of that but with a little bit more cloud cover. in the morning we will expect to see clouds increasing, by late we will keep track of those showers, concord a high of 70 degrees, san jose will top out in the 70s, san francisco will be a little cooler at about 63 degrees. here it is, doppler radar you can already see all that mooch about 700 miles off the coast of san francisco and this is what we're keeping a close eye on. let's take a look at some of that timeline if you're wondering about when it's going to move in. at about 8:00, 9:00 it's going to stall over the north bay so it's going to sit over the north bay for a while, lingering there, if i push this timeline through at about 11:00, 12:00 that's when we start to see it

spread further south. there it is, thursday, 6:00 a.m., between 5:00 and 6:00 spotty showers. we are not expecting wide heavy downpours, these will be scattered showers so i think we will be okay in terms of rain amounts, about a quarter of an inch, snow digits right now just a couple of inches, nothing compared to what we saw last weekend an over the next seven days, the next seven days is showing all rain. i did not mess that up. these icons are accurate. over the next seven days we're tracking the first system tonight, second system on saturday and take a look at monday there goes a third system. so we've definitely got plenty of time to keep a close eye on the incoming rain. vianey said right now the roadways are dry, the system comes in tonight. we are looking at a smooth flow of traffic. be prepared for tomorrow morning's commute. we're looking towards san francisco, the activity i marked there 22nd at capp that's where pete it is he officer-involved shooting. capp is screen van ness and

mission so good alternates to avoid that intersection and investigation. no problem at the bay bridge toll plaza, we talked about this crash 280 at wolf at cupertino, off the roadway. 17, 101, bigger commutes coming in from the south county no problems. also same thing coming over the santa cruz mountains. we will look at the transit systems and no delays here, either. transit systems moving on time. almost 30 trains for the bart system available. ace train does have a five minute delay, that was the update i got. i apologize, i will change that, but ace train minor delay coming out of tracy and in through the tri-valley, 580 moves smoothly, you have company but no delays during the dublin interchange. to developing news, this out of washington. we are tracking another shake up at the white house. this morning president trump looking for a new economic adviser. gary cohn is out as head of the national economic council after butting heads with the president over tariffs.

"today in the bay's" tracie potts has more on what's next for the future of trade in america. >> reporter: gary cohn's resignation isn't a huge surprise, he made it clear he is no fan of president trump's plan to tax steel and aluminum imports. key republicans were counting on cohn to convince the president to reconsider. >> i think the smarter way to go is neighboring it more started. >> reporter: cohn the latest in a string of high profile white house departures. asian markets closed lower after the news broke. >> short term this could be bad news for the stock market, traders on wall street like gary cohn. >> reporter: cohn says it's been an honor, president trump praised him for helping orchestrate tax cuts but behind the scenes, tension. cohn's efforts to beef up infrastructure, side lined. one official says the wealthy former banker wanted a bigger job and cohn may not be the last to go. >> there will be people, i'm not going to be specific, but there will be people that change.

they always change. >> reporter: no names as president trump promises to announce a new economic adviser soon. tracie potts, nbc news, washington. it is 4:50. happening today education secretary betsy devos will be in parkland, florida. she will visit with students and staff at the marjory stoneman douglas high school. it's been three weeks since that mass shooting there. 17 people were killed. last week the education department gave $1 million to the school district for emergency relief. new this morning we're diving into a brand-new report that shows while majority of students at public colleges and universities in the state are minorities, most of the professors and college administrators are white. according to the campaign for college opportunity more than two-thirds of students are minorities. at the same time more than 70% of leadership and tenured faculty positions are held by whites. while the majority of students are women, fewer than half of the leadership positions are held by women. at 4:50 coming up next on

and good morning. as we head back right here on "today in the bay," 4:51 right now. this is a live picture of the golden gate bridge. a few people on the roads. mike will have a better look at what it's looking like across the bay coming up. nbc bay area responds to a san leandro man who says his warranty claim was unfairly denied. >> he reached out to our responds team for help. consumer investigator chris chmura is here with the story. >> good morning. omar johnson's saly mattress was sagging in the middle. he put a broom across the bed and you can see a shadow as there is a dip inside the mattress. he said you can see the side of it beginning to condense and saga long the sides. omar said he cared for that

mattress by the book, flipping it over and rotating it every few months. so when that sagging started he filed a claim with sealy because the mattress was still under warranty, but sealy denied that claim. omar says the company reviewed those pictures he submitted and determined the sagging was his fault. that he must have spilled something on the mattress. omar said that wasn't true. so he reached out to us for help. we contacted sealy and it replaced omar's mattress. the company didn't explain why it at first denied the claim. instead in a statement it said our customer service team is always happy to provide help to consumers when they need assistance. one last note here. warranties change over time. for example, sealy's website lists three warranty updates since 2003 so you've got to keep an original copy of your warranty and don't make any assumptions about what's covered or not. if you have a consumer complaint

much for joining us this morning. i'm marcus washington. >> and i'm laura garcia. we've been following these two stories overnight, a lot of developments, but first developments in the weather department as well. changes coming to our forecast. >> we have several changes. we are going to get to not one but three chances to see rain make its way back to the bay area so it looks like we might end up these last couple days official winter on a rainy note. san jose 51 degrees, clear skies. another thing you will notice as we head into the afternoon is an increase in that cloud cover. the temperatures remain 9 to 10 degrees warmer at this hour than yesterday. here is a quick check of that, that 24 hour temperature change. san jose nine degrees warmer, sunnyvale 11 degrees warmer. we're looking at the roadways, calm as far as the speed sensors are concerned. a minor crash in san jose off of the freeway at the wolf road off ramp. we have a little tiny slow down as folks are coming out of the
