"today in the bay" continues right now. good morning, thank you for joining us on this tuesday morning, i'm marcus washington. >> and i'm kris sanchez in for laura garcia who is out but getting better after a bout of laryngitis. you can't do this job if you can't talk. >> that's the important part. >> you don't want to come back too soon because then you might mess it up. >> the gift that keeping giving.
6:01 am
>> the weather we've been getting the last couple days -- >> it's been so nice and gets even nicer as we we go into the next several days. a cool freeze for yesterday afternoon. you won't feel that as much today because it will be slightly warmer. here is a live look in j is. before you head out let's go to los gatos. it's going to be in the mid 40s and a quick warm up in our temperatures by late morning with all all of that sunshine. upper 60s and low 70s all around the bay area. we will talk about that coming up. mike, you have a new crash in the east bay. >> another crash in the east bay and more activity of course there as well as the rest of the bay. although the speed sensors barely show it, san jose a little slowing. we do have a crash on highway 17 southbound around camden. i will get more detail but it just appeared on the blotter. this also just appeared, this crash westbound 80 your commute direction toward the bay bridge at powell, reports that it's blocking one lane you see slowing here. i moved our camera around and was able to catch this.
6:02 am
there is that car. this is the situation, it's in the fast lane, watch these cars come whizzing by so close, that's got to be nerve-racking for the person involved. when you do see cars like that move over, give them a lane because crews have to arrive and it's nerve-racking. we're going to track this and hope for the best. happening today an east bay elementary school is bracing for protests. members of the westboro baptist church are planning a demonstration at rancho rom row elementary school in alamo this morning. >> the organization claims the school is encouraging discussion of sexual and gender identity. "today in the bay's" pete suratos is live outside of the school this morning with counterprotests also expected today. pete? >> reporter: good morning to you, marcus and kris. well, we are expecting that counterprotest to begin roughly around 6:00 a.m. but so far we are not seeing any protesters outside of rancho romero elementary school in alamo but it is westboro baptist church that is planning to do this protest in just a couple of
6:03 am
hours over what they say are their disagreements with the school when it comes to a gender equality lesson plan, the school's stance on transgender issues, that's what's leading to this protest. this church was considered a controversial hate group in some senses, hating on both sides of the aisle, in fact, our newsroom did some digging overnight on some of the protests that they have had over the years. dating back to more than a decade at this point. we want to show you this point a list of them. in 1998 there was a protest margd matthew shepherd who was a gay man who was beat and tortured to beth:et in wyoming. then the group protested it he funeral of a u.s. marine killed in iraq, they were sued for that, but the supreme court sided with the church's right to protest in that case. and then most recently they also had protests in orlando following the pulse nightclub shooting. now, just yesterday i did reach out personally to the san ramon unified school district and in a statement they told me regarding today's protest that, quote, our
6:04 am
focus today is on student and staff safety. we have a plan in place and are working very closely with law enforcement to mitigate the impact of that protest on our school. as i mentioned the aclu is planning a counterprotest and they will set up umbrellas between the westboro baptist church protesters and the school so they can kind of serve as a blockade in that area. we're being told that protest is set to begin at 8:00 a.m. live in alamo, pete suratos for "today in the bay." >> pete, thank you for that update. relieved parents say there are still lessons to be learned from a violent school threat that turned out to be not credible. it started on friday when san mateo police say this man walked into a big 5 sporting goods store and threatened to shoot up a school after asking to buy a gun. officers located than ma, he is now in custody for a mental evaluation. the man told investigators he just said it as a joke, but parents at one peninsula middle

school says the scare makes them think about campus and what they need there around their school. >> i think it probably is this day and age, yes. you know, some of the, you know, kids are changing classes on the sidewalk around here. >> the parent there is referencing the fact that there is no gate around the school. there is no fence. district leaders say the fence at the school has been delayed because of state requirements, so red tape. they do expect it will be installed this summer. new this morning a terrifying shooting investigation in east palo alto. police say that someone shot a man in his car and then a woman who was walking home from the grocery store. officers say that both of those attacks unprovoked. "today in the bay's" roz plater is live in palo alto at the police department this morning with the bizarre string of events that led up to this shooting. roz, just crazy incidence here. >> reporter: it is crazy indeed. seemingly unprovoked and possibly random. that may be the most terrifying part of it all.
6:06 am
two victims and a car chase all of which came to an end once palo alto police here captured that suspect not far from here, but this began last night in east palo alto. investigators say that's when a 35-year-old man the first victim was sitting in traffic near schofield street and capital avenue, he was on his way to his second job. suddenly a man in a silver suv pulls up, points a gun and shoots at him then takes off. the first victim begins chasing the suspect. then near newel road and wood land avenue a 65-year-old woman was walking home from a convenience store carrying some groceries, the shooter then fires at her twice. he struck her in the arm and knocked her into the bushes. the first victim stopped to help her and the suspect keeps going. he abandoned his car but palo alto police caught him and arrested him in the 400 block of emerson street. again, that's not very far from where we are now. now, we're told that east palo alto investigators are still
6:07 am
trying to figure out a motive or what led up to this. they are asking if you saw anything, if you know anything about this incident, they want to hear from you. we're live in palo alto, i'm roz plater, "today in the bay." >> tough story to follow there, roz. you helped us get a better understanding of what's going on. thank you. more protests are expected in oakland this morning as alameda county supervisors vote to fund the controversial law enforcement training program called urban shield. at least one local group of activists says that the training militarizes law enforcement agencies. they plan to protest before this meeting this morning. last month supervisors voted to continue with the training, but they also called for change. now to decision 2018. a significant no show in last night's debate involving california's top candidates in the race for governor. our sister staying hosted that event. lieutenant governor gavin newsom skipped out to take part in a

fundraiser in pasadena. other leading candidates noted his absence antonio villaraigosa alluded to the knew some not being there when thanking republican john cox for appearing. >> thank you for caring enough to show up. i respect you for that. that's why i showed up. >> it's sad that one candidate chose not to show up. if he doesn't respect you now as a candidate, why should you trust him as governor? >> and that was state treasurer john chiang who is lagging behind villaraigosa and knew some in the democratic race. recent polls indicate that cox is running second overall behind knew some. the top polling candidates will head to the south bay to face off on live tv and nbc bay area is hosting that debate on may 8th at the california theater in san jose with the silicon valley community foundation. nbc political director chuck todd will moderate the event. 6:08 now.
6:09 am
today the city of san jose could take a big step in meeting sustainability goals set by the paris climate accord. the city council is expected to adopt the climate smart san jose plan similar to the paris accord san jose's plan would combat greenhouse gas emissions. the city is taking this step because president trump pulled america out of the paris climate agreement, claiming it wasn't fair. the u.s. is the only country in the world that is not part of that agreement. right now it's 6:09. we already have people out there k working at at&t park to clean up the stands and get ready for the game again this evening for spring training for the giants versus the a's. looking at temperatures in the upper 60s, it will be much warmer today than it was yesterday out there at at&t park, but it cools off just as quickly getting down into the upper 50s. a look at all of our mike climates for today, starting out in the coast with highs in the low 60s in half-moon bay, 65 in
6:10 am
san francisco will be the high and santa rosa up to 75 degrees. we will have some really nice weather today and that extends into the next few days. more on that in just a few minutes. mike, you are still concerned about the driver in berkeley. >> the one driving that vehicle that is stopped on the east shore freeway. let's show you overall everybody else gets a chance to look at their commute a pretty pleasant drive. the issue is the commute direction for the east shore freeway. westbound 80 folks are slowing down approaching powell street and we will get you to that live look again. this is why you should slow down. see that disabled vehicle. watch, from time to time we've seen a stack of up to a half dozen, almost ten cars backing up on the approach because one person comes up close to this person, sees it, there is a disabled vehicle and then they start to stack up and then they have to start back out into traffic. we have seen a harrowing situation a couple times this morning. we are advising everybody when you see the flashing lights stay over to the right. >> bridge crew and chp are heading over there.
6:11 am
once again that's a slower drive developing as you travel past alameda in toward powell. that's where that disabled vehicle is in your left lane, stay over to the right. back to you. >> and stay in your car. you find yourself in that situation stay in your car with your seat belt on is the safest way. coming up next on "today in the bay," exclusive new information on the malfunction at an ohio fertility clinic. what we're learning about what went wrong and why the damage was worse than we first reported. and, boy, did we have a spectacular day on the stock market on monday. can we do it again? we will take a look when "today in the bay" continues.

6:15 am
and a very happy tuesday to you. we could see even more gains on the market this morning after the huge rally on monday. the dow jumped 669 points, its third largest point gain in one day in history. nasdaq up 227, that's about 3%. apple and facebook you can see they are both in the news. facebook of course facing all kinds of new trouble this morning, an investigation by the ftc and states attorneys general. you know about the privacy scandal, you've heard probably people talking about deleting their facebook. another problem, though, is the biggest competition in silicon valley isn't really for customers, it's for talent. convincing the next generation of engineers who probably don't use facebook to work for them. apple executives will be in chicago today to announce new products for education. if you're old enough you remember apple was the first computer company to make inroads into schools, but now it's google that dominates because google makes inexpensive chrome

6:17 am
do like a convertible in the summer and an suv during the winter. you could swap them out. >> i hadn't thought about that angle. are they trying to reach those of you who are older or is this targeting the millennials? >> that's a good question. i'm not sure where this change came from. i do know they are worried about uber, people are saying why do we need a car at all? but now seeing it as a service that you can start and stop and that kind of thing might make more sense. >> interesting. we will have to see who ends up rolling in with a new bmw. a brand-new investigation finds that the company responsible for that freezer mishap that destroyed embryos in cleveland, ohio, is linked to other problems in the past as well. this week impacted patients are getting a letter from the clinic and in that letter it says that a freezer holding 4,000 embryos somehow shut off and then stayed off for an entire weekend. the total number of em bows destroyed is now about twice
6:18 am
what the initial estimate was. one couple that also has two children and was hoping to have a third, now can't do that. >> i've got a taste of how good it is because i've got two really perfect kids and i think that makes me more angry. >> because you wanted more? >> yeah. yeah. and they deserve that. >> nbc's investigation found that the same company is tied to other freezer breakdowns including one in florida and one in the uk. you can watch the full report at 7:30 this morning following "today in the bay." 6:18. if it seems like you're seeing more sea lions in the waters around northern california scientists say you are not imagining things. according to the marin i.j. a population survey finds sea lions are making a mass migration to cooler waters in the bay. scientist right side not sure why this is happening but it is likely to do with the sea lions food source also moving northward. they are also not sure if this is just a temporary phenomenon. >> let's hope not. oakland's brett hunter takes

6:20 am
with our temperatures now in the mid to upper 40s, grab a jacket before you step out, we have all clear skies. the coolest temperature right there on the right side of your screen in the tri-valley looking live in sunol and 44 also in the north bay looking from belvedere towards san francisco. it's 55 in san francisco right now, so as we get the kids ready for school they are probably really excited because it's one of the last few days before they may have a break. in oakland it's going to be at 46 degrees, walking to school, and then at recess it will be in the upper 50s and low 60s. so definitely a day outside with all of that sunshine. we are going to see our highs in east san jose up to 73 degrees, 71 in los gatos and light winds coming in from the northwest. east bay and oakland upper 60s there and 73 degrees in pleasanton, 71 in redwood city and a big warmup from yesterday as well in san francisco. some mid 60s and 75 today in sonoma with those winds coming in from the north. a morning drive through the

south bay starts out cool with mid 40s but then as we go into the lunch hour you may be heading out and want to take the lunch outside, it's going to be in the mid 60s and this large area of high pressure causing the air to sink and warm, it also keeps our skies clear and will steer any wet weather to the north and south of the bay area. we keep some dry weather. if you are thinking about this weekend heading to santa cruz it's going to be at 71 degrees on friday, that will be the warmest day before some slightly cooler air comes in and we will be watching that. now, your complete weekend forecast in 20 minutes. mike is watching the east shore freeway. with eyes peeled because of that disabled vehicle after that earlier crash, we talked about all those cars whizzing by so close. we are looking at 35 minutes because the cars do dip in speed as they slow down and change last minute over in toward one of the lanes over to your right. 35 minutes from highway 4 most of that slowing as you're passing by university and get over toward powell. i have i had nd out the camera is bit. here is that vehicle that was
6:22 am
stuck in that fast lane. here are flares and a flatbed tow truck and another car behind t there are two crashes being addressed right now, consider that left lane and possibly further back one of your other lanes blocked that's adding to the time traveling past golden gate field. the build starting back at richmond. that's the toughest drive of the bay right now. hayward a little slowing passing a crash on the shoulder around washington. tri-valley across the bay the san mateo and dumbarton bridges and the south bay show a mild build right now. the trouble is in berkeley. coming up here on "today in the bay," allergies can be extremely annoying, i know we both have the sniffles in the morning, but turns out there could be a major health benefit to this. all new this morning the reason some health experts say allergies could help you live longer. you want to find out about that one. we will have that when we come back.

6:25 for you right now. allergy season is here, but it turns out sneezing and having the stuffy nose and swollen eyes could help you live longer. some a lermg specialists say that allergies could help people live three to five years longer than those who don't have allergies. they are citing studies that have shown people with allergies have lower risk of cancer, stroke and even heart attacks. doctors say this makes sense because allergies are caused by overactive immune systems. they served an important role in
6:26 am
the past. >> allergy is actually a defense system and at one point in history many thousands of years ago it was valuable because the anti-body that gives you allergy is the same one that protected people against parasites like worms. >> the parasites as doctors mentioned are gone now so immune systems are attacking the next thing which includes ragweed and other common allergens. >> i guess i'm going to live forever. the lady washington hawaiian chieftain will continue to sail across the bay today. this time the tall ships are moving to antioch for a five-day visit. they were previously in oakland and redwood city. tours in antioch don't start until friday. coming up next on "today in the bay," breaking news to tell you about on the east bay, the reason police have a major off ramp closed and how it could impact your commute this morning. plus -- >> a lengthy high speed chase

6:31 am
and now a fire. >> but separate incidents, kari. so the crash right here we've moved it back a little further east. this is still westbound 80 your commute direction but notice that this spot as the tow trucks move around to clear more vehicles we have two lanes blocked, folks are slowing considerably at the approach to powell that is again westbound 80 getting over toward the bay bridge more flatbeds and another tow truck arriving. more activity, a little more slowing. just about 35 minutes from highway 4 through that mess and over toward the backup at the bay bridge. that is the slower spot for the bay area right around that area. as we look at the rest of your -- zoom in towards the south bay, this is the fire. a roadside tire in one of the trees along northbound 280 around wolf is causing a couple lanes to be closed. you're jammed up from 17 all the way up into 280 northbound. 101 a clearer drive for the rest of the bay. there's the san mateo bridge also slow but that's your typical commute.

fleet of patrol cars pursuing that van. chp says that driver veered into a construction lane on the bay bridge and a patrol scar at the scene tried to pull that van over. that driver finally exited in pleasant hill and ended up in a cul-de-sac where he surrendered. chp is investigating if that driver may have been under the inn flounce of drugs or alcohol. sacramento city leaders will hold what is expected to be an emotional hearing when they discuss the recent deadly police shooting of an unarmed man. body camera video shows officers firing 20 times as they shot and killed stephon clark in a backyarded on sunday night. he was holding a cellphone but officers say they thought that cellphone was a gun. now sacramento's mayor is among those calling for accountability. also clark's grandmother broke down in tears during a news conference that we first brought you yesterday in our midday news. >> migrate grand babies don't have their daddy.
