"early today" starts right now. good to be with you. i'm francis rivera. >> i'm philip menna. >> protesters blocked the golden state center for the second time in a week. they were demanding justice for stephon clark, an unarmed man shot dead by police behind his grandparents' house a week and a half achlgt mogo. the sacramento kings released a statement saying that the doors had been locked to maintain guest and public safety. earlier in the day, protesters led by clark's brother disrupted a city council meeting chanting stephon clark's name. the brother as well as several others were escorted from the chamber and the meeting continued after a 15-minute

recess. and the family of alton sterling is devastated after it was announced that the police officers who shot and killed sterling outside of a convenience store will not face charges. graphic cell phone video sparked a wave of protest. but the attorney general said that the state's investigation found the officers' actions reasonable and justified. gabe gutierrez tells us more. >> he was murdered like an animal. >> reporter: for the family of alton sterling, the last two years have been excruciating. >> they took a human away, they took a father away. >> reporter: his aunt has had two strokes. the video showed the deadly encounter between sterling and two baton rouge officers outside a convenience store in 2016. the louisiana attorney general announced there would be no criminal charges against the officers. he says they tried to make a lawful arrest. >> mr. sterling was under the influence, and that contributed

to his non-compliance. >> reporter: last year, the justice department decided against bringing federal civil rights charges against the officers, claiming they thought sterling was reaching for a gun in his pocket. his family says he never pointed the weapon at police. did today's decision surprise you? >> today's decision did not surprise me. >> reporter: she is the mother of sterling's son. >> i ask god to give me the strength. >> reporter: both officers have been on paid leave since the shooting. when a disciplinary hearing wraps up friday, their attorney expects both cops to be fired. he plans to appeal. >> these cops have to make split-second decisions in tense situations and we don't go back and say oh, you should have done this. you should have done this. >> reporter: sterling's family still has a civil case pending. they've been urge being the police department to release

body cam footage and surveillance cam footage from that store. chinese state media now confirms kim jong un paid a secret visit to the country to meet with xi jinping. it's believed to be the first time kim has traveled outside his country since taking power in 2011. the trip coming at a tense time with pressure on north korea to denuclearize and pressure on china though mitt gate north korean aggression. hans nichols is live in seoul, south korea this morning. good morning. >> reporter: good morning, guys. you mentioned the significance of that trip. it's pretty clear here in south korea, even though we haven't had official government reaction, they are cheering this trip for a number of reasons. number one, it is indication that kim jong un is taking negotiations with south korean counterparts and donald trump potentially in may very seriously. the symbolism can't be overstated. then you have the actual substance. and the substance is according to chinese state media that kim

jong un committed to denuclearation, if that's the goal of these peace talks, trying to figure out an off ramp on this escalation ladder. aside from this, there are reasons to be concerned. there's a report in the "new york times" saying that there's a new nuclear reactor the north koreans are building. so for all the talk of the visit, we haven't seen him leave the country. he took a same secret bullet-proof train that his father and grandfather would take. they didn't announce the trip until kim jong un was back in north korea. there are concerns, namely, is north korea using this as a smoke screen to continue with their plan to have a nuclear armed weapon that can enter in as an icbm that can hit the united states. those are the concerns. south korea is waiting for their briefing. we've heard from the united states that they had their briefing yesterday. and i think we need to watch as washington wakes up today, just what the language is out of the white house as well as the defense department on these diplomatic moves as well as

potential new physical side on the nuclear stuff. now to the census uproar hitting washington this morning. at least 1 states say they are suing the trump administration in an attempt to block the white house from adding a question about citizenship to the 2020 census. they argue that the change would cause fewer americans to be kountsd and would violate the constitution. for the question to be ultimately adopted, critics say it could have serious implication nationwide. for more, we go to tracy potts in washington. >> reporter: we're talking about something that lasts for a decade and could have an impact on representation here in washington. and on millions of federal dollars that support transportation and schools and crime fighting, public safety. there are 20 states opposing this and more than 100 civil rights organizations. california is one of the states suing saying they believe they're being targeted because

they have a large immigrant population. lotting of people, legal or not, who may be afraid to answer that question. >> given the way that this administration has attacked immigrants, you can understand why immigrant families would be afraid to fill out the census questionnaire. adding a question on citizenship threatens to derail the integrity of the entire process. this latest move by the trump administration to threaten california is not just a bad idea. it's against the law. >> reporter: and that is the course of their argument. now this particular question has not been on the short form census that most people get since 1950. it's been in the american community survey but not on the short form that most households answer. that is something that was addressed by the white house as

well. and, as we said, lots of money involved here. federal funds for a number of different areas that these states argue may be diverted from mostly democratic states and cities to more rural areas that supported president trump. >> all right, tracy potts for us, thank you. now to a shocking followup to a reporting earlier this month about a tank failure at a cleveland fer tilt clinic. we're now learning that as many as 4,000 frozen eggs and embryos were lost, twice what the hospital initially reported. the hospital is blaming human error. nearly 1,000 patients at the fer tilt center received the crushing news. nbc news has also found the tank's manufacturer has a history of similar malfunctions. they told nbc news our objective is to work dill gently to support the investigation into what occurred and be helpful in the search for answers. at least 18 lawsuits have been filed against the fer tilt

fbi agents have arrested a man in connection with more than a dozen suspicious packages sent to government sites in and around washington, d.c. the man was arrested on the other side of the country at his seattle residence. officials say the packages containing potentially destructive devices turned up in military and intelligence agencies. the "washington post" is reporting president trump is reneging on his pledge to have mexico pay for his proposed border wall, with the president privately pushing the u.s. military to pay for the signature campaign promise. the report comes after the president tweeted, because of the $700 and $716 billion dollars gotten to ree build our
