forward to more sunshine and even warmer weather than yesterday. so as we start out it feels mild, it's 52 degrees. stepping out the door in the peninsula and the south bay, 47 in the tri-valley, north bay also at 47 degrees and san francisco at 51 degrees as we go through the day in san jose and also in santa clara some low 50s throughout the morning, all clear, look at that sunshine, noon 69 degrees. we go up from there. we will talk about all of our high temperatures coming up. mike, you're tracking an easy drive this morning. >> ert that, you just said all clear for the forecast and it is kind of all clear. we do have overnight road work in patches but i don't usually call that out unless there is a full closure of the freeways and we don't have that this morning. a smooth drive, even south county 101 out of gilroy, morgan hill, show little glips here and there, but we have crews, slower moving vehicles overnight, but no full closures, 17 moves smoothly through the 17 and los

gatos side. no delays coming down the east shore freeway through this beautiful backup at the bay bridge. we just have a few folks waiting a couple minutes in the cash lanes. back to you. we start with breaking news for you this morning. major developments overnight regarding adult film actress stormy daniels' legal case against president trump. could the president have to testify under oath? earlier this morning daniels' attorney released the text of the court filing and it seeks to dispose -- depose president trump and his lawyer michael cohen, daniels' attorneys filed that motion yesterday in california's central district court. the attorney likely wants to ask the president and cohen about so-called hush money that daniels received right before election day in 2016. the president denies having an affair with daniels, which she says began in 2006. tempers continue to run high in sacramento after police shot and killed an unarmed black man. the city council was supposed to discuss the issue last night,

but take a look at what happened instead. inside the chambers dozens of people voiced their outrage over the police shooting death of stephon clark. one person was arrested outside the meeting, that's what you're seeing here on your screen. the meeting was eventually shut down all together. "today in the bay's" cheryl hurd was there and as she reports it was a day filled with protests at the state capitol. >> reporter: there were two demonstrations last night, one here at city hall, the other at the kings game. this community is frustrated and angry and right now they are demanding change. tuesday city council meeting packed with people expressing their anger and concern over the shooting death of 22-year-old stephon clark. his brother making his point in front of the mayor. >> stop. stop. stop. stop, y'all. stop, please. my brother just got shot. >> reporter: at one point protesters briefly taking over the meeting and council members

listened to family members and the community. >> you shoot us down -- >> reporter: protesters marched around the golden 1 center for a second night. the arena virtually empty. >> the entire city is culpable and responsible for the injustices that continuously happen to the people of this community. >> reporter: the community has been wanting answers since clark's death. police promising transparency from releasing from video on the air and on the ground. police firing 20 shots at him in his grandmother's backyard, finding no weapon, only a cellphone. >> i'm dedicated to making sure that we gather all the facts, conduct a thorough investigation and promise we will continue to be transparent throughout the process. >> these police officers will never come to justice. >> reporter: demonstrators feeling that frustration outside council chambers, one demonstrator was arrested, he is facing charges of assaulting an

officer. stephon clark will be buried on thursday. al sharpton says that he will attend. in sacramento, cheryl hurd, "today in the bay." >> thank you, cheryl. school is back in session this morning at cupertino high school after a chaotic day on campus. the snapchat video shows what happened after the school got a robocall threatening the school. students were forced to run away from class yesterday, some of them ran to nearby businesses which sheltered them until their parents could pick them up. >> it was a little bit scary because you wouldn't expect something like this to happen in the middle of the day. >> when i saw a bunch of cops i was furious. this has to stop. >> deputies searched the campus but found no credible threat. that call came from a number that's been traced to similar threats at schools across the nation. a mysterious light in the sky and a loud boom rattled some south bay neighborhoods. >> this happened near branham high school but people miles away say they heard it, too.

video posted to a south san jose page shows a small light traveling across the sky for about a minute. it happened at midnight on sunday. then there was a flash and a boom and the light disappears. dale johnson said it shook the windows and set off a car alarm. >> new year's eve there's always mortars or m-100 or m-1000s going off here or at the park. this was nothing like that. >> more than 100 comments were posted on that next door page. the faa said it didn't look like any aircraft operation. >> maybe it was a drone. >> maybe we are not alone. coming up -- okay, so up one day, down another. what to expect from the wall street markets today. we will take an early look at those markets. and as mark zuckerberg agrees to testify before congress about facebook's data scandal, some of its users are suing facebook. a look at the details of the twists and turns. and plus what are the best

aztec stocks came under heavy pressure. facebook, twitter and google leading the losses on concerns about more regulation in the wake of facebook's data privacy scandal. the dow closing down 344 points to 23,857 the nasdaq losing 211 points to 7,008. facebook is sending signals that ceo mark zuckerberg plans to testify before congress about the company's data privacy scandal. reports say several details still need to be worked out and zuckerberg hasn't accepted any formal request to appear just yet. if he does, though, it would mark his first ever public testimony before u.s. lawmakers. facebook announcing changes this morning in response to the data scandal. it's making it easier for users to find privacy settings, control what they share and download and delete their data. they will also make their terms of service more transparent. apple is likely to unveil a redesigned watch this fall. he says the watches should have

it's all typed out. that's laura garcia nbc bay area. >> that's the most she is -- that was her allotment for yesterday. >> right. no more talking. >> she's feeling guilty. i promise it's true, right? it's so hard. >> you know, there have been a lot of people on there saying, hey, try this, try that, just trying different things. hopefully she will be back soon. we miss her. we are starting out with great weather and making sure we keep that sunshine and the warm temperatures right now as you head out the door, morgan hill at 45 degrees, 52 in san jose and palo alto and in oakland 50 degrees. 47 in the north bay. so we do have some cool spots that as you head out the door and the seven-day forecast is now up at the bottom to of the screen and our highs today reaching into the upper 70s in san jose, 78 degrees there, 76 in cupertino. our winds will pick up as we go through the day from the north and for the east bay, look at these, highs in the low 80s for

concord and danville and oakland today, 72 degrees and 75 degrees in san mateo, 76 degrees on the embarcadero -- rather, 69 degrees on the embarcadero. we will have 79 today in sonoma. so if you've been suffering with the allergies, well, this is the reason why, the trees are blooming, the grass is really high at this point and the weeds and mold are still low. so if you are having problems right now it's all because of those trees budding and blooming as we are going into some very warm weather. it's going to get worse as the week goes along. shorts weather today and also sandals even though you might need a jacket stepping out early, later on today it's going to be very warm and it's all because we still do have this large area of high pressure and it's intensifying, so that causes that air to sink and warm up. we are also going to have that flow around this high pressure bringing in some northerly winds. as it does so it flows over those mountains and gives us very warm air, some of the

warmest temperatures will be in the north bay today. and in san francisco expect a high of 69 degrees and 72 degrees tomorrow. it does cool off, several degrees heading into next week, but in the meantime we could set new records here within the next couple days. mike, you are thinking about the crews working overnight. i'm thinking they have great conditions unlike when it's raining overnight so that's great for them. we are also looking at great conditions for the drive despite the crews. in fremont, for example, these folks traveling north past the truck scales pass by dixon landing road, we have one set of crews there for 880. no slowing on the sensors, just one lane closed there as well as 680 coming up through the area heading up towards sunol. keep that in mind, if you see the flashing lights crews will start moving and clearing the roadways in your commute directions and that means they will have to slow traffic through the area. prepare for that. altamonte pass this slowing just happens because this is where the bottleneck happens off 205

and 580. easy through livermore, the dublin interchange, the rest of the day looks great, even the longer commute through the north bay, no major problems all the way down to the golden gate bridge for highway 101. back to you. >> thank you very much. pay a small fee, drive faster. it is the idea behind the express lanes on bay area freeways. >> a senior investigative reporter vicky nguyen learned thousands of drivers are being fined for something they didn't do. >> reporter: good morning. our investigation began with a tip from a father and son who both received tickets for using the fast track express lanes in the east bay, both had her tickets overturned because they weren't at fault. and there was photo evidence. in one case the cameras read the license plate incorrectly, in the other the car was next to the express lane not in it. while we learned they are far from alone. since january of 2017 the agency in charge of sending out express lane violations has sent out more than 58,000 bills that were

jong-un is back home this morning after wrapping up that trip to china. this is new video of him in his meeting with the chinese president. chinese state media quoted kim jong-un as saying that he is committed to the denuclearization of the korean peninsula. our scott mcgrew is following the new developments this morning, he will have the latest for us at 5:30. in san jose tonight the opening night of sirk due saleh crystal. the entire show is performed on ice. this is video of that show. crystal is only running at sap through the weekend. cirque du soleil is going through difficult times right now. you may have heard of them losing a performer earlier this month during a toe in tampa bay. a 38-year-old performer died while plunging to the stage. today the city of sonoma in the north bay gets back to the topic of regulating marijuana. city leaders are holding a town hall meeting tonight. the county and its cities have

smuggling activity at a home there. there have been several raids across the country in the last month. plus, the housing market is not slowing down. weekly mortgage applications are up nearly 5% from last week even as the interest rates are going up. experts say home buyers are not as concerned with those interest rates. nbc bay area responds ta san frao nc

nbc bay area responds to a san francisco man whose credit card points just disappeared. >> $3,000 worth. that's a lot of money. consumer investigator chris chmura explains what we did about it. >> john russo had an american express gold card for about 15 years, he said he earned reward points for every dollar he spent and racked up a balance of

400,000 of them, but when he went to use those points in february american express said his balance was suddenly zero. john says american express told him his points vanished because he had downgraded his gold card to a green card instead. he said he had no idea that would happen. so he contacted our team. american express declined to comment specifically on john's case but in general it said if you have an american express card with membership rewards and you downgrade, you keep your points. so we are not sure why john's account was zeroed out. but after our call american express reinstated all of john's points, all 400,000 of them which based on our calculations are worth about 3 grand. you know, points programs might seem simple on the surface, but underneath there are lots of conditions to look out for. limits, expiration policies and transfer restrictions. they can take a big bite out of your hard earned rewards so read
