the new cholula buttery jack. part of the buttery jack family. only at jack in the box. a chaotic scene in san jose.. a stolen vehicle cr right now at 4:30, breaking news, a chaotic scene in san jose, a stolen vehicle crash turns deadly. we're live at the scene. and we're fast tracking more wet weather for the evening commute. when we can expect the rain to move in. good morning, thanks for joining us, i'm marcus washington. >> i'm laura garcia. >> we start out with mild temperatures this morning and also just a few clouds here and there. we're going to see a mix of sun and clouds as we go throughout the day. here's a live look outside in san jose, nice and quiet. we're going to warm up as we go into the afternoon. reaching into the low 60s by noon. i wanted to show you again what it looks like on the satellite imagery as the clouds start to move into the north bay. we'll see the rain later on this

evening. i'll put a time line on that coming up in a few minutes. mike tracking a crash on nimitz. >> just about clear from the roadway, shouldn't be a problem through san leandro. you see north 80 around the coliseum and that moves nicely as well. good number of cars for those unaware. and there was slowing over the last half hour and cleared the construction zone between 23rd and 29th. there may be activity on the shoulder but most of the lanes are completely clear now. filling in, no problem for the speed sensors. back to you for breaking news. >> the breaking news in the south bay, the driver of a stolen car is dead after plunging off a bridge and into a homeless encampment overnight. >> live in san jose at the scene with what led up to this crash. looks dramatic, roz. >> reporter: we should tell you first police and evidence

technicians still on the scene of the horrifying crash investigating what is happening here. take a look out there, they've made markers and measurements still taking. it appears the car veered over that side of the overpass or bridge and went over. let's show you video from the scene and tell you more about what we know. this was a single car crash. it happened around 1:15 this morning. and for some reason it appears that the driver lost control, struck the guardrail on that west overpass then went over the bridge and crashed on the homeless encampment below. the car burst into flames and firefighters arrived and there was a desperate effort and race against time to get the driver out of the car. we're told the driver's legs were stuck. he was taken to a trauma center but did not survive. there were two other passengers, women in the car, they did survive. they were taken to the hospital. but we don't yet know their conditions. apparently police did not initially know that this was a

stolen vehicle. we have lots of questions we want to ask investigators about what their working theory is how this happened and what other things may have been a factor in all of this. meantime as they are still out here investigating and taking measurements, this area of west san carlos from bird avenue to the other side of that overpass is shut down at least for now until the morning traffic. as we get more information we'll bring it to you. for now i'm ross platit platteey in the bay. people were killed in a military plane crash near an air base, it's not clear what caused the crash or if there are any survivors. officials are starting to process the identity of the victims. continuing coverage at 4:33, facebook founder and ceo mark zuckerberg back in the hot seat on capitol hill. testifying on the sharing of

user's data. zuckerberg got a grilling from u.s. senators. during his testimony he agreed to work with lawmakers to better regulate facebook and social media. we spoke with one media ethics expert. he believes tech companies may be capable of the same answer themselves and more quickly. >> facebook and twitter have more power than the government right now to control how we communicate. if the government got involved, how quickly they could make the regulation effective. i think it's really going to come from the company and the other big tech companies. >> zuckerberg testified for some five hours yesterday. supposed to begin at 7:00 a.m. our time today. that's right when the "today" show gets under way. scott mcgrew will break down more what we can expect from zuckerberg during today's testimony. we'll have his analysis at 5:00. at 4:34, new details on the arrest of a contra costa

sheriff's deputy. the deputy may have committed rape, a detective stated that in an affidavit the 26-year-old patrick morseman committed multiple violations of rape under the color of authority. he was arrested earlier this month. at least one woman said the sex was not consensual. so far no comment by the sheriff's off on why the deputy isn't facing more serious charges. at 435, alton smith scheduled to appear in court in san francisco. been in custody since friday, being held on half a million dollars bail. they arrested him after they say he violated conditions of his original bail agreement and failed to appear in court. smith faces domestic violence charges after police say last month he assaulted his former fiance. he was then charged with violating a protective order. he played for the niners and raiders until 2015. al immediate da county is making a move to simplify the

sale of the coliseum site. it's a hot piece of real estate that has several notable bidders, now willing to sell the share of land back to the city of oakland. there are three possible bidders including a's and tesla and private developer from walnut creek. the city of oakland will review the bids. for the last 50 years they have owned and operated the coliseum complex. the raiders and warriors are expected to leave by 2020. happening today, bay area transportation leaders debate a framework for offering discounts to low income riders, hoping to offer a 20% discount to commuters. the program would be available for anyone with annual incomes far below the poverty level, which is $50,000 for a family of four. 4:36 on caltrans, crews are about halfway through a project on interstate 880 that keeps

good morning, i'm kate rogers live cnbc business headquarters, wall street could get back in gains after china's president pledged to open up and cut back on tariffs on some products such as cars. we'll get data on consumer prigs inflation and the minutes from the fed meeting. the dow soaring 428 points to 24,408. kroger is putting out the help wanted sign. the supermarket giant plans to hire about 11,000 workers even as it faces heavy competition from the likes of walmart and amazon. it created 22,000 in the past two years.

kroger has more than 2700 stores in 35 states under the kroger king superers and ralph smiths and fred meyer brand and raising wages after employees in ohio voted for a union backed deal that will lead to higher pay in several cities. the iphone is number one among america's teens. a survey shows 82% of teenagers own an iphone, up from 78% last fall. that trend could continue, 84% say the next device will also ab an iphone. this may bode well for the apple watch, 20% of teens plan to buy one in the next six months. they think this sets apple up nicely as it expected to release three new iphones this fall. >> we love our iphones kate, thanks. >> teens must have a lot of money. >> or the parents. >> coming up next on qu"today i the bay", another bought of rain to pass through. >> it will move through later this evening. most of the day is slooking good. as we look outside in fremont,

at 4:44 for you this morning. taking a look at the bay bridge. a beautiful sight as we wake up and start our day. >> pretty. clear. somebody got the windex out. >> or windshield wipers might be doing this later. >> that will be later tonight. most of the day is looking good. as we start out this morning it is dry. let's take a live look at at&t park. you may have plans for that early afternoon game and it's going to be nice out there for at&t park at first pitch at 12:45. our temperatures will be on the cool side, only reaching into the upper 50s throughout the game. you want to make sure you're bundled up with layers because you know how windy it gets. as you check out the 7-day forecast at the bottom of the screen you'll see the rain icons but that does hold off until this evening. most of the day in oakland will be a cool day. 51 degrees at 8:00. noon at 59 degrees.

and 62 for the middle of the day but the clouds will start to move in and we'll see some showers by 8:00 tonight. here's a look at all of our high temperatures today, mid-50s for the far north bay and napa and oakland 62 degrees and 54 degrees in san jose. here's a live look at san jose and as you get a look out the window and getting dressed this morning, a good day for a jacket because it is a cool start. we've mostly had 40s around the bay area and you can probably keep on some light long sleeves for the afternoon. and then as we look at what's happening on the satellite imagery, starting to see showers develop being just offshore and that will move farther south as the next cold front moves through and it will be mostly cloudy for the afternoon to evening hours. we can start to see the rain developing in the north bay by 6:00. so once again that will be after the giants game for san francisco and then it continues to move into parts of the east bay and south bay by 8:00 to 9:00 tonight then spotty rain

left over and few lingering showers for the north bay tomorrow morning. but we will be drying out and also very cool day for much of the bay area. a rainfall total will be very light for the south and east bay, barely measuring anything for san jose. but then you go up towards the north bay and there may be about a half inch or more. and mike, you're looking at something happening on the san mateo bridge. >> unfortunately all i can say is something. there were flashing lights across the flat section. eastbound towards us it looks like everything is moving smoothly but for a second i thought there was a break there too. over to the high rise and then they just disappeared. no reports of any problems or real slowing shows up on the sensors over last half hour, two minutes, dumb barton very clear. smooth drive through the north bay. south bay nice drive and

altamont, a little slowing over the pass. overnight construction cleared and west 580 through the area. livermore and dublin, you're at speed there. no major problems on the peninsula. palo alto northbound towards willow and san francisco. back to you. >> 4:48. live look at four bay area bridges this morning as that commute is getting under way. mike keeping his eye on everything. come rush hour traffic will be at the stand still like always. legislators are looking for a solution to some of our bay area traffic woes and could mean a new bridge in the bay area. the possibility is gaining some momentum. dianne feinstein and congressman are now asking the metropolitan transportation commission to conduct a comprehensive study to find a solution. >> one thing we're going to look at, a whole new crossing, traditional sense of a bridge across the bay. >> the general location for what is called the southern crossing would connect 238 on the east side of the bay off of 880, all

the way across to the west side, connecting 380 to highway 101. price check on the potential project, $10 billion. a lawsuit is prompting san francisco to put the brakes on collecting fees from ride share companies, they sued the state saying uber and lyft get preferential treatment because drivers are exempt from requirements. supervisors voted to suspend the registration requirements and fee payments across the board. a sudden surge of scooters in san francisco in the past few weeks the scooters have been rolling in by the hundreds on streets and sidewalks. and one supervisor says without permission. three different companies put the bikes out. you rent them by using an app called line bike and leave them wherever and whenever you're done. a spokesperson said it admits it knew the city was working on

regulations but put the scooters on the streets two weeks ago. no everyone is happy about this. >> they would rather ask for forgiveness than mpermission. it's not the way corporate responsible citizen s behave. >> sonoma county leaders are seeking common ground among the budding cannabis industry. such advi supervisors held a five hour long hearing and board agreed to come up with new rules to shield neighborhoods and families from operations. facebook's mark zuckerberg continues testifying today as lawmakers consider regulating the tech industry. back here at home lawmakers in sacramento are moving forward on that front. there's a new bill making its way through the legislature that could create the data protection authority and department of consumer affairs, that would lay the groundwork for state regulations in the absence of

new colony of honeybees. they'll be located in 38 boxes on the back side of the park and there will be about 50,000 bees per box. doing the max it's almost 2 million buzzing insects. they'll replace the thousands of bees who died during last year's devastating coyote creek flooding. a water level indicates how high the water zrose. >> kpoll naturers are an important part of our community. we need pollinators to keep us healthy and these hives here help us raise money for conservation. >> pretty cool. the zoo will sell the bee's honey to help save remaining mountain gorillas in the congo. the new colony was made possible with $15,000 from the county and $7,000 in prisvate donations, yu

>> later this evening. most of the day is looking good for plans getting out there out and about. as we head after that evening commute, it's going to start to get a little soggy here as we see a round of rain moving through. yesterday's system fell apart before it moved across much of the bay area. don't think that will be the case for this one today. a little stronger and bringing in cooler temperatures and looking at the time line of the rain by about 6:30, it moves in the north bay and approaching san francisco and oakland moving into the south bay and east bay by 8:00 to 9:00 tonight. i'll be tracking that and talking about how much more rain we may see in the forecast coming up. mike is saying the drive is slow in milpitas. >> because of overnight road crews dispatched around the bay. over here exceptionally slow over the last ten minutes, northbound 680 starting to jam up out of milpitas. if you join north of mission towards the tri-valley you're just fine
