>> later this evening. most of the day is looking good for plans getting out there out and about. as we head after that evening commute, it's going to start to get a little soggy here as we see a round of rain moving through. yesterday's system fell apart before it moved across much of the bay area. don't think that will be the case for this one today. a little stronger and bringing in cooler temperatures and looking at the time line of the rain by about 6:30, it moves in the north bay and approaching san francisco and oakland moving into the south bay and east bay by 8:00 to 9:00 tonight. i'll be tracking that and talking about how much more rain we may see in the forecast coming up. mike is saying the drive is slow in milpitas. >> because of overnight road crews dispatched around the bay. over here exceptionally slow over the last ten minutes, northbound 680 starting to jam up out of milpitas. if you join north of mission towards the tri-valley you're just fine.

privacy and election interference, this morning we have an idea what today's grilling might look like after he spent five hours yesterday answering senator's questions. scott mcgrew has been watching the testimony very closely. he's got more on what we can expect from the testimony today. he's got some hours underneath his belt here. >> that's exactly right. i think that's going to bring confidence, laura, things went really well for zuckerberg yesterday before the senate. he has the house energy and commerce committee today. zuckerberg was poised as he testified before the senate judiciary yesterday morning, well prepared. i'll show you a couple of highlights, everyone seems to be talking about one of them in which zuckerberg seemed to hint it there would be a paid version of facebook some day and orrin hatch didn't seem to know how they made money. >> there will always be a version of facebook that is free. it is our mission to help connect everyone around the world and bring the world closer together. in order to do that we believe

community. here's australia's foreign minister a few hours ago. >> i'm not going to comment on u.s. military operations but if the united states does carry out an air strike in response to this illegal use of chemical weapons against citizens, australia will support any action that is targeted calibrated and proportionate. >> in an unverified video shows a canister in a rubble of a home bombed by syrian aircraft. some claim that's the canister used in the alleged poison attack. at 5:06, happening today, the next step in the lawsuit against president trump when it comes to sanctuary cities. oral arguments start today in san francisco. pee pete joins us with what we can expect today. >> reporter: good morning to you, laura. you'll have the trump administration officials appealing that federal ruling if you remember back in november, you had a federal judge blocking the president's executive order

that would strip federal funding from the so-called sanctuary cities. really this back and forth between counties here, san francisco, santa clara county and trump administration dates back to last year. that federal judge in san francisco came to the conclusion that they deem that executive order to be unconstitutional. but you have a department of justice saying this executive order only applies to what they consider a small amount of money for the cities and counties not abiding by the federal immigration laws as they see it. all this is happening as cities deal with controversies regarding cooperation with the city and immigration ens for enforcement officials and have the justice department deciding this last month to sue california over three state laws including one that requires a state review of -- >> sounds like we lost the audio with pete there in san francisco. but of course we will continue

to follow the sanctuary city and what is going on in these san francisco courts today. in the meantime, search continues this morning for a missing southern california family heading to the bay area. they were supposed to arrive in san jose on april 6th but they never made it. now relatives are converging in mendocino county and friends say the last contact was from redwood national park and multiple agencies now searching south of garberville where witnesses saw a maroon suv slide off 101 and into the eel river during last friday's storm. the suv matching the description of the family's car. family members and neighbors of course are understandably concerned and one neighbor showed video showing the family of four driving away at the start of the road trip. >> very lovely people that would be surprising if something like that happened. >> on the video that i have, they got home from school and took the trash cans and left at 3:00 on the 30th and that was

the last we've seen of them. >> chp has not located a suv in the eel river and so far not confirming the vehicle seen plunging into the river belongs to the missing family. a 5:09, we're learning new video from last month's deadly shooting of an unarmed black man in sacramento will be released within a week. the police chief says the new video will come from body cameras worn by other responding officers and squad cars in addition to this video that we saw a few days after that shooting. stephon clark was shot and killed last month. officers say they thought he had a gun but turned out he just had a cell phone. it's 5:09, new this morning, people in san jose have been getting calls asking whether they would support a soda tax in the city. mercury news obtained audio which went out last week and it's a poll by a research group and claims quote, san jose will vote to approve a tax of one cent per fluid ounce. no such measure has been announced. the research group is not saying who funded the poll.

san francisco oakland and berkally and albany have all soda taxes. >> we've gotten one of those calls before. right now at 5:10. we start out with clear skies looking live out there in san jose. and i wanted to tell you about the temperature trend in willow glenn, it's going to be a nice and cool start at 9:00 we're in the low 50s and mix of sun and clouds. now most of your day is going to be dry. i will be tracking that rain as we go into this evening. overall we're looking at a cooler day with some highs in the mid-60s for the interior valleys upper 50s for the coast and parts of the north bay. i'll break down the trend for palo alto coming up in four minutes and mike, there's really one slow spot. >> we can pick -- can you find it. i'm standing in front of it. northbound 680 out of milpitas towards fremont. the rest of the bay -- except for the altamont pass west 580 always slow through the area and north 680 we have up to two

lanes blocked and three if you include the shoulder over there, northbound is slowing through the construction zone as you come up north of 237. they may have those lanes affected until 6:00 a.m. but likely they'll clear those over the next 20 to 30 minutes. we'll continue to track that. 880 heading towards mission, fine past the truck scales, good volume of traffic out there to greet you in the usual spots. here's the north bay southbound 101, no major problems, no issues for highway 37 either. the north bay is clear. back to you. >> 5:11. a bump in the road, changes coming to a senate bill that would increase housing near public transportation. >> and first the super bowl now college playoffs. the announcement we're expecting today at levi stadium that could mean big bucks for the bay area.

the weekend forecast coming up in less than five minutes. >> for this one driver, nothing much ahead across the bridge, an easy drive there. towards the bay bridge, travel times look great. you're at speed and backups starting to form once again, a few folks paying cash. bay area transportation leaders get an update on long term financing plans for a new b.a.r.t. cars along with upgrades across the trans bay corridor. they have plans to add 300 brar cars and with a to improve i am from infrastructu infrastructure. a follow-up now, state senator scott wooiner making changes to the bill that calls for an increase in public transportation hubs in the

state. he is amending his bill to include affordable housing, his original bill exempts developers from certain local rules such as height restrictions. that part of the bill actually still stands. happening today in san francisco, an l.e.d. light bulb give away handing out 10,000 light bulbs and happening at 10:00 this morning on the rooftop of the tenderloin development corporation on eddie street. that give away is organized by the city and san francisco public library. so all you need is your library card to get yourself a lightbulb. football season may still be months away but for one bay area group the clock is ticking. for first time levi stadium will host a national college playoff ch championship and host committee unveils events leading up to the game. today's news conference happens at 10:00 a.m. and hall of famer ronnie lot is among those

or coffee with these cool temperatures this morning and later on this evening you'll need the windshield wipers on after that evening commute as we get a live look outside in san jose. it's an all clear start. the seven-day forecast for the south bay is coming up at the bottom of the screen. i want to get you through that morning drive in the south bay. does start out cool with upper 40s and making it in the mid 50s by 2:00. we'll see a mix of sun and clouds and at times the sunshine comes out and you'll need the sunglasses and then it kind of hides behind the clouds. we're at 62 degrees, our high temperature today up to 64 in san jose. and 63 in cupertino, up to 60 degrees in oakland for the high temperature and in pleasanton, 65 degrees. upper 50s for half moon bay and mostly cloudy skies there. redwood city a little more sunshine and 63 degrees. and the outer sunset at 58 degrees and north bay up to 59

in santa rosa. it will be breezy with winds picking up as we go through the day because we will have another cold front approaching. right now it doesn't look all that strong. a lot of clouds and rain just offshore and starting to move into the northwestern corner of the state. we'll see this system dipping in the north bay first and making its way southward into this evening and during that evening commute for the north bay, it does look wet and some bouts of very heavy rain just briefly. as it moves farther south, we'll see some of the downpours by about 7:00 to 8:00 for the east bay peninsula and the south bay. tapering off tonight but there may be lingering showers through noon tomorrow for parts of the north bay. the rest of the bay area looks pretty dry but also very chilly with breezy winds. this round of rain doesn't look that heavy. once again barely measuring anything for parts of the south bay. the east bay up to close to a quarter inch and then for the

north bay that's where the highest rainfall totals will be about a quarter inch of rain to a half inch. and very cool tomorrow, our 7-day forecast for san francisco, upper 50s and then drying out, warming up for the weekend and saturday looks so nice, up to 70 degrees, but there will be a slight chance of rain late sunday into monday morning and looks active next week. it's good to see rain chances here in between the nice and warm weather. now mike, you were saying there's not much of a change on the map. >> no, the backup starts at the bay bridge, triggering a few slower spots along the cash lanes and northwest of just shy of mission, those are borders towards sunol. they'll move those crews the next 15 to 20 minutes. a nice drive into morgan hill. 101 at 25 there's a disabled

northbound 680, they perhaps opened one or two lanes. plan on a little slowing but these speeds are starting to improve as we speak here. the bay bridge toll plaza, a little slowing up the incline and at the toll plaza itself, the metering lights were turned on. it was a gradual build over last ten minutes but it is filled towards grant avenue as you would expect. now for breaking news at 5:31 in the south bay. the driver of a stolen car is dead after plunging off of a bridge and into a homeless encampment from overnight. roz plater is live. >> reporter: lots of questions what led to the crash. police still on the scene just behind me a couple of tow trucks have arrived. looks like they are going to lift the car up from the bottom of the overpass. in that direction from the evidence markers earlier it crossed over the line and went

over the enbaenbankment where t truck is parked there. let's show video from the scene and show you -- tell you what we know so far. this was a single car crash and happened around 1:15 this morning and for some reason, it appears that driver lost controlling and krark ecrashed n the guardrail in the overpass and plunged into the homeless encampment below. firefighters waged a race against time to get the driver out of the car. his legs were pinned in. they got him out finally to a trauma center but the driver did not survive. we're told two other female passengers in the car did survive. they were taken to hospital but we don't yet know their conditions. police did not initially know this was a stolen vehicle. now, investigators again are still on the scene here. when we get an opportunity, we're trying to get from them their working theory how this exactly happened, what led up to it? was the speed a factor in all of

this? police have also not released any information about the victims. again, a couple of tow trucks arrived and flat bed trucks. it looks like they are about to try to retrieve the car from under the overpass there and as soon as we get more information about all of this, we'll let you know. one more note, this section of west carlos street from bird avenue to the other side of that overpass, still shut down at least for now as this investigation continues. for now we're live in san jose, roz plater, nbc bay area news. it's going to be a long investigation. thank you. 5:33 right now. breaking news in north africa. this is brand-new video just into our newsroom. more than 250 people killed in a military plane crash in algeria. the country's state radio says the crash happened here an air base. it is not clear what cause the crash or if there are any survivors. officials say they are starting the process of trying to identify the victims.

at 5:33, new details this morning in the arrest of a contra costa county sheriff's deputy accused of having sex with two jail inmates. internal records obtained by the east bay times show the deputy may have committed rape. the detective stated in an affidavit -- affidavit that 26-year-old patrick morseman committed multiple violations of rape under the color of authority. he was arrested earlier this month. at least one woman said the sex was not consensual. so far no comments by the sheriff's office on why the deputy is not facing more serious charges. former football star aldon smith is scheduled to appear in court in san francisco. being held on a half million dollars bail and deputies arrested him after they say he violated conditions of his original bail agreement and failed to appear in court. smith faces domestic violence charges against -- police say at

least a month he assaulted his former fiancee. he was then charged with violating the protective order. smith played for the niners and raiders until 2015. and closer to selling. alameda county is making a significant move to simplify the sale of the oakland coliseum site. this is a hot piece of real estate that has several notable bidders, now offering to sell its share of the land back to the city of oakland. right now there are three possible bidders including the a's and tesla and a private developer from walnut creek. the city of oakland will review the bid and for the past 0 years allah immediate ameda and oakla and operated the complex. it is 5:35. making public transit more affordable. today the metropolitan transportation commission will consider a 20% discount to low income riders. bob redell is live with how it could impact really thousands of

families. good morning, bob. >> reporter: good morning, let's say you're a low income rider traveling from b.a.r.t. here in dublin to the embarcadero in san francisco. you' your savings could be $3 a day, $15 a week, $45 a month. later this morning the metropolitan transportation commission will discuss this proposed 20% discount for riders with the four agencies which have so far shown interest in this program. namely b.a.r.t., caltrain, golden gate transit and muny, you and your family would have to make less than twice the federal poverty limit, which for single people is just over 24,000, almost $33,000 for couples -- over $50,000 for a family of four. you would have to use a clipper card to be eligible for this discount. ac transit and samtrans will not be participating because they are afraid they might not be able to afford the program. if it were approved, they would

looking over here towards the south bay, getting to your job, easy or not, we're looking at the pretty smooth drive, we're tracking this. this slowing for north 680. that construction zone does indeed look like they are clearing a couple of off ramps that were closed overnight. the freeway itself, crews should be on the move and completely gone over the next few minutes, speeds are improving north of 237 up towards mission boulevard. westbound out of the altamont, a little slowing, pretty typical and no problems through dublin. over here the berkeley curve and despite a backup at the bay bridge, look how smooth the traffic flow sen all of the cars traveling through the maze. >> puzzle out there. >> the weekend weather, it's going to be a nice one. >> it's going to be a great weekend. really excited about the events going on around the bay area. there are so many but of course there's one i'm excited about. let's get a look at saturday's

forecast. coast 72 degrees and 76 for the bay, inland at 78 degrees. for sunday more clouds and that rain starts to move in late sunday evening. most likely as you're winding down from all of the events you tried to check out for the weekend. i'm really excited to host autism speaks walk, that will be happening in san jose at history park on saturday and during the morning, the weather of course is going to be really nice, low 50s and then it does warm up as the day goes along. with the walk happening in the morning, we've got sunshine and also temperatures at about 63 degrees during the middle of the walk. if you're hitting the road it's going to be warm, especially on saturday. reaching up to 80 degrees and then a few more clouds on sunday and we'll bring those temperatures back down to 73. if you're going to monterey this weekend, maybe going to make it a beach weekend, it's going to be at 63 degrees on friday and then saturday 65 degrees. sunday once again the rain holds

lights are on. a live look at four bay area bridges this morning as our commute gets under way. come rush hour traffic is sometimes at a stand still. the problem seems to be getting worse and leg legislators are looking for a solution to the traffic woes. it could mean a new bridge in the bay area. dianne feinstein and congressmen are asking the metropolitan transportation commission to conduct a comprehensive study to find a solution. >> one thing we're going to look at, a whole new crossing, traditional sense bridge across the bay. >> the general location for the southern crossing would connect 238 on the east side of the bay all the way across to 380 to highway 101. the pricetag on the project is $10 billion. the president is warning russia this morning how missiles

will be launched at syria. >> scott mcgrew joins us now. the russians have said they'll shoot them down. >> we are talking about direct military conflict between the united states and russia. certainly sobering news on a wednesday morning. the president tweeted directly at russia this morning, get ready russia because our missiles will be coming, nice and new and smart. tuesday russia vetoed a united nations security council measure to look into who was responsible for the latest chemical weapons attack on syrian civilians. russia is a permanent member of the security council so despite the fact 12 nations voted yes, russia's no was enough to stop it. >> here's nikki haley. >> history will word on this day russia chose protecting a monster over the lives of the syrian people. >> so it would appear we are striking syria. the president said so and russia says it will defend syria.

a new colony of honeybees. we're getting a brands new look ahead of that unveiling. located in 38 boxes on the back side of the park. and there will be 50,000 bees per box. stay away from those. we did the math, that's almost 2 million buzzing insects, they'll replace the thousands of bees who sadly died during last year's devastating coyote creek flooding. >> pollinators are an important part of our community. we kneel pollinators to keep our plants happy and keep us healthy. so these hives here help us raise money for conservation. >> the zoo will actually sell the honey to help save the remaining mountain gorillas in the congo. the new colony was made possible with $15,000 from the county and another 7,000 in private donations. pretty cool. today is a very important day.

>> you said every day is pet day and we're trying to make plans again, a walk before you go to work this morning or maybe take the pay cut to bring your pet to work, i don't know, but it looks really good today. going out for a walk this morning or maybe taking your pet to the giants game. you can't do that, can you? here's a live look outside at at&t park. we're getting ready for an early giants game that will be at first pitch at 12:45. now, the temperature is only going to be at about 59 degrees and holding steady throughout the game. and it's going to be partly to mostly cloudy. no worries about rain as of yet. we will see our high temperatures a little cool for this time of year reaching upper 50s, 64 degrees in san jose and livermore and anty of course, 62 degrees. showing the peninsula. you see the rain icon but once again the rain will be later this evening. we do start out with clear skies

and let's get you dressed. grab the jacket because it's chilly but much of the day you'll be comfortable with light long sleeves. there will be another front moving in. the cold front we had yesterday, the rain fizzled as it moved farther south. i do not think that will be the case with this one today. we will start to see the rain first moving in the north bay and working into the rest of the bay area in time for the evening commute and shortly there after. at about 5:00 or 6:00, we see the rain moving into santa rosa and approaching san francisco. in the east bay, light showers and into the peninsula by 7:00 and then the south bay by 8:00 to 9:00 tonight. there may be some brief heavy downpours but then it all quickly clears out by tomorrow, still light spotty showers lingering for the north bay but the rest of the bay area will stay dry with cooler temperatures back behind the cold front moving through. the rainfall totals very light.

south bay barely measuring anything. then about a tenth of an inch for much of the east bay, about a quarter inch or more for the north bay. up to a half inch in ukia then it's going to be cool and drying out and looking nice as we go into the weekend. mid-60s for san francisco on friday. 70 on saturday and inland areas will be slightly warmer and rain returns late sunday into the start of next week. and mike, you're tracking a change on the roadway. >> that was the report. i'm assuming it means heavier gauge -- not a neck chain over here. west 92, that's where it was reported as we look around the bay, a big look shows a smooth drive and early signs of the commute. we're almost at 6:00. 5:51, looking here towards west 92. no problems towards the high rise and i haven't seen the traffic. we'll track that. hayward a little slowing for southbound 880. let's look at our waze system, the slowing northbound 680, that construction zone still not completely clear north of 237.

all time zones. according to reports, a student from follow folsome called for the walkout. same support of students who walked out of class to raise wearness of gun violence -- >> the florida man charged in the shooting at marjory stoneman douglas high school. a judge will determine whether he qualifies for services a a public defender. he's charged with killing 17 students and staff members and wounding 17 others when he open fire inside that school on valentine's day. people are encouraged to wear orange today to raise awareness for work zone safety. today is officially go orange day. transportation workers across the country will be wearing that color. it's parts of a national work zone awareness week and held to bring attention to driver and worker safety in those work zones to slow it down. the iphone is still number one among american teens.

a survey shows that 82% of teenagers currently own a cell phone and that's an iphone. that's up from 78% last fall. that trend is expected to continue. this could be a good sign for apple watch, about a fifth of teens plan to buy one in the next six months and analysts say that this is set apple up for a good fall when the company is expected to release three new iphones. >> 5:57. happening now. the tax deadline quickly approaching, scammers are taking advantage. pg&e says a lot of customers have been reporting that people are posing as pge employees and asking for your personal and financial information. the irs says scammers take advantage of tax season every year and try to steal important information ahead of the tax deadline. some of the pg&e scammers are telling customers they could be eligible for a tax refund if they give up information like
