throughout 9:00 and mid-60s for later today. you can see the clouds rolling by on those icons there. we'll see the rain once again this evening. we'll talk more about that and what's ahead as that rain arrives that might get you out the door with a look at what's happening in a relatively mild commute. >> relatively, which means you have slower spots but you can expect them. one that may be unexpected we're tracking over here is northbound 680 as you look at the big view, we're going to zoom in towards milpitas towards fremont. we're still looking at slowing for northbound 680 but because of the way the fringes look the slower drive approach and after the construction zone we've had all night, i think they are moving crews and cones and that may be a great sign. 6:00 was the expected clearing there. northbound 101, a little bit expected slowing there as well for san jose because the volume with traffic from the live camera, it tends to build right about now. it builds in through the rest of the next half hour you really see slowing towards silicon valley. in san francisco, the north bay

an easy dry across the golden gate bridge without delay. back to you. thank you very much, mike. happening today, facebook ceo back in the spotlight on capitol hill this morning. facing more questions about privacy and election interference, he spent five hours answering questions from senators. scott mcgrew has been watching mark zuckerberg's testimony closely and explains what we can expect from him today. >> good morning, confidence is what we can expect, things went really well for zuckerberg yesterday before the senate and he has the house energy and commerce committee today. zuckerberg poised as he testified before the senate judiciary yesterday, well prepared. i'll show you a couple highlights, one everybody seems to be talking about in which zuckerberg seemed to hint there will be a paid version of facebook some day in the future and utah's senator orrin hatch didn't seem to know how facebook made money. >> there will always be a

as we dig deeper. >> 6:03 right now. >> coverage continues on "today in the bay." nbc news will cut in as soon as his testimony begins. that's expected to happen at 7:00 this morning. breaking news coming into our newsroom, the associated press reporting that house speaker paul ryan will not run for re-election. that means he won't be house speaker next year. rumors have been swirling that the republican leader has been preparing to leave washington after his current term. the 48-year-old conservative shot to prominence in the 2012 election. he was the republican vice presidential nominee as well you'll recall. ryan has scheduled a press conference set for 7:00 a.m. our time. we'll certainly monitor that. also following breaking news this time from the south bay this morning. a live look near the san carlos street overpass in san jose above royal avenue. that's where police say the driver of a stolen car lost control and it plunged into a

homeless encampment below. it happened a little before 1:00 this morning. the driver of the car died. two passengers also inside that car survived. no updates so far on their conditions but you see the scene of the crash there. the car just burst into flames. we have a crew at the scene and we'll have a live update at the bottom of this hour. >> 6:05. happening today, the next step in the lawsuit against president trump when it comes to sanctuary cities. oral arguments began in san francisco for two bay area lawsuits, today in the bay pete suratos is live. what can we expect in court today? >> reporter: good morning, marcus, we can expect to see the trump administration appeal that decision by federal judge last november to permanently block that executive order that was strip federal funding from the so-called sanctuary city counties which includes san francisco and santa clara. this back and forth dates back to last year. you have the ninth circuit court of appeals in san francisco

deeming the executive order unconstitutional following two lawsuits by san francisco and santa clara counties saying president trump did not have the authority to add these new conditions to funding already approved by congress. but the department of justice says that executive order only applies to what they consider a small amount of money for the cities and counties and already complies with federal immigration law. all of this is happening as the justice department decides to sue california in march over three state laws including one that will limit local law enforcement to turn people over to immigration authorities now texas and more than a dozen other states led by republican governors support this saying california laws interfere or block federal immigration enforcement but the oral arguments will take place later this morning. set to start at 8:15 a.m. we're live near the golden gate bridge, pete suratos for "today in the bay." now to the latest syrian crisis, president trump is responding overnight after

bralted and proportion naate. an unverified video shows a canister in the rubble of a home. in civilians say that is the canister used in the alleged poison attack. a search continues this morning for a missing southern california family headed to the bay area. the family were supposed to arrive in san jose on april 6 lgt but never made it. relatives are converging in mendocino county. they say the last count r contact was from redwoods national park. multiple agencies are searching south of garberville where witnesses saw a maroon suv slide off into the eel river last friday during that storm. that suv matches the description of the family's vehicle. the family members and their neighbors say that they are concerned. one neighbor shared video showing the family of four driving away from the streets of their road trip. >> very lovely people.

that would be surprising if something like that happened. >> on the video i have, they got home from school and took the trash cans and left at 3:00 on the 30th that was last we've seen of them. chp has not located the suv in the eel river and so far isn't confirming the vehicle seen plunging into the river belongs to the missing family. at 6:09, new this morning, people in san jose have been getting calls asking whether they would support a soda tax in the city. mercury news obtained audio that went out last week. it's a poll bill a research group and claims quote san jose will vote too approve a tax of one cent per fluid ounce. no search measure however has been announced. the research group is not saying who funded the poll. san francisco and oakland and be be be berkally and albany all have a soda tax. >> we got one of those calls and ended up hanging up on them. we're starting to see clouds

move in ahead of the next cold front. some of the rain still offshore hasn't made it inland as we go throughout the day, the rain will be moving from north to south. but most of your day is looking dry. here we are at 7:00 to 8:00 tonight and see. of the bay area covered with showers and quickly moves through by 9:00 we'll start to see that rain winding down and there still be may be lingering light rain early tomorrow morning but with cool temperatures. there may be low elevation snow mixing in for the north bay hills. i'll track this and what's ahead for the weekend and break down a temperature trend for fremont coming up. mike says it's a slower drive across the san mateo bridge. >> that might not be a surprise to folks but we've been tracking the report of a length of chain mid span and so i've been watching for any traffic breaks because there are none. i think that is that volume of traffic building from the hayward side. probably a traditional pattern. there's westbound 92. we'll track that again for any traffic breaks over the next few minutes. they haven't cleared that yet.

it's 6:14. a dry commute as we look outside in fremont. and the rain will come mostly after the evening commute. so today looking dry bit clouds mixing in. it's a cool start and fremont will be at 56 degrees ats 10:00, noontime temperature at 62. mid 60s for today. and we'll talk about the time line of the rain and if there's any more in the forecast before we head into the weekend.

that's coming up in less than five minutes. >> easy drive at dublin. and at the top of the screen, that windy road towards the castro valley, smooth drive there. north bay has slowing for 37 out of vallejo and lakeville highway. it's quarter after 6:00, happening today, bay area transportation leaders get an update on long term financing plans for new b.a.r.t. car trains along with upgrades across the trans bay corridor. mtc has plans to add 300 bart cars along with more buses area ferries and leerds want to also improve infrastructure. costs are pegged in the billions. they get an update for funding options. a follow-up, scott weiner making changes to his bill that cause for an increase in housing near public transportation hubs in the state. after a blow back, weiner is

amending his bill to require developers to include affordable housing and the original bill exempts developers from certain local rules such as height restrictions. that part of the bill however still stands. >> 6:16, new this morning, there's new evidence that wildfire smoke can be dangerous. according to a new study out this morning, rxers at uc san francisco found an increase in e.r. visits in the summer of 2015. not only suffered from breathing problems but also heart failure. researchers say it has pollutants that could be dangerous to your heart. a high school student didn't know how to find a prom date so his co-workers helped him out. he said he was stressing about his senior prom. they put his name and request on the sign outside that fast food restaurant, tanner needs a prom date. details inside. his co-workers printed off pictures and showed them to

it's all dry and of course the commute is rolling. everyone getting this day started. i wanted to show you the temperature trend through the east bay. it's going to be cool to start. upper 40s, make sure you have a nice warm jacket. as we go throughout much of the morning early afternoon, a mix of sun and clouds, at times you may need the sunglasses and then when the clouds move in you may be taking them off. here's a look at the highs reaching up to 64 degrees in los gatos, 60 in oakland and 63 in concord, the coast 58 degrees at half moon bay and san mateo at 62 degrees for the high temperature, up to 61 degrees in the mission district. em bebarcadero at 60. now the north bay is where the rain will start first. we can see this system moving in, still a lot of rain is offshore. it's been fairly light but this will make its way into parts of mendocino and sonoma counties by this evening.

it looks like it for the most part it holds off until the evening commute gets going in the north bay. santa rosa, point reyes towards napa at 5:00 and then into san francisco by 6:00 to 7:00 and into oakland and rest of the bay area, seeing scattered showers, most of it starting out very light. a little bit later for san jose, it will be mostly at 8:00 to 9:00 and then it tapers off tonight. still may be a couple of lingering showers and cooler temperatures for the north bay by tomorrow morning. and rainfall totals for the south bay barely measuring anything. and for the north bay by a quarter inch of rain, of up to a half inch in ukia. here's the 7-day, after this round of rain moves in we'll clear out for the weekend and sunshine warming temperatures inland areas up to 78 degrees on your saturday. and mike, you were saying there's two crashes now in san jose. >> they just popped up in the report with updates. i'll update you.

smoother drive for. of the bay. the bay bridge toll plaza has the backup and metering lights are on. you're not getting away without that. towards the two crashes in san jose, one 87 to 280, looks like everything is out of the lanes. it's northbound 87 that's a bad spot. slowing maybe a little enhanced over the next few. we'll track that. hopefully the lanes will clear but even on shoulder that will be an issue for san jose. here's the berkeley curve, you see the slowing over here. the approach to the bay bridge now starting to fill in. a quick look at the waze system, a slower drive through the tri-valley and east bay. fremont, purple route 41 minutes. you take the other routes and there's only a five minute difference. not much difference through the castro valley and union city. back out to the live shots, one more to show you over the east bay. just 23 minutes from highway 4

the bay bridge as you would expect because that's where it is, the bay bridge. back to you. >> pretty busy out there. thank you very much. it's been a busy morning in the south bay. this is breaking news that we've been following since we came on the air at 4:30. the driver of a stolen car dead after crashing in san jose overnight. it's where he crashed which is very interesting as well. roz plater is live with what led up to the deadly accident. roz? >> reporter: indeed we've gotten new details from a witness of the crash. the witness who dialed 911 rather who -- he heard that car as it was approaching the overpass here. let's go ahead and show you video of the scene and tell you what we know so far. we know this was a single car crash that happened about 1:15 this morning and appears the driver lost control and crashed into the guardrail on that west san carlos overpass and plunged into the homeless encampment

below. the nearby gas station clerk says the car was moving very fast. >> i heard a car coming down real fast and heard the tires screech and loud bang. so i went outside to go check and then i saw a fire coming from the side of the hill. i guess it rolled over down the side of the hill. i can hear this lady screaming. >> reporter: he says the female that was screaming was screaming for help and also saying get out. we know the driver was trapped in the car and his legs pinned in. firefighters had to get the fire out and get him out of the car and take him to the trauma center. he did not survive. we're told that the two other passengers in the car we have just discovered are juveniles, two female juveniles were taken to the hospital. we're told they are in critical condition and the police are still of course investigating all of this. now the road has reopened here and investigators not on the scene bit we're hoping to get information about what led up to the crash and whether or not they believe speed was a factor

in all of it. for now we're live in san jose, roz plater for "today in the bay." >> thank you, roz. we want to tell you about breaking news in north africa. this is brand-new video just into our newsroom. more than 250 people are killed in a military plane crash in algeria. the country's state radio says that crash happened near an air base and it's not clear what caused that crash or if there are any survivors. officials say they are starting the process of identifying the victims. it is 6:34. we have new details now on the arrest of a contra costa county sheriff deputy accused of having sex with two jail inmates. internal records obtained by the east bay times shows the deputy may have committed rape. detectives stated in an affidavit that 26-year-old patrick morsemen committed multiple violations of rape under the color of authority. he was arrested earlier this month. at least one woman said the sex was not consensual. so far no comment by the sheriff's office and why the deputy is not facing more

serious charges. troublinged former football star aldon smith is scheduled to appear in court today in san francisco. smith has been in custody since friday. he's being held on a half million dollar bail. deputies arrested him after they say he violated conditions of his original bill agreement and failed to appear in court. smith faces domestic violence charges after police say last month he assaulted his former fiancee. he was then charged with viol e violating a protective order. smith played for the niners and raiders until 2015. al immediate da county is making a move to simplify the sale of the coliseum site. it's a hot piece of real estate that has several notable bidders, now offering to sell its share of the land back to the city of oakland. there are three possible bidders including the a's and tesla and a private developer from walnut creek. city of oakland will review the bids.

for the past 50 yearsal immediaalameda and oakland own eed and operate the complex. 6:36, happening today, a plan to make your commute more affordable is moving forward. today the metropolitan transportation commission is considering a 20% discount for low income riders. bob redell is live any dublin b.a.r.t. station to explain how it could affect thousands across the bay area. good morning, bob. >> reporter: good morning, marcus. your saves could be substantial over time. let's say you're a low income rider taking b.a.r.t. in dublin here to the embarcaderembarcades would be $3 a day, $45 a month. you can see how it adds up. later this morning the metropolitan transportation commission will discuss this proposed 20% discount for low income riders. there are four agencies participating in this proposed program namely b.a.r.t. and kol

train and golden gate transit and muny. you can see on the tv screen, you would have to make less than twice the federal poverty limits, single just over $24,000, 33,000 for couple over $50,000 for a family of four and have to use a clipper card to be eligible for the discount. two agencies that won't be participating because they are afraid of not being able to afford the program. if approved, mtc would provide $26 million in reimbursement for the four agencies, most of which split between b.a.r.t. and muny. they'll discuss this proposal today at 9:30, the four agencies will have to approve any changes and that would take place over the summer. if there are into surprises, this new 20% discount for low income riders would go into effect sometime during the summer of 2019. reporting live here outside dublin b.a.r.t., bob redell

"today in the bay." >> always looking for improvement and money. the road crews have cleared out of milpitas. crash still on the shoulder, not a major problem for the south bay. this is the biggest issue, southbound 880 at winton, the crash may be in the middle lane, that's the initial report from chp causing more slowing from 238 down into san leandro towards hayward. has easing up traffic here at the hayward interchange with 92 and 880 but that's not a great relief. that's causing a problem for folks coming out of oakland. rest of the dry out of the altamont, very easy, dublin interchange, no problems for 680. this is the north bay. san rafael, a nice pleasant drive down to the golden gate grij. >> for the traffic guy to say pleasant drive -- >> sitting in his office though. >> very early.

6:43. let's get this wednesday started. we're already starting to see the clouds move in as we look outside in san jose. it's a dry morning commute and the rain holds off until after the evening commute. let's go to south san jose and santa theresa, 56 degrees at 10:00 this morning. a mix of sun and clouds throughout the day and some mid-60s for our high. it's going to be cooler tomorrow, after the rain and that front moves through, we'll talk about all of that and details in the forecast in less than five minutes. and looking at the drive here palo alto moving well and the traffic flow for 101 through the area. east shore freeway a nice drive

as well, no problems but there's slowing of course heading through berkeley out of richmond. it's 6:44, mike is always taking a look at our cameras and bridges across the bay area. here's a look for you as the commute is well underway. well, come rush hour it makes it tough. problem seaems to be get being worse and legislators are looking for a solution to the bay area traffic woes and could mean a new bridge in the bay area. the possibility is gaining some momentum. dianne feinstein and mark desell nai are asking the transportation commission to conduct a comprehensive study to find a solution. >> one thing we're going to look at, a whole crossing and traditional sense of a bridge across the bay. >> the general location for what is called the southern crossing would connect 238 on the east side of the bay off of 880 across the west sigh connecting 380 to highway 101. the price tag on the potential

loyalists and people that worked for obama. it would appear we're going to strike syria. the president said so, russia says it will defend syria. the last time mr. trump ordered a strike almost exactly one year ago, we used missiles fired from navy ships it is reasonable to assume this is the only thing we will use again this time around because manned aircraft would create the possibility of russian and american servicemen shooting at each other which would launch us into uncharted territory. what has to be a sign of our topsy-turvy world. what normally would be a top story is something at the end. paul ryan speaker of the house will not run for re-election in wisconsin. he'll leave congress at the end of his term in january. ryan came to washington as a balanced budget hawk and leaves having overseen a tax cut and spending bill that the cbo says will add a trillion dollars to the deficit every single year.

sanctuary cities. the trump administration is planning to appeal a ruling that blocks president trump's executive order to strip federal funding from sanctuary cities. san francisco's ninth circuit court of appeals later called that order unconstitutional. the supreme court then refused to issue an injunction saying the case should play out in lower courts. >> the searches on this morning for missing southern california family. they disappeared on their way to the bay area. they were supposed to arrive in san jose on april 6th but never made it. friends say their last contact was from redwood national park. multiple agencies are searching an area just south of garberville where witnesses say a maroon suv slid off a highway and into the eel river during last friday's storm. that suv matches the description of the family's vehicle that was last seen pulling out of their driveway in this video. the florida man charged in
