trend. and we'll talk more about that. san jose crash, has that cleared yet? >> the one on 280 has cleared but we have it on the bloter because it cleared in the last few seconds. not a whole lot going on but there may be another over here 84, that's what i'm working on right now we're watching work on the kmurt and nothing really showing any changes through san martin or over the summit. easy drive for both of those, longer commutes into san jose. northbound 101, a light easy drive, crash on the opposite direction, coming into downtown has cleared from lanes around meridi meridian. fremont moves clonicely as well. there's the truck scales and northbound taillights. no delays through oakland and towards the bay bridge where the cash lanes just starting a little backup guys, back to you. >> 5:01. developing this morning, federal agents expected to arrive in

concord today because of the massive fire that destroyed a five story apartment building under construction. this is a story we've been telling you about since yesterday, forcing 250 people living next door to evacuated. they will look for clues. pete suratos will have a live update in half an hour. the big showdown over trump's travel ban. the supreme court finally taking on this case. "today in the bay's" kris sanchez is live at sfo where many protested the original ban and has more of what we can expect in court today. kris? >> reporter: protesters plan to be outside the supreme court in washington, d.c. this morning. this morning san francisco international is lit up in warriors color but we could see images anti-travel ban images projected here at sfo a little later this morning. we have seen protests like this one before here at sfo. this is over president trump's executive order banning

travelers from majority muslim nations from entering the united states. now today the supreme court justices will hear a one hour argument, that's it. this is for the third version of the executive order and it amounts to a permanent ban on nationals from five muslim majority nations including iran, libya, somalia and syria and yemen. it also adds restrictions to travelers coming from north korea and venezuela. the president said this is necessary for the reason of national security. opponents say it is unconstitutional because that ban is based on religion. bay area members of the council on islamic relations or care are in washington, d.c. as we speak and the national council tweeted in part, this ban is causing tremendous suffering for countless families and communities. #no muslim back ever. no tweet at this point from president trump. we'll let you know when he speaks out.

one hour argument at some point following they'll release the transcript and also audio from the hearing and we'll bring that to you in our midday newscast. we expect that at 11:00 this morning. if they release it before 11:00, our midday hour, then we will bring it to you sooner than that. asfo, chrkris sanchez, "today i the bay." late last night another notable ruling about another immigration issue. they have ruled against the trump administration's campaign to end daca. it did cause the attempts to end the program unlawful. it gives the administration 90 days to come up with better reasons to scrap daca or the judge will reinstate it in its entirety. there's been no response from the white house as of yet. >> community leaders will discuss how to better house the homeless in south bay. one solution already in the works, tiny homes, let's bring in bob redell this morning. how small are we looking at here, bob?

>> reporter: good morning, we're talking about the housing crisis obviously and everywhere you go around the bay area it's evident in the try valley. they have very dense housing and a lot of homes crammed together and unfortunately this is not enough. we need more and the same goes for city of san jose. what is different with the city of san jose and made worse is the fact that there are many people who cannot find a home and end up on the streets today at 12:30 the department of housing organizations will host a public discussion on how those tiny homes we're talking about, tiny homes can help the homeless, you might recall within the past several months, city unveiled plans for houses ranging in size from 80 to 140 square feet. no plumbing, just electricity. the question now is where to put them, a number of residents have said not in my backyard. the mercury news reports that the city is considering a state owned site that used to be a

police believe two men tried to lure a child into their van. a 10-year-old boy tells santa rosa police two white men in a black van approached him as he walked home yesterday afternoon. he says they offered him candy and when they pressed harder, he ran off and hid in the bushes, it happened on brush creek road near badger road. the child could not provide a make or model but says the van had silver trim. quick thinking moms saved her baby and herself after a teenagerer tried to kidnap them. police say on saturday, 19-year-old alexander pretended to be lost in a neighborhood near river. over by 880 in fremont and asked the mom for directions and took out a gun and told them to get into his car. they then picked up her child and get away. the suspect got in his car and drove away as well but police managed to find him the next

day. 5:07. when a rape happens there's no question about it that the rape kits need to be processed faster. santa clara supervisor cindy chavez and rosen are calling for the kids to be processed within 30 days. currently the requirement is 94 days and there's a huge backlog in the crime lab. full board will consider the proposal next month. new this morning, east coast coffee, coming to the south bay but you have to wait longer. our very concerned newsroom got curious and probably rather hungry and contacted the developers who now say the store should be open by late this summer near the corner of smell and blossom hill where the arby's used to be. if you just can't wait like some in our newsroom, there are hard dun kin doughnut stores in half moon bay and south san francisco. >> 5:08, you know what you're looking at there.

there is a live look at oracle arena. warriors fans, you need to book the plans for the second round of the nba playoffs. >> where were you last night? the dubs took care of business, taking round one, four games to one. kevin durant scored 25 points in the game. warriors pretty much controlled it through three quarters. the spurs did make it close late in the game but golden state took it, winning it 99-91. you can be sure fans came prepared. >> i love the warriors, especially my main man hurt right now stephan curry. any guess who i'm really representing here? >> she's got the colors. warriors take on new orleans in the conference semis, game one is saturday, time to be determined. the team today starts its exclusive pre-sale ticket events. fun to go to. >> so exciting. >> field trip. >> taking down the pelicans.

as we get a look at our temperatures now as you head out the door right now at 5:10, it is 46 degrees in napa but much warmer in san jose. it's 55 and also 55 in palo alto and 49 as you head out the door in livermore. let's go to oakland for our day planner. it will be cloudy to start but as those clouds clear out our temperatures will start to warm up. we'll still in the 50s at noon there and reaching eventually into the low 60s for this afternoon. a look at all of our high temperatures today, 75 in morgan hill, santa rosa, 68 degrees, we'll city in the upper 50s in san francisco and today in half moon bay, only 57 degrees. we'll take a look ahead to the weekend coming up. mike says it's a pretty calm commute so far. >> don't wake it up. >> looking nice and dry and green sebs sensors all around. there's one crash, i hope you got a chance to look at your drive. we'll zoom over and show a crash reported, i'm get being a few more details, drive times

mike traffic tease it )s - - - on your wednesday it is 5:14. let's look at temperatures for san jose heading to the neighborhood of evergreen, we'll be at 58 degrees and sunshine by 9:00. we'll keep that sun all throughout the day and reaching into the mid-70s by 3:00. our normal high is about 70 degrees but we're going above that today. a cooling trend will be under way. time to dig the sweater back out of the closet. we'll look at our forecast for the next several days that's coming up in less than five minutes. >> kari, we're looking at the

satisfaction numbers are out. united did not do well. more importantly, its numbers are falling, southwest is best according to the american customer satisfaction index, alaska number two, aleej ant a big surprise at three. united didn't make it to the top five. virgin america not on that list drek directly, now owned by alaska airlines. today is the last day american virgin america will fly as it's own branded airline. virgin was number one airline on conde nast list of best american airlines every single year it operated. nine years in a row at number one. so today it's the last excuse to show you this. ♪ you're never going to hear that one again and never see that again. >> that was fun. >> no real reason to show

or you just probably watch on all of the networks. >> and yeah we're looking forward to that and also looking forward to cooler weather around the bay area. it is starting to cool off starting today as the clouds move in. here's a live look outside in san francisco and the golden gate bridge still clear although we've seen patches of fog across the coastal areas but so far looking good here as you make your drive out of the north bay or heading to the north bay. we are now feeling temperatures in the low 50s, san francisco, 53 degrees it is 48 in fairfield and 49 now in livermore. morgan hill 49 degrees and as we get a look at our temperature trend, it's going to be in the upper 50s at 9:00 and then reaching into the mid-70s for the afternoon. so a very nice afternoon. let's head to the south bay as we see our high temperature in milpitas up to 70 degrees. cupertino 72 and winds from the west at 10 to 15 miles per hour in the east bay.

antioch, 76 degrees and fremont a high of 72 degrees. we'll also get some clouds along the coast keeping those temperatures down in half moon bay while palo alto will get more sunshine and 72 degrees. and 57 in the outer sunset. north bay up to 73 in novato and sunshine and santa rosa and 68 degrees. and the pollen count still really high for the trees and grasses. oak and mulberry the main offenders and there's still nothing to help wash those allergens out of the air. we have this area of low pressure moving away from the coast but we'll have another one moving in and that will give us a slight chance of some spotty showers, only for the north bay on saturday. the rest of the bay area sees increase in clouds and cooler temperatures and san francisco staying in the 50s over the next few days, inland areas, 75 today and 65 on saturday. mike, now you have a crash in the tri-valley. >> doing homework on the crash in livermore valley, the one we're talking about of the three

valleys and it's a smooth drive for rest of the bay. towards that livermore valley, we're looking at 84 and that's where the crash is just past where they merge and you see the slowing that started already, the reference here, ruby hill country club and houses around there. a slower drive towards 680. let's show the waze system, how slow depending on the route. if you go from 580 and trying to cut through, you might want to use siis is a pel. a couple minutes but it might build. dublin interexchange, still okay. nbc bay area wazers will get you up to minute traffic. we'll refresh your drive through conco concord. just like yesterday we have the closures still through downtown. watch willow pass and mira vista till closed because of recovery work and inspection after the fire from yesterday. keep that in mind. it will tie things up.

horrifically on a southwest plane .. is speaking out about the woman he loved. jennifer riordan died last week .. the man whose wife who died horrifically on a southwest plane aspeaking out about the woman he loved. jennifer riordan died after an engine exploded mid-air. she was nearly sucked from the plane. michael riordan talks about the support he received following her death. >> she was genuinely and pure to her core and the community got to see that. so i'm just so so uplifted with the -- every time you talk to someone in the community they felt that with jennifer too. >> tragic loss. the story will air during the first hour of the quts today show following "today in the

bay." >> the man accused of shooting into a waffle house killing people will be in court for first time. travis reinking killed those people early in the morning and spent a day on run. right now in jail on a $2 million bond. at 5:26, some believe california's coastal access law may well be at stake at recent request by the u.s. supreme court it really dates back years. it involves silicon valley billionaire's effort to block access to martin's beach. he recently filed an appeal to the higher court after the state supreme court refused to hear his case. high court justices are now requesting his opponents respond to the petition by mid june. some legal experts believe this means the court may be interested in taking on the case. 5:26 right now. coming up on "today in the bay," more than 24 hours later and it's still smoldering. >> it was crazy, it's something like you see in the movie, it was amazing and just like you

here on clayton and galindo. we want to show you a big flare-up. you see the flames behind me that's in the past five or so minutes when it flared up and that's one of the main concerns here at the construction site as they are still working to put out this fire. now as far as the investigation goes, we know atf will be here later this morning to assist. we're showing you the flames back there, another concern is the possibility of more scaffolding falling down or collapsing in the area. let's show you some video after our midday report wrapped up yesterday at 11:00 a.m. from a firefighter's mass camera and captures the collapse of scaffolding at the fire scene. officials say the wall behind it could also collapse at any time. you know that's exactly why you've got more than 250 people living in the building next to it and evacuated or still evacuated at this time -- at this point this morning after flames took over. that construction site we just showed you yesterday morning and

at this point they still can't return to their homes. in fact they were given less than ten minutes yesterday to grab essential items. here's what they told their crews. >> it was crazy, it was something like you see in the movie. it was amazing, like you can't believe it. >> cops you know, taking groups of people around and getting emergency items out. medication pets and stuff like that. >> as for atf investigators, they'll have a special response team here in concord this morning, currently investigating similar fires that took place at construction sites in 2016 and 2017. one in oakland and two in emeryville. let's take you back out here live. you see those flames there at the construction site and of course officials are saying it's too early to determine if this fire was intentional or accidental. i did speak to the mobile command and they are saying that a spokesperson with contra costa fire is expected to arrive in the next half hour and if they give us new more updates we'll

bring it to you in the newsroom. pete suratos for "today in the bay." >> a lot of work going on there. >> it is 5:33. the company accused of lying about toxic cleanup at hunter's point ship yard in san francisco plans to address what some are calling misleading reports. tetra tech holding a news conference at a law firm. the epa is questioning 97% of the company's cleanup data and wants the soil at the ship yard retested. the chronicle is reporting this week a lot of dirt and soil in question was dumped in landfills across the state, including brisbane and morgan hill. a ship yard was home to a navy radioactive lab for deck ates, our investigative unit is tracking updates. you can learn more on nbc by area.com. it seems we're getting a better understand of san francisco's new electric scooter regulations. and with that clarity it seems

the city may end up with no scooter rental companies at all. the examiner reporting transportation leaders laid out new preliminary regulations for the stationless scooters which customers are really leaving pretty much anywhere. city leaders say the rental companies will have to quote play ball once those new regulations are approved or risk not receiving a permit. >> you still recovering from the 2016 election? might be some unwelcome news. in decision 2018 get ready for a new wave of political ads like these. >> for republicans, the race for governor is crystal clear -- >> i was born in san diego. >> we've got a governor's race this year and some voters say they are already tuning it out. >> because i don't listen to ads on tv. >> most i take with a grain of salt because a lot of it is hyperbole. >> expect to see and hear these ads on tv and radio and online over next six weeks. the primary is coming up in

emoji, tell skipper the emoji is actually a picture, you can use that too. 101 itself, the picture tells a thousand words, it's slow. there's a crash north of our camera at 280 and 101 and that crash may still be blocking one lane. we'll track that build as it started to form over the last couple of minutes and could have the ripple effect pushing 280, traffic towards 87 to get around this backup, we'll watch. so far stick to your course and coming in out of the south county, we have slowing through san martin and typical there. a stall highway 17 looks likes it's out of lanes but i'll track it north of the summit. we have the slow area drive just developer because of traffic in fremont. >> look at the glow out there. people are getting rolling for the weekend already. i know i am. >> yes, we're halfway there, look forward to a very nice but cooler weekend and we'll have to watch out for rain in parts of the bay area. that will mostly be the north

bay where we'll see a mix of sun and clouds for the inland areas on saturday while the coast only making it up to 59 degrees with some breezy winds, sunday more of the same but all clear sunshine around the bay area. slightly warmer temperatures for the inland areas up to 66 degrees. if you're heading to petaluma, that's on sunday and good thing it is on sunday because once again we don't have the worries about the rain and it's going to be up to 66 degrees by 3:00. chris chmura will be out there and you'll be able to see the former san francisco giant noah lowery on the nbc bay area float. watch out in lake shas at a, there could be storm chances there, highs reaching in the upper 50s and low 60s all weekend long. you can enjoy clear weather if you're going to monterey. it will be up to 60 degrees on saturday and sunday 59 degrees. let's head out of town to

after a crash happened this morning. several cars may have been hit-and-run as well. it all happened about 3:00 in the morning near the treat boulevard onramp. no one had serious injuries. northbound lanes were closed for more than a half hour before crews managed to clear that scene. >> 5:44 right now, in an emergency, you want firefighters to be able to find a hydrant as fast as possible. >> it's not always that easy. a cupertino hydrant caught our attention thanks to social media post from santa raclara county firefighters, fire hydrant is totally covered in ivy. fire officials say it's part of the annual inspections. >> who often than not obscured by landscaping and bushes grow around them and it does make it hard to find and that is one of the reasons we do those inspections every year. >> the local water districts own the hydrants and should maintain

at the top of the hour to fill us in. arizona held a special election tuesday to replace republican congressman trent franks who resigned. now, another republican won but barely, five percentage points and arizona, very republican. other news we have an ambassador nominee to south korea admiral harry harris was supposed to be the ambassador to australia but there was a last minute switch. we've been without an ambassador to south korea for more than a year. we're getting mixed signals this morning on the future of dr. ronnie jackson. president trump nominated him to head the veterans administration but yesterday suggested jackson should back out after allegations jackson drinks on the job among other things. now even if jackson were absolutely pure, there were already doubts about him. the va is the second largest government agency and has more employees than ford motor company. jackson has never let a led a team bigger than a few dozen.

but the stands will be filling up and we'll have the early afternoon game at 12:45, first pitch will be at 60 degrees and low 60s today. perfect as you take in that sunshine. oakland will be up to 64 degrees today and 76 in antioch, still warm for the inland areas but not as warm as it's been recently. as you're getting dressed this morning, long sleeves a good option, also pants as it will be breezy, especially along the coast today. make sure you're dretsed nice and comfortably and then as we get a look at the big picture, i see on the satellite imagery swirls of clouds moving away from the bay area but we'll see an area of low pressure developing, stronger onshore flow keeping it cool as we go into the weekend and early next week. slight rain chances for the north bay as we go into saturday. meantime, san francisco keeps those 50s over next few days and inland areas still on cool being trend with mid-70s today and mid-60s by saturday.

the new car smell. he noticed a foul odor in his 2013 ford explorer about a year after he bought it. he said he took the suv to a ford dealer several times but the dealer couldn't find anything wrong. then in 2016 ford reported an exhaust problem with some explorers that caused the interior to smell like sulphur. he asked the dealer to finally fix the problem. and it said okay but it would cost him nearly 1,000 bucks because his explorer was no longer under warnty. he didn't think that was fair because he said he report d the problem long before his warranty had expired. he ultimately paid for the repair himself and then reached out to us for help. we contacted ford and it reimbursed him $771. $200 short of the repair bill. in a statement ford said we are pleased to assist him and cover 78% of the repair cost.

restaurant recognized her and called 911. >> major concerns about health and safety at csu campuses, a scathing state audit says the chancellor's office failed to see health and safety on four campuses, putting half a million students and staff at risk. north bay assemblyman requested the audit after learning about a lot of issues, one involved lead based paint and another involving a chemical spill at sacramento state. csu employer's union says the union tried to work with the csu administration after the chemical spill in 2016 but it ended up going to the legislature. >> it was more than we even anticipated and it saddens me at this point because our students and employees and public are being exposed to toxic and hazardous materials on the campuses. >> the four campuses mentioned in the report were sonoma,
