controversy. why u-c berkeley grads... turn their backs on the grad right now on nbc bay area news, commencement ceremony controversy. why uc berkeley grads turned their backs on the graduation speaker. >> the main issue we are struggling with this year is basically mother nature. plus, the weather taking the toll on a sweet treat. a popular fruit grown in the south bay that you may not see as much of this year. what's behind the shortage. oh my god. >> first, thick black smoke billowing into the sky after a massive fire breaks out in the east bay, causing chaos in a neighborhood. the news starts right now. good evening and thanks for joining us. >> we're on with a special edition of nbc bay area news

because of a playoff hockey game. in >> a fire quickly escalated to five alarms. a plume of smoke could be seen in the sky for miles around. sergio quintana is live with the story and the reaction from neighbors in vallejo. >> reporter: as we mentioned, several homes were affected. a total of four. you see two of them here at the street. a third home was damaged in the back yard of one of these. a fourth additional was damaged. fire crews called for as much backup as possible to make sure the fire did not spread to the rest of the neighborhood. this cellphone video shows black smoke from the intense fire that could be seen for blocks. you see the yard of the home where the fire started is destroyed and the home is basically gutted. one neighbor's home was saved by the quick work of firefighters. >> they shattered the window here. it melted my blinds.

this is my living room. >> reporter: she says the fire was so intense she and her family had to leave. >> i realized it was time to go. we got in the car, grabbed the neighbors' kids and got out of the driveway. >> reporter: one of the biggest concerns was a row of trees in the back yard that created an additional challenge. >> the cypress trees with the oils and embers, already caught one home and did severe damage to a primary structure and were causing fire damage to three adjacent homes as well. >> reporter: crews eventually got control of the flames and stopped it from spreading further. the good news is that no one was injured. unfortunately, a pet was killed in the fire, and another pet may still be missing. reporting live in vallejo, sergio quintana. nbc bay area news. >> sergio, thank you very much. fire danger is on the minds of many people this weekend because of the warm and windy conditions. a live look outside over fremont. you can see old glory blowing in

the wind. let's check in with rob my yedda. >> the winds have shift the directions. santa rosa 70. check out the temperatures over my shoulder. san francisco, oakland, north bay, upper 50s right now. as the sea breeze has picked up we are seeing temperature drops as purple as my tie for santa rosa and napa. more than 20 degrees cooler right now than the same time yesterday because of the sea breeze which is downright gusty from san francisco towards fairfield. we have seen gusts around sfo at 35 miles per hour. if the cooler marine air is sweeping in, that limits fire danger because humidity levels come up. with the clouds, we could begin mother's day sunday morning with some drizzle for parts of the bay area and unusually cool temperatures for this time of year showing up in your seven-day forecast. a look at that coming up in about 12 minutes. >> sounds good, rob. you can track the wind and the

temperatures with our free nbc bay area app. click on the weather tab to get your personalized forecast. thousands of students came out in caps and gowns for the commencement ceremony at uc berkeley today but some were very upset. the scheduled speaker wasn't there. senator kamala harris canceled her keynote address in support of uc workers who were on strike. some students participated in a protest of their own. >> reporter: graduating seniors at uc berkeley walked into the stadium for the commencement ceremony without the scheduled speaker on hand. spencer knew it would be different because senator kamala harris would not be there. >> a little disappointed that she is not able to do her speech. understanding of the cause she is supporting. this is berkeley. it's a very political place. >> i am understanding of the cause, but still disappointing. >> reporter: senator harris said

she would not attend due to the ongoing labor dispute. members of uc's largest union went on a three-day strike on monday. families took note. >> i would rather the people who work at the university have a decent contract. >> reporter: some people told us, yes, they were disappointed they wouldn't hear senator harris today, but not everyone felt that way. >> my own political views. yeah. they are not aligned with hers. >> i understand her decision not to attend this ceremony. as the university of california continues important contract negotiations. >> reporter: chancellor delivered the address as some students stood up with their backs turned in solidarity with the workers. crist said the staff the union represents are essential and that she hoped negotiations could be fruitful. in berkeley. christie smith, nbc bay area news.

>> we are following developing news in paris where isis has claimed responsibility for a deadly knife attack. one person is dead and four others are wounded after a man shouted allahu akbar and then attacked with a knife. it happened in the center of the city in an area popular with tourists. police shot and killed the attacker. we're also following developing news out of north korea. the country announced today that it will dismantle its nuclear test site between may 23 and 25 ahead of next month's meeting between prucesident trump and k jong un. the president tweeting "thank you. a very smart and gracious gesture." north korea's state media said journalists will be invited to inspect the process. kim jong un first revealed plans to shut down the testing ground during a summit with south korea's president last month. tragedy for an oakland

family on a trip to the east coast. the mother killed in a car crash, leaving seven children with no way to get home. the tragic story began in march. the family went to jacksonville, florida, to help a relative move to california. their mother was killed in a crash while there. the mother's sister and nephew were also among the victims. the families spent all their money on the funerals and could not afford to send the children back home until united airlines stepped in to help. the children arrive home tonight. an emotional homecoming and a story we'll have for you tonight at 11:00. filing a complaint against the oakland police department is now easier than ever. the city announced today you can now file complaints through a new app. the move was designed to allow the public the unprecedented ability to file and then track complaints of police misconduct. it also allows the community police review agency to track patterns.

find the app in the agency's complaint portal. search continues for a man who robbed a bank inside a local safeway using a disguise. the police say the man you see in this surveillance picture robbed a u.s. bank branch yesterday afternoon. investigators say the suspect walked up to the bank teller and demanded money. police would not say how much money was taken. no one was injured. the suspect is in his late 40s. he is 6'2", with gray hair. he is believed to be wearing a fake dark-colored goatee. a disturbing situation inside a north bay drug store. this is security video from the right aid store. this man shown in surveillance photos is said to have rubbed himself against a 16-year-old girl and exposed himself to her. the girl walked away from the man. we are told he is on the loose. around 200 weapons turned in at a gun buyback event in san mateo county. dozens of people showed up to the government center to give up their guns to police.

the city worked in partnership with the city of pacifica and o tacoma. >> i got here around 9:15, 9:30 and the line was down the street already. and so for me, you know, people were ready, eager, learned about the event and wanted to participate. >> gun owners turning in pistols and rifles received $100 in cash. those turning in automatic weapons received $200. a similar gun buyback was held last saturday in redwood city. a big move in helping keep people safe in south bay. the san jose fire department received a $500,000 donation to install smoke alarms specifically in mobile homes around the community. two weeks ago a man was killed after flames ripped through a mobile home park in north san jose. the money donated today will also be used to host fire safety and prevention events.

cherry farmers in the south bay you may be finding it tougher to find your most favorite fruit this summer if your favorite fruit is a cherry. cherry farmers in the south bay say their trees are not doing

what they have in the past. nbc bay area's marian favre ro explains. >> reporter: this is a cherry tree. you would have a difficult time finding cherries on it thanks to an ill-timed chill and a lack of busy bees. >> we probably won't open. >> reporter: this cherry farmer is telling customers they won't likely be able to pick the fruit this season thanks to the perfect storm of imperfect weather conditions. the trees are producing very few cherries. >> unfortunately this year was a fairly warm winter and we didn't get the chill we require to set a nice crop. >> reporter: when the chill came it was at a bad time. >> the temperature dropped down to 28 degrees in the orchard. when it drops that low you run the risk of getting damage from the freeze and unfortunately we had some of that damage. >> reporter: also, the fact the bees were not busy.

>> it rained ten days in a row when the blossoms were out and the bees don't like to fly in the rain so they stayed in their boxes and nothing not pollenated. >> reporter: he state statewide the production is planned to be less than half, one of the worst years on record. chris says he even used a special air blaster here to try to get that pollen out, but it just didn't work. now, if you and your family enjoy picking fruit at an orchard, be sure to check the farm before you head out because it may not be an option this season. reporting live in morgan hill, marianne favro, nbc bay area news. >> thank you. north bay wildfires claimed yet another business. a popular santa rosa chocolate shop closed its doors for good tonight. the store meaning search for pleasure has been in business for seven years but the fire damaged tourism so much that the shop simply cannot afford to

stay open. customers say the owner and her creations will truly be missed. >> you know, she was a very sweet lady, and very dedicated to her craft. that's what i will miss. i am a toolmaker myself, so craftsmanship is a very important part of my life, and i respect her in that regard. >> the owner says while it is a sad day, she will remember all the special occasions she was able to sweeten over the years. . [ bell ringing ] as the last business closes a big boost today for the sonoma county economy in the wake of the wildfires. the ironman triathlon took place today. the race winds across sonoma county including santa rosa. more than 2,000 athletes from 47 countries come to compete in the event. this year it has special meaning for the community and for people traveling here to take part. >> i think people recognize the beauty of santa rosa and i think the athletes as they do the bike

course are going through all of it and really taking in everything that's happened here. so the support that we bring, hopefully it helps the community and brings a lot more awareness to santa rosa. >> sonoma county is also hosting a half ironman coming up in july. city officials estimate the two events will generate close to $13 million for the local economy. just as we were enjoying the beautiful weather, it's about to get cold, rob, ahead of mother's day. >> it's really kicked in. fog spilling across the bay. we could see misty skies to start off some of the brunch plans tomorrow morning around the coast and peninsula. take you outside to the north bay. after temperatures earlier were comfortably in the low 80s, look at the turn-around. 64 degrees. sea breeze. san rafael. big cool down. low clouds cross over the bay. 70s earlier. right now 64 degrees. check out the tri-valley. earlier close to 80.

now only 68. winds out of the west at 13 miles per hour. san jose, 70, down from the 78 earlier. we'll eventually see low clouds spilling in towards the morning. still some gusts up to 35 miles per hour around some of the peninsula hilltops into solano county. wind speed southwest at 24. that's not good news for allergies, especially for all of oak and walnut. if your eyes were itchy this week, the tree pollen counts have come up as well as grass pollen. ground level ozone pollution due to car exhaust and other things, with the winds staying gusty, air quality other than pollen should be good for plants tomorrow. 40s, low 50s. misty skies, likely to start the day for san francisco and the coast will break out the partly cloudy skies around midday. staying cool on the coast and by 7:00, the low clouds sweep in once again. so highs tomorrow, nowhere near the 80s. we are thinking low 70s will probably be the upper boundary

of the temperatures for the south bay. notice as you head into the east bay, bayside temperatures only in the mid 60s and low 70s from the tri-valley. concord and antioch. upper 50s and 60s around the peninsula. san francisco low 60s with misty skies to start off sunday morning. north bay temperatures nowhere near the 80s we saw earlier. the weekend ending in the upper 60s. there is a look at low clouds. locally, inland by 8:00. in the afternoon they clear back out towards the coast. a similar pattern except that the inland temperatures stay below average, through the better part of the seven-day forecast. if you're heading to the sierra look out for thunder showers. we could see over the next seven days drizzle here in the bay area and a chance of showers in the far north bay as the areas of low pressure come in. that will keep the ocean air-conditioning turned on high.

you see the forecast at the bottom of the screen. right now maybe towards friday, high pressure tries to build back, so we could see temperatures trying to recover by next friday. but going from upper 50s to mid 60s in san francisco, it will be a cool, blustery week with some morning clouds and mist. and after 80s, over the last couple days, now the valley temperatures are in the upper 60s and low 70s, below average for most of the week. we'll watch for a chance of some showers maybe in the far north bay hilltops towards tuesday and wednesday. the heat was there and it's gone. >> that was the heat wave? >> it was a really big tease. okay. still ahead, nbc bay area responds. >> a family sends a five-figure check to the wrong business, which cashes it and keeps the cash. so we confront the owner and help you know when a contractor has crossed the line. i am consumer investigator chris

mistake. ...and then, that company fails imagine paying thousands of dollars to the wrong company by mistake, and then that company fails to give it back to you. >> that's exactly what happened to one family in vacaville. they turned to our responds team for help. consumer investigator chris chmura shows us what happened when that person confronted the company. >> you often hear me say, you should always get multiple estimates before beginning a remodeling project. well, in this case that savvy move backfired with a five-figure price tag. >> it's a rental. >> the duncan family condo needed remodeling. >> it was painting. >> after a tenant moved out last year. >> the kitchen had to be pretty much redone. >> the duncans did their homework and got several estimates including a quote from carpets and more in vacaville. >> they had very good reviews. >> ultimately the duncans chose a different company but keith's

mom, who is in her 80s, was confused. >> she sent the check to carpets and more for $20,000. >> how much work this they done. >> they hadn't done anything because we did not use them. >> keith said he discovered the mistake weeks later after carpets and more had already cashed the check and too late to stop payment. he asked them for a refund. it responded with a check. >> their check was returned for insufficient funds. >> it bounced. >> carpets and more then gave them a certified check for half what his mom sent them by mistake. >> she was quite upset. >> keith said he repeatedly tried to collect the remaining $12,000 with no success. >> they will not respond to me. >> he contacted us. we called them repeatedly over several months. we too did not get a response. how are you doing? so we went too the showroom. the owner, mike alexander, was on hand to address the duncan

family's concerns. >> what's it going to take for them to get their money back? >> i already talked to him. >> we pressed alexander for answers about why the company cashed the $24,000 check. where the money went. and why the duncans were still waiting for a refund. >> i don't know what you want me to tell you. >> why it's taken them almost a year to get their money. >> we've just been struggling to pay them back. that's all. that's all i have to say. >> the state contractors board says carpets and more had an obligation to return the duncans' full $24,000 as soon as keith told them his mom sent the check by mistake. alexander said the company might have cashed the check as a deposit, believing it was just about to start the duncan job. >> we took a deposit for a job. >> if it was a deposit check, the state says it would have been illegal for carpets and more to accept a deposit of $24,000. >> they can require you to pay

no more than 10% or $1,000. >> whichever is less. the contractor board encouraged keith to file an official complaint, which could prompt a state investigation. keith can also try another route. he can file a claim against the carpets and more bond. >> all contractors are required to carry a $15,000 surety bond so there is a level of protection you get with that if you have a problem. >> keith is weighing that option to finally settle the 365-day dispute over unit 806. >> it's unbelievable. >> he hired an attorney who is trying to broker a payment plan. keith has low expectations the business will actually pay, even with the threat of legal action. >> at this point, i don't think anything would surprise me with these guys. >> it is ironic that getting multiple bids for the condo job burned the duncan family. it's smart to get multiple estimates, just make sure you make payment to the right place and never give a home contractor more than $1,000 up front.

>> this is a special edition of nbc bay area news because of playoff hockey. a warm start to the weekend but it's not sticking around. >> cooler temperatures are rolling into the bay area. they could affect your mother's day plan. rob mayeda is tracking how much temperatures will drop. >> cool temperatures and low clouds and perhaps misty skies. parts of the bay area tomorrow morning. right now look at the big drop in temperatures. san francisco, north bay, upper 50s to mid 60s. that's a 24-hour temperature change by more than 20 degrees. napa and santa rosa, you were seeing numbers close to the low 80s at this time yesterday. you can see how the ocean air-conditioning is reaching all the way in to solano county. we still have gusty winds outside. wind speeds to 20 and at times 30 miles per hour. that's what we have to watch out for over the rest of the evening. you see towards solano county and fairfield, the wind speeds close to 20 miles per hour. low clouds are spilling in that will thicken up towards tomorrow morning. jacket weather this evening.

under investigation. not backing down. hawaii's kilauea volcano is creating more tension and concern, especially as the latest movement is happening less than a mile away from a geothermal energy plant. after days of lava flow and dozens of homes destroyed, experts worry there is no end in sight. chris >> reporter: the kilauea volcano is threatening to do more damage. a 16th fissure opened up in the ground saturday. so far, just minor lava spattering but experts say it could change in an instant. the new fissure and flowing lava destroyed dozens of homes and cars. the national guard is ready to evacuate 2,000 people at a moment's notice. geologists fear the biggest explosion could be on the horizon. hot lava draining into cooler water could cause a huge steam

explosion. launching bold boulders the size of cars into the air. >> we don't want people injured. >> reporter: president donald trump signed a disaster declaration providing federal funding for emergency operations and to help people affected by the eruption. chris pallone, nbc news. >> experts are also keeping an eye on volcanos along america's west coast. this is video of mount st. helens in washington state which erupted in 1980. it has often been declared as the most disastrous volcanic eruption and u.s. history. 57 people were killed and it caused $1.1 billion in property damage. the west coast is home to an 800-mile chain of 13 volcanos from washington state's mount baker to california's lassen peak. we are following developing news out of pris where isis claimed responsibility for a deadly knife attack. one person is dead and four

others are wounded. the man shouted arabic for god is greatest and then attacked with a knife. it happened in the center of the city in an area that's popular with tourists. police shot and killed the attacker. paris has been on high alert in recent years after a string of deadly terror attacks. developing news out of north korea. the country announced today that it will dismantle its nuclear test site between may 23 and may 25 ahead of next month's meeting between president trump and kim jong un. the president appeared to take the rogue nation at its word, tweeting thank you, a very smart and gracious gesture. north korea state media state journalists from the united states, south korea, china, russia and britain will be invited to inspect the process. kim jong un first revealed plans to shut down the testing ground during his summit with south korea's president last month. ahead of the un's world food program said he received unprecedented access to north korea during his four-day visit there this week.

david beasley spent two days in pyongyang with government officials and two days visiting a number of world food program projects in rural areas of the country. the program aims to help 650,000 north korean women and children every month, but about 10 million of north korea's 25 million people need humanitarian aid to fight malnutrition. >> there is improvement. we are making a difference. people are working hard to truly be food secure. the bad news is only 15% of the land in this country is arable. also, they face floods and droughts and malnutrition. so we are working with them to address the food security issues. >> those security issues include natural disasters as he mentioned, floods and droughts were contributing factors in the disastrous famines in the 1990s that nearly brought north korea to economic ruin. uc berkeley's commencement today did not come without controversy. thousands of students were looking forward to a keynote

jose was suspended this afternoon for a time after a light rail train and car collided. there is the car. happened about 3:30 this afternoon. north first street and east brokaw road. the vta spokesperson says there were injuries resulting from the crash but the extent of the injuries is not clear right now. you may find it tougher to buy a popular fruit this summer. cherry orchard farmers in the south bay said the trees are producing a third of what they have in the past. farmers say they're having a hard time finding much fruit in part because of a poorly timed chill and the lack of busy bees. the perfect storm of imperfect weather conditions. the trees are producing very few cherries. one farmer used an air blaster to send out the pollen but it didn't seem to help. it is expected to be one of the worst years on record. >> it happened to rain about ten days in a row when the blossoms

began the day with. it's kicking up the pollen which for this week all of pollen has been extremely high. if your eyes have been itchy that's the prime component. tomorrow morning, 40s and 50s begin the day. we'll likely have low clouds inland with drizzle in spots. cool and breezy. warmest temperatures, 3:00 likely topping out in the low 70s inland and low 60s bayside. sunday temperatures around san jose low 70s. like we are seeing outside later on this afternoon. it's cooled off quite a bit. tri-valley temperatures, we are thinking low 70s tomorrow, 60s bayside and 50s around half moon bay. upper 50s in daly city. mid 60s around the peninsula. in san francisco highs only near 60. cool and likely with drizzle for the morning and north bay temperatures that were in the 80s. now we are talking mid to upper 60s with drizzle and low clouds. there you see the clouds from

the morning, which at this point looks like it will be all the way through the straits towards the altamont pass. by mid to late morning, skies clear inland. still cool on the coast and then towards tomorrow evening and 11:00, the low clouds surge in once again. one thing that will be different, though, if you are heading to the sierra, we still have the weather system east of the sierra crest tossing showers and some chance of afternoon thunderstorms. watch out for that. interesting seven-day forecast. check this out for the far north bay as more areas of low pressure cross over northern california, there is a chance lake county, and i think sonoma and napa counties, maybe around tuesday there could be a chance of an afternoon shower or two. but for the bay area, what you are seeing is some drizzle that could add up for a few spots especially for the peninsula and coast. cooler than average temperatures and a chance you might see afternoon showers around hilltops. here is the pattern responsible. cool areas of low pressure. not a lot of moisture but

bringing the cool air aloft. it will add instability during the day. enough lift over the mountains, sierra and coastal range. you may see a shower or two. high proper kept at bay at this point. we'll wait to friday or the beginning of next weekend for the valley temperatures to make a run to the mid to upper 70s. so, seven-day forecast, unusually cool this time of year with lots of low clouds. steady supply of a sea breeze for san francisco. highs in the upper 50s at times early in the week. for the valleys, out of the 80s. didn't last long. we'll drop into the 60s and low 70s and maybe a chance of some mountain showers in the north bay tuesday and wednesday. then maybe mid 70s by next weekend. so stay tuned. things running cooler through the next seven days and certainly a cool start to mom's day plans tomorrow. >> you are breaking my heart, rob. i get attached to the warmer temperatures. then it gets cooler and i don't know what to do. >> the 90-day forecast still
