a deadly shooting in a san jose neighborhood right now at 4:30. breaking news in the south bay. a deadly shooting in a san jose neighborhood overnight. at least two people shot. the investigation under way to find out what happened. good morning to you and thanks so much for joining us now on this tuesday morning. we'll have more on that in a live report coming up. i'm laura garcia. >> and i'm marcus washington. we want to go to kari hall to see what we can expect. >> another cool one but we're seeing a few more clouds, the temperatures are in the mid to upper 50s. fremont, a live look with nice clear visibility and a breezy wind there and as we go through the day, the winds will pick up

as we go from 56 degrees at 8:00 to 68 degrees at 2:00 today. we're going to stay in the 60s and then see the winds increasing later this evening. a couple of sprinkles in the forecast for tomorrow morning and i'll detail that. mike, you're seeing some complications out of the altamont pass. >> typical for westbound 580 into the area. livermore out of tracy, we have the road work going on. you see the speed sensors close to the water over here, just fine, it's farther out where we typically see the slowing. early morning hours like this, we have a road crew just a couple of lanes open. in those couple of lanes reports of a crash involving a motorcycle. sounded like everything moving smoothly up to one lane now is backed up. there will be a distraction by the crash and construction crew off 205 and you're clear after grant line road and getting in towards dublin and to livermore. we'll track the injuries if there are any to report, guys,

back to you. >> breaking news to tell you about, a double shooting near a san jose school. this happened in the neighborhood right across the street from kol lower ro high school. police are still investigating at this hour. officers also at the nearby gas station. we're sending kris sanchez there to ask questions and get more answers for us. she'll have a live report coming up at 5:00. >> now to a horrific story out of fairfield. police say ten children ages 4 months old to 10 years old were brutal brutally injured by their father in their home. >> chilling new abuse allegations. >> right over my back back fence. never seen a kid out there or heard anybody. >> david thacker lives behind the house where fairfield police say jonathan michael allen was abusing nine of his ten children. >> the children described incidents of intentional abuse, resulting in puncture wounds and burns and bruising and injuries

consistent with being shot with a pellet gun or bb gun. allen is charged with torture and child cruelty. by phone the maternal grandmother calls him a monster, providing photos of saying a room he worshipped the devil. >> he would put duct tape on our eyes and lay us on the floor and tell us we couldn't move. if he did, we would pounce us and beat us in the stomach. said the demons were making him do it. >> but the children's mother insists there was no abuse. >> why would i ever have a house full of children that were abused or allow them to be abused. >> reporter: the investigation into the family started in march when rogers reported her 12-year-old son missing. police searched the home looking for the boy and called child protective services after finding food and feces on the floor. after finding her son, police arrested rogers for child endangerme endangerment. the kids were taking family members home. rogers bailed out of jail and

showed nbc bay area her home revealing filthy conditions. she insists she provided a loving home. >> mommy loves you so much. and daddy loves you so much. >> reporter: neighbors say when officers arrested allen last week, they had guns drawn. >> k-9 guy was standing here. >> one we'll continue to follow there. also happening today, a man accused in a violent sexual attack at palo alto is due in court for a plea hearing. last month authorities arrested 29-year-old eduardo diaz of richmond, back in march, police say he pulled a teenager jogger off a popular trail near tesla head quarters and then according to police put a gun to her head and assaulted her. police believe this is not first time he's done it. >> 4:34. this morning police are clearing up rumors around novato high school, saying there was never a threat on campus. a student allegedly sent threat

being messages to his roommate. say he was not threating to shoot up the school. we first told you about this a few months ago. search crews found the body of a missing skier from the east bay. tom malarky disappeared and avalanche conditions prevepted crews from finding him. weeks past and the snow melted and dogs led searchers to the body yesterday. >> a quick startling shake that rolled through parts of the east bay last night. a 3.5 earthquake strong along the hayward fault near oakland. if you're a wake veteran, you know when it comes to earthquake you often don't feel it in those locations in the area. no everyone in the epicenter felt it but it did catch a lot of people by surprise.

>> it lasted maybe five seconds. it was super loud. i've never been through an earthquake before, so i had no idea. i thought a loud truck was going by. >> we felt the earthquake and few things dropped and it sounded like a loud boom. now, there are no reports of any damage but b.a.r.t. briefly stopped its trains. happening in frsan francisc your commute going possibly more green. talks kick into high gear into switching to all electric muny buses, right now they have hybrid vehicles, they want to convert to zero emission buses by 2025. now to jinx anything here but charles barkley says it's already over. >> the warriors and dub nation know there is more work to be done but you have to be pretty pumped about them grabbing game one of the western conference finals last night in houston. the warriors showed why they are the reigning champs led by durant's 27 points. winning 119-106.

good morning, i'm kate rogers live at cnbc headquarters. wall street could take a breather after stocks rose yesterday. the dow extending its winning streak to eight streak session, that is the longest stretch since last september on hopes of a possible break through in the growing trade tensions between the u.s. and china. china's vice premiere will be in washington for high level talks this week. economic data on housing and retail sales. the dow rising 68 points yesterday to 24,899 and nasdaq closing up to 7,411. elon musk is hitting back at a report that tesla ignored engineers that urged the company to add more safety sensors to the vehicles. saying this is false, to ensure drivers kept their eyes on the road because it cost too much. musk said they were rejected because the technology was

4:44 right now. >> do you remember the last time you had an unwanted visitor. take a look at your screen. this is what happened to one south carolina couple. they found this, a 7-foot alligator on their front porch in the morning. the husband actually heard and saw the gator through the blinds and ran back to his wife in a panic. she called police and of course the family say that i have seen gators before but never up close and personal like this. can you imagine looking out your window and seeing that? like good morning. the couple glad their children didn't actually open up the door and greet that gator. but they wrestled the gator right there and got him away. everyone is fine. >> mailman. >> candy gram. >> candy gram, that's frightening. >> thank goodness the mrs. wasn't there too -- >> ran to get his wife. >> like hold on -- i got this. >> all right, we start out with

cool weather across the bay area. taking a look at those clouds, looking live from palo alto, you can see the city lights reflecting off those clouds overhead. and we're going to see at times clouds passing by at least for the next several hours and we'll start out in the mid-50s in palo alto and reach into the low 60s by lunchtime. we're only going to make it into the mid-60s there for today. and the 7-day forecast is up at the bottom of the screen. as we go to walnut creek, checking out temperatures there, we'll be at 56 degrees at 8:00 and 61 degrees at 11:00. you'll see the sun breaking out by late morning, early afternoon. we'll be at 65 degrees at 2:00 today. here's a look at all of the high temperatures, most of us will be staying in the upper 60s for the inland areas. upper 50s for half moon bay and san francisco today, 61 degrees. it will definitely be much cooler than what we've had recently as we start to see some more clouds moving in and breezy winds. as you're getting dressed this morning, make sure you have a nice warm jacket.

you'll probably be comfortable wearing some light long sleeves all day long. then if you're going out to the giants game this evening, it's going to be at about 59 degrees at first pitch. then a mix of clouds starting to move in. we may even have drizzle out there tonight as our temperatures come down to about 57 degrees. i've also been watching the storms each afternoon firing up over the sierra. this is what happened yesterday afternoon with showers and lightning moving through. as we go through tomorrow -- today as well as tomorrow, we'll see more of those showers and storms passing by but we'll have have a chance of light rain passing, looks like much of it will be to the east of us during the morning hours but we may have sprinkles to start out tomorrow morning and some mostly cloudy skies. then our high temperatures only make it up to 67 degrees for the inland areas. then as we go through the rest of the week, it starts to warm up a little bit to the mid-70s but still very nice. and san francisco will be windy

this afternoon and then that chance of drizzle early tomorrow morning. then mike, you're taking us back out to the altamont pass. >> i am, that's where the sensors are changing. everything closer to the water is moving at green. that means at speed and great, and which you expect for the morning commute. out of the altamont pass, we have the slow drive and jam-up for west 205 as it merges with 580 and through the construction zone. we typically see the slowing, there's a crash there blocking the remaining lanes though. chp seems to be on a shift change. we're getting a delay getting the update but it does look like from the speed sensors they may have opened one lane but traffic is backed up to where it crosses over, where 205 crosses over. i'll keep my eyes on that. to the rest of alameda, contra costa from the north bay, everything is at limit. there's orinda on the map. we'll show you the transit systems are also reporting no delays. great stuff for the rails.

we're looking at a live look here in the north bay, san rafael northbound 101 moving smoothly down to the golden gate bridge and there's the berkeley curve towards the bay bridge without issue. back to you. thank you very much, 4:49, a new plan to clean up san francisco is controversial or even illegal but could save thousands of lives cutting down on drug needles across the city. it went viral after showcasing diseased streets with a dangerous mix of used needles and feces and trash. one potential solution has health experts pointing north to canada. investigative reporter traveled to vancouver to see it firsthand and caught up with marcus to talk about that plan. >> so what exactly is the idea here? >> i mean, we're base he canally ta basically talking about a place for drugs, where drug addicts can use illegal drugs under the care of medical staff equipped with life saving drugs that

could reverse the effects of an overdose. >> he went to vancouver and saw what was going on. talk about the difference it made. >> they now have eight sites and in the history of the program not had a single person die of an overdose inside the centers. they also say they've even a serious reduction from diseases like hiv, hepatitis c. they had seen a serious spike because of people sharing needles but they get clean syringes which also helped cut down on number of used needles they see on their own city streets. >> what will we see happen in san francisco? >> there are some in california who think it is another way to encourage people to use drugs illegally. city leaders however disagree, they are pushing forward with potentially opening two sites by august. the question is how do they intend to do that with these sites still be illegal? we'll get to that part of the story in our full investigation tonight at 11:00. >> we will be watching.

nearly went up in smoke. 4:54. nbc bay area responds to newlyweds whose big day nearly went up in smoke. >> chris chmura looked into trouble they had with a vendor who didn't want to return their deposit after the venue burned down. >> good morning, henry and lauren planned their dream wedding for the last weekend in october at the hilton in santa rosa then ten days before the ceremony, the north bay fires destroyed the hotel and that is video of the hotel burning. the couple got full refunds from hilton and other vendors but the limb moe provider offered less than half of the deposit. they contacted us for help. the limo company said they were a victim too losing all of its business for months. he offered them limo services wherever else the wedding would take place but couldn't agree. after talking with us, the limo

us, i'm marcus washington. >> i'm laura garcia. it was a pleasant day yesterday. >> it's going to be even nicer today but going to be a little bit more windy and that's what we'll have to watch out for. we're starting out with clouds this morning as you get started and looking at the highs for next few days, it will be in the upper 60s for the inland areas, this is much cooler than normal but we'll be warming things up a few degrees in time for the weekend. and in san francisco, starting out with some clouds this morning, it's going to be windy later today and we may have some drizzle and sprinkles by tomorrow morning. i'll have details on that and also more on the weekend coming up. mike, you have a big delay showing up. >> we do, it's over in oakland -- actually hayward. we're showing this backup now. the sensors show green all over most of the bay but this just popped over the last couple of minutes, southbound 880 as you're approaching 92. we know the eastbound 580 will slow sl show slowing through the construction zones. t'
