us, i'm marcus washington. >> i'm laura garcia. it was a pleasant day yesterday. >> it's going to be even nicer today but going to be a little bit more windy and that's what we'll have to watch out for. we're starting out with clouds this morning as you get started and looking at the highs for next few days, it will be in the upper 60s for the inland areas, this is much cooler than normal but we'll be warming things up a few degrees in time for the weekend. and in san francisco, starting out with some clouds this morning, it's going to be windy later today and we may have some drizzle and sprinkles by tomorrow morning. i'll have details on that and also more on the weekend coming up. mike, you have a big delay showing up. >> we do, it's over in oakland -- actually hayward. we're showing this backup now. the sensors show green all over most of the bay but this just popped over the last couple of minutes, southbound 880 as you're approaching 92. we know the eastbound 580 will slow sl show slowing through the construction zones. let's look at the waze system.

as i check the caltrans reports, all incidents of construction are reported clear but waze talks about a 20 minute delay and registers because of construction given the input from all of the users on our team. make sure you join nbc bay area wazers and we can share that input and information out there. back to you. >> back to breaking news recovering in the south bay this morning a san jose neighborhood now a crime scene. this morning police are investigating a deadly double shooting next to calero high school. >> kris sanchez is live with what exactly happened there and kris, i can imagine shots fired near some people where they live, certainly a scary moment for them this morning. >> reporter: yeah, they have to be wondering what's going on. all of this started in a quiet residential neighborhood now we're here in the strip mall parking lot, that silver car you see in the background there, that is where those shooting victims were found here in the parking lot of the lucky grocery store, there's a wall greens

here. here's how the scene looked a little earlier. we're expecting the police out here at some point but san jose pd was trying to put together what happened. we did see firefighter paramedics trying to do cpr on at least one person, but we do know homicide detectives are headed out here which means that person likely died. we know two people were shot and one of them was shot in the leg, appeared to be conscious as he was being loaded into the back of the ambulance. and both of these young man looked very young, could even be teenagerers. this all started with the shooting in the 400 block of calero avenue not far from calero high school. it's a quiet scene here, it is about a mile, five blocks away from where we are this morning. and again, we don't know whether these victims were targeted or whether this was a random act of violence. certainly there are different causes for concern for you as a

community member depending on how this shakes out. we're waiting for the homicide detectives -- spokesperson from san jose pd to meet us this morning. when we find out more we'll put it up here and social media. kris sanchez, "today in the bay." >> thanks, kris. at 5:03. breaking news near downtown san jose. more fire crews are on their way to the corner of east saint james and ninth street where a house is on fire. this is not too far from japantown. there are concerns that that fire may spread to nearby homes. not really clear at this hour if anyone is hurt. we do have a crew on way to the scene and we'll bring you live pictures as soon as they get there. >> at 5:03. developing right now, new tensions in the middle east as palestinians are out in force again. protesting the new u.s. embassy in jerusalem. we've seen a lot of protesters, people in fact on stretchers, fighting, cars on fire in the west bank. it follows a day when some 60 palestinians died opposing the

decision to move the u.s. embassy. palestinians accuse the u.s. of taking sides in a struggle over what israel calls its capital. the palestinians believe it's also theirs. palestinians add this latest move may threaten what has been a very fragile peace process. the white house blames the radical group hamas for the explosive reaction among palestinians. >> hamas is intentionally and cynically provoking this response and as a secretary of state said, israel has the right to defend itself. >> the violation of international law and flagrant violation of the peace process. >> the move is also a concern among republicans on capitol hill. president trump plans to meet with gop leaders later today. happening today, here in the bay area, palestinians plan to protest in san francisco and promise to gather outside the israeli consulate. that gathering is supposed to start at 4:00 this afternoon. a second protest is being

organized for tomorrow night outside san francisco's jewish community center. repealing daca protection. today the trump administration will argue the president was right in doing away with protections for nearly 700,000 undocumented young immigrants, you may recall a federal judge in san francisco blocked trump's cancellation of daca in january. the federal government wants the ruling overturned. today a three panel judge from the ninth circuit will hear arguments from both sides at a southern california court. >> it is 5:05. santa clara city council will ask one of its own councilman to resign. he's facing several allegations of sexual abuse and improper behavior. this could affect your neighborhood. bob redell is live with the story we've been following very closely now. bob? >> reporter: good morning to you, laura. the mayor of santa clara is one of those people asking the councilman to step down. the mayor of santa clara, lisa

gilmore released this statement requesting that dominic step down from his position at city councilman. the city learned last week about potential -- about allegations of potential sexual abuse and improper behavior by ka are ser ta. there were initially four complaints filed with police now there are nine. they believe the complaints are credible and asking for city council to ask him to quit. nbc bay area spoked with the councilman and he says he feels he hasn't done anything wrong and looks forward to telling his side of the story tonight. >> if i have offendsed anyone or made anyone feel uncomfortable at all ever, perception is reality and i'm sorry for that. >> councilman will have the opportunity to defend himself and answer his accuser as he wishes. but for the sake of our

community, i hope he will choose to resign immediately. >> he engaged in a pattern of behavior that shouldn't be tolerated by the community. and therefore, needs to be taken down. >> reporter: the lady you just heard from is one of his accusers and asking for his campaign bill board over stevens creek boulevard in san jose to come down. he is running to become a santa clara county supervisor. today at noon at santa clara city hall, the unit will hold a news conference demanding he quit the race for supervisor because of allegations of abuse. reporting live in santa clara, bob redell, "today in the bay." in making san francisco safer for you and your family. today mayor mark farrell along with bill scott are expected to announce a $34 million investment for public safety. this includes adding another 250

officers over the next four years. we're expected to hear more details during a news conference. overnight we pored through the crime data, violent crime reports which includes murder and rape are slightly up from last year while property crimes like auto theft and burglary were up nearly 15%. and then happening in about an hour, six buses full of high school students and parents and community leaders from the south bay will head to sacramento. >> the group plans to spend the day meeting with california lawmakers, they will discuss key issues like -- the buses leave at 6:00 this morning. better take their jackets, right, kari? >> it's going to be a cool start. breezy winds making it feel cooler throughout the day. here's the temperature trend for concord, still going to be cloudy through about 7:00 then we'll start to see the sun peaking out by 8:00 to 9:00 this

morning. temperatures in the upper 50s, we're heading in the mid-60s today which is a little cooler than normal but still really nice as our high temperatures reach up to 64 degrees in oakland. our winds will be picking up at about 15 to 20 miles per hour and also breezy in san francisco with a high of 61. 70 today in morgan hill and upper 60s in the tri valley. as we head to mike, you've been tracking those overnight closures. >> we're looking at the smooth drive. movement of the closures are picking up and that's causing the only real slowing, east shore, no problems. there may be some debris reported right around highway 24 and 13, waiting for chp to give us more detail. any sort of alert there. no problems reported through the area. here look at that southbound 880, it looks like things are start being ing to improve sout8 where one late construction project did pick up towards the san mateo bridge. otherwise a smooth drive including 580 out of the altamont.

the crash in utah was indeed on autopilot at the time when it slammed into the back of a truck at 60 miles per hour. the ntsb is investigating, tesla c echt oelon musk tweeted was amazing about this accident is a model s hit a fire truck at 60 miles per hour and the driver only broke an ankle. the impact of that speed usually results in severe injury or death. this is one of two recent accidents where autopilot was engaged. the utah crash there on the left. the accident on 101 here in the bay area on the right. that one was fatal. facebook says it's cut off access to more than 200 apps because they gather information about you. now facebook stock turned lower monday. but when you look at the broader picture, facebook is doing just fine. this graph shows the price before the cambridge analytica disaster, during the disaster and the price now as you can see facebook has made a full

recovery. >> i want you to know, just how excited i am to write uber's next chapter with you. >> uber's new ceo has released a new video promising more changes at the company as he tries to undo some of the damage created before he arrived. one of the changes, the user agreement will no longer require passengers to settle their complaints in arbitration. they can take an uber driver to court, for instance, it's going to publish a safety report listing instances where drivers were accused of assault. a recent study by the company e commerce found that uber is really slowing in its market share and lyft is taking advantage. last year uber's ride share shares fell from 90% down to 77%. presumably that's all going -- >> because of the -- >> uber could not get rid of bad publicity. >> this guy is trying to turn it around. >> he's trying hard but a lot of people deleted uber accounts and

uber/lyft it's the same car. just the sticker. >> interesting. okay. thank you. >> all right, something to tell you about, paying out $100,000 to settle violations at his refineries in rodeo, 13 violations occurred in 2015, they include excessive emission, venting of odorous gases and failed test involving monitoring systems. the air district also says the refinery corrected each of those violations. if you're planning a summer vacation, want to bring a pet, you better listen to this. the largest airline tightening restrictions for passengers flying with support animals. american airlines will now ban certain animals including insects, hedge hogs and goats and ferrets. but guess this, miniature horses are still allowed. >> okay.

clouds. we'll see those clouds throughout the day as you get to work and maybe by the time you're heading out for lunch it will be 62 degrees. and then we'll get more sunshine. if you're going to some of the hiking trails in the east bay, we'll be at 52 degrees and cloudy skies and starting to clear in the east bay by about 10:00, we'll make it up to 64 degrees at 1:00 and then starting to cool off a bit with the breezy winds picking up once again. as you check out the 7-day forecast at the bottom of the screen, we'll look at the high temperatures for today in the south bay and east san jose morgan hill, we'll see the high up to 70 degrees and for the east bay, 68 degrees in concord. 66 in hayward. and then 64 today in san mateo. san francisco up to 61 in the mission district and upper 60s for napa today. also we'll be watching out for another chance of thunderstorms. why we will see some clouds moving in as we go through today with breezy winds and start out early tomorrow morning with

sprinkles especially for parts of the north bay and east bay. not expecting this to amount to much and clearing out quickly as we'll have cooler highs up to 67 degrees and mist and drizzle for the inland areas and warming up in time for the weekend. mike, your updating something off highway 24. >> something is what we reported, something over here off 24 near highway 13. it's just off college avenue. reports of a little smoke coming there and little brush fire reported. i believe local fire will be able to take care of that without any problems. no other issues reported over towards the bay bridge where we're just starting to see the cash lanes start the backup right on schedule. as we zoom out, the rest of the bay shows pretty much an easy drive, a little slowing out of the altamont. the earlier crash did clear off grant road. still slowing and more slowing from the castro valley. let's check with our waze system. they are advising to go down towards the san pmateo bridge bt

welcome back, it's 5:25. marijuana is now legal here in california but pot businesses are facing a new problems, the banks. most won't open accounts for people in the state's new legal industry because marijuana is of course still illegal under federal law. >> that means people are carrying a lot of cash and many getting robbed. investigative reporter liz wagner discovers there's no solution in sight. >> good morning, there would be no problem if the feds would take marijuana off their list of illegal drugs. cannabis companies could put the cash in banks and take out credit cards but the federal government isn't likely to budge any time soon. some business owners say california should have come up with work-arounds before we became legal here in jan. the state's top banker admits the state failed to figure out

weather here. here's a live look outside in dublin. you can see a little bit of light trying to come over the hills but the clouds will keep us from seeing a beautiful sunrise this morning. let's go to the tri valley and livermore as our xol day forecast starts out with mid-50s and it's still going to be cloudy as you walk down to school. by the time they head for recess, it's going to be nice and sunny and still cool with lower 60s and heading in the mid-60s today, upper 60s for much of the inland areas. we'll talk about this and mid week cooldown in just a few minutes. mike, you've been tracking the commute this morning. >> he knew this shot was coming, the bay bridge backup is on because metering lights are on, right on schedule, for a tuesday this looks great. we don't have all of the cash lanes fully blocked in just yet. and fast track lanes are showing good movement. hov, the car pool still your best bet. coming out of the area, no problems out of the maze and

anywhere south of there. you're pretty much at speed. little blips for san jose, an incident in fremont southbound 880 is fine. there's a crash near on ramp. be careful through the area but here's a live look at the nimitz where traffic moves smoothly. back to you. break being news to tell you about, this is near downtown san jose. fire crews are on the scene of a fire. here's video from 2that scene, firefighters on the scene, at least two units, you can see the flames coming from the home as firefighters try to battle it there. this is all unfolding at the corner of east saint james and ninth street. not too far from japantown. there were initial concerns that the fire to this victorian home as you saw right there would spread to nearby homes, it doesn't appear the fire spread but we are told that that fire was in the back of the house. everyone made it out okay and no one is hurt and three people unfortunately are displaced. >> 5:32, developing news on this tuesday morning, a really

horrific story to tell you about. shocking really. police say ten children ages four months to 12 years old were tortured behind the doors of this home. "today in the bay's" pete suratos is live with a gut wrenching investigation. we understand the children's grandmother is talking this morning. and really revealing some chilling new details about abuse allegations here. rx re. >> reporter: very really laid out chilling details about conditions inside the home and fieldstone court. her name is wanda rogers, the maternal grandmother of the kids and taking care of seven of them as we speak. she did speak by phone to nbc news really laying out some of these conditions, describing among them that this home was filled with both animal and human species and claiming the kids did not know how to take baths and tortured every day, all day long. she places a lot of this blame

squarely on the father, jonathan michael allen of fairfield who was arrested and charged with nine counts of felony torture and six counts of felony child abuse. now, rogers did provide these photos of a room she claims allen worshipped the devil. >> he would take the baby and slap it in the face and put duct tape on the baby's mouth to shut it up and beat them up for the baby crying and waking him up. >> reporter: the investigation into the family's home here in fairfield began in march when the mother, 30-year-old ina rogers reported her 12-year-old son missing. after police located the boy and returned him to the home they called child protective services after finding garbage, spoiled food as well as feces on the floor. now rogers was arrested for child neglect but released after posting bail. rogers denies these allegations against her and her husband calling them ludicrous. her husband's bail is set at

$5.2 million but the d a's office is considering filing additional charges against ina rogers as well. we're live in fairfield, pete suratos for "today in the bay." >> really troubling there. thank you, pete. happening today, a man accused in a violent sexual attack in palo alto is due in court for a plea hearing. last month they arrested 29-year-old eduardo cha varaia diaz, he pulled a teenager jogger off a popular trail and put a gun to her head and police say assaulted her. police believe this is not first time he's done it. >> and new this morning, police are clearing up rumors going around novato high school, they said there was never a threat on cam campus. but they did arrest an 18-year-old student who sent threatening messages to his former roommate. police searched his car and found world war ii ammunition. they say that he was not threatening to shoot up the

school. a sad follow-up story to tell you about this morning a few months ago we told you about search crews found a body of a missi skier from the east bay, disappeared back in march near bear valley resort. avalanche conditions prevented crews from finding him. weeks passed and the snow melted and led searchers to his body yesterday. 5:36 right now. did you feel it? thousands say they did. a quick and starting earthquake rolled through parts of the east bay last night. usgs says it was a 3.5 earthquake, striking along the hayward fault near oakland. if you're a quake veteran, you know when it comes to feeling a 3.5 it lless ha to do with location. not everyone felt it but caught others by surprise. >> heard a loud shake and lasted maybe five seconds, it was super loud. i've never been through an earthquake before so i had no idea. i thought a loud truck was going by. >> we felt the earthquake and

few things dropped and it sounded like a loud boom. >> no reports of damage but b.a.r.t. briefly stopped its trains as it usually does to check those tracks. 5:36 right now. more the of the same in hawaii but it is absolutely terrifying. people living on the big island still bracing for the big one. kilauea could erupt on a scale not seen in nearly a century and could happen any time. geologists fear a lava inside the crater drains into cooler ground water below. that could trigger a catastrophic stream explosion, potentially launching boulders the size of cars into the air and like flaming missiles, which terrifies people in the three-mile blast zone. >> scares me to death. >> a lot of people are really freaking out. >> it's kind of hard to ignore it because it makes me emotional thinking about it. >> and while people wait for

that explosion, lava keeps destroying the homes nearby. the air fills with poisonous gas as well. >> it is 5:37, melania trump is recovering from kidney surgery. she underwent a procedure to treat a benign kidney condition. the communications director says she's doing well and will likely be at walter reed medical september sistcenter for the rest of the week. police officers association is upset with the city's new app. it launked this weekend to make it easier for people to file complaints against officers. we covered the story during our saturday night newscast. this morning the police union says it is upset the app doesn't have a way for people to praise officers for doing a good job. >> 5:38 right now. as of today, san trans discount riders no longer have to worry about carrying exact change. they offer paper tickets can be

purchased in packages for ten for $10 and they don't expire. only disabled and people over the age of 65 qualify for those discount fares. > . >> if you're paying fare to get over the bridge, we're looking at the smooth drive from the east bay to the north bay. a disabled big rig right there just before you get to the coming skyway and that's what we see, a big backup just suddenly forming over the last couple of minutes. we'll track that and hopefully they can get assistance. there's a crash on shoulder past the bay bridge where the metering lights are on. a lot of activity for folks heading towards the bay bridge there to contend with. over there though, concord, orinda, coming off contra costa county, a smooth drive as well as much of the bay. we're looking towards the soy bay with a little blip through 101 through san jose. little burst there and over on the pennsylvaninsula, a crash r

there. it doesn't look like it's affecting lanes, i see a little slowing down towards redwood city. we'll track that. the traffic is light you see from palo alto. that looks like a beautiful shot there. >> yeah. >> beautiful. >> beautiful weekend ahead, a lot of kids still have proms and graduations are coming up -- >> also fair and festival season too. that's beginning to kick in. you're already starting to make plans on this tuesday for what to do this weekend. here's a look at saturday's forecast. it's going to be nice and cool for the coast. 64 degrees. 71 for the bay and inland areas perfect weather for those proms and also for those festivals that will be beginning. 62 will be the high on sunday for the coast. bay at 68 degrees and lower 70s as we keep the sunshine for the inland areas. if you're going to monterey this weekend, it's going to be chilly out there. also still pretty windy with our highs reaching in the upper 50s and low 60s, a mix of sun and clouds and heading to lake shas

slowing pops up coming up. your age may indicate the time of date when you're most likely to crash your car. not really a scientific connection but there's definitely a trebd. you can see it here, elderly drivers are more likely to crash between noon and 4:00 p.m. that would make sense when they are out driving. drivers in their 20s more likely to crash between 9:00 p.m. and 3:00 a.m. most likely when a 20-year-old would be out. collisions spike for that age group in the older category, 21 and on. after 2:00 a.m., which is what -- yes, closing time. >> if you take highway 17 you'll want to listen to this one. there are plans in the works to make one of the busiest curves safer for people and animals, that stretch is called laurel curve. you'll certainly recognize it. it's considered a road kill hot spot and environmental groups say that hundreds of those animals around that area are

killed each year. so now caltrans is going to build a wildlife crossing. this project uses a culvert and fences to guide the animals and construction is expected to begin in about three years. >> that will be interesting to see. 5:46. today affordable housing week continues across the bay area. expects and activists and city leaders all talking about the issue. at 10:00 a.m., walnut creek hosting a discussion on community benefits of making housing affordable. san francisco planning an urban research association will talk at the san jose headquarters. >> there are more calls this morning for the white house to make an official apology over an aide's comment about john mccain. >> scott mcgrew it is a story that just keeps going. >> a number of republicans saying you know what, just apologize, already, we can move on with this. white house adviser kelly sad d ler said john mccain's opinion doesn't matter because he's dying. she made an apology by phone to

mccain's daughter but so far has not made a public apology and we've seen little reaction from the white house. >> why not apologize so america doesn't think that is an acceptable way of speaking inside this white house? >> well, i understand the focus on this issue but it's going to be dealt with and has been dealt with internally. you know -- >> how? >> i was hold on kelly sadler called the mccain family late last week and did apologize. and beyond that i don't have further comment. >> in that same press conference, the president's spokesman said president trump called james shaw jr., the waffle house hero to congratulate him. the white house also pushed back against questions about violence in gaza yesterday saying it was hamas that was to blame for monday's death and injuries not israelis, that violence came as america opened up the embassy in jerusalem. white house adviser and trump son-in-law jared kushner alluded to the protest in his speech. >> as we have seen from the protests of the last month and

at 9:00. and then we'll see skies clearing there. by 2:00, reaching the high of only 67 degrees. the 7-day forecast at the at the bot many of the screen and showing that we will have cooler air for today as well as tomorrow. we're looking at a high today in santa rosa at 63 degrees. that's cooler than normal. and some upper 60s from concord to antioch and livermore and san jose at 68 degrees. 58 in half moon bay. and in san francisco, expect a high of 61 degrees. as you're starting out this morning, you're getting dressed, you do need a jacket and it's a nice chilly morning but you'll probably be comfortable with light long sleeves as we go throughout the day. if you're going to the giants game tonight, hopefully don't feel the ground shaking tonight like at first pitch last night. we will have temperatures in the upper 50s and breezy winds and we'll see very chilly night. also watching out for a few storms that have been firing up over the sierra and we'll have a

chance of spotty sprinkles by tomorrow morning. not expecting anything really major here but a chance of some light rain by tomorrow as you head out the door. as we head over to mike, you're starting with the drive in the south bay. >> that's right because the south by drive did show slowing but we're starting to see it lighten up a bit. first we have the 5:30 burst of traffic and eases up by 6:00 as you see here but does show up on our sensors. then we'll see things kick in over the next half hour, especially on a tuesday pattern, seeing a little slowing around capital expressway and 101 continues with a slower drive through san martin and morgan hill, south san jose, highway 17, to and from the summit moves nicely. marcus told you about the work they may be doing at the laurel curve. no problems this morning. a smooth flow of traffic, hayward shows a little slowing and on the peninsula, south 101 i'm still tracking the crash. >> one lane blocked here off the

welcome back, it's 5:55, a new plan to clean up san francisco is controversial, even illegal but it could save thousands of lives white cutting down on the number of drug needles cross the city. exposing san francisco's diseased streets lined with a dangerous mix of used needles and fees sces and trash. one is pointing to north to canada. traveled to vancouver to see it firsthand and caught up with marcus to talk about the plan.

>> so what exactly is the idea here? >> we're base beingalic >> so what exactly is the idea here? >> we're base beingalally talkit a place for drugs, drug addicts can come in and use illegal drugs under the care of medical staff equipped with life saving drugs that could reverse the effects of a deadly overdose. >> i went to vancouver and saw what was going on there the centers and talk to me about the difference it made. >> when vancouver first opened the sites 15 yearsing, they have eight and in the history not had a single person die of an overdose inside the centers, they also say that i have seen a serious reduction in number of infections from hiv, hepatitis c. they had previously seen a serious spike because of people sharing needles. they get clean syringes which helped cut down on number of used needles they see on their own city streets. >> what will we see happen here in san francisco? >> there are some in california who are against this idea, think it is another way to encourage people to use drugs illegally.
