>> it's a nice morning. you do need a jacket heading out the door. a cool start and mostly clear skies. let's go to cupertino for temperature trend. 58 at 8:00 and warm up into the upper 60s today. mostly sunny skies. it's going to be really pleasant. a touch warmer than yesterday. antioch up to 74, 74 half moon bay, santa rosa up to 70 degrees. we'll talk about what's ahead for the weekend coming up. mike says there's some more slowing for the valley. >> typical morning commute. looking over here south bay along the peninsula, drive to the other side of the bay east bay, heading into the tri-valley eastbound 580 where we typically see road crews in the area do overnight roadwork. i think that's what's going on now. we shouldn't see those completely clearing until the next half hour. maybe an early start leaving the area. we'll track that from 230 to the

dublin grade. commute westbound 580 dublin out of the altamont. things are moving nicely here. one crash off of the freeway. sounds like folks are getting by that all right. back to you. >> all right, mike. 5:01. breaking news coming out of the south bay. we just confirmed in the past five minutes a double homicide in the san jose neighborhood off sierra road and skyview drive. "today in the bay's" bob redell live with that information just coming in. bob, what have you been able to find out? >> reporter: well, good morning, marcus. the police have a roadblock at skyview drive preventing people going up 3800 block of skyview road. the crime scene here. police confirming they received a phone call one person shot at that crime scene. you can see the corners. a van arriving in the past half hour. 2011 them. when the officers arrived on the scene they found not one person

shot but unfortunately a man and a woman both shot at least once, both pronounced dead at the scene. police point out they have not identified any suspects at the time. it's not clear if we've had to presume they are still looking for whoever it was, one or two or more people involved in this crime. number nine and number ten homicides of the year for the city of san jose in 880. again, to reiterate, two people shot beyond the checkpoint here. reporting live, bob redell, "today in the bay." >> bob, haw so much for that update. meantime breaking news from oakland, a deadly crash shutting down an intersection. two mangled cars you see there in the distance might change your commute. police say 98th and bancroft is closed. they expect it to be closed several hours while they investigate. no other details yet. we'll stay on top of this.

5:02, happening today in san jose 49ers linebacker reuben foster's case goes before a judge. foster is accused of attacking his former girlfriend in february. although she has recanted her claims against foster, she may testify under oath at the hearing. foster charged with having an assault weapon. if suspended from the team activities as this case plays out. continuing coverage now. you and your family can now eat romaine lettuce. cdc giving all clear following e. coli break that sickened 200 people. meanwhile a north bay family is now suing a pizza claim. that family claims contaminated lettuce from papa murphy's and american canyon sickened them. families filed the complaint in

solano county. the lawyer says the family's 3-year-old daughter is still receiving treatment from kidney problems. asking for damages and closer food inspection. >> without testing it, there's no way to know what they are selling is either safe or harmful. >> papa murphy's is not commenting on that lawsuit but it did say, "immediately upon hearing the announcement by the cdc on april 13th, and out of an abundance of caution, we directed our system to remove product from our stores and inventory." at 5:04 this morning, there are a lot of questions surrounding a charter school in clayton and surprise exit of school leaders. according to "east bay times" the county is launching an audit. the audit follows this week's surprise departures of the top two administrators at the clayton valley high school. the two happen to be husband and wife. for more than a year people raised questions about the school's money trail and questionable hires.

in history. mark zuckerberg traveling to europe to face questions. here we see zuckerberg testifying before congress after it was revealed cambridge analytica was allowed to use so much of our information. a big week for tech in european union. tuesday closed-door meeting with zuckerberg. friday very strict new rules protecteding european's privacy. the toughest rules we've seep to hit the interpret in years. here at home the senate voted wednesday to protect net neutrality rules. all democrats voted yes. they were joined by three republicans. net neutrality said internet service providers, like our parent company comcast, can speed up or slow down in favor of a website. this almost certainly is not going to pass the house.

the fairgrounds now. you get to see a little bit of everything. the fair runs through sunday. >> we've heard people say man's best friend but try dog's best friend, especially when it comes to saving a life. that's what one dog has done in arizona. check this out. look closely at this home security video. this is may 1st after the owner went inside. you see the dog in the pool he's actually drowning. look what the other one does, jumps in the pool and pushes his friend out. he helps push him out of the pool. he swims back to safety and helps everyone. the dog's owner says smoky has been a hard swimmer. we're happy to see he stepped in when he needed to help his friends out. man's best friend and also pet's best friend. >> isn't that beautiful to see. everybody thinks all dogs can swim. >> no, you've got to be careful. >> if they are tired and can't find a way to get out.

>> that's how i feel sometimes. >> i don't think we'll have any pool weather around here. it's been so chilly out there. even when it warms up, it's still for the warm enough to go out for a swim or go to the beach. we're going to continue on with this kind of weather. as we take a live look outside in fremont as you get thursday started, it is going attack mostly clear. look at the temperature trend, go from 50s to 60s. today a nice little warm-up with all of that sunshine and seven-day forecast already up at the bottom of the screen starting out in the south bay as we look at our high in morgan hill up to 73 degrees. it's going to be 73 also in concord. hayward we're looking at a high of 67 there and some upper 50s and low 60s for the coast. half moon bay 61. in san mateo 65 degrees. 59 in the marina district, while the mission district up to 62. 71 for an afternoon high in sonoma with breezy winds.

weigh in on the gas tax. proposition 59 clarifies where the money goes. the gas tax took affect last november. you may remember that raising prices $0.12 per gallon. this measure requiring to be used only for road improvement projects. one way or the other. lawmakers are not putting that money where they are supposed to. >> we have seen three decades of nothing but diversions of valuable transportation dollars. i think motorists would be foolish to trust them this time. >> down the road, there's another possible curveball. gas tax opponents say they gathered more than enough signatures for repeal measure. >> one of three companies involved in a lawsuit tied to lead paint is now agreeing to pay $60 million to remove that toxic paint from california homes. they agreed to the settlement which ends an 18 year legal battle. two other companies tied to the

your shot at the golden gate bridge this morning. going to see sunshine as we take a look outside in san jose. as the sun gets ready to rise in the next few minutes, temperature trends for sunnyvale mid-50s at 7:00. normally we're up to 74 degrees. we're not going to be quite there today. our temperature trend as we get the kids ready for school in concord, 55 degrees. then it warms up to 67 at recess. last school bell will be in the 70s. so it's going to be a beautiful day. we'll talk about the weekend in just a few minutes. mike, there's a surprise at the bay bridge. >> let's take a look. it's a good surprise. no back-up at the bay bridge and no metering lights. talk about the last of the day, i'm looking at the last of the year. some colleges done for the session. that's why we see fewer commuters heading through the area around berkeley, for example, a little lighter. we do have one minor crash

san francisco, hard to walk by, especially if you have kids. this is a story investigators have been looking into for months. today san francisco mark farrell will lay out an ambitious plan to get some of the city's homeless people to try and kick that habit. not only will it clean up the streets but help people have serious drug addictions? >> reporter: yeah. we're going to hear san francisco mayor mark farrell roll out this plan. it will be the first in the nation, actually bringing medical treatment to the streets, to those folks fighting addiction in the streets of san francisco. they want to prescribe or the drug we're talking about, according to san francisco chron cull, bupernorphine. it happens immediately instead of a gradual process with methadone. they did a test in san francisco more than two years ago. they said 60% of the 200 people

who use this drug are still working to stay clean. the plan for the city is to prescribe this drug to 250 people. they want to have a 10-person team to prescribe it over the next two years. the funds will be included in the mayor's budget proposal. also estimates there are 11,000 heroin users in san francisco. pick up more than 12,000 needles at homeless units every month. they did a story on supervised injection sites as possibly a solution for the city and gain access to one of those sites in canada. can you see more on that story on our website at nbcbayarea.com. live near golden gate bridge, pete suratos, "today in the bay." thank you for that story. 5:33. a follow-up, a man accused of driving high and killing three people in fremont is heading to court. all yesterday we were covering had as breaking news. that story closed 880 shutting it down for hours.

in our midday newscast we found out tran was behind the wheel. there were eight people in the suv all heading home from manteca after a day at the zoo. three died and a baby is in critical condition this morning. continuing coverage this morning, people upset over recent accusations surrounding san jose's presentation high school are vowing to keep the pressure on school leaders they met last night with concerned parents to talk about how leadership is handling the crisis. seven months ago our investigative unit uncovered a wave of allegations at the catholic high school. parents of students that go there now seem conflicted. >> if the pope can say he's sorry, i don't understand why they don't say, there are things we mishandled and this is how we're going to go forward in the

future. >> school administrators released a letter in part saying they understand recent turmoil and their goal is to keep students safe from harassment and abuse. to see our exclusive reports on sex abuse allegations at presentation high, head to our website, nbcbayarea.com and click on the investigative tab. 5:35 and new this morning, happening today, hope for home owners in san jose who would like to add a granny unit to their property. if you've ever tried to build off of your home in san jose, you know that permit process is grueling. now the city leaders say they may ease up on restrictions. kris sanchez live for us this morning. kris, this is definitely something a lot of people are talking about here in san jose. >> listen, if you live in san jose and thought about adding a granny unit to have a little extra granny space or perhaps a little short-term rental opportunity you know the city of san jose has not made that easy. that is going to be changing in

the near future. the planning commission is unanimously recommending changes to the zoning and permitting process to allow home owners to create more accessory dwelling units. that's city talk for what most call granny units. the commission will tell the council it will help house people and their extended family members and perhaps create more affordable housing here in the silicon valley. take a look at the proposed changes on the screen. the city may expand zones where granny units are allowed. could also allow more single lots to qualify and increase the maximum size of a unit, also ease and clarify setback requirements which will likely comfort neighbors. now, i confirmed this yesterday with the city council, but the city council won't hear this item until june 17th. you don't have to wait to get answers if you are interested because the city is having a special presentation about granny units tonight at the city hall rotunda, building safety

skies will be mostly clear. can you wrap up your weekend in campbell with boogie on the avenue. this will be going on both saturday and sunday. it's going to be very comfortable for sunday afternoon with 72 degrees the high temperature. just make sure you bring sunscreen or a hat or something to give you a little bit of shade and protection from the sun. if you're going to the sierra this weekend, heads up that there's still going to be afternoon thunderstorms firing up for the next several days. that continues into saturday and sunday as well as more of that snow melts we'll be up to 57 degrees on sunday. if you're thinking, man, i just really need a beach weekend, make sure you bundle up. it's only going to reach into the mid-60s on saturday panned on sunday 62 degrees. long sleeves and pants with those gusty winds it's going to feel even cooler in the tri-valley it's also going to be very nice and comfortable up to 70 degrees on saturday and sunday 69 degrees. we'll talk about what's going on with our forecast for today.

morning, a nice sunrise under way. as we take a live look outside in san jose, let's go to sunnyvale for temperature trend. you'll see a mix of sun and clouds throughout much of the morning starting out in the mid-50s but making it into the upper 60s today. it's still going to be cooler than normal but we will have a warm-up, just a little bit, for that weekend forecast. we'll talk about that and what to wear coming up in about five minutes. >> tracking richmond to san rafael bridge. toll plaza, no back-up here or at the bay bridge. we'll show you where things are getting crowded coming up. 5:44 and the search continues for the owner of two pit bulls after an attack at a popular park in st. francis. police say the dogs in this picture -- you see them off in the distance here -- tacked another dog named bloom on sunday. bloom's owner said she tried to break it up and she was bitten as well.

three other people also bitten. now investigators are looking for the man as well as the dogs in the picture. it's 5:45. frustrated folks have a new way to report. a if you didn't know a lot of people cut through los gatos on the way to santa cruz because the highway gets so backed up. it turns surface streets into a parking lot in los gatos. it's tough to get around. they have shut down the off-ramp to keep people from coming into town but not this year. it didn't work. los gatos is setting up beach hot line for neighbors to call. you want to try to get out early if you want to head to santa cruz. >> you want to make as little money on your commute? they have been rewarded $25 for car-pooling.
