another day that's going to be cooler than average and then we'll be warming up as we get into the holiday weekend. so i'll detail that in a few minutes and mike you have a couple of issues for highway 101. >> one of them we knew about, we'll continue to have closures overnight as they continue the construction. this is northbound 101 at university. there's the shopping mall. there's chp and caltrans. they have not yet removed the cones but should be clearing right now. you see that one vehicle blacking up. they are going to do a traffic break before you get to university. allow yourself ten extra minutes. everything through that area should be okay. meanwhile up a little farther north, we have the off ramp 101 northbound at broadway is affected by a crash there. should have lanes cleared in the next few. back to you. >> a castro valley man attacked by sheriff's k-9 is accusing deputies of commanding that dog to attack. this whole ordeal was caught on

camera. the sheriff's department saying it was an honest mistake. >> terry mcsweeney has both sides of the issue plus the new video. >> 2:15 monday morning in castro valley, a k-9 officer handcuffed joshua phillips on suspicion of dui. suddenly the door opens and the door jumps out and ranz towards the handle and then to phillips and attacking him for approximately 20 seconds before the handler can get the dog off of him. >> i was shocked and scared and screaming. >> phillips showed us some of his injuries but there are more. >> some of them are deep cuts, one had i to get stitches on. a couple are by my knee, under my knee where i can't bend. >> three, two, one. >> the allameda equipment sheriff's office says it was a equipment malfunction, the dut upon was actually depressed when the handler leaned off and

pushed it on the magazine below. >> they did what they are trained to do. >> he doesn't care where the door open but believes the sheriff demanded the dog to attack him. >> shines the light on me and dog attacks me when he shines the light on me. you know how the dogs are trained. >> the sheriff's department says that's not true, it was drawn to the agitated suspect. >> this was an accident. he had no reason to bite this gentlemen. we would not want to do that. >> i feel like it was intentionally done and i don't have any remorse for anything that happens to the officer or dog. >> terry mcsweeney, "today in the bay." >> now to a story we've been telling you about, a san pablo man charged with killing his exgirlfriend in front of her children will return to court today. this is mcbride from last year court appearance. a few days after he shot and killed rashonda franklin of richmond. shooting was caught on surveillance camera. she was shot driving her

children to school. the children saw the entire ordeal. at 4:33, be careful who you open your door to. suspects in morgan hill are forcing their way inside. here's some of the images of the suspects captured by surveillance cameras, the men park anywhere car in the area and walk to front door of the home and ring the doorbell and when someone answers they force their way inside to steal jewelry and cash. >> san francisco leaders debate the controversy. this surrounding the small presidio playground. that is named after julius kahn, a bay area congressman who supported the exclusion act. many say it is time for a name change similar to the one recently happening by the former justin herman plaza. sup -- a supervisors committee

yesterday it fell nearly 200 points and yesterday's session after president trump said he's not satisfied with china trade talks and the north korean summit may not happen in june. boeing and home depot led the decline which closed asdaq off airlines bragsing themselves for what will be the busiest summer in the history of air travel. they estimate 246 million passengers will fly u.s. airlines between june 1st and august 31st. that's a 4% bump from the previous year. to accommodate all of those extra people, airlines will add 116,000 extra seats to their summer schedule. a4a says a stronger economy and historically low air fares are fueling the travel surge. so much for elbow room on the airplane. >> if you want to buy a political ad on facebook, be prepared to identify yourself. anyone who wants to run political ads to prove they are

today in the bay. it )s wednesday - we )re getting closer to the long holiday welcome back on this wednesday morning. taking a nice look outside this morning. we're getting closer to the long holiday weekend. a lot of graduations coming up, some finals coming up. good luck, kids. >> take a look at this, the sun did manage to show itself in the south bay yesterday. but i want you to look at this in san francisco. nbc bay area sky ranger was over the sky line late afternoon tried to film the grand opening of the salesforce tower. the top of that tower, yeah, stuck in the clouds there, barely can see it. so was goodyear blimp, you can

make it out, the goodyear blimp there over oakland last night for the warriors game. clouds and drizzle but today are we going to see any change? >> no. it's going to be just like that today. >> and you know, in the south bay, it was all completely clear and beautiful but you can see those clouds in the distance kind of rolling over the hills in the distance. that's going to be the same thing again today. and we have those clouds right at about 1500 to 2,000 feet. and that's right at the top of the salesforce tower. as we take a live look outside this morning, it's still mostly cloudy and drizzly and our temperatures are feeling very mild in the upper 50s as you get ready to head out the door. the 7-day forecast is up at the bottom of the screen and it shows we will have cooler air on tap today. low 70s for the south bay and east san jose will reach up to 72 degrees. we're going to have upper 60s

and low 70s for much of the east bay and also some breezy winds, and all of that ocean air being transported inland. 63 degrees the high in san mateo. san francisco stays in the upper 50s today, another repeat of yesterday with that mist and drizzle. and in santa rosa, look for a high of 65 degrees and some breezy winds coming in. as we're goetting dressed, if it's drizzling, put on a hat because it's going to be a day for a bad hair day and jacket too. it will be cool all day long and you need extra layers at the a's game, coliseum first pitch at 58 degrees and breezy and partly cloudy. looking at the satellite imagery, we're seeing just a few clouds rolling by. then as we widen out the view showing the next disturbance that will be here by tomorrow morning into early friday morning. looking at how this will pan out for us, we're looking at a lot of clouds for the coast inland areas, clear out today.

for tomorrow, more clouds and then heading into friday, there will be a few spotty showers rolling by, especially for the north bay. rest of the bay area does look like it will stay dry and we'll also have cooler temperatures but then right after that system clears out, we'll feel those temperatures warming up quickly up to 90 degrees on memorial day. still hot on tuesday as well. san francisco going from the 60s into the low 70s. and mike, you're tracking two crashes and a closure. >> the closure i already tweeted about that as you follow me on twitter at mike inouye. we'll remind you where that was. this is not a closure but first of the two crashes westbound 80. your commute direction at the boulevard, a big rig went off the roadway and busted into those barrels at the off ramp. those barrels are now broken and there may be cleanup work going on. no lanes reported blocked but the slowing for the activity and flashing lights off thebridge, only the cash lanes currently have a backup and we'll track

over the next 15 to 20 minutes to make sure they clear. i expect a lighter volume overall but the early commute may see early slowing as you head in towards the weekend. we're looking over here towards north 101 and broadway. the second crash results in the barrels being broken here. activity off the lanes. the off ramp is open again at broadway but we may have activity there. i'll let you know if they have to have any closures but probably not for the morning commute. a smooth drive and that overnight closure in palo alto is open. you're back at speed university up towards willow. back to you. >> thank you, mike. >> 4:48, it's technology being touted by federal authorities as a tool to prevent some violent crimes. >> the investigative unit found many police agencies aren't using it despite the technology being around since the 1990s. stephen stock tells us what it is and finds out why.

off. >> consumer investigative chris chmura looked into his damage dispute for us. >> good morning, thomas o'shea rented a car from europe car while he visited the emerald icele and paid 440 bucks. after he got back to california he saw europe car had billed him on his credit card close to $3,000. when he called to ask why, he says the company told him, he was being charged more because he had damaged the bumper. thomas insists there was no damage when he returned the car and he told us europe car never offered proof of that damage or the cost of repairing it. they called his credit card issuer and later got a partial credit. but was still out almost $1300. thomas asked us for help. >> we asked europe car for answers and they didn't respond to us but they did get back to thomas with a full refund of the amount he requested.
