mostly cloudy for the peninsula. and starting out in the mid-50s, watch out for the drizzle and fog in spots and it's going to be very nice in martinez today with those highs reaching in the mid-60s, we'll talk about that weekend coming up and mike says we may have a problem in the tri valley. >> just hearing about this. overall first of all to start our commute as you would imagine, things are moving great. there's a little blip over here in palo alto. kari just showed the live shot. all lanes cleared north 101 and university but slowing on the sensors and folks held up in a quick traffic break at embarcadero. all lanes are open. in the south county 101 is at speed, san martin through morgan hill and into san jose and no delays for the summit, highway 17. over here we're looking at behind my head the little slowing over there out of the altamont pass. the construction cleared and

commute has begun on rash and m. i'm hearing it may be scattered across all lanes but do not hear about a full closure. i'm tracking that for you as well. the san mateo bridge westbound across the span, we can see clearly but we did have low clouds and fog as well yesterday. so there may be an issue as far as visibility later on but right now we're looking fine. there's mist on the lens that did hit near the berkeley curve. once again those crews just about clear the last of the vehicles here north 101 and university. back to you. >> thank you very much, mike. a potentially big day in court for one of the 49ers top players, ruben foster may learn if his felony domestic violence case will go to trial. a judge today is expected to make a final ruling. police in los gatos arrested foster in february. his girlfriend at the time claimed foster dragged her and punched her in the head at least eight times. last week on the witness stand she said she made the whole thing up. foster still faces a separate

marijuana charge. he is suspended from team activity. >> a follow-up to a story we told you about yesterday. do you recognize this man? concord police are hoping these new pictures will help track down a man who attacked a 93-year-old woman and stole her purse. this is from a surveillance camera inside the bank of america that is over by sun valley mall. the assault happened outside the bank just minutes later and ann peterson she broke her hip during the attack. right now at 5:02, we're bringing b.a.r.t. to livermore, an idea we've been talking you about for years now. tomorrow we could learn the fate of the proposal. the board of directors expected to make a pivotal decision that will determine how to make that dream into reality for or for some a nightmare. bob redell is live with what's

next. this may ease that congestion. >> reporter: good morning to you, marcus. to bring b.a.r.t. to livermore specifically to the proposed location behind me on the intersection of isabel and boulevard, would cost $1.6 billion. more than a million of which still needs to be raised according to mercury news. i do want to show you this map we put together for you on your tv screen to give you a better idea what the transit agency is considering. the line currently ends at the pleasanton dublin station. this proposal would extend b.a.r.t. another five and a half miles east along 580 to isabel, the right side of the tv screen but stop several miles short of the altamont pass. critics say this isabel location would not help alleviate the crush of central valley commuters coming over the pass into the tri-valley. they suggest b.a.r.t. has to go even further to let's say greenville which is the last

exit before you get on the altamont. when the b.a.r.t. board meets tomorrow, they have two decisions to make. one, whether or not to approve the final environmental impact report surrounding the isabel station and two what to do next. the board has five options. they can do what we've been talking about. they can extend regular b.a.r.t. to isabel and also extend using light rail trains that run on diesel electric. that would passengers to transfer at dublin/pleasanton and two options involve buses and no rail. the final option, the board could not do anything, there would be no b.a.r.t. extension into livermore. the b.a.r.t. board meets 5:00. as always, you have an opportunity to publicly make your feelings known to the members of the board. reporting live in livermore, bob redell, "today in the bay." >> thanks so much, bob. new for us this morning, we now know that the santa clara city council plans to do with dominic

caserta's empty seat. you may remember last week caserta resigned after being accused of sexual harassment. >> live in santa chair ray with the steps the city leaders will take against caserta and the new lawsuit against the city, kris. >> reporter: it seems at this point city council is going to appoint someone rather than allow the voters to decide who will represent them on the city council. that's at least for now. this is video from the city council meeting just last night where the council voted on a short term fix to that sudden resignation of city councilman dominic caserta. that move was not without opposition. two council members wanted to leave the seat open all together and until voters can decide in the november election. so what now you might be wondering? they'll have a chance to apply to be appointed to that open seat and then will submit to open public interviews. at the same time, the city is also dealing with that lawsuit

you mentioned brought by asian american citizens who say the current election system is not fair. in the last week or so the judge seemed to agree with them. these are two items that could further divide the santa clara city council, that is already quite divided. kris sanchez, "today in the bay." right now at 5:06, rallying to save their teacher. tonight heritage high school students in brickwood will fight to keep their well life teacher from being transferred to another school. here's the back story for you. history teacher tyler rust was videotaped taking the knee during the flag raising ceremony. that move sparked controversy on social media and now the school district saying they are transferring him so he won't be a distraction to the learning process. but some students are determined to stop that move and even started a petition. >> he's a bold teacher and makes bold comments that students

don't always know how to take. >> we reached out to rust by phone and he says his intent was never to disrespect the military or the school. he says that he took a knee to raise awareness to police brutality and the killing of unarmed african-americans. 5:07. a live look at capitol hill in washington. that is where democratic lawmakers are outraged over a meeting planned for tomorrow. the meet being will rineview to secret documents. the meeting is supposed to include intelligence leadsers and two senior house republicans. but no democrats. democrats are demanding they be included in any private meeting surrounding an informant. one intelligence expert believe he knows what an fbi informant would have been looking for. >> they were spying on a term i don't particularly like, but on what the russians were doing. >> it's unprecedented and outrageous and overtones of things that would be done in a banana republic.

good wednesday morning, you walk out the door and see clouds. we'll see the clouds throughout much of the morning, even in san jose as we start out in sunnyvale. we'll see those temperatures going from the upper 50s into the upper 6 0e's. it should be all clear by 3:00 today but still cooler than normal and we'll keep this kind of weather for the next couple of days. but there's a major warm-up in our memorial weekend forecast. i'll detail that coming up in about five minutes. >> good drive right here, southbound 101 is clear sailing from san rafael down towards the golden gate bridge. watch the low clouds quar rkari talking about, may be a spritz on windshield. >> it could be a tough day on wall street. a number of things are not working out the way washington was hoping. president trump said on tuesday he was uncertain whether the summit with north korean leader kim jong-un would go forward and washington has made it clear military action is the alternative.

the chinese trade talks are not going as well as hoped either. pressure on the market. futures call for broader -- the broader indexes to increase their losses today. the new york stock exchange has named a new leader. she'll take the reigns on friday. she's the first woman to lead the nyse. >> there are very few women in finance. very few women in technology and you're at the cross sections of finance and technology. it's a male dominated environment and that hasn't changed quite as rapidly as other industries have changed. >> the house approved a measure to put pressure on banks after the financial disaster ten years ago. the president is expected to sign that today. tesla says it will fix its model 3 after consumer reports said it didn't brake well. consumer reports says the tesla model 3 takes a longer distance to break than the f-150 pickup truck from forward. tesla ceoelon musk says they

weather to start out and it's hard to imagine that in a couple of days up to the low 90s as we look at this view in emeryville, it's misting and drizzling. we have the clouds and fog to start out this morning and you can check out the 7-day forecast coming up already at the bottom of the screen starting in the south bay as we go to concord we'll be at 59 degrees at 9:00 and mix of sun and clouds throughout the morning as it gradually warms up and once we get that sunshine we'll be up to 70 degrees. highs today up to 64 in oakland. 59 in san francisco. really not much clearing again there today. san jose 71 degrees. and livermore today 69. so overall a fairly cool day and we're planning for those graduations and all of the celebrations going on around the bay area. tomorrow night, the fireworks show for the 2018 graduates at san francisco state will be at at&t park. i know you're wondering, will it

welcome back, it's 5:24 on your wednesday morning. restaurants risking your health. our investigative unit went undercover to examine how restaurant owners are gambling with food safety. >> here's vickie nguyen with what she found. >> reporter: we went with a temperature gun and camera to see how your food is transported from the supply store to the table. and day after day, we saw raw beef and chicken and seafood sitting out for hours wio refrigeration before it went to local restaurants to be served. in one case, food sat for more than four hours before it arrived at the restaurant. state health codes require any potentially hazardous food like meat and dairy to be kept below 45 degrees because of the risk for food poisoning. in santa clara, more than 300 people a year report getting sick after eating at the restaurant from things like e.

as we get a look at palo alto, we'll start out in the upper 50s rising in the low 60s today still a little cooler than normal. we'll have this cool weather for next several days and then look what happens as we head into memorial day. some 90s inland and san francisco heading into the low 70s. i'll talk more about all of the events going on this weekend. there's so much. that's coming up in seven minutes and mike, you have two notes for drivers in the east bay. >> the first of course is that the bay bridge toll plaza backed up because the metering lights are on. you notice there's a little glow to the lights, a lot of moisture in the area and kari is talking about low clouds and mist and drizzle. we see that on the lens at the berkeley curve. even though there's no slowing, you may have to contend with slicker roadways, that's a gentle curve. doeg ju as you look at the map, there's a little slowing on the upper east shore. there may be debris before you get to the warren freeway. i think it's out of the lanes

and do still track this with a crash south 680 in washington trying to get the cars removed but they are in the center divide. >> mike is always watching the cars on the roadway, what about speeding up that commute. san francisco leaders are asking the state to require driverless car companies to share gps and other data if you're going to be on our roads. pete suratos joins us with how this will help tackle our traffic congestion problem. good morning, pete. >> good morning to you, laura, you've got san francisco city officials warning traffic data because they feel it could impact traffic as car s head towards the city, to get that traffic out to combat the problem. the california public utilities commission will vote on regulations but they want companies such as lyft and uber to share gps and other data with the city. the claimants are saying it's going to tackle traffic

congestion issues and also help them make better investment decisions when it comes to transportation networks in san francisco. now the companies are totally against this but they are open to sharing safety data. they want to keep it to just this scope. they also say that the traffic data should stay confidential. that's the argument and then of course the topic has been met with resistance in the past. the pushback is not surprising from the companies but a vote on all of this will take place on may 31st by the california public utilities commission. ro rrting live, pete suratos, "today in the bay." >> new this morning, san jose city council is putting off accepting an independent police auditor's report. this examining those complaints against the police department. now the police association tells kris sanchez that the mayor called that report misleading. the ipa agreed that the city clerk writes that the report needs to clarify data about race dispari disparity, they deferred

septemb acceptance, we went through the report yesterday morning on "today in the bay," the story is still on our website but essentially it shows the number of police complaints found to be valid went up 16%. there was a decrease in the use of force and an increase of officer discipline. >> it is 5:34 right now. authorities are downplaying accusations made by one man who believes a deputy purposely sicked his k-9 dog on him during an arsz. cell phone video call the whole thing early monday in castro valley. the video shows the deputy's car door open and the dog jumps out and attacks. >> hey -- >> joshua phillips believes the deputy commanded the dog to attack with flashlight beam. >> the dog walks out and he shines the light on me and dog attacks me when he shines the light on me. you know how these dogs are trained. >> this was an accident. we have no reason to bite this

gentlemen. we would not want to do that. >> the allameda county sheriff' get says a button got pushed allowing the dog to get oust car. they apologized and promised to pay any related health bills. >> follow-ups to a story we first brought you last week. a strink of violent chain snatching, surveillance image helped crack the case. may 6th at the valero gas station, surveillance video showing the attack leading police to identify 22-year-old jermaine smith of pittsburg police already arrested him on different charges and already in custody when fremont investigators connected those dots. happening today, another possible name change to tell you about. san francisco leaders debate the controversy surrounding the small presidio playground. that playground is named after julius kahn, a bay area congressman who critics say supported the chinese exclusion act back in 1882.

they say it is time for a name change similar to the one that recently happened for the former justin herman plaza. a supervisor's committee will debate the issue this morning. >> talks to make a major south bay road safer. the drive runs through sunnyvale and milpitas. the transportation authority is asking people to share their thoughts on how to improve the 7-mile stretch of road. it is home to companies like samsung and cisco and levee stadium. you can also attend tonight's public meeting at the lakewood park building in sunnyvale. nfl owners will keep talking about a national anthem policy. obviously this hits close to home, former 49ers quarterback colinkaepernick started the controversy. owners spent hours talking about this. espn is detailing the possible rules. may be letting each team decide

this is the plea hearing so we could get a big update in this case. his name, luis vin goss, we've been covering this for a while as a result -- the assault allegedly happened in a dorm. >> it is quarter to 6:00. now to a shocking story we've been telling you about for about a year now. a san pablo man charged with killing his exgirlfriend in front of her children will return to court today. there's video of mcbride from the first court appearance last year a few days after investigators say he shot and killed rashon da franklin of richmond. the shooting was caught on surveillance camera. she was shot while driving her children to school. the children saw the entire thing. >> 5:45, the president is returning to a familiar theme this morning. >> he'll once again attack the gang ms13. scott mcgrew joins us now. >> he'll do it from a few miles away from the place where he did it last time. he's returning to new york's long island for a round table on

stuck in the clouds. and so was a goodyear blimp. you can make it out there but barely. it was over the warriors game last night in oakland. lots of clouds yesterday and drizzle as well throughout the area and kari, you're telling us pretty much a similar thing today. >> it wouldn't be may gray without it. and the city by the bay, we are going to still see low clouds lingering even as we go into this afternoon. those clouds are right at about 1500 to 2,000 feet. so that's right at the top of the sales force tower. no change today. here's a look now in dublin where at least you can see the drive as you head through this morning. and it's going to stay this way for a little while longer. the 7-day forecast is coming up at the bottom of the screen showing that we will have some slight rain chances in there for early friday morning and still some cool temperatures the next couple of days. as walk the kids to school in concord, it will be in the mid to upper 50s, 60 degrees as i get ready to head out for lunch

and then by the time the school bell rings for the last one of the day, we'll be heading up towards 70 degrees. 71 degrees in antioch today and also in san jose, upper 50s for half moon bay. will testill be cool and breezy along the coast, 65 degrees in santa rosa. as you're starting out this morning you're getting dressed if you're seeing all of the fog and drizzle right now, grab a hat. good idea to have that and then also a light jacket will be needed throughout the day. it's graduation season. suill have the graduation today and that's going to be nice, a very beautiful temperature taking them maybe out to dinner before the event. it's going to be in the upper 60s and then later on this evening heading out for a celebration, it will be dropping back in the upper 50s, cool night and we'll also be watching a cool front that will be approaching. we can see the clouds here in the pacific. this will be moving closer to the bay area as it does so, it will bring in more clouds for tomorrow evening.

even a potential of some spotty light rain. looks like not a whole lot going on here into early friday morning. and very lit rain chances here and there and highest chance will be over the north bay and then as we go into friday night, things start to clear out. a lot of that heads over towards the sierra. if weekend, he head's up there still be rain chances, and it's going to stay cool, high ins the upper 60s but a big warm-up. a large jump in temperatures from saturday into sunday and then it's a monday memorial day looking hot, 90 degrees and san francisco goes from the upper 50s today to low 70s early next week. heading over to mike, you still have the crash inside the c caldecott tonight. >> it is counter commute, one of the eastbound bores getting away from the maze is still blocked by a crash there. i'm hearing about head injury to one of the people involved there. we'll track that and let you know if it's a major injury.

we have a major problem. half of the eastbound commute is closed and just past the warren freeway. west bounds out of let's say walnut creek and interchange through orinda, traffic flow at the limit. westbound commute both bores are open and slowing for the east shore freeway, a crash before you get to the slowing heading over towards san pablo. southbound 680 at washington, i continue to track the crash there but no slowing on the sensors, be careful as you hit the bend towards the district and rest of the bay looks good. peninsula and south bay little slowing 101 north of 680 and this is a little lighter than we often see on a wednesday at this time. a smooth drive north 101 underneath the 680. 880 through oakland a nice smooth flow and tail lights through the low clouds towards the bay bridge. back to you. >> thank you, mike. >> coming up here on "today in the bay," spending too much time on social media? the way instagram will help you
