have a beautiful afternoon. spots like san jose, it starts out cloudy and then we'll get some sunshine by the afternoon as we go to santa teresa the temperature starts out in the mid 60s and then upper 60s heading up to 71 degrees for an afternoon high. and then as we head through the forecast, we have some major warming on the way after only making it up to 59 today in san francisco. looks a little bit better for the holiday weekend so i'll detail that in just a few minutes and mike still tracking the alert in east bay. >> we're talking not about the berkeley curve but want to show it to you first of all. we have slowing and buildup and we have a slower drive towards the bay bridge with the backup. that's if you're heading towards san francisco. getting away from the area as we look, the commute in towards the bay bridge moving smoothly but away from it we have one of your bores blocked, the caldecott eastbound 24 towards the orinda side. they removed one of the cars

involved in the crash and other one still in the lanes. the truck is still there in the tunnel. we're watching for progress. only one bore counter commute. the rest of the bay shows a smooth drive, there's the build off the castro valley and towards hayward. watch for slowing on the nimitz pretty typical pattern. back to you. >> 6:01. new this morning, the santa clara city council has a new plan for filling an empty seat. caserta resigned amid growing accusations of sexual harassment. he denies the allegations but fellow council member asked him to step down. kris sanchez has the steps now city leaders are taking. good morning, kris. >> reporter: it turns out the city council is going to appoint a replacement for dominic caserta's seat rather than allow the people to vote. there's a very specific reason why they chose to do that. this is video last night's meeting where the city council voted on the short term fix and sudden resignation of city

councilman dominic caserta. it was not without opposition. two council members wanted to leave the seat open until voters can decide in the november election but that would make consensus difficult with an even number of council members. a city attorney said the city charter does not provide for a special election before november and the june election is just too soon to be fair. what now? santa clarans c-- the position opened when caserta resigned abruptly amid allegations of sexual harassment. estimate the city is also dealing with a lawsuit brought by asian-american citizens who say the current election system is not fair and at this point it seems the judge might agree with him. these are two items that could further divide the santa chalar city council which very often fails to reach consensus. chris sekris sanchez, "today in bay." a potentially big day in court for one of the 49ers top

players. ruben foster may learn his fate in the felony domestic violence case as it goes to trial. now a judge today is expected to make a final ruling. police in los gatos arrested him in february. his girlfriend at the time claimed foster dragged her and punched her in the head at least eight times. last week on the witness stand she said she made the whole thing up. foster still faces a separate marijuana charge. he's suspended from team activities. a follow-up to a story we told you about yesterday. want you to take a look at your tv screen. do you recognize this man here? concord police are hoping these new pictures will help track down the man who attacked a 93-year-old woman and stole a purse. this is from surveillance cameras inside the bank of america at the sun valley mall. that assault happened outside of that bank minutes later ann peterson broke her hip during that attack. rallying to save their

teacher. tonight heritage high school students will fight to keep a well liked teacher from being transferred to another school. here's a back story on this. history teacher and black student adviser tyler rust took a knee during the flag raising ceremony. that move sparked controversy on social media and now the school district is saying they are transferring him so he won't be a distraction to the learning process. but some students are determined to stop the move and even started a petition. >> he is a bold teacher and makes bold comments that students don't always know how to take. >> we reached out to rust by phone and he says his intent was never to disrespect the military or the school. he says he took a knee to raise awareness to police brutality and killing of unarmed african-americans. >> the commute from livermore in to san francisco is one of the worst in the entire bay area. you probably know it if you take it. but expanding the dublin pleasanton b.a.r.t. line could help out. it's an idea we've been telling

you about for years and tomorrow we could finally find out what's happening with the project. "today in the bay's" bob re-dell is live in livermore with the new options and this could get costly here. >> reporter: it could, good morning to you, marcus, to bring b.a.r.t. to livermore to the intersection of isabel and boulevard would cost an estimated $1.6 billion but unfortunately the transit agency still needs to raise more than $1 billion of that money. that hasn't happened yet. to give a better sense what the project would look like, we put this map together with you. the line currently ends at the dublin pleasanton station along 580, the left side of the tv screen. this would extend b.a.r.t. another five and a half miles east along 580 to isabel here in livermore but would stop several miles short of the altamont pass. critics say this isabel location would not help alleviate the

krish of commuters into the tri-valley because it doesn't go to greenville. they have two decisions to make, one whether or not to accept or approve the final environmental impact report surrounding the developed station and two, what to do next. the board has five options, one they could extend regular b.a.r.t. to isabel which is what we've been talking about. they could also extend using light rail like trains that run on diesel or electric. it would however require passengers to transfer at the pleasanton stations and two more options involve buses, no rail. the final option, the board could not do anything, no extension into livermore by bus or rail. the b.a.r.t. board meets tomorrow night at 5:00. there will be an opportunity for you at home to show up there if you like to publicly make your views -- comment to the board members. reporting live here in

livermore, bosh redell "today in the bay." >> thank you very much, bob. 6:06. if the roads you drive each day needs repaired, you might get a say in election day in san jose. the mercury reporting they could see a $700 billion bond measure to repave streets and repair play grounds among other projects. leaders are still working on the details. >> ground breaking on a bill dollar water front project in alameda and it includes a lot of affordable housing. this is happening in alameda point which used to be a navy base, as you can see here in the pictures, it will soon be filled with stores, restaurants and homes. these pictures also show what's there now and what it will look like soon. the entire project will take years but many of those homes will be ready to move in by next year. >> as we approach 6:08 on this wednesday morning, it's cloudy now but we won't see the clouds

all day long in los gatos, we'll still have partly cloudy skies and temperatures in the upper 50s at 8:00. we're heading in the low 70s today. it's going to be beautiful but if you're going to some of the hiking trails near the peninsula and along the coast, it is going to be cloudy. we won't see much clearing in spots like half moon bay. 52 degrees with mist and drizzle at 7:00 and only making it up to 57 degrees today at 2:00. we'll talk about what's ahead for the weekend and i know you'd like to get to the beach. we'll talk about that in just a few minutes and mike you're tracking one main problem. >> i am, getting to the beach, probably not the only one who wants to get there later on. it's a smooth drive 17 and 101 towards the south county from the south county, a little slowing there. the main problem is not the speed sensors that you saw for green for most of the bay, it is this stretch eastbound 24. the caldecott only ase res open heading towards orinda towards the bay bridge.

we see a cloudy start in fremont. a little bit of a breeze. it will be a breezy day. our temperatures start out in the upper 50s and then we'll get clearing as the morning goes along head being in the low 70s today. it's going to be a beautiful afternoon and especially for the interior valley but then we'll all have a warm-up as we head into the holiday weekend. i'll talk more about that in the full forecast in less than five minutes. >> we're looking at the travel times as you travel to the east bay. we're almost at 40 minutes slowing down through san pablo towards berkeley and also of course the bay bridge toll plaza. we'll show you the alert we talk about and continue to follow this for the caldecott tunnel. >> it looks like it could be a tough day on wall street. a number of things are not looking out the way washington is hoping. president trump said tuesday he

was uncertain whether the summit with north korean leader kim jong-un would go forward, washington made it pretty clear military action is the alternative. and the chinese trade talks are not going as well as hoped. so futures call for the broader indexes to increase their losses today. the new york stock exchange has named a new leader, key word is she. the first woman to lead the nyse. >> there are very few women in finance, very few women in technology and you're squarely at the cross sections of finance and technology so with a male dominated environment, that hasn't changed quite as rapidly as other industries have changed. other f the house approved a to weaken protections on banks put into place after the financial disaster ten years ago. the president is expected to sign that today. tesla says it will fix its model 3 after consumer rorlgts said it could not recommend it because it doesn't break well. consumer reports says the tesla

model 3 takes a longer distance to break than a ford f-150 pickup truck. tesla said the company will fix a problem by sending out a software update. consumer reports responded in part by saying, now, if tesla can update the brakes over the air, an industry first, we would be happy to retest our model 3. i think you can see the arched eyebrow in that statement, an industry first. if you can fix the brakes using software, you go ahead. >> interesting. thank you. >> it is almost quarter after 6:00. new this morning, lava continues to spread across hawaii's big island. it is so dramatic to see. we've seen it now play out for weeks. again this morning there's a big concern lava could reach a power plant and no one can do anything about it. incredibly only one person has gotten hurt during this eruption. his name is darrel clinton and he's talking about it for first time. this past weekend a piece of

escape room for memorial day weekend, alcatraz the breakout. it lasts an hour and you need a group of four to eight people and solve puzzles and use clues to escape before the guards catch you. in 1962 three inmates broke out of alcatraz using a utility corridor. they made fake heads and put them in the beds so the guards wouldn't notice they were gone. they were never heard from again. >> i love that as a kid. >> we should go, one, two, three, four, we have enough. >> we have a whole team. >> if you get out of alcatraz, i don't think i could swim in the cold water. >> not at all. i'll stay on the island. it will be heating up so a lot of people will be heading to the beach. no swimming in the water around that area but we're starting out this morning. you can barely see anything. let's get a look at our view from at&t park. we've got this low clouds that have been misting and drizzling and we will see this linger throughout much of the day.

i know the unveiling yesterday. as we look at the 7-day forecast at the bottom of the screen, it will be cool over the next few days and concord for our temperature trend, low 60s at 10:00 and then we'll start to see the sun peeking out. it's going to be a beautiful day for the inland area, reaching in the low 70s and all heading into temperatures that will be slightly lower than normal in oakland, up to 64 degrees and 65 in santa rosa and palo alto expect a high of 69 degrees. we're making plans and there's a lot of graduations going on. tomorrow night at at&t park we'll have the graduation ceremony for san francisco state. i know you're wondering, will it be foggy? we'll have higher clouds. i don't think we'll have the low clouds and fog. you should be able to see the fireworks but it's going to be cool out there. make sure you're dressed in layers and there will be an approaching system moving in right now looks fairly weak in the pacific. as it approaches, it will bring

in more clouds for tomorrow afternoon and breezy winds looking at a lot of clouds and slight chance of rain between the late thursday night and early friday morning. rain will be spotty mostly for the coast and also for the north bay and then clearing out as we go throughout the day on friday as that system moves offer towards the east. if you're heading to the sierra, there still will be a chance of afternoon showers and storms on friday and into saturday but the rest of the holiday weekend is looking beautiful. warming up to 70, near 70 degrees in the sierra on memorial day. let me know what you're doing @kari hall weather on facebook and twitter. i'll highlight a lot of events going on as temperatures heat up. check that out, 90 degrees for the inland areas and also on tuesday a lot of people head back to work it's still going to be hot. san francisco upper 50s today but low 70s heading into monday. and mike, traffic alert, has that cleared yet? >> it has just clear. enough time for me to make this a blue sign over here. but we're looking at a good

recovery. it was not a big backup because it was counter commute, both bores of even 24 have been open and traffic alert just cleared minutes ago. again, that's counter commute. westbound coming in out of the contra costa county area. concord showing slowing and pleasant hill and walnut creek a little for southbound 680 and little build for highway 4 through pitts burg and bay point. travel time 40 minutes from highway 4 to berkeley curve and crash still hovering around the biggest slowing through richmond. the rest of the bay we've moved south and nothing -- no big problems here. 619 and we see a little slowing a bit through hayward and across the westbound san mateo bridge. nice smooth flow right now. low clouds but visibility is okay here. the golden gate bridge you'll get caught with mist and maybe some fog. be careful out there. to reaffirm we're looking at the berkeley curve rve, the backup the bay bridge toll plaza.

ripped off. 6:23. nbc bay area responds to a berkeley man whose car rental in ireland left him feeling ripped off. >> chris chmura looked into his damage dispute. >> good morning, thomas o'shea rented a car from europe car, while he visited the emerald isle and paid about 440 bucks. a few weeks after he got back to california, thomas show europe car had billed him on his credit card close to $3,000. when he called to ask why, he says the company told him he was being charged more because he had damaged the bumper. thomas insists this was no damage when he rueturned the ca and told us europe car never

activates sending out a text message on phones and computers and it automatically closes and locks doors. the company's president says it also calls 911 and can focus cameras on an active shooter or victims and send their loc to f>>we can't prevent the incit from occurring but what you can do is minimize the damage. the kids today understand that the world we live in and we should be teaching them what to do. they shouldn't be learning this as they go along. >> the company decided to start selling the system to schools after last week's shooting in santa fe. it costs anywhere between 3,000 and $50,000. >> 6:25 right now. important news to pass along if your doctor is a part of john muir medical group. there's word of a data breach that involves patients who receive treatment during a three-year period. this ending in february of last year. former employee took social security numbers and treatments information and test results from the muir doctor's group. if you haven't been notified

afternoon reaching in the low 7 o's, normally this time of may we're in the mid-70s but we won't quite make it there. check out the 7-day forecast, it will be heating up over the next several days but no before rain could roll through parts of the bay area. i'll talk about the weekend forecast and more on the rain in a few minutes and mike has a problem for drivers trying to get into the san francisco across the golden gate bridge. >> that's right, one of those issues over here, you see it behind me, the fog, now touching the span itself. we can't even make out anything anywhere north of actually approaching that south tower. so that will affect your visibility here but also getting here through the north bay, southbound 101 reports of a crash near spencer. reports that the golden gate transit bus checking on things but no injuries are reported and it sounds like it's just that one bus. they've got the service vehicle headed out there. the other incident looks like it was duplicate so it cleared from the maps. you can see the update happening before you. slowing west 80 towards rich monds and from richmond across

the bridge to san rafael. the build is on but a lighter build. the bay bridge toll plaza metering lights are on. we have a new crash in san jose, tracking 101 at tully, i'll sort out the details in the next report. back to you. >> thanks, mike. >> 6:31. you probably already have seen the self-driving cars on the test drive around the bay area. soon they'll be all over. how could that impact your traffic patterns? that's what transit leaders want to know. pete suratos is live along highway 101. how is this going to change our traffic patterns in the bay area? good morning, to you marcus, a new article by the fran examiner, saying that city officials want to see the traffic data because they feel it could impact traffic congestion for folks in san francisco driving around san francisco or driving in from areas into the city. they want to see this in place for part of the requirements before the california public utility commission makes the

final vote on regulations for driveless cars, exactly what are these officials asking for. they want these companies that are having these driverless car companies to share any gps and other data with the city because they are saying that that's going to tackle -- help them tackle traffic congestion -- traffic congestion because cars are operating on city streets and impacting residents and also they feel will help them better make decisions on investments for transportation networks in the city. of course the companies are against sharing this data specifically the traffic data but they are open to sharing rider safety data with the city. they say they feel this traffic data should stay confidential and this is a topic that is met with resistance in the past. as i mention the california public utilities commission will have the final say on these regulations, they'll vote on the issue specifically on may 31st. we're live in burlinggame, pete suratos for "today in the bay." >> at 6:32, we've got a follow-up for you to a story we

brought you last week on "today in the bay." a string of violent chain snatchings in fremont. police now say surveillance images help them crack the case. one of the attacks happened on may 6th at a valero gas station, surveillance video showing the attack led to identify 22-year-old jermaine smith of pittsburg. police in oakland had already arrested smith on different charges however. he was already in custody when fremont investigators connected those dots. >> rolling the dice, it looks like there will be a casino workers strike in las vegas. thousands of unionized workers approved the plan last night. a strike could start any time after june 1st. they are demanding higher wages and protection from job cuts. the strike could cripple the city's world famous resorts along the strip just as the vegas golden nights play in the stanley cup final. >> authorities are downplaying accusations from a man who believes a deputy purposely sicked his k-9 dog on him during an arrest. cell phone video caught the

entire thing. this happened early monday in castro valley and video shows that deputy's car door opened enthe dog jumping out. attacked for 20 seconds. joshua phillips believes the deputy commanded the dog to ak tack with the flashlight beam. >> he shines the light on me and the dog attacks me when he shines the light on me. you know how these dogs are trained. >> this was an accident. we had no reason to bite this gentleman. we would not want to do that. >> now the alameda county sheriff's office claims a button on the deputy vest got pushed accidentally allowing the dog to get out of the car. they do apologize and promise to pay any related medical bills. >> at 6:34, another possible name change to tell you about. san francisco leaders debate the controversy surrounding the small presidio playground named kahn, aay area congressman who critics say

supported the chinese exclusion act. many say it's time for a name change similar to the one that happened for the justin her man plaza. a supervisor's committee will debate that issue this morning. talks on how to make a major south bay road safer. we're talking about pitasmilpit valley authority is asking people to share their thoughts how to improve the 7-mile stretch of road. the drive is home to giant tech companies like samsung and cisco as well as levi stadium. can you take the online survey until june 1st and also attend tonight's public meetings at that lake wood park building in sunnyvale. it's 6:35, happening today, nfl owners will keep talking about a national anthem policy. obviously it hits close to home. former 49er come inkaepernick started the controversy. spent hours talking about this.

espn detailing the possible rules, maybe letting each team decide its own policy or telling players who don't want to stand to stay in the locker room during the anthem of the what about punishing teams and players who don't stand with a 15-yard penalty and/or with fines and contracts added to -- language added to contracts that would require players to stand. also leaving the current policy in place which states that players should stand for the anthem but does not require them to do so. at 6:36, if you're a warriors fan, probably feeling it in your gut this morning. this is a hard one. >> they are still in the game though this morning. you may be asking what happened though. they had a lead last night against houston game four, didn't go quite as planned. warriors had the 12-point lead early in the fourth but they got cold. houston certainly heated up. in the end the warriors still had a chance to tie but they couldn't hit the key shot when

as well. right here through san martin heading towards morgan hill, typical for the bay shore freeway. friends at waze told us heading towards the beach, highway 17, probably see a burst of 140% of people, that's what the meters read towards the beaches around the country. keep that in mind. we're at below 100% for this volume through fremont. that's a light drive right now as folks are probably easing off into the holiday weekend starting today and tomorrow. >> they already thinking about that. >> i'm sure they have scheduled meetings. >> it's going to be pretty nice this weekend as well. >> it's going to be a nice weekend, there are so many events and festivals to help you celebrate the holiday weekend. in san francisco there's carnivale and parade happening and there will be a slight chance of rain early friday morning. and it's only going to make it up to 62 degrees, still fog and clouds on saturday morning but clearing out for the rest of the weekend with highs in the low

70s heading into memorial day. in san jose, taco festival will be happening and it will be beautiful on saturday. 69 degrees. that will be the high. much warmer on sunday. 79 degrees and warming up even more for memorial day and mid-80s for monterey, there will be the california roots festival happening. it will be cool and breezy on saturday, make sure you're bundled up. there will be some sunshine on sunday. a little bit more sun and then on monday nice mostly clear 69 degrees will be the high and then if you're going to santa cruz, the long board surf competition will be happening and it's going to be on saturday and sunday. still windy, highs in the low to mid-60s and a little bit more comfortable on memorial day. mushroom mardi gras will be happening this weekend and saturday will be your day to get out there because it will be sunny and highs in the mid-7 o's, a lot hotter on sunday. a head's up about that. we'll bring you back to today. i'll have a look at today's temperature trend in fremont

e b.a.r.t. line similar to the one saturday in antioch. the san jose city council is putting off accepting an independent police auditor's report examining complaints against the police department. the police association tells kris sanchez the mayor called the report misleading the ipa agreed. city clerk writes the report needs to clarify data about race disparities so they deferred acceptance and did accept an internal report on the same topic. we went through the report yesterday morning. the story is still up on the website. >> lawmakers will consider concerns about the state's proposal to create a new online only college. the examiner reports city college is among the universities where a new offering would be bad for its online courses. the school wants the state to use that money to support current programs not start a new one. the proposal is in the budget which a committee considers today. if passed, it still needs approval from the floull assemb and senate. >> make sure you're careful the

next time you open your door. police say suspects in morgan hill are forcing their way inside homes. here are some of the aimages th suspects captured on surveillance cameras. the men will park their car in an area and walk to the front door of the home and ring the doorbell and that's when someone answers the door, they force their way inside stealing jewelry and cash. >> it is quarter to 7:00 right now. we're following breaking news this morning, we're getting word of police activity in a neighborhood on san jose's east side. >> kris sanchez is there and this is near an elementary school, kris? >> reporter: i'm not sure how close it is to the elementary school because we just rolled up on the scene. but this is on florence avenue which is not too far from south capitol road here in san jose. you can see a lot of police officers, i counted about ten of them standing outside this home. and we had heard reports of a

well. in and out of the water there. apparently the sea lions have been living in the sacramento river for the last couple of decades. wildlife expert say the marine mammal protection act helped them thrive off the west coast. they say there are few reasons why they've chosen to move inland. >> their open tunistic feeders so they follow around different populations of fish and feed on what they can. >> sea lions are pretty social so it's not unusual to see them get close to the public. if you do go check them out, make sure you do keep your distance and don't feed them. >> don't ask them that annoying question, you know the ones over in san francisco -- >> you do that? you talk to sea lions? >> do you know gary? >> yeah, i know gary. >> we all know gary. >> very interesting, mike. all right. we're going to have some great weather across the bay area, at least if you're inland it's still going to be cool and those

pier 39 will be soped in with clouds. it's a cloudy start but that's typical for may and we'll get clearing into late morning early afternoon. we'll be reaching in the upper 60s in willow glen, still a little cooler than normal. as we get to walnut creek, the clearing happening sooner as the sun breaks out from behind those clouds. still a nice and cool day with highs in the mid to upper 60s there. as you're getting dressed you need a hat especially if you look out the window and see it's foggy and drizzly and it's going to be a bad hair day. grab a hat and long sleeves, light jacket needed and a lot of things going on around the bay area, including san jose state's graduation for today. and if you're going to that, maybe going out early for lunch, it's going to be in the upper 60s. after graduation going to dinner or going out to eat, it's going to be in the upper 50s. beautiful weather today but

we'll be tracking a few changes as this weather system starts to approach by tomorrow afternoon into the evening. we'll start to see more clouds and looks like we could have a slight chance of rain between late thursday night and early friday morning but it doesn't look to amount to much and moves to the east heading into friday afternoon. after that, it just warms up very quickly throughout the weekend. mid-80s inland on sunday. monday 90 degrees. it is going to feel like summer and san francisco warmer as well. heading over to mike, you're tracking that bus crash in the north bay. >> that's right. that's the only major issue right now, the rest of the commute minor. we have the metering lights on at the bay bridge. the south bay shows a little build -- i want to show you southbound 101 where traffic slows from the sausalito exit down to spencer. the golden gate transit plus still blocking two lanes. they should have a crew out there any second hopefully to remove the bus. no injuries reported. we talked about the bay bridge backup and slowing builds from

the city charter doesn't allow for special elections. the city will choose the replacement based on applications received and interviews conducted. voters will elect the new permanent council member in november. >> a critical day for one of the 49ers top players, today a judge will decide whether the ruben foster tdomestic violence case goes to trial. he was arrested back in february. at that time his then girlfriend claimed foster dragged her and punched her in the head at least eight times. last week on the witness stand, she said that she made the whole thing up. foster still faces a separate marijuana charge and he hasn't been practicing with the team since. >> do you recognize this man? concord police release these new pictures as they look for the man who attacked a 93-year-old that stole a purse? this happened at the bank of america parking lot at the sun valley mall. these pictures were taken inside the bank. 93-year-old marie peterson broke her hip during that attack.
