live look at downtown san jose - good tuesday morning to you. 4:30 right now and let's start the day off right as we take a live look. well, look at that, golden gate bridge and can't see too much there. that's not the way our morning is going to look. thank you for waking up with us. i'm marcus washington, mike is here and we'll start out with kari coming in it was nice and cool. windows down. >> nice and cool and the fog is back in parts of the bay area. it's going to be a cooler day an we do srt out with mostly clear skies for the inland areas and here's a look at the cool temperatures right now as you get ready to head out, we're starting out with some 50s around the bay area. it's 55 right now in san jose but check out santa rosa, 46

degrees. it's also cool in morgan hill with 48 degrees now and primary election forecast for san jose starts out at 60 degrees at 9:00 and it will be windy but also much cooler with highs in the low 70s. we'll talk about a warm-up in the forecast when we can see some 90s coming up in a few minutes. and mike tracking two crashes on i-80. >> both crashes are on the map right here, contra costa at the walnut creek and concord area just fine. we're worried about getting across the bay and east shore freeway. eastbound 80 out of the city, saw slowing of the sensors in the treasure id area. reports that your three right lanes are still blocked by a crash, traveling towards the oakland side. again those speed sensors cleared up over the last ten minutes, trying to get an update from chp to see if they made quick progress like they often do at this time.

all lanes are open and counter commute not much of a commute off the carquinez bridge. a smooth flow of traffic to the south bay but i do have a spot to watch on the peninsula. we'll talk about that coming up. i'll hand it back to you for now. >> 4:32, your vote matters, one of the closest watched local races the one for san francisco mayor. and this case if one receives more than 50% of the vote, the race will then be decided by ranked choice. more than half a dozen candidates are in the mix. the top candidates include supervisor london breed, jan kim, former legislator mark leno and another former supervisor angela al yoet to. it is a crucial election day in santa clara as well. one of the most controversial issues, recalling judge aaron persky after he sentenced former stanford swimmer brock turner to six months in county jail for

sexually assaulting an unconscious woman. people behind the recall say the judge was too lenient. persky says he followed the law. voters will also choose between two candidates to replace persky today. voters will decide whether to i raise tolls on our bridges, regional measure three. if it passeay brie tol would eventually go up to $9. quts tod"today in the bay's" chd breaks down the measure this morning. >> reporter: you can blame it on the economy. bay area commute traffic is awful. those in favor of regional measure three believe the toll increase will make it better. >> regional measure three represents 35 specific traffic relief and transit improvements throughout the nine county bay area. >> if it passes, that means more money towards adowntown san jos and santa clara. a south bay extension and rail cars and rebuilt freeway

interchanges and new connections. passing out flyers telling potential vo w they should vote yes on measure three. >> this is how we fund the 35 improvements we know we've needed for decades and they don't happen for free. i hate tolls. i hate traffic more. >> cupertino vice mayor is against the toll increase. >> it's very hard to support a measure when our transit needs are so great here, we have over half of our teachers say they are leaving employment in the district within six years. what's our answer to those teachers? this measure does not address that. >> the tolls are already too high. the tolls like $6 and i feel like that's too much for people to commute. >> cheryl herd, "today in the bay." >> we have much more election coverage ahead including the governor's race. that's coming up at 5:00. and of course you can head to nbcbayarea.com for all things election.

4:34 right now, today at the white house, president trump hosts almost a thousand philadelphia eagleanso quo honor our great country but the super bowl champs will not be there because the president disinvited them. a statement from the white house says that the eagles wanted to send a smaller delegation but the fans planning to attend the event deserve better. the statement also said the eagles disagree with the president because they insist that they've proud stand for the national anthem. you probably remember back in february the warriorsed not to attend a victory ceremony at the white house. the players instead met with students from a maryland school. >> now to a disturbing story in the east ba on saturday oakland police stopped a man who was allegedly tried to strangle a baby pit bull. while threatening to kill an adult pit baull. the man had a knife in his hand and they eventually got him to drop it and he gave himself up.

seattle is third with nearly a 14% se. and coming up here on "today in the bay," kari has a look at the tuesday forecast. you can tell us about the cooldown. >> it will be nice as we look outside in palo alto. starting out with low 50s and as we go through the rest of the morning, low 60s at 11:00 and eventually reaching near 70 degrees today, just perfect but does warm up as we head through the forecast. i'll talk more about it coming up next. over here the other side of the bay we're looking at fremont, the nimitz freeway at the truck scales, soth drive, a little construction north of here, not a big problem. i'll show you what is going on though coming up.

the nasdaq closing up 52 to 7606. starbucks founder howard schultz is stepping down as chairman effective at the end of the month. he's also stepping away as an active member of the board. but will take on the title of chairman emeritus, he handed over the reigns to kevin johnson more than a year ago. he originally planned to announce his departure last month but that was delayed due to the pr crisis following the arrest of the two black men at the philadelphia starbucks back in april. shultz won't say specifically what he plans to do although he has alluded to possible public service. there's been much speculation he could run for president in 2020. >> and apple takes the wraps off several new features for iphone and ipad at the developers conference, theware available for devices later this year. apple sayst wl faster and siri

sunny. as we go into the rest of the day with those highs in the low 60s there and some gusty winds. as we go to concord, our temperatures start out in the 50s and we'll be at 59 degrees at 8:00. 72 degrees at noon and also sunny with highs in the upper 70s there, very nic with upper 70s in antioch today. 78 in santa rosa, palo alto 75 degrees and san francisco 62 and in san jose, only up to 71 degrees. that's cooler than normal. so as you're getting dressed today, you need a jacket and it is a cool start but also a good day to wear some pants because it will be very nice and comfortable today. also windy, our winds coming in from the west and northwest in san francisco at about 23 to possibly 30 miles per hour today. even the inland areas will be quite breezy at about 15 to 20 miles per hour. and then as we go into the day tomorrow, more of the same, windy and cool and this is our little break from the heat because we will som see changes

on the way. we do have this trough moving in, this elongated of low pressure and bringing rain across the pacific northwest. but for us bringing in cooler temperatures and stronger ocean breeze. highs in the low to mid-70s over the next couple of days and then it starts to warm up. by the weekend, we'll be in the lowerle 0's and then up to 90 degrees early next week. it's going to get hot once again but we have several days to relax and enjoy the cooler weather. san francisco going from 59 with morning fog tomorrow to 73 by sunday. i'll have more on that and mike checking on the peninsula slewing. >> overnight road work going on and it stands out because we have mostly green around the bay right there. we'll zoom in towards northbound 101 through palo alto and approaching university. right there is a lot of slowing just the focus embarcadero and oregon expressway. we do see crews and flashing lights starting to move around

where they had the traffic down to just two lanes overnight and now we're starting to see things clear up. when the daylight comes over here, you'll see this area right there, that's the overhead bridge they continue to work on. wood scaffolding around it and the configuration shifts as we have progress over there. still the overnight road work causing some lane con striks, should clear by just after 5:00. the bay bridge moves smoothly in getting out of san francisco, eastbound at treasure island. chp told us a couple of minutes ago, everything is clear and that's great news, no problems for the morning ba to you. ks,than 4:50 right now. today new punishment possible. this is against an east bay scrap metal company. richmond may revoke operating permits for sims metal corporation. in january a fire burned and air quality officials cited the company saying the fire released dangerous chemicals in the air. the shell refinery in martinez is promising to clean up its act. it's also paying a penalty to the epa as part of a settlement.

repeat inspections since 2014, the epa found multiple violations, including quote, failure to follow procedures in handling hazardous waes. shell has agreed to make improvements which epa says will being released in the ous from environment every year. talk about gun shows, they could soon be a thing of the past in the cow palace supervisors will consider to support a bill to ban sales at the van enue. it is making its way through the legislature right now. gun control advocates recently protested the cow palace, demanding a stop to gun shows. americaly got a glimpse of the first lady after 24 days. melania trump attended an event at the white house alongside president trump to honor military nore allowed inside so all america got was a glimpse of
