paying more at the tolls. thanks for starting your morning with us, i'm marcus washington. >> i'm laura garcia. cooler temperatures prevailing today. cast your ballot for that. >> you better enjoy it because we have major changes -- >> i vote for cooler. >> me too. and it's going to do what it wants to do. we're going to see those highs in the 60s today, let's get a live look outside in san francisco as you get the wednesday started, we're seeing light patchy fog but overall mostly clear visibility and it's a mild start with mid-50s there. you're getting out the door in san jose to 54 degrees and 51 now in livermore and our highs today heading into the mid-70s for concord and antioch and san francisco, 59 degrees. we'll talk about those hot temperatures ahead and mike still tracking one lane in palo alto. >> it's always open for mornino 101. crews blocking all but fast lane approaching the university off ramp. you see the lights flowing as you get up towards the area.

from embark zer cadero to unive you have slowing. if things go like yesterday, we'll see a quick traffic break and hopefully by 5:15 they should have crews starting to clear there and improvement. we have slowing through oakland. capitol expressway there will be traffic control because of this. we'll hand it off to for the reason why. back to you. breaking news we continue to follow in the south bay. a small grass fire quickly turned to a chaotic and even scary scene for san jose firefighters. a driver crashing into the fire truck. >> "today in the bay" kris sanchez live off capitol expressway with the frantic moments for everyone involved. what happened out there, kris? >> reporter: well, there were three firefighters from this rig that were down fighting a vegetation fire when one of the firefighters was trying to rearrange cones to make sure drivers could see them. that's when the driver of the black car seemed to be coming

straight at him. what happened next is that the firefighter had to dive out of the way. take a listen. >> i don't think the driver saw him at all. my driver actually saw the car coming and was able to dive out of the way before that car struck our vehicle. >> reporter: diving. that's pretty close. >> very close, yes, nearly injured. >> reporter: so the driver of that black car appeared not to see the firefighter or the rig at all, which firefighter reggie williams tells us is really strange because though this is a dark stretch of capitol expressway, it is a very straightaway so that the driver should have seen all of the hazard lights on these rigs and all of the cones and flares on the roadway. but it is a dangerous place to fight a fire and yet there are a number of fires here. the fire is now out. the driver of that car is

heading to the hospital, had to be extricated because he slammed in t -- was trapped in the car and slammed into the rig. >> a crazy morning for them, thanks, kris. now to our election coverage this morning. big news in the race for san francisco's mayor. >> overnight mark leno got ahead of london breed slightly. if you take a look right here at those results, it shows the two are neck in neck. thom jensen is live in san francisco and thom, this is going to be one that a lot of people are going to be watching. >> reporter: and it definitely is and it's definitely too soon to call even though some people are saying that it's projected that leno will continue to win. there are so many of those mail-in ballots still out there that could come in until friday. tens of thousands of them. in the quickly organized special election which also makes a little bit different after mayor

ed lee's sudden death in december. with a thousand votes separating the two in the ranked choice system where the voters choose their first and second picks out of the three candidates, we talked to -- it is too soon to call. we talked to breed when she had a small lead and she was too early to say that she believes she would win and leno said if he wins he'll continue to fight for the people of san francisco not special interest groups. >> i will put everything that i've put into my past 18 years in public office in the mayor's office. >> oh, no, we -- it is not -- i don't think it's the right time at this time. we need to make sure that more of the returns come in and as they return it -- and come in, we'll get to that point but not right now. >> all three of of the candidates with supervisor jane kim in the race had a history of

public service. leno dating back 0 years where he worked at city hall and finally in the state senate. these two could be up against each other very soon. just next year when the normal general election is scheduled. we're live in san francisco, thom jensen, "today in the bay." >> big one to watch there. thanks, thom. >> in the governor race gavin newsom is coming out on top. this is from last night, no big surprised here. he had more than 30% of the vote. he'll now face republican john cox in november. cox came in second place with more than 25% of the vote. cox who is backed by president trump did not waste any time last night going after newsom and the democrats. >> wasn't donald trump who made california the highest taxed state in the country, it was gavin newsom and the democrats. >> newsom told his supporters in san francisco that he's fighting for equality. >> a state where we don't criminalize diversity, we celebrate diversity.

a state where we don't obstruct justice, we demand justice for everybody. we don't regulate a woman's body more than we regulate assault weapons out on our streets. and where we invest in children jeff sessions, invest in children where we don't tear them from the loving arms of their mothers and their fathers. >> the former l.a. mayor antonio villaraigosa finishe thirdith 14% of the votes. >> now to t bdge toll measure, regional measure 3. at this hour seven out of nine voted yes to increasing tolls. regional measure 3 money will come from the $3 toll increase. increases will come in stages starting next year and ending in 2025. tolls on bay bridge could go up as high as $9 during peak commute hours. contra costa and solano voters

rejected the measure. we spoke to some overnight about the results. the toll increase is expected to raise more than $4 billion over 25 years. that money would be used to pay for transit projects all designed to alleviate the bay area's traffic crisis. more election coverage on our website right now to see how all of the races and measures c did in your county. nbcbayarea.com. it's easy, click on the red banner at the top of the home page. in other news this morning, a frightening and gruesome crime in san francisco. a body found dismembered and stuffed in a storage area under an apartment. police say it happened on saturday on 14th street in the mission. lisa gonzalez was arrested and charged with murder. investigators believe gonzalez was the woman's roommate and will be arraigned today. >> new this morning for you, a break in a murder case in the east bay, richmond police say they arrested vernon dowd,

police say he's responsible for the death of mark johnson on 15th street back in april. investigators say good detective work an social media and alert community led to that arrest. >> it is 5:08. embattled 49er ruben fost certificate expeer is in court for a weapons charge. he had charges dropped including two domestic violence charges. another misdemeanor marijuana charge was dropped as well. he must pay court costs and $100 bail bond fee. >> happening tonight, will the warriors make it 3-zip. you most likely will be watching. >> i will be watching for sure. sacrifice some sleep for this one. the dubs will take on the cavaliers tonight in cleveland. we do have good news for you on the injury front this morning. klay thompson and an dree iguodala will most likely play tonight. if the warriors win, they will take a demanding 3-0 lead in the

get a look at our forecast in san jose. but mike is tracking the delay through oakland. >> it's because there are restrictive lanes there. southbound 880 from 980 down towards about 23rd before you get to the construction zone, you're of course have to funnel over towards where the closure has opened up. they've alternated lanes over the last few weeks and southbound traffic after that is just fine past the coliseum and actually approaching the bay bridge no problems either. disabled vehicle reporter for highway 4 around port chicago sounds like it's out of lanes but i'll keep tracking it. we're looking over here towards the south bay. no real problems either. but over at palo alto, they continue to start to clear this. we should see a quick traffic break approaching university in the next couple of minutes, guys. back to you. >> sounds good, mike. >> our election coverage continues, including what's next for a big affordable housing measure in the south bay. >> we're covering business and tech as well. facebook has gotten itself in

week, we have a major warm-up on the way. i'll have that look at those numbers and what's ahead as you make your weekend plans coming up in less than five minutes. >> right now, dublin looks great, westbound 580, we have headlights and we have good spacing, you're at the limit here approaching the interchange, we'll show you the rest of the commute and changes coming up. good morning, good wednesday to you. shares in twitter have jumped 5%. $1.92 doesn't look like much but this is 5%. i told you yesterday before this happened why it was going to happen. meanwhile the department of justice is going to court to fight a ruling that the president has to let everybody read what he says on twitter. the president has blocked some people and the judge says that's unconstitutional because citizens have a right to read and respond to what the president writes. the court said mr. trump can use people mute people but can't

stop them from reading their tweet. number trouble from facebook, facebook have been giving phone makers access to user data without permission. one of the phone makers is wawei, the american intelligence community says it is a security threat. it's the third largest phone maker in the world but the fbi has publicly recommended americans not use huawei phones. mark warner, the top democrat on the intelligence committee says does our personal info reside on a server in china. we could see facebook headed back to washington for more testimony forgiving data to the chinese. now, facebook does not seem to get into trouble for this. their stock price recovered from the latest scandal. you saw a few people publicly leave facebook but generally users remain the same. we'll see what it is with the chinese.

>> seems like they are very forgiving. >> users are, yeah. >> interesting. >> 5:15 right now. back to our decision 2018 coverage. people in san jose voted inno o measure b. this is calling for the city to change zoning rules to let places build senior housing. 57% of that vote is in. 54 voting no. 45% voting yes. >> measure c is a mayor's counter proposal, voters appear to have approved this one with 51% of precincts ros s reportin 41% voting no. >> sam liccardo skated into victory. it was a packed house downtown surrounded by his supporters, he says the re-election is rewarding. he was first elected in 2014 after serving on the city council. >> back to other news this morning. this might affect your next flight.

jetblue is laying out new restrictions for passengers flying with emotional support animals. starting july 1st, the airline will require you to notify the airline about your pet 48 hours in advance. they will only allow dogs, cats and miniature horses. that's right. miniature horses. you must however provide documentation about the animal's health and behavior and get a health form from the doctor's office prescribing that animal. other airlines are also issuing stricter rules for emotional support animals. imagine getting off of a flight and being greeted by this. take a look at your screen there. that's exactly what a woman saw as she came home. her suitcase shredded and her belongings there destroyed. the woman says she never got an explanation about what exactly happened. the airline apologized and said they were sending her a $3500 check for the damages and $300 travel vouchers. >> that says new shoes.

sometimes it can be hard to get people to follow your instructions but one deliverly man took a directive to heart and followed it to letter. here's what happens, the delivery guy walks up and sees the mat there, please high packages from husband. looked at the door and sprang into action. he was looking for a place to hide the package. he's actually trying to follow the rules there. looks like he hid it hibd a park bench. >> you have to really hide those from the thieves too. >> i don't have a mat like that but my guy does pretty good. i give him credit. >> i have a request to put it inside a container we have that opens so i see him read the sign and put it on top of the sign. >> i got a camera watching too. >> there you go. >> all right cooler today. >> we're looking forward to great weather and inland valleys will really enjoy today. it's going to be cool though for the coast and in san francisco

where we get a live look this morning as the sun rises, love this view and look at the sal salesforce tower lit up in bright purple. we'll see a lot of sunshine today. the seven-day forecast is coming up at the bottom of the screen, you'll want to look at this because there are a lot of changes here on the way. let's go hiking today in the peninsula. it's going to be nice and cool there. although we will start out with patchy fog, we'll be at 52 degrees at 7:00 and not much of a warm-up today. we stay in the 50s as the skies clear and it's going to be windy today. getting a look at our highs today, in los gatos, expect a high of 70 degrees. that is just perfect. it's going to be breezy and nice and sunny and inland areas, livermore up to 68 degrees and 63 today in oakland. once again it does take stay in the 50s for the coast sean palo alto expect a high of 58 degrees and upper 50s for san francisco, the marina district at 58. in napa, 74. also 74 in santa rosa.

as you make plans for today, maybe you'll head out to first wednesdays in wall nwalnut cree, weather will be nice with low 70s and it will be cooler off. make sure you bring a jacket. by 8:00 we're only at 62 degrees. i've been watching to see the weather pattern and how it evolves over the next couple of days. we have a trough giving us a few more clouds and keeping us in with westerly winds and that's going to keep it cool for at least a little while longer but that will be moving on. as you make plans for the weekend, let me know what you're doing, i'm @kari hall weather on twitter and we'll talk about a warmer weekend ahead as we look at the seven-day forecast. mid-70s inland but 84 on friday. a quick little spike in the temperatures but more comfortable on saturday. then we get the big ramp up from sunday into early next week. and it looks like that heat stays with us for quite a while. san francisco getting a little

bit warmer. i'm sure they are looking forward to 70s in the forecast. mike has changes for drivers through oakland. >> i do. they just cleared the lanes southbound 880 and look how quickly this backup cleared as well. only about five minutes since they cleared all of the lanes southbound and 980 down to 23rd is now basically back at speed. walnut creek interchange and 680 off the ven eesh sha bridge. alameda looking great as well. a couple of fender benders out of lanes. slowing shows up here over in the pen nings la, later than yesterday but it looks like they may be getting ready to do the traffic break. they are getting a couple of tractors left over here and cones. they have to clear the cones and they can release the traffic northbound but we have lane restrictions approaching university, still slowing from about embarcadero. >> coming up next here on quts today in the bay, a tragic loss in the fashion world, the new revealing details we're learning about the death of kate spad as

temperatures in the upper 50s, a little bit more sun as we go through the rest of the morning and early afternoon with highs in the mid-60s, here's a look at our highs today, up to 68 degrees in livermore and 74 in antioch. inland areas will really enjoy today's weather while the coast will be cool. san francisco only 59 degrees but we'll warm up some as we head into the weekend. more on that and the weekend forecast and mike now has a traffic alert. >> it's an alert, good kind though, they had a traffic break but just showed a couple of seconds ago just restored traffic flow northbound 101. even that is outdated and we change it as it happened. live look shows north 101 all lanes accessing traffic past university avenue, a little slowing remains on the sensors as you travel north past the embarcadero area. a tiny bit of slowing for the freeway. the south bay does show a little slowing for 101 and we have this activity here, a crash just off

capitol expressway and 101. i'll talk about that coming up. but more on the mayor's race, back to you. >> that election coverage we continue this morning, first, like mike said the big changes overnight in the race for san francisco mayor while you were sleeping. mark leno now ahead of london breed. as we look at the graphic, it's so close it shows the two are tied. >> "today in the bay's" thom jensen has the late night reaction that came in. thom? >> reporter: this is really certainly too soon to call who will win because there are still tens of thousands of those mail-in ballots still out there. however those votes normally go to the more progressive candidate and that would be leno in this case. there is some speculation and this is also a ranked choice system where the voters pick their first and second choices for mayor in what was a three-person race.

it was also a quickly organized election and campaign after mayor ed lee's sudden death in september. who knows, a lot going on out there. nbc bay area did talk to breed late last night when she had a small lead and she felt good about her chances but it was still too soon to call she said. she also talked about ending the divisiveness that ran throughout the late stages of this race. >> and it's time for us to come together no matter who becomes mayor of san francisco, we have a lot of work to get done. i'm still going to be here doing the work in my leadership capacity. >> reporter: now, leno, breed and supervisor jane kim all have a history of public service. leno dating back 20 years. breed and leno could face off as soon as next year when the normally scheduled general election takes place. we're live in san francisco, thom jensen, quts today in the

"today in the bay's" bob redell is live with what's next. >> reporter: good morning, laura. this is the first time in 86 years californians have recalled a judge. judge aaron persky who presided

over cases here in palo alto is now off the bench. voters by a margin of 70% ele electelec elected cindy henderson to replace him. judge persky scene last week at the rally to save his job has been heavily criticized over the past couple of years for sentencing of stanford swimmer convicted of sexual assault of a woman on campus to just six months in jail. brock turner was his name as you're familiar with. he was released after serving three months for good behavior. persky's defenders believe his recall will threaten judicial independence if judges are now having to worry about how the public perceives their sentencing decisions. here's one of persky's supporters. >> i'm emboldened and thankful to the 40% or more who said this recall is wrong. it's a threat to judicial independence and i'm glad they got it. i'm asking them to continue to stand up and speak up about

middle school in pleasant hill. police say he posted a message with a guns emojis and threaten to kill 30 people during last week of school. they'll host a press conference this afternoon. a woman in serious condition after she was hit by a car while crossing the street in berkeley. it happened about 7:30 last night at sacramento and delaware streets, not far from the north berkeley b.a.r.t. station. the driver who is said to be cooperating with police says he can't see the woman. police say drugs or alcohol do not appear to have played a role. 5:38. you can get a glimpse of the feature of the bay area. we talked before about bay area 2040 action plan, to lower the cost of housing and spur economic development and protect the climate. regional manning committee is meeting is bay area metro center this afternoon. we're looking -- good flow

of traffic despite what the sensors show, it should be back to the speed limit 101 from university -- from embarcadero through the construction zone. it's south of there we have one issue. i told you briefly the crash right here, it's on westbound east capitol expressway at center. there's a closure there because of the fire truck that was hit by another vehicle while they were doing fire duty there. kris sanchez follows. there may be folks heading towards 87. that's normally not a problem, however this crash may have folks just by reaction heading over towards 87 and that could be a problem for folks. we're looking at the slower krif really backing up as it sounds like two lanes blocked by a crash there now. we're tracking that for the south bay. everybody else looks pretty good and light traffic north of that crash. that's good news at least. >> there you go. well, folks looking forward to the weekend. lots of kids starting to get off of school too. >> my son, last day is on friday and i'm thinking what are we

going to do this weekend, something to celebrate, right? >> get out. >> here's a look at the forecast heading into the weekend. as you start to make plans on saturday, it's going to be really nice but still cool for a beach day. upper 60s and partly to mostly cloudy skies for the coast. the bay will be at 74 degrees. and inland areas at 79. it will start to heat up on sunday especially for the inland valleys and we'll be at 78 degrees for the bay and 64 at the coast. if you can wake up very early on saturday morning you'll be able to catch the sonoma county hot air balloon classic happening in windsor and yes, it starts at 4:00 in the morning with the balloon glow. it will be 50 degrees cool temperatures. make sure you're bundled up. it will gradually make it up in the upper 60s through the day. we're celebrate portugal at history park on saturday. it will be at 63 degrees at 11:00 and some low 70s for the middle of the afternoon with

sunshine. if you're going to the sierra this weekend, heavenly will be really nice. really warm on friday with 74 degree temperatures and then lower 60s for the rest of the weekend. in russian river valley, also warm on friday, 78 degrees but then those temperatures come down on saturday, highs reaching 69 degrees and also some warmer weather ahead. we'll talk about that warm-up and a look at today's temperature trend in about three minutes. >> sounds good, kari, thank you. >> 5:41. coming up next, complete election coverage continues including a possible run-off for an important sheriff's race. >> when the democrats said run for something, it's possible too many of them did. we'll take some analysis into that when "today in the bay" continues.

sfl back to our decision 2018 coverage. the sheriff's race in santa clara county appears to be heading towards a runoff. the current sheriff lori smith needed more than 50% of the votes to win and as you can see she's falling short of that. her former undersheriff and second in command john hirokawa coming in second place with more than 30% of the vote. sheriff smith facing a sixth term has faced a lot of controversies over the past four years, including the death of inma inma inmate michael tyrea. she spoke to us last night. >> we've done a lot of jail reform, very, very busy but we're going great work in the sheriff's office and looking forward to another four years. >> what numbers show me right now, most likely there will be a runoff in november, but the majority of the voters who cast their ballots are indicating they want change. >> there you also heard from

smith's top challenger, john hirowawa. >> now to proposition h. it would equip san francisco police officers with tasers, 60% voting against it. 39% voting in favor. at 5:46, californians also weighed in on congressional races as well. >> scott mcgrew has his overnight analysis. >> some races are foregone conclusions. but there were some close votes down in southern california where remember, we're still dealing with california's unusual top two primary. that means two candidates from the sam party can go onto the electioneaving the other party without a candidatet all. this was a huge worry for the democrats. democrats were saying to people, run for something and they did. that meant there were a lot of democrats in various races. in some races, the party actually tried to get some of the candidates to drop out. here's why in my little fictional case here. the republican is guaranteed a spot.

republicans vote for her but democrats will then split their vote amongst all kinds of people. that's what you saw in the gubernatorial race. it helped john cox in that race. a republican in a very blue california. the democrats mostly voted for newsom but split the rest of the vote among candidates in their party. you see this in the race for the tenth district. this will be down in modesto area, this vote count is not done yet. we know the top vote counter -- vote getter rather is a republican. then it gets fuzzy as to who's going to get enough to be the other candidate on the ballot. had the democrats voted for one candidate, they would have instantly assured themselves a spot. as it turns out, it does look like democrats did quite well statewide and cook's political report predicts they'll be on every ballot on the state. back in washington, president trump will sign a va bill today that will extend the veterans choice program for a year.

low 70s and sunshine. it will be cooling off fast. make sure you bring a jacket. our high temperatures today heading into the mid-70s for antioch, oakland at 63 degrees. 74 in santa rosa and also in napa. and san francisco will only make it into the mid-50s today. as you're starting out getting dressed, you do want to make sure you have a nice warm jacket and then later today with all of that sun, sunglasses and you'll be comfortable with some short sleeves but you do need a lot more than that if you're going to the giants game, even though it's an early yarafternoon game with sunshine, it's only going to be upper 50s and windy. sun makes it feel a lot more comfortable. as we go through the forecast, check out the changes ahead. we'll be in the mid-70s for the next couple of days inland and on friday it will be warming up to 84 degrees. saturday is looking nice and then we'll have a big ramp up in our temperatures by early next week and it looks like that heat stays with us for quite a while as we go through the extended

forecast. but san francisco, you'll be happy to know you'll have some much warmer weather. highs in the mid-70s early next week. as we head over to mike, you have the ripple effect going on. >> that's right. we talked about what if over here for the scene that kris sanchez reports. we're looking overall the south bay looks great but san jose has a problem at tully. a motorcycle down. the update says the three right lanes are blocked. two lanes get by. that's got traffic quickly jamming past capitol expressway. a lot of times people get over towards capitol and take it to 87. right now this crash that kris is following, over there westbound, it's closed at center road cutting off a lot of traffic. they have to take center and hit other city streets. the traffic rippling around through the area. we'll see how things play out and how long it takes to clear that portion of the bay shore freeway. the rest of the bay does show a pretty smooth drive, still slowing north of that
