we're on early because of the stanley cup final. a heavy police presence in the mission district after reports of a double shooting. this video was just sent in from our photographer near the scene. you can see this neighborhood roped off with police tape. the shooting happened about 90 minutes ago near treat street. >> police say two victims have been taken to the hospital. no word yet on their condition and no word on a suspect either. we'll bring you any more information as it comes into our news room. >> other top story, sfpd is asking for the public's help tracking down a man who attacked a homeless man. >> you can see the person in a suit walking up and kicking the man while he's sitting on the sidewalk. >> nbc bay area's sam brock joins us with details.

>> reporter: this happened in broad daylight, at 3:00 in the afternoon on a thursday, may 24th. the whole thing happening right over my shoulder on leavenworth street where the dumpster is right next to it. police don't believe there was a pre-existing relationship between the man who committed this assault and the 38-year-old victim which is to say they believe it was unprovoked. uc law school is right there. they weren't aware of the video. a man waits briefly behind a dumpster and emerges, lies next to the person lying over a metal grate on the ground and kicks him twice, taunting the man on the ground and wandering off. a sergeant was flagged down after someone reported a bloodied man on the sidewalk suffering from head injuries. those who live and work around here reacted to this crime. >> you see the guy wearing a suit, clearly already in a

higher position than this guy. why does he have to kick him when he's down? he's literally down, literally and figuratively. it's beyond words. >> it's not normal. this is a normal lifestyle for people out here. it's not normal to be punching somebody who can't defend themselves. you should never do that. >> take a good look at the still images. this is the man police are trying to track down right now. the sergeant working this case tells me he's tall, probably about 6'5", white and in his mid 30s and he freekts the area. this is an active investigation. sfpd is making headway. one of the topics we talk about here in san francisco, the wealth gap between the have and the have-not and trying to bridge that in terms of opportunity and treatment. this evidence of this sort of treatment today makes us churn. live from san francisco, sam

brock, nbc bay area news. >> if you want to see a closer shot of that suspect, we have posted that video on our twitter feed. our handle @nbcbayarea. a bizarre arson attempt caught on video. police are asking for the public's help in trying to find a woman who may have tried to set two day cares on fire. this was at a union city safari kid facility. a similar method was used on may 26th at a knew ward safari kid preschool. >> it would appear the suspect showed up to the school when the school is vacant. so it seems she's not attempting to harm anybody, but again, a very dangerous crime. >> police are asking anyone who recognizes the woman in the video to contact them. coming up in our special

forecast, we'll have more from police. a woman was found killed around 11:00 a.m. on mission street near santa rosa avenue. few details released at this time. investigators do confirm to us a suspect fled the scene and is still on the loose. you can see our nbc bay area sky ranger shows the car down below being towed from this area. more unsettling news about self-driving tech kolg. the ntsb released information about a tesla crash that killed a software engineer. the agency confirms the suv was on auto pilot and the driver did not have his hands on the wheel. we're live with more. >> police and first responders admitted to us that day they didn't know how to properly

handle the tesla's burned battery. two tesla employees had to come out and take care of it. now we're learning that that battery was still dangerous days later. the images from the crash are horrible. the front end of a tesla suv ripped off and burned, its driver killed. tonight the national transportation safety board confirming that the auto pilot feature was on and that for the last six seconds prior to the crash, the vehicle did not detect the driver's hands on the steering wheel. >> no matter how good it is, it's software. it's written by humans, and you can never count on it doing everything. >> they concluded the tesla's speed increased with no braking. an expert in the field of

self-driving technology says it is possible that the tesla's technology malfunctioned here. >> what it seems to indicate that the vehicle system, the auto pilot did not have the full understanding of the situation. >> on the day of the crash, two tesla employees worked for hours to safely remove parts of the exposed damaged car battery that caught fire after the crash. the ntsb's report reveals five days after the crash that burned battery reignited, something the doctor says can easily happen because the chemicals in these electric car bratries are still interacting with each other even after a crash. >> you cannot just pull the plug or flip the switch and turn it off. >> reporter: according to an ntsb spokesperson, it will most likely take a year to determine an exact cause for that crash. live in san jose, anew shah ras sta, nbc bay area news who will be the next mayor

of san francisco. two days after the election we still don't know. we have updated numbers. would you believe this race is getting even tighter. mark leno now leads london breed by just 25 votes, and the vote count is likely days away from complete. san francisco, as you probably know by now uses ranked-choice voting where voters pick their top three candidates. if no single candidate gets 50% or more in the first count, then voters' second and third choices come into play. london breed didn't get more than 50%, she was a topic by a majority of voters. leno got more second place votes. that's what has him clinging to a slight lead. the feds need to stay out even though recreational pot has been legalized in nine states, attorney general jeff sessions says it's still illegal under federal law.

marijuana businesses can't get access to banking services. >> that forces a multibillion dollar industry to operate all in cash. that's bad for business and bad for safety. >> the senators say it's a perfect example of honoring states' rights. fourth of july is right around the corner and fire investigators are cracking down on illegal fireworks. today they announced one of the biggest fireworks busts in state history. nbc bay area's roz plater joins us with details. >> reporter: state investigators hope shutting down this illegal operation will make a big differen difference. investigators say these boxes contain the nearly 50,000 pounds of illegal fireworks, some

seized in the bay area just before the july 4 holiday. >> four semi truck trailers full of what are essentially weapons of wildfire, not to mention huge potential disturbances to our community. we have to put our foot down and say that's enough. >> seven people were arrested in the sting. investigators say it started with a tip from a concerned citizen. >> law enforcement officers have reason to believe these suspects have been illegally importing, transporting, storing, distributing and selling these products, dangerous fireworks throughout california. with indications that this practice has gone on for at least 30 years. >> investigators say jack schroll was arrested twice. no one answered the door at his walnut creek home. a neighbor said he spotted atf agents carrying out boxes about ten days ago. cal fire says fireworks each year start more than 18,000 fires around the state. the agency hopes by getting these illegal ones off the streets, it makes for a safer

holiday. >> that means fewer fires, fewer injuries, fewer deaths, less property damage and let impact to the environment including air plaugs. >> reporter: if you're going the use fireworks this holiday season make sure they have the safe and sane label. those are the only ones that are legal. roz plater, nbc bay area news. as beach weather approaches the list of california's most ten polluted beaches is out including five in the bay area. the tests test the water for bacterial pollution. it's not all bad news. more nor cal beaches pass water quality tests with a grade of a or b, including all 15 beaches tested in san francisco. the number of healthy beaches has been trending down for years. >> san mateo county had four

coested commute. facebook and a bay area transit agency say after a year of talking about ways to help people get around faster, they're ready to spend money to create possible solutions. our business and tech reporter scott budman has the story from one of the choke points along the dumbarton bridge. >> reporter: it's no surprise that traffic along these parts like here on the dumbarton bridge has gotten worse, largely because of tech growth. it's fitting that facebook, one of the fastest growing tech companies is fighting back. bay area traffic near facebook is a mess coming and going. >> i'm in reverse commute out of san jose. my commute has gone up five minutes just in four minutes of being here. >> reporter: relief may be on the way. the san mateo county transit district says it's planning to work with facebook to ease traffic, partly by adding bus and pedestrian options to the dumbarton bridge. >> the plan also calls for

rebuilding the dumbarton rail bridge which would initially act as a shuttle from knew war to menlo park. >> reporter: they say redoing the rail bridge which was originally built in 1910 would likely cost about a billion dollars. they also say having help from facebook is a big step towards making it happen. >> it if the process does result in funding being secured, that speeds things up quite a bit. if we see that, we may see this built in the near future. >> reporter: other than that, they admit it's too early in the process to even estimate a timeline. i should mention that even as facebook helps to fight traffic, it's growing all over the bay area with offices planned in sunnyvale, fremont and san francisco. along the dumbarton bridge, scott budman, nbc bay area news. >> because of that, bay area commuters are spending way more time in their cars than in past years. the metropolitan transportation commission recently released new

numbers that show since 2009 the average commute went from 27 minutes to 32 minutes. the top cities with the biggest commute, a average commute in antioch at 34 minutes, bent wood at 42 and pittsburg at 41 minutes. facebook is apologizing for a software bug that made private posts public. you might see one of these messages in your news feed today. facebook said some posts that users thought were private, including messages, were shared publicly. facebook switched all those posts back to private within days. two california toddler formula makers are being sued by the state of california, accused of making products with dangerously high levels of lead. the suit was filed by state attorney general javier becerra. it claims peaceful planet, toddler spreems and sammy's free range goat milk contained 13 to

15 times the maximum amount of lead allowed by state law. experts say lead exposure can lead to brain issues, stunted development and behavioral issues. >> in this particular case where it's a known product, then you're going to definitely want to make sure that those children who have been exposed have their pediatrician do the lead levels on them to make sure that's not at a level that requires treatment. >> both companies agreed to stop selling the products in california but have yet to respond to our calls for comment. our chief meteorologist jeff ranieri is here. yesterday jeff said this is one of the most exciting seven-day forecasts for june. >> it's true. we have a lot of ups and downs in our forecast. not as simple as sunny and warm. let's take you into our microclimate forecast this afternoon on early due to the stanley cup.

look at all this traffic. interstate 80 near emeryville, that's heading towards sacramone oh and just before that into berkeley. currently we have in nearby oakland 64 degrees and clear skies. what i want you to notice is through tonight, not much in the way of cloud cover in oakland. we'll stay with mostly clear skies. that's due to warmer, dryer air i'm seeing building in from the south. that's going to be the big headline for tomorrow, the warmer air moving in. i want you to think about a cooler system to the north that will impact our weekend. more on that coming up. but our friday forecast, a little fog near the peninsula and 56. otherwise sun for the south bay and 55. just how you like it in the tri-valley, 54 and mostly sunny. patchy fog in san francisco and 54. just a few clouds near the bay and 56. as we continue through our day on friday, temperatures are going to warm up. it's going to be normal in the south bay. instead of 70s, we're pushing

things back into the 80s for a few location. east san jose down to morgan hill and gilroy, low 80s tomorrow. close the that in san jose and 80 in los gatos. going up ten degrees across the east bay. not uncomfortable but you'll feel the heat. 84 in danville, 84 in antioch. oakland getting up to 72. sunshine here throughout the peninsula. cool in half moon bay with the ocean breeze. the warmest in palo alto at 79. not that warm in san francisco. just couldn't bump these temperatures up that much. that's dow to the cold ocean breeze out of the west at 2. mildist in the mission at 66. through marin, napa and sonoma counties, there's the heat for you. in napa, three-day weekend in the grapevines, 85 degrees. also warming up in mill val lieu to 77. once we hit this weekend, we do have that new change coming our

way. system off to the north will bring rainfall near the california/oregon border, clouds and cooler temperatures. going on a road trip? not only rain right here but also into oregon and washington. my extended forecast, milder weather, we've ratcheted up the temperatures in san francisco. low 70s monday, tuesday and wednesday. for cities away from the coastline, here are the temperatures, 85 tomorrow, 75 saturday. back up to 83 on sunday. there's our heat coming our way this week and higher fire danger. we should see it back down by next thursday to 80. i hear a few sighs of relief. >> the heat wave is twice as long. instead of two days, it's four days. >> you can never catch a break. it could be ten. >> yes, that's true. >> thank you, jeff. up next here at 4:30, show dogs abandoned on a hot day into side a closed van.

we )re learning more about the man accused in the attack. new details about a road rage rampage in sacramento. we're learning more about the man accused in the attack. cell phone video shows the driver of this white trail blazer ramming this car. the driver didn't stop there. he got out, then jumped on top of the crv to kick in the windows. fortunately no one was in the car. police showed up, arrested the driver. he's 40-year-old jose garcia alvarez. officers believe he may have been under the influence. we have very good news. a joyous outcome for two dog trainers after their trip to the bay area. someone stole their van with 14 show dogs inside. today a tearful reunion as the dogs and trainers were reunited at the redding humane society.

the trainers were travel for a dog show, stopped in redding for lunch, left the motor running so the dogs could have air conditioning. seemed like a smart move. that's one someone snatched the van and drove off. police found that van this morning in a field outside redding. the dogs were all inside, very hot but thankfully okay. >> great reunion there. former 49ers quarterback colin kaepernick is taking aim at president trump. his lawyers want to know if the president had anything to do with the 1/2's new national anthem policy, it's part of his collusion case against the nfl. he took a knee during the national anthem to raise awareness about police brutality. the president has been vocal about these protests. we're counting down toward the stanley cup final between washington and las vegas. up next, man's best friend saved from a burning boat. final, in j

final in minutes. after the game, special newscast including a blistering report from san jose's city auditor involving the police activities league. the report claims the program is mismanaged and wants immediate changes. here at 4:30, a pit bull, a row boat and a fast-moving fire, an unlikely combination for a wild story in marin county. before dawn, there was a fire on board a boat in the san rafael yacht harbor. the fire department handled the flames, witnesses spotted a dog cowering on the deck. that's when a doctor grabbed the row boat and headed out. somehow he coaxed the frightened dog to him just in time. witnesses tell us the ball was almost immediately engulfed by flames. that dog is reunited with his grateful owner. that officer who made the daring officer is getting a lot of love from his colleagues, the community and social media. out on a row boat, you don't see that very often at all. >> that's impressive.
