change in immigration law that restricts who can apply for asylum in the u.s. it's a challenge for jeff sessions who declared fleeing domestic or gang violence will no longer be considered grounds for asylum. the aclu and other groups want that reversed. among their clients are a mother from el salvador and her daughter. during the hear at federal krort in washington, the judge discovered the government was taking the mother and child back to el salvador. the judge ordered the government to bring them back, turning the plane around if necessary. he issued this order "return carmen and her daughter to the united states forth with." that's judge speak for "right now." he said he would not tolerate any delay. judge emmett sullivan said he

would hold jeff sessions, the homeland security secretary and other government officials if the mother and child were not brought back. u.s. officials said the plane did land in el salvador but the mother and her daughter never got off and were immediately flown back here into deportation to wait for the judge to rule on whether they can seek asylum or not. the aclu says it must have been terrifying for them to think they were going back to the country where they raised credible claims that they could be killed. hoda, craig? >> pete williams. pete, thank you. new questions are being raised about the raid on that desert compound in new mexico where children were allegedly being taught how to commit school shootings and why authorities didn't act sooner. we are also hearing from the suspect's father, a controversial leader of a new york mosque. for the first time, nbc's gadi schwartz has the latest on that. gadi, good morning. >> good morning, craig. this is the innermost part of the compound. you can see we're four feet underground here and this is where the family dug out the

desert floor and put this rv. the conditions inside the rv are horrendous. this is where a family of 17 people were living, including small children and even babies. a disturbing mix of trash, ruined toys and the evidence of a lethal arsenal. human remains were also found here. authorities still have not confirmed whether the body is that of a missing three-year-old boy, but after last friday's raid, guns, ammunition and other potential pieces of evidence were left behind. >> found two gopros, a video camera, laptop, there were two phones sitting in that truck. like cell phones. >> reporter: you found evidence. >> and found his passport, siraj's passport that had shown he'd been to saudi arabia. >> reporter: property owner jason badger says that's not all investigators missed. >> they dug this tunnel out. >> reporter: he says law enforce. should have acted months ago when he and his wife first alerted them that a three-year-old child, abdul-ghani wahhaj, was there.

the boy allegedly kidnapped from georgia by his father. >> a innocent child sick here in pain suffering. >> reporter: the fbi, which has been surveilling the compound, isn't commenting but the father of one suspect is speaking out. imam siraj wahhaj, a controversial leader of that brooklyn mosque, says he's been meeting with police ever since his grandson's abduction. >> we've been meeting with law enforcement since day one. >> reporter: imam says when he heard the group was asking for food he passed that information to authorities. >> i said find out where we should send the food. she did and we gave it to the police. that's why the police came in. >> reporter: police called the suspects who were arrested and charged with child abuse muslim extremists and in court filings, prosecutors sayest there one of the children had been trained to shoot assault weapons in preparation for school shootings. the father of the other male suspect, lucas morton, says he doesn't believe the accusations.

>> that's not his character. propaganda and lies. propaganda and lies that people put on muslims. >> reporter: one of the big questions, why did investigators leave so much stuff behind here? there's a briefcase, a knife, a radio scanner, a lock picking kit. investigators tell us they were constrained in what they could take by the search warrants. those five suspects are due back in court on monday. now to an emotional apology from a san francisco area police chief after his own son was arrested in the beating of a 71-year-old sic mkh man. jacob soboroff has that story. >> this is unbelievable. new video released shows the shocking incident. it was caught on camera and it's very disturbing. two men attacking a sikh man wearing a turban. the father of one of those suspects is actually a local police chief saying his family's

been shaken to the core by his son's arrest. this morning a community and family are reeling from this brutal attack, some calling it a hate crime. police say sahib singh was walking in california when two people in hoodies approach him. the man, who doesn't speak engl the attackers confront him and began kicking him in the chest, knocking him to the ground. he attempts to defend himself. when one of the attackers kicks him again. the attacker kicks him several more times, finally spitting on him before leaving. on wednesday, police arrested 18-year-old tyrone mcalester and another 16-year-old charging them with attempted robbery, elder abuse, and assault with a deadly weapon. nearby union city police chief daryl mcalester says he and his wife worked with local investigators helping to track down one of the suspects who

turned out to be their own son. mcalester posting an emotional letter to the department's facebook page writing "my stomach has been churching from the moment i learned this news." he says "words can barely describe how embarrassed, dejected and hurt my wife, daughters, and i feel right now. violence and hate said are red we've taught our children. intolerance for others is not in our vocabulary." >> we don't feel safe when we go to work that oir parents and kids will be safe. >> reporter: mcalester says his son began running away and they hadn't seen him for months. "despite having the desire any parent would have in wanting to protect their child, my oath is and always will be to the law and my vow of integrity guides
