blocked right now. back to you. >> thanks. 4:32. happening today, the man facing charges for killing a chp officer and another driver in a crash last week will be arraigned in court. officers say there's evidence that 36-year-old sean walker was distracted behind the wheel when he slammed into the officer and the driver. >> it was a combination of reckless driving and distracted driving that took the lives of ofcer g coming from chp captain 36-year-old shaun matthew walker is now under arrestts o felony and one count of reckless driving. >> we have evidence that he was distracted by his phone at the time of the collision. >> driving at an excessive speed on the freeway while he was on his phone. and then he caused this accident

and caused the deaths of both of these two innocent individuals. >> authorities say walker was driving well over the speed limit when his truck slammed into officer kirk grist and driver jamie manuel who were on the shoulder of westbound i-80 last friday in fairfield. >> we want the message to be sent that your actions have consequences. >> the chp has numbers backing up that statement. in 2015, 14 people were killed on california highways because of distracted driving involving c in the two years following, there was a steady increase. last xtg or talkin preventable. >> today in the bay. >> happening today, the care of migrant children takes center stage on capitol hill. senators holding a hearing on that issue. it comes after senate investigators found the government isn't checking up on migrant kids after their release from custody. number of minors separated from their families has increased

under the trump administration. >> a live look at genoa, italy, the site of this week's deadly bridge collapse. italian authorities say as many as 20 people are still missing. 39 people are confirmed dead. italy declared a state of emergency following tuesday's collapse. the rescue teams remain hopeful there are still survivors trapped in the rubble. one woman said she was below that bridge nearby in her car when that bridge collapsed i si. a lot of steel. >> investigators are now looking closer at the bridge design and maintenance records. they're also hoping to get accounts from the 16 people who were on thatdgsurvived that dis plrbing development to a mystery in colorado. what happened to two kids and their pregnant mother? police say overnight, her husband confessed to killing them all. this is the watts family.

late last night, police arrested the man in this picture, chis watts. until now, this was a missing persons case. this is the scene outside the family's home when police made the arrest. yesterday, chris watts gave an interview. here's what he told reporters. >> knowing if they could be in trouble, it's earth shattering. i don't feel like this is even real. it's like a nightmare i can't wake up from. >> overnight, police formally charged him. you'll likely hear more about the story throughout the day. it's makingio time at about 7:30 a.m. >> 4:35 right now. a new twist in the ghostship warehouse fire. attorney for max harris, one of the defendants, plans on filing a motion co-defendant derrick almena. last friday, the judge in the case rejected a plea deal for the two men. the judge said almena wasn't remorseful enough. he would have received a nine-yeel jail sentence while harris got six years.

harris' attorney said the judge's decision told him the case should be dealt with separately. >> federal agents in sacramento arresting a man suspected of being a member of isis. omar amine is accused of killing an iraqi police officer back in 2014. as part of an attack. federal investigators spent several hours searching his apartment and cars gathering evidence. according to court documents, he has been a member of al qaeda and isis since 4:36 right now. pushing for customers to get the flu vaccination. what free item they're offering you if you get the shot. >> plus, if you're thinking california's ocean waters you'r. what sophists are saying about the increasing temperatures of the ocean.

good morning. i'm contessa brewer at cnbc global headquarters. here are today's top business headlines. wall street is set to open higher this morning. dow futures up 232 points thanks in part to walmart, which just reported much better than expected earnings on the strongest sales growth for the retailer in ten years. stocks were dragged down by a decline in tech shares. today, we're watching for reports on new filings for unemployment and housing starts. the dow closed down 137 points. the nasdaq fell 96 to 7774.

t-mobile is offering new perks to its wireless customers. it will give one free year of pandora plus to existing customers who sign up this month through its t-mobile tuesdays app. it's the ad free music streaming service that normally costs $4.99 a month. they can also get access to special s promotions at concerts and events run by live nation. rite-aid is offering a rather sweet incentive to get people in for flu shots. the drugstore chain is offering free scoops of ice cream with every shot throughout the entire flu season. shots are covered by most insurance plans, already available at the more than 2500 rite aid stores across the country during pharmacy hours. a little ice cream never hurt anybody. >> makes a shot sweeter. >> unless you're lactose intolerant. >> great. bring us down. rather graphic this morning. >> thanks, contessa. >> southern california's ocean

waters are getting warmer. in fact, last week, scientists in san diego recorded sea surface temperatures at 81.3. that's one of the highest temperatures ever recorded in california since officials started recording that back in 1916. an unusual weather pressure system is settling over southern california. the bay area has been chilly this summer, getting as low as 50 degrees. >> kids trying to hang on to the end of summer by heading to the beach. today a good one? >> it will be as we head into the afternoon. right now, we're still in the 50s. 57 degrees in san francisco, and we are expecting toe areas of fog, but i am tracking that warmup. i'll have all the details coming up. tracking a delay for b.a.r.t. in the east bay. may be a new one out of san francisco. we're tracking that update as well as an issue getting to the

richmond-san rafael bridge. we'll show you the problem getting there.

jose thinking what day is it. 4:45, as you take a live look at san jose as you get started with this friday eve. >> crazy new video to show you this morning. a yacht comes dangerously close to waterspouts. this is off the italian coast. a waterspout there.

down below, you see the yacht. it seemingly looks like it's crossing right in front of it. the waterspout split into two even as the boat got close to the whirlwind. the man who shot the video said the spout lasted a few minutes before eventually dissolving th. >> they were tryin >> oh. >> many crew members on the yacht to do that. >> super fascinating, but we know how quickly mother nature can become dangerous and powerful. >> absolutely. >> now, we're not tracking anything powerful in terms of any major storms but we are tracking a warmup, and i think that might be enough to change your plans this week in a good way. 57 degrees right now in san francisco. we've got a light breeze at 10 miles per hour. it's not too cold out there, but it is on the side of cool. however, it's going to be fairly fast warmup. 63 right now in san jose.

wind speeds at 8 miles per hour. we're expecting to keep a little cloud cover through the morning hours, even through the inland areas. tri-valley at 60 now. check out the humidity, nice recovery, about 83%. a little cloud cover out there as well. let's take a quick check of the 24-hour temperature change. no major changes for the start of your day, which means it's been very similar to what we have kind of seen all week long. half moon bay, about 2 degrees cooler. but into the o w expect? definitely warmer temperatures. cupertino, 79. it's going to be warmer but not extremely hot. it will still be bearable. san jose, 82 degrees. as we head out towards the east bay, concord and pittsburg in the antioch area still expected to climb into the 90s. keep that in mind. in oakland, 72 degrees. along the peninsula, temperatures in the upper 70s. 78 degrees for redwood city. daly city in the 60s. in the city, 66 for the

embarcadero, and check out the north bay. 82 for santa rosa. ukiah still climbing into the 90s. our noticeable warmup will start today and get even warmer as we head to the mid the work week. let's look at the next seven days. as we head into friday, just before the start of the for san francisco. event, which don't forget, you but check out ay our big clear the shelters can adopt a pup at a reduced fee or free depending on the location. check out the temperatures. 70 deee like mother tu pick your new pup or kitty on a walk. monday, 67, and i do want to show you these inland temperatures because this is where we'll start to notice that warmup. by friday, by tomorrow, 95 degrees. by saturday, we'll be kind of playing around with the idea of a return of triple digit heat, but not quite. we'll top out into the upper 90s. on saturday, 98 degrees. by sunday, we'll kind of start to see a decrease in the temperatures to much more comfortable weather. by monday, tuesday, and

wednesday, our temperatures drop back down into the low 90s. but not before seeing another warmup by next weekend. but for now, let's get a check of tra prcouplems. that's what we have. not just one but two areas where we're having delaysrted. the uone out of san francisco heading to the east bay. reports of a ten-minute delay. obther delay in the east bdelay there because of a problem on the track that may be near the maintenance yard. that could be a bigger problem. tracking that, still unable to get more specifics from the b.a.r.t. trouble line, but we're looking at the rest of the systems and they're moving nicely. roadways are clear. you can take to the roads if that's what you have to do. a smooth drive. it's bayfair, hayward down at the bottom. no delay. getting to the richmond-san rafael bridge, there's one issue after the split around central. reports of a crash there. now, it sounds like the majority tof richmond-san rafael bridge, but

we'll track that. thanks. visitors at san francisco's brand-new transbay transit center something very familiar. the city escalators out of order. someone shared a media. this was on tuesday. there of the brockel escalators it reminded many of the people at b.a.r.t. stations. but officials say that the transit center escalator was not broken. it was actually taken off line during nonpeak hours for fine tuning and was back up and running again in the evening commute. >> perhaps some relief for residents of a new development in hunter's point naval ship yard. they said the most recent tests show no evidence of harmful radioactive residue around completed units or those now being built. according to the chronicle, state leaders reported only slightlyium 40. critics including those who live there, say the tests are te.

airlines flight out of los angeles are sitting on the runway under quarantine. mike huckabee is on the plane, he's been tweeting about what happened. he said someone onboard the red-eye flight became sick. he said, quote, one hour after landing, got to far away gate where american air will hopefully get us off this plane. medical personnel at the gate. hope it's not because i got that straw in california. attempting to be humorous about it. we'll make sure it's not a serious situation. nbc news working on the story to find out what happened. we'll bring you updates as the story is unfolding this morning. >> right now, nbc bay area responds to a san jose family being bugged by debt collectors even though they say they never got a bill to pay. >> chris chmura is here to explain how we helped. >> good morning. back in july of 2016, darlene becker's daughter badly sprained her ankle. they went to urgent care and left with an orthopedic boot to

help her heal. darlene said she never got a bill in 2016 or 2017, so she assumed her insurance company had paid for everything. fast forward to this past april. darlene received this -- a collection notice for the orthopedic boot. the debt collector wanted more than $300, too. she contacted her insurance company. it said it would have paid the bill, but never got one either, and it was now too late to file a claim. so darlene turned to us. we contacted djo global. that's the medical supply company that sent the bill to collections. djo didn't respond to us, but darlene says an executive reached out to her and within a couple weeks she was told she did not have to pay that djo remove the from her credit report. that is critical. any time you win a dispute with a debt collector, you need to be sure they pull the red flag from your credit history and ideally
