guthrie and hoda kotb. and welcome to "today." thank you for joining us on this tuesday morning. some people may be waking up a little tired. they caught the vmas and caught jennifer lopez. >> some people might be thinking i've got to see that we have you covered. more on that. >> we certainly will. but we begin this morning with an explosive new claim surrounding murders of a colorado family. the man who police say killed his young wife and daughters now telling investigators his wife actually took the lives of their children. nbc national correspondent miguel almaguer has the latest. hey, miguel, good morning. >> hoda, good morning. the suspect is set to be in court later this morning. in new court documents police say he has confessed to one murder but not all three. it's the first time we're hearing his story.

but a story police just don't buy. just hours from now chris watts will face a judge to be arraigned for the murders of his pregnant wife and two little girls. in a newly released affidavit, we're now hearing his version of what he claims happened. according to police, watts said after his wife arrived home in the middle of the night, he told her he wanted to go through with a separation, and they were both upset and crying. >> i want her back so bad. i want those kids back so bad. >> reporter: the next day he told the world his family was missing. then, a stunning confession to police. watts changing his story. he said after talking to his wife about splitting up, he saw her on their baby monitor actively strangling celeste, their 3-year-old and the 4-year-old bella was sprawled out on her bed and blue. watts said he went into a rage and ultimately strangled shanann to death claiming his pregnant wife killed their children so he

killed her but the d.a. doesn't buy it. >> we endeavor to do a complete thorough investigation on every case. >> reporter: after the murders watts said he loaded the bodies into his truck and dumped them at this oilfield where he worked, later leading investigators there. celeste and bella, found in a well filled with oil. his wife nearby in a shallow grave. >> keep the prayers coming for our family. >> reporter: in the affidavit, authorities say they also found watts was having an affair with a co-worker, which he denied. >> he's the best thing that has ever happened to me. >> reporter: jeremy and jennifer lindstrom with chris, bella and celeste hours before the murders. he's now listed as a potential witness in the case. >> there's no way i would have thought this was the outcome. >> they were just here. they were just playing. they didn't know, and they didn't deserve it.

i'm glad they got to have a fun day. >> reporter: a husband, police say, who killed his wife and daughters, then blamed their mother for their murders. >> that's such a horrifying story. we know that watts is charged with multiple counts of murder but tell us about the punishment he may be facing. >> hoda, colorado has the death penalty. when the d.a. was asked yesterday about that, he said he would take his time to make that decision. so no answer just yet. >> miguel almaguer. miguel, thanks. breaking news overnight, demonstrators at the university of north carolina tore down a confederate monument that stood on campus for more than 100 years. craig is following that story for us this morning. >> good morning, ladies. today is the first day of class at unc chapel hill. last night, hundreds of protesters started the school year by gathering around the controversial silent sam statue demanding change, then they knocked it over.

this morning, a 105-year-old confederate statue at the university of north carolina no longer stands. wild cheers erupting last night as the monument known as silent sam hit the ground. protesters kicking the statue's head and some covering it with dirt. earlier hundreds of students gathered chanting for its removal. protesters working under banners which read, "for a world without white supremacy" attached ropes. to pull down the statue. the university tweeting, last night's actions were unlawful and dangerous. we're lucky no one was injured. the governor understands that many people are frustrated by the pace of change and he shares their frustration. but violent destruction of

public property has no place in our communities. a statue to honor students who served as confederate soldiers has long been a point of contention. unc spent thousands of dollars on security for the statue last year. this latest incident comes as the national debate over confederate monuments took center stage last year after the unite the right rally in virginia left one person dead. the number of confederate statues around the country, nearly 700 still standing, erected long after the civil war, mostly between 1890 and 1920. back in north carolina, as authorities and administrators ask for calm, long controversial silent sam gone. now silenced by protesters. one person was arrested during that protest, charged with resisting arrest and concealing his face during a public rally. and while the movement to take down the statues and monuments

around the country really began in earnest after charlottesville, you can really trace it back to 2015 after the crazed gunman opened fire in the basement of the church in charleston and governor haley taking down the confederate battle flag. the debate goes on offer what to do. >> thank you, craig. meantime, in a new interview overnight, president trump is voicing concerns about a potential interview with special counsel robert mueller. our white house team has it all covered beginning with nbc's kristen welker. good morning. >> hey, hoda, good morning to you. in a new interview the president is escalating his attacks against special counsel robert mueller again, this time with a stunning claim that he could take charge of the russia investigation if he wanted to. this morning, president trump unleashing a new message to special counsel robert mueller asserting as president he is totally allowed to be involved in the investigation and suggesting he could take charge of it if he wanted to, telling reuters in an interview overnight, i can go in and i could do whatever. i could run it if i want but i

decided to stay out. when asked if he will sit for an interview with mueller, the president indicating he's leaning against it saying he's concerned about what he calls a perjury trap, something rudy giuliani has been pushing for days and echoed overnight. >> in situations like this, the truth is relative. >> reporter: at issue, whether he'll believe the president. fired fbi director comey and critical conversations they have, so mueller might say, well, i believe comey. and even if i'm telling the truth, that makes me a liar. that's no good. all of it comes amid revelations white house counsel don mcgahn has provided 30 hours of testimony to the special counsel. on monday, mcgahn on capitol hill ignoring questions. >> why did you speak so long to the special counsel, mr. mcgahn? >> reporter: according to the

"washington post," he e-mailed the trump legal team to ensure them mcgahn did not incriminate the president. mcgahn would have resigned if he thought he would have witnessed a crime. giuliani insisting he's not concerned. >> he's a very ethical guy, very careful guy. >> reporter: for his part giuliani also trying to clarify this comment to chuck todd. >> when you tell me he should testify because he's going to tell the truth and he shouldn't worry, that's so silly. it's somebody's version of the truth, not the truth. he didn't have a conversation about -- >> truth is truth. >> no, it isn't truth. truth isn't truth. >> reporter: giuliani telling fox news. >> it's like the tree falling in the forest, did anybody hear it? how do we know what the truth is? >> reporter: and also in that interview the president again neglected to blame russia for interference in the election despite the conclusion by the intelligence community, saying mueller's investigation played right into russia's hands.

we may hear more about all of this when the president rallies in west virginia, hoda and savannah. in addition to all that, there's more breaking news overpass about more russian hacking. what can you tell us? >> that's right, hoda. microsoft saying in recent weeks it has uncovered six fake websites meant to look like some conservative public policy sites. the phony sites were intended to trick you for people who clicked on them and then in effect your computer with viruses. they were created by a hacking group linked with the russian government which the u.s. government believes interfered with the 2016 election. microsoft got a court order to shut down the websites and said so far there's no evidence the sites were used to launch attacks. still, it's an indication russian hackers remain committed to interfering with elections here with midterms fast approaching. >> kristen, thanks. in the meantime, supreme court nominee brett kavanaugh

facing questions after a new released memo revealed questions he thought prosecutors should ask then-president clinton 20 years ago during starr investigation. hallie jackson is on that story. >> good morning. he hasn't said anything recently but may be asked about it during his meetings on capitol hill. in this two-page document he advocated strongly to a tough approach to questions to bill clinton. i'm told now that kavanaugh stands by that overall approach of holding the president accountable. the president's pick to sit on the supreme court. >> you wanted very graphic questions asked of him,, is that appropriate? >> reporter: simply smiling after being asked about a memo just released packed with explicit questions for then president bill clinton. brett kavanaugh was an attorney working for kenneth starr investigating clinton's affair with monica lewinsky. kavanaugh wanted the team to

take an aggressive approach. he wrote, i am strongly opposed to giving the president any break in the questioning unless he either resigns or perjury. the president has disgraced his office, the legal system and the american people by having sex with a 22-year-old intern and turning her life into a shambles. kavanaugh lays out a list of graphic questions he think clinton should be asked. if monica lewinsky said you inserted a cigar into her while she was in the oval office area, would she be lying? if monica lewinsky said you had phone sex with her on approximately 15 occasions, would she be lying? >> i'm troubled by some of the things that have been reported about his role in the starr investigation and materials he pressed for inclusion in the final report. >> reporter: an official tells nbc news, while kavanaugh given years of hindsight might change some of the words he used in that memo, he stands by the overall approach for holding a president accountable for

inappropriate conduct. quote, among all the weighty issues to be discussed at the hearings, we doubt that this is very high on the list. kavanaugh's position on sitting presidents seems to have evolved over the years. in 2009, he wrote that lawsuits or investigations take the president's attention way from the people. >> ken starr is, in fact, a hero. >> reporter: kavanaugh has longtime links to starr, author of the controversial starr report and praising starr at an appreciation dinner in 1989. >> maybe i'm an optimist. one day i hope for myself to be able to call him, mr. justice starr. >> hallie, what else can you tell us about kavanaugh and what we should be watching? >> well, big day today for him, savannah, particularly a big morning. he's going to have what may be the most important meeting of this whole confirmation process

so far, the one with senator susan collins of maine. she's a pivotal swing vote in this confirmation. it seems like everybody on both sides of this understands the stakes here. an official familiar with this process says that the entire part of it has been designed partly to appeal to collins to try to show kavanaugh is a qualified judge and not a partisan figure. we asked senator collins about that. she said that is certainly part of what she wants to see. she's also looking for somebody who respects judicial precedent. bottom line, a lot of eyes will be watching that face to face later on today. >> a biggie. thank you. >> much more to get to including investigation into a rare and deadly alligator attack in south carolina. the victim, a woman who was walking her dog at the time. here is nbc's kerry sanders. >> reporter: it was a routine walk that took an unthinkable turn. authorities in hilton head, south carolina, say 45-year-old cassandra klein was walking her dog as she often did along the edge of a lagoon in her neighborhood.

monday morning, an alligator lurking at the edge attacked dragging cassandra to her death. >> it appeared that the alligator was after the dog. in an attempt to free her dog from the alligator, the deceased was basically pulled into the water by the alligator. >> reporter: an autopsy will now be performed to confirm the cause of death. the nine-foot-long alligator was later captured and killed. >> i cannot make any sense of what's happened, none at all. none at all. because she would never go near an alligator. she would never irritate an alligator. >> reporter: cassandra's mother in shock. >> i just keep thinking about her being dragged away by that. i just -- i just can't imagine it. >> reporter: experts say this time of year, alligators are nesting which can make them more aggressive. is there something here that set this off? >> circumstances of watching a

small animal, a small child along freshwater for alligator has recipe for disaster. >> reporter: alligator attacks are uncommon but not unheard of. cassandra's death comes just two months after a nearly identical incident involving a woman and her dogs in davie, florida. cassandra, who's known as sassy to family and friends, was someone who would do anything for anyone. >> she was a wonderful person. she was an all-day kindergarten teacher and she's been one for many years. she loves her students. >> reporter: her death only the second as a result of a gator attack in south carolina's history. >> very rare occurrence and one we hope that we will not witness again. >> reporter: for "today," kerry sanders, nbc news, miami. >> i was just there in hilton head two weeks ago about two miles from where that attack happened. they have signs up everywhere. we were playing golf. we saw signs on the golf course, do not feed alligators. a cousin of mine commented,

alligators in south carolina? lo and behold. >> just imagine walking your dog. >> terrible story. we want to switch gears and say good morning and a belated happy birthday to al. >> thank you very much. thanks so much. well, it wasn't a happy day for all these folks in madison, wisconsin. some areas picking up five inches of rain or more. turn around, don't drowned. you don't want to go into the water because you don't know how deep it will be. we do have a risk of strong storms, stretching from western pennsylvania, new york, all the way to the virginias. 16 million people at risk as this system pushes to the east. we're looking at storms developing during the day today. a severe threat into the evening. as those storms shift to the east coast later tomorrow an isolated risk for flash flooding. the ground is so saturated right now it doesn't take much. we could see rainfall 1 to 1 1/2" per hour. western new york to the virginias, a risk of rain.

headlines. breaking news son unkormd reports by nbc news that missing university of iowa student mollie tibbetts has been found dead. she hasn't been seen or heard from since july 18th when she went for an evening run in her hometown of brooklyn, iowa. she was reported missing the next morning when she did not show up at work. a press conference on this case is scheduled for a bit later today. 95-year-old nazi concentration camp guard has been deported to germany 14 years after a judge ordered his expulsion. the white house says the deportation was carried out early this morning. after world war ii, pauley hid his involvement in the concentration camp in poland, gained entry to the u.s. claiming he was a farmer and factory worker, though the judge did order his deportation in 2004, he did continue to live in new york city because no other country would accept him. his fate in germany is unclear. an attempt on monday to save a historic post office building

of sexual assault against asia argento surfaced the attorney for harvey weinstein released a withering statement. the news reveals stunning hypocrisy. supporters of #metoo wondering what effect this will have. harvey weinstein's attorney wasted little time responding to the news, taking aim at asia argento. >> in 1997 i was raped by harvey weinstein here at cannes. >> reporter: now facing her own sexual assault allegations. weinstein attorney saying in part, the sheer duplicity of her conduct is quite extraordinary and should demonstrate to everyone how poorly the allegations against mr. weinstein were actually vetted. according to "the new york times" actor jimmy bennett said he was 17 when argento had sex with him in a california hotel room in 2013, an encounter that according to a notice of intent to sue, quote, threatened his mental health. the l.a. county sheriff's department says it is considering opening a criminal

investigation. the legal age of consent in california is 18. the "times" reports that argento paid bennett nearly $400,000, a negotiation that the paper said her then-boyfriend anthony bourdain helped navigate. bourdain tragically took his own life last june amid tabloid reports their relationship was troubled. >> this is difficult i think for people in bourdain's circle to realize how much he knew about this and helped her navigate it. >> reporter: bourdain's attorney did not respond to our request for comment. the news shook the foundation of the #metoo movement. argento has been one of the most public weinstein accusers alongside rose mcgowan who tweeted, i got to know asia argento ten months ago. our commonality is the shared pain being assaulted by harvey weinstein. my heart is broken. i will continue my work on behalf of victims everywhere. weinstein accuser sarah massey writes, nothing has changed.

progress to letting their kids be more independent. >> don't get all up in their grill. >> exactly. parents of -- people who say they are happier, they keep a really nice perspective. a lot of the things we see as threats to our kids are not threats. not making a soccer team is not a threat. losing your best friend, it's awful, it sucks but it's not a threat. so they keep a good, healthy perspective on things, an adult perspective. that's important for keeping your kids on track. also, happier parents they keep an adult life. >> what do you mean? >> craig is like what's that? >> what's that? >> they don't put their kids every day needs above their own. well, i was going to meet my friend for coffee, now you have a science project so we have to buckle down. no, that's their science project. >> that's my achilles heel right there. >> it's tough. we love them. they are demanding and we want to work with them.

but the last thing that happier parents really do is they take time to absorb the good moments, to really look around and go, you know, we wanted this. we wanted these kids. >> yes. >> we wanted this time. they may be laying on the floor howling because math is too hard, never happens at our house, but you're just going, you know, it's okay. >> revel in the chaos. >> absolutely. >> it's not chaos, it's joy depending on your perspective. speaking of chaos, mornings. mornings are a big challenge for a lot of families especially with older kids, getting them off to school, brush your teeth, you feel like it's a never ending nagging cycle. >> the thing about mornings, it feels like everything is at stake. everybody has to be somewhere earlier than anybody wants to be. you have to get violin, gym clothes. >> brush the teeth. >> you know what, there's really basically nothing at stake other than maybe you need to clock in

when you need to clock in. if your kid doesn't brush their teeth one day or more relevantly, doesn't bring their gym clothes, they aren't going to enjoy the consequence bsut in the grand scheme of things it's not a big deal. mornings are a great time to let your kids take the lead and not worry about things. >> let the chips fall where they may. >> i want to go back to something you said a moment ago regarding homework. that's something a lot of parents are dealing with especially at the start of a new school year. you say there are two things we can all be doing that makes that part a little easier. >> the things about homework, up can help your kids to figure out their own perspective on homework. it's their homework. they feel like they own it. also you can take a step back and accept that your self. so change your perspective on homework. every teacher and principal i talked to wanted parents to know when we take over the homework or the getting the homework to
