tweeting this video showing images of the google home page supposedly taken during the obama years. then in 2017 and 2018 without mention of president trump's speeches, donald trump including the hashtag stop the bias, the only problem, google says its not true. they did promote the president's 2018 address. on january 30th, 2018, we highlighted the live stream of president trump's state of the union on the google.com home page. we have historically not promoted the first address to congress by a new president, which is technically not a state of the union address. as a result we didn't include a promotion on google.com for this address in either 2009 or 2017. the president's former adviser steve bannon weighing in overnight bashing the executives of facebook, twitter and google calling them socioyoe paths, quote these people are complete narcissists, they ought to be controlled and regulated bannon said to a cnn reporter. these people are evil.

there is no doubt about that. this war of words coming just days after the president who built his base on social media started attacking it. >> i think that google and facebook and twitter, i think they treat conservatives and republicans very unfairly. you know what we want? not regulation, we want fairness. >> reporter: the president claims google search results for trump news shows only the viewing reporting of fake news media as he tweeted earlier this week adding google and others are controlling what we can and cannot see. there's no reliable data to back up the president's claim. tech journalist kara swisher casting doubt on all of it this morning, writing, rather than attacking techie he should send them a gold embossed thank you note. those who complain loudest about being silenced never ever shut-up. >> so while the president takes on tech, there's also this controversy that's surrounding this senate race down in florida, what's happening there?

>> reporter: yeah, the race for governor we talked about just yesterday, craig, on this show so today the race is only in day two but there's an uproar after what was an up-seton both sides of the aisle. you had ron detan sis winning his primary. that means he's now going up the progressive mayor of tallahassee, the first african-american for governor in florida history and the guy who shocked the establishment with his surprise win. so here is what desantis said, watch. >> he is an articulate spokesman for those far left views and the last thing we need to do is to monkey this up by trying to embrace a socialist agenda. >> reporter: the florida democrats describe those comments as disgusting as racist dog whistles. they insist the candidate was obviously talking about florida, not making the wrong decision to embrace the socialist policies that andrew gillum espouses.

to characterize it as anything else is absurd. gillum says florida is better than this. >> thank you. also this morning a former texas police officer has now been sentenced, 15 years in prison for the fatal shooting of an unarmed black teenager. convicted tuesday in the 2017 death of 15-year-old jordan edwards. the teen was in a passenger seat of a car leaving a party when the officer opened fire. the officer claim the car was moving toward his partner. oliver's half sister testified against him on wednesday confirming that she sent his mother a facebook message saying, quote, i hope he gets what he deserves because he took an innocent life. now to a stunning new twist in that disturbing case of alleged child abuse at a desert compound in new mexico. prosecutors said the kids were being trained to kill there so why were most of the charges suddenly dropped? gowdi schwartz has followed the investigation from the start. he joins us from the screen this

morning. what's happening? >> reporter: good morning, craig. shocking to say the least, three of those five defendants have been released from jail. they're charges dropped because the prosecution blew an important deadline even though the sheriff himself asked prosecutors about that deadline three days before it lapsed. this as we're now hearing more details about an alleged terror plot. >> it is disturb to go me that the district attorney would put this court in that kind of a situation. >> reporter: seeming at times irritated, the judge said he had no choice but to free three of the five defendants after prosecutors failed to hold a preliminary hearing within ten days. >> i must dismiss these charges. >> reporter: the court noting the district attorney's office could have requested an extension for extraordinary circumstances but didn't. prosecutors can refile charges against the three who were released.

suspects remain in custody on charges of child abuse leading to the death of a 3-year-old. his body discovered after the raid in this underground tunnel. the couple denied him medical treatment and medication. the failure to provide medical treatment and/or prescribed medications called ag's death. the body was returned to georgia where the boy's mother lives. meanwhile authorities have revealed some of the evidence found at the compound. a journal they say was written by jamie lavel describing phases of a terror attack. including to prosecutors, interviews with some of the children that they intended to corrupt institutions or individuals such as the military, big business, teachers, school and reveal the truth. they were to shoot or attack the nonbeliever. there have been some questions and criticism about law enforcements handling of the case. overnight the sheriff releasing a statement on facebook saying

in part, i will defend that tcso stepped up to put the search warrant together lawfully and correctly. why weapons and other potential evidence were left behind and why authorities later destroyed much of the compound. the sheriff saying the compound land is in evidence that everything there was collected, photographed and documented properly. the other 11 children are still in foster care. the three defendants who are now free are expected to stay in the couldn't. >> the conditions as far as remaining in the county that as long as that criminal trespass case is pending and will do what we can to try to make that case go away as soon as possible. >> i think the question on everyone's mind this morning, is how could this possibly have happened? how could the prosecutors seemed to have dropped the ball in such a way? >> reporter: that is a big question, craig, and here in new mexico a lot of people are saying, this is incompetence. you saw afterall this happened

how we were allowed to go to that compound and look around with the property owner's permission while we were there we saw many journals that sound very similar to what prosecutors are now saying there was an alleged terror plot inside, those were laying around, those were uncollected and many of them still might be out there, the district attorney last night responded to a text saying that there is a chance that me might file new charges against those three suspects or possibly take this all to a grand jury. guys? >> thank you. >> you wonder where the federal authorities are in suspected terrorism case. shocking incident in florida to tell you about, an uber driver shooting another man dead in a heated confrontation and it was captured on the uber driver's dash cam. police are saying this is a clear case of stand your ground. gabe gutierrez has more on the investigation, gabe, good morning. >> reporter: this is the bar where it all started.

investigators say a man and his girlfriend got into an argument, he thought that she left in an uber, turned out she hadn't but he chased the car any way. the confrontation turned deadly. this morning a family is grieving after the shocking footage was released from the dash cam of an uber in florida. a pickup truck blocks the uber car. the driver gets out and starts shouting. instead -- the uber driver robert west lleg shoots the man then calls 9-1-1. >> i couldn't get away. he came towards me, shouted he's got a pistol. >> reporter: turns out the sheriff's says they found no weapon on the truck driver. >> he dropped a cell phone. i kicked it away. i didn't realize it was a cell phone at first. >> reporter: he did compressions until the ambulance arrived. >> i was applying pressure to the wound.

he was faintly breathing. >> reporter: but he did not survive. he had an extensive criminal record and tailed this uber because he thought his girlfriend was in the car. authorities say she was still at this bar where the two had been arguing but she had helped another woman get in that uber, in a series of heated text message investigators say he threatened to beat the expletive out of the uber driver. the sheriff says the shooting was justified. >> this is a classic stand your ground case. >> reporter: but the family disagrees, telling nbc news they're angry of the sheriff's handling of the case saying the uber driver had plenty of time to leave the scene, still in stand your ground cases there's no duty to retreat. the sheriff's office says west l westleg had a conceal carr/carr permit. he wishes the whole thing never goes out. no one goes out looking to use their firearm. they have it in case they need to use it to protect themselves

schools with higher than acceptable copper or led in their tap water. also this morning, could the rules an how universities handle sexual assault and harassment cases be about to change and give rights to the accused? kate snow is following that for us this morning. good morning. >> reporter: good morning. proposed rules by education secretary betsy devos obtained by "the new york times" could strengthen protections for students accused of sexual misconduct and reduce the potential liability of schools. it comes at a time when a number of major universities are dealing with serious abuse allegations. with the new school year comes the possibility of new rules. a report overnight from the new york times revealing education secretary betsy devos is proposing new policies aimed at dealing with sexual misconduct on campus. the rules obtained by the times but not verified by nbc news would reportedly allow schools investigating misconduct to require more proof.

potentially making it more difficult to find accused students guilty. they would also narrow the definition of swarmt, limiting it to the most severe acts. schools would only be held accountable for formal complaints and conduct that happened on campus. in a statement to nbc news, the department of education says we are in the midst of a dlib rative process calling any information in the report premature and speculative. with the growing me too movement, empowering victims of sexual misconduct to step forward, some worry this will push them back into the shadows. >> i think these policies if this is what the regulation turns out to be, will prevent survivors from coming forward. >> reporter: the move is after secretary devos announced plans to overhaul the administration's 2011 guidance for schools saying it failed too many students. devos and others argued the obama era rules stacked the odds against the accused.

and put an unfair burden on schools. >> survivors, victims of a lack of due process and campus administrators have told me the current approach does a disservice to everyone involved. >> reporter: the president of the national coalition for men voiced support for the administration's approach saying we're very hopeful that they're resulting modifications will be fair to everybody. but president obama's education secretary said last night the proposals are a step back ward. >> any attempt by the current administration to roll back protections for those who are victims of sexual assault on campus honestly is a little mind boggling to me. i can't understand it. >> reporter: the possible changes as major universities deal withi explosive scandals. two women told "today" in june their university wasn't doing enough. >> i was more hurt by the way

they treated me. >> reporter: at the time the university responded saying we care deeply about our students and are committed to a safe, secure environment. the school recently outlined new actions its taking to deal with the issue. these proposed rules cover all levels of education from colleges all the way down to elementaril schools where, for example a teacher might be accused of misconduct. there will be a public comment period and the department of education says the proposed rules are still a work in progress. >> the timing is interesting. kids are going back to school. >> it's fall, and if you look at sexual assaults, they rise in the summer and fall. a study in 2007 found more than 50% of assaults happen between august and november. this is the time to be looking at the issue. >> we'll see where it shakes out. kate, thank you. all right. let's get the weather. for that we turn to mr. roker. what's the word, sir? >> well, that cold front that's going to be bringing some relief from the heat and humidity is going to bring a few scattered showers as it moves into the mid atlantic states and the

mississippi river valley. the rainfall amount is going to be light. we have another system coming in from the midwest. and that's going to bring more scattered showers and thunderstorms. but heavier storms late tonight and on into friday night into saturday morning. so some airport delays possible. and we have to watch out from iowa all the way to illinois. a flood risk increasing because we're looking at locally some areas picking up 3 to 4 inches of rain through saturday. this will be one we'll be watching great start in san francisco. look at this live take. now, we've got a couple spots with some cloud cover, but for the most part, san francisco looking really nice. especially with the temperatures expected to climb into the upper 60s through the afternoon. as far as your san jose temperature trend, we'll start to burn off some of the cloud cover by 12:00. temperatures will be at 70 degrees. 1:00, 72. by 2:00, in the mid 70s. eventually climbing into the 80s. and mid 80s for inland areas.

years. we have more with tom. good morning. >> reporter: good morning. so two and a half million people flying every day. it's a record, and as that number grows, the concern is we won't have enough pilots. here's the problem. if you learn to fly in the military, great, it's free. but if you don't learn to fly in the military, it can cost a small fortune to get trained and certified and here's the problem, the starting pay isn't very attractive. the nation's pilots unions say it's a potential crisis in the cockpit. not enough pilots to fly all the planes in the increasingly crowded skies. >> the pilot shortage is here. it is reaching crisis proportions. >> reporter: for passengers it could mean higher fares. the airlines most affected, small carriers. more people are flying than before. nearly 4 million worldwide and

rising fast. at the same time record numbers of baby boomer pilots, almost half the pilots flying today, the reaching the mandatory retirement age of 65. >> we're facing a demand at a time when supply is at an all time low. >> reporter: the major airlines we talked to insisted they're well prepared. >> we're in the largest hiring cycle we've been in in a long time. it's a large turnover but it's not anything we haven't seen before and we can handle. >> reporter: but it's the small regional airlines that are struggling. this is a flight instructor in atlanta. he says he gets solicitations from regionals once or twice a month offering signing bonuses, incentive pay and promises of a bright future. >> there's no deterrent to becoming a pilot other than being able to pay for it. >> reporter: that's the challenge. the cost of training is sky up. up to $80,000. there are no student loans or financial aid packages.

starting salaries at regional salaries less than half. $50,000 versus $113,000. still some student pilots are willing to take the risk. >> if you're a dedicated person who wants to live in the clouds, you should go for it. >> reporter: hoping to eventually land the bigger bucks. >> hey tom, are airlines doing anything to help with the costs of the training for pilots? >> reporter: yes. some of the regionals are offering signing bonuses to help people offset the cost of the training that they personally have incurred. but the big airlines, the big names we all know, they treat the regionals as kind of the farm teams. right? they select the best and the brightest pilots out of those regionals to eventually move on up to the big airlines. >> tom for us there in northern virginia reagan national. tom, thank you. your brother is a pilot? >> he is. but like so many of the pilots that tom talked about, he got his training in the military. if you're trained by the military, you don't pay for it.
