area news starts right now. >> we are on with the primetime newscast because of the notre dame and michigan state game, and while we were watching it you may have felt the earthquake. it provided a volt across a wide section of the eastbound. it was centered north of crocket. >> nbc bay area's tom sinkovitz is there live. tom? >> reporter: fortunately it was not powerful enough to do damage, you guys, but it did give everybody here quite a shake-up this afternoon. it happened at 4:30 this afternoon and people across the east bay did report feeling it, and on social media people were saying it felt like a truck hit their home. that's what people told us when we arrived here as well. it did not last long, five seconds or so but it gave them quite a shock. >> all of a sudden i felt it, so

i hurried and i picked up my dog and i ran out and saw him walking down the street, and i said, hey, that was an earthquake. >> lasted less than five seconds but it felt like the earth shifted and we all almost got knocked off our seats. >> reporter: some of the people said it felt like it was going to be a 5 or 6 magnitude earthquake, but it was a shallow earthquake and those can be some of the most damaging, and those that are closer to the earth's surface is considered shallow, if they are within 40 miles within the surface and it was less than five miles, 8 kilometers. we're live in crocket, tom jensen, nbc bay area news. thank you.

we turn to the weather. air quality concerns ahead of the labor day holiday, and that's a live look right now at san francisco. >> and we have been dealing with these concerns over the air qualities for the past week now. i want to show you this live camera in san francisco, and you can see the fog rolling through. this is going to keep the temperatures cool, and the air quality index came out at 7:00 a.m., and we were all green and now we are still seeing moderate conditions and parts of the north way and even parts of the eastbound, and in through livermore and antioch. what does it mean for your outdoor activities? it means we need to be mindful. the worst of the smoke is expected to be over nevada but if you are somebody that deals with respiratory issues you want to limit your outdoor

began last night at 6:00 p.m. and since then six people have been killed on the roads statewide and chp officers have made 307 dui arrests statewide. it only takes ten to 15 minutes to get through a checkpoint like this one, but most drivers we spoke with tonight say it's a minor inconvenience and they believe it will increase their safety on the road. >> it's needed. there's the holidays and there's traffic and safety comes first, and i think dui checkpoints are a must. >> hopefully they are thinking twice of how much they are going to consume and if they are going to get behind the wheel, call a uber or lyft. >> chp officers are not conducting a checkpoint but are still cracking down on drunk drivers, they issued 95

citations, mostly for speeding and issued 47 citations to distracted drivers who were on their cell phones. last year chp officers arrested more than 2,000 people statewide for dui and there were 30 deaths. that really is the point of tonight's checkpoint when it gets under way between 9:00 and 9:30 tonight, they are trying to reduce those horrible numbers. reporting live, marianne favro, nbc bay area news. >> thank you. that destructive fire in san francisco's richmond district last night is being called accidental. investigators say it was an electrical fire, and one person was seriously hurt and then close to a dozen other people displaced after flames ripped through an apartment near ocean beach. one person jumped from a third-story window to escape serious injuries, and three others were rescued by firefighters. one of the rescued took time to

thank the rescuers. firefighters are helping the woman also get back on her feet. america did its final farewell to arizona senator john mccain in washington. his memorial bringing together family and friends and a adversary. >> lester holt has a look at today's emotional service. >> a somber service inside the national cathedral as mourners gathered to honor the life of john mccain, and his wife cindy fought back tears as those close to him paid tribute to the man they loved. >> i am here before you today saying the words i have never wanted to say, feeling the loss i have never wanted to feel. my father is gone. >> his daughter gave a powerful remembrance.

damage from the company's equipment, and it would only ask the utility to pay what it could as long as it doesn't harm service to critics. th they say it would save rate payers more money than if partly cloudy -- than in pg & e filed bankruptcy. two bay area men are no longer in i.c.e. custody tonight after community groups raised money for their bond. people gathered for a celebration in the east bay facility where they were once held. >> reporter: they chanted, yes you can in spanish, and yes, they did. >> feels great to be with my family again, reunited. it's just something that i

personally did not think was going to be possible. >> the 29-year-old hernandez is one of two bay area men released from i.c.e. detention after community groups raised money for their bonds. the father of four grew up in san jose and he has a clean record but has a possession of marijuana charge that landed him in i.c.e. custody. he says being locked up was hard on his family, but being moved to another state added to his legal troubles. >> all our resources were here. our lawyers were here, and you know, all of our help was here in california. >> new restrictions made working with his lawyer difficult as well, and he was not allowed to use e-mail. >> my attorney was not able to, you know, come and visit me and get a paper signed, he had to send them through the mail and wait until i received them and signed them and sent them back.

>> many that turned out for the homecoming rally proclaim the trump administration is purposely putting up roadblocks for those going through the immigration process. >> bonds are getting higher, and the government judges and officials have been more restrictive and less discretion, so we are seeing this part of a pattern of making it difficult. >> and the other man released, his bond was set at $80,000, which many believe is too high for an immigration violation. i.c.e. was not available for comment, but in a recent e-mail to nbc bay area, they said when i.c.e. is not allowed to work in local jurisdictions, further facilities must be idealized. for his part now that aguilar is out, he says he will keep fighting. >> i will do whatever i have to do to stay here.

cupertino, put a car right into this mcdonald )s. new tonight, an unexpected detour put that car in mcdonald's. it happened just before 10:00. the driver said she mistook the gas for the brake and drove into the restaurant. five people were injured and one taken to the hospital but everybody expected to be okay. students in california middle and high schools will be able to sleep in a little longer thanks to a new bill passed by lawmakers. the bill narrowly passed both chambers yesterday and it

prevents middle and high schools starting before 8:00 a.m. the governor still needs to sign the bill for it to become law. schools would have three years to comply with that new start time. >> bank of america is facing criticism tonight for reportedly freezing accounts for asking about customers' citizenship status. a phd student from iran told the kansas city star that his account was locked after documents he provided as proof of residency were not accepted. federal regulators say citizenship is not required to get a u.s. bank account. all you need is a name, date of birth, address and identification number. bank of america says it asks about citizenship to comply with sanctions against certain countries. we will turn our attention to the weather. we were talking about how mild the summer has been so far.

we had wildfires certainly, but it doesn't feel like it did last year. >> there's a good reason for it. last year on this exact day, september 1st 2017 broke a record of 106 degrees. the previous record daily record before that was 103 set back in the year 2000, so if it felt cool today compared to this time last year that's because it was. today's daily temperature, half of that. that's all in part with the marine layer we woke up with this morning, and it helped to keep our temperatures cool but we warmed back up. we have got our temperatures heating up with a ridge of high

pressure that will kick out the little low hanging around, and keeping us nice and cool during the daytime, and it will warm the temperatures up in the 80s and 90s. no major changes there. we are dealing with the 60s and 70s and still be slow to clear into the mid morning. as far as monday, if i take this all the way through labor day, we have a system that could bring the possibilities of rain chances, but looks like that will stay off to the north. the chances of rain are pretty much nonexistent. current temperatures across the board right now, 62 degrees in palo alto. 61 for hayward. let's check out some of the coastal fog. there was a really cool shot on top of our live cam that i posted on twitter. the fog is really rolling through. half moon bay, and no changes in the temperature, but by tomorrow the conditions are going to get

better in terms of the cloud cover. still sunshine, and hazy conditions, especially for the north bay, and remember that air quality remains moderate for the north bay. as far as overnight lows, we will drop in the 50s and then wake up with more sunshine than we did with our daytime highs tomorrow. and check out, 84 for san jose. over the next seven days we are dealing with 60s and morning cloud cover for san francisco, but where we are going to feel the heat is going to be in the inland areas. >> a nice little taste of the end of summer. >> yeah, a nice and tiny warmup. >> thank you. if you are just joining us we are on late tonight because of the college football game between notre dame and michigan. turning back now to news. our investigative unit was the first to expose a long list of safety problems at a local towing company, and that towing company was responsible for the

crash that killed a san francisco city worker. tonight her father speaks out about what the family is now doing to help protect you. >> a very, very smart girl, and i guess it's hard to explain to a 3-year-old. >> her father, jose, is now raising his granddaughter. >> i told her that her mom went to bed and woke up in heaven. >> her mother died after being pinned in a ditch where she was working when a tow truck driver lost control of a car, the gaping hole left by her loss felt every day. >> just walking in the house,

you know, everything reminds me of her. >> with what you know now, how do you feel about that company? >> i am upset. i am upset at them and why they are still in business and operating. >> reporter: back in july the investigative unit first uncovered that irvine auto towing that also goes by another name was operating without a permit the day she was killed, which is illegal according to the chp. two months earlier state regulators already suspended irvine's permit after finding a string of safety problems, including hiring unlicensed drivers, and towing cars without safety restraints and failing to have insurance. the family has now filed a lawsuit against the towing company and state farm insurance, accusing state farm of negligence for hiring irvine to tow for its customers. >> do you think state farm put public safety at risk by hiring the company?

>> no doubt. there's plenty of tow companies that can do the job safe pea. insurance companies like state farm has access to all kinds of sophisticated data basis, and they can tell you in a minute whether an individual driver has blemishes on their record and they will know if this company had performance problems. >> we reached out to state farm to see if it is aware of irvine's safety record. while we do not comment on pending litigation, state farm does not have any direct relationships with towing providers. >> a company with this kind of history, where they are operating without a license and insurance, should they be shut down? >> yes, they should. >> chp inspected the tow comp y company's officers, and they issued two unsatisfactory ratings for other safety issues. the records show irvine got its

many of us have lost luggage when flying but few of us know the heartbreak of this, an airline losing your dog. that's what happened to a new york family. the dog's name is logan, an emotional support dog for an older couple. logan was supposed to fly from jfk to paraguay on august 27th. according to an airline employee the dog was never loaded on to the flight because of a ramp issue, and a worker took the dog home and now it's reportedly gone missing and now the airline is putting out posters and offering a reward for logan. that's coast guard video, and they are hoisting a woman from the cruise ship. they went into labor when the ship was about 100 miles from shore, and hopefully she will have a safe delivery on land.

>> that was jeff bennett reporting. california is taking net neutrality regulations into its own hands. state lawmakers passed a bill where if it becomes law customers will have equal content on the internet. earlier this year the federal communications commission voted to overturn the protections. if passed the law would be restrictive for internet providers in the united states. the search for a missing woman continues this weekend. they were passing out flyers and searching for the 66-year-old. she vanished after driving to the country time market to buy cigarettes. surveillance video shows her driving east, and license plate readers did not see her car.

re-opened this weekend. normally hundreds of people hurry to the fountains to beat the heat on summer days, and the neighborhood services spent months repairing a broken valve. the fountain will run daily f. m this is obviously a publicity stunt. kentucky fried chicken wants you to name your baby after its founder. the chain promises to donate $11,000 to the first baby born on the colonel's birthday which is september 9th. that first baby to be named harlan, and so if baby harlan is on his way you can submit an application online within 30 days, and it could be a girl,

right? >> i am thinking in terms of my student loans and by the time the baby goes to college, the $11,000 will be one unit in a university. >> don't remind me. if you are going to be outside with your families or puppies, the temperatures are going to be hot. i know you saw the fountains are coming on in downtown san jose and that's great news because we are going to be tracking a slight warmup. you will notice the inland area mostly. we were at 77 degrees in san jose, and right now at about 63 degrees so still a little cooler into the overnight hours. check out this cool shot of san francisco. we have the nice marine layer and we have a low that is keeping our temperatures nice and cool on the coast. we are not going to notice a main difference along san francisco or the bay, and maybe

not even the peninsula, but areas like dublin will feel it. high of 85 for today. wind speeds at about 12 miles per hour, and by tomorrow a lot of the inland temperatures, including concord will warm up. let's look at the temperature changes in the next 24 hours. again, no major differences along the coastline but it's getting breezy. san francisco about 10 miles per hour, and livermore, 12. down through san francisco, nice and light at about 7 miles per hour. tomorrow's daytime highs, this is what i want to take you through because we have a ridge of high pressure, and it's not going to be extremely hot. concord one of the hotter spots at 91 degrees, and then san jose, 67 for san francisco. for the air quality, i know you

are wondering, santa rosa through antioch and livermore and parts of the east bay still dealing with moderate air quality. what does that mean? we are seeing hazy conditions because of the smoke but the first of the smoke is expected to remain over nevada. be mindful if you are spending more time outdoors. and then keeping some of the cloud cover into the overnight hours, but check out the inland temperatures. we go from 90s. tomorrow is expected to be the hottest day of the week, but even through monday, labor day, i saw a ton of people at the pool, and expecting more of that, and tomorrow will be 89. an extremely difficult day for bay area football fans. coming you know next in sports the giants and mets go into extras. plus the 49ers and raiders cut their team down, and we will

and officially coming to an end, the 2016 defensive player of the year was traded to the bears today after holding out for a bigger contract. he stayed away from the training camp. he reached a record-setting six-year extension with the bears and that includes $90 million guaranteed. so the raiders deal mack as well as two draft picks and a second round and conditional round in 2020. oakland received two first round picks and a third rounder and sixth rounder all over the next two years. and the raiders' teammates took to twitter to weigh in. carr saying this, this is the
