good morning and thank you for joining us. i )m marcus washington. and i )m laura garcia. breaking thanks for starting your morning here with us. i'm marcus washington. >> we're right here. >> that's right. >> you know what? we did have breaking news in oakland a fire at a possible homeless encampment. look at this picture, just into our newsroom, pretty large, broke out near 880 and 23rd. now, we just talked to fire dispatchers in our newsroom and they tell us the fire was knocked out. no one was hurt. good news there. it also happened near the b.a.r.t. track. we checked with them a short

time ago and they said no impact on the system so far. that could have been a messy morning. mike, you've been monitoring this. >> we have. you said it's right by the b.a.r.t. tracks, sort of under the b.a.r.t. tracks. there were two located there. the one around 41st is near the station of fruit veil. b.a.r.t. service unaffected. 18 trains running on time, the two spots addressed by oakland fire. you may have seen some smoke but right now the flames that you saw in the first pictures are gone so that shouldn't be a big distraction for the nimitz. easy drive toward the bay bridge. there's construction through hercules for westbound 80 and 880 construction traveling in order through hayward. we have no slowing to this scene so that's the good news. we'll send it back to kari for the forecast today. >> looks pretty good as we look at cupertino and our temperatures, how things will go

throughout the day. 50s as you head out the door, mid-70s by early afternoon with highs in san jose reaching 79 degrees. little bit cooler than yesterday and still warm for some of our inland spots. we'll get a look at all of our microclimates and the cooler week ahead. it's coming up in a few minutes. >> we'll check back with you, thank you. breaking íbuj in the north bay, brush fire continues to burn this morning, it got larger overnight. this is aerial video that we're seeing here and shot from a distance, showing the line of fire in marin county. the fire burning outside samuel taylor park near lagunitas. it started a little before 8:00 last night and at least 100 acres burned. the fire is just 10% contained and all new overnight our crews spoke to people forced to evacuate with their animals. >> i packed up my things and my

pygmy goats even though i'm not in a mandatory evacuation. >> reporter: you're a block away. >> one street away, that's too close especially if you have got goats. >> pete suratos is on his way to the front lines and have a live report in our next half hour. sonoma county officials taking action to try to prevent another tragedy, almost a near after the deadly north bay fires the county said they need to warn the city in the event of another firestorm. >> "today in the bay" shows us how the test worked. >> operations center. >> operations center. >> reporter: people in santa rosa called the emergency operations center after getting a test call from the so co alert system. >> this is a message from -- >> reporter: for the first time, the emergency services department is calling all land lines and the cell phones people registered for so co alerts, about 290,000 calls. >> this is a test to see the

maximum capabilities of the system. we have to make sure we design our warning systems, our warning plans to fit within that capability. >> it's part of an effort to improve emergency notifications. during the deadly october wildfires, officials say they sent the so co alert, but fire damaged infrastructure, making delivery impossible in many cases and they say not many people signed up for at lerts. >> the call came in at 6:21. >> reporter: it took 21 minutes for virginia bagley to get the test alert. >> i think it's really important that they get the word out and so if it works, kudos, and i think testing it right now is the way to do it. >> reporter: planners say it took nearly three hours to complete the call list. 51% of the calls connected to a person or voice mail. 49% of the numbers were called more than once and never connected. some of those numbers may be disconnected, but planners are now looking into why alerts in

those cases were not delivered. jean elliott, "today in the bay." 4:34 right now and today america pauses to mark 17 years since the 9/11 terror attacks, and as americans have done each year since the attack, ceremonies and moments of silence to honor the victims and first responders. first let's show you a live picture from ground zero in new york, and you'll remember there that that's where that first plane struck the world trade center tower a little before 6:00 a.m. our time where the survivors and many of the family members will gather once again for the reading of the names. and new this morning, menlo park firefighters sent us this video showing their firefighters doing the work in the aftermath of the attacks in new york. later today president trump will speak at services there in shanksville, pennsylvania, this is where the memorial now stands, passengers on united flight 93 thwarted the terrorist attackers there as they tried to hijack that plane. that plane was headed toward

sfo. sf fire is holding a remembrance ceremony at all of its stations at 6:45 this morning. the vallejo fire department will pay tribute at fire station 21 at 11:00, and the exchange club of san ramon valley is hosting its annual ceremony at oak hill park in danville, that's at 5:30 tonight. a follow-up now to a story we first brought you yesterday morning, the fight over trees in lafayette. last night city council members decided to put the issue on their agenda in the coming weeks but we13ñ don't expect a decisi any time soon. as we told you yesterday, pg&e wants to tear down hundreds of trees, saying they block access. neighbors say it doesn't make sense. both sides showed up to last night's meeting. listen for yourself. >> we're comparing it to how the fire department needs access to fire hydrants. they don't need them all the time but when they need them they sure need them right away. >> it's something pg&e say they

are doing for safety but at the same timer this ignoring exposed pipeline and no survey of our line. >> as of right now pg&e cannot cut the trees down. citizens group filed two lawsuits last year to keep the utility from acting. happening today, two leaders in the south bay school district under fire, will meet in front of a judge today. they hopefully want to settle a dispute involving claims of harassment and intimidation. the school superintendent was recently granted a temporary restraining order against school board trustee hakan tran. bauer accused tran of verbally harassing her and making threats. nbc bay area previously reported tran called her corrupt. bauer meanwhile is leading the charge to remove the board which has been accused of making sweetheart deals with contracting companies. the restraining order expires today and the judge will determine if it should be made a

permanent thing. kris sanchez is following this story and will more for us at the top of the hour. it is 4:37. coming up next, major u.s. airlines waiving fees for travelers changing their flights, moving to get out of the path of potential hurricanes along the east coast and the caribbean islands. a long-time cost saving favorite may soon be a thing of the past. the plans to faze out the $5 foot long at subway again.

good morning, i'm meghan at cnbc global headquarters. here are the top headlines. wall street is indicated to open lower this morning, a mixed session for the markets yesterday. the dow slipped but the nasdaq and s&p 500 snapped the four-day losing streak on a rebound in tech stocks. the sector fell nearly 3% last week on concerns about tighter regulation for facebook and twitter. the dow closing down 59 points to 25857 the nasdaq rising 21 to 7924. major u.s. airlines including delta, american, southwest and jetblue are waiving change fees at airports that could be in the path of hurricane florence. that means passengers will be able to change their travel without paying extra charges which usually can run $200 or more. delta is also capping fares for flights from some affected cities. american is extending change fee waivers for travelers flying to or from more than a dozen airports in the caribbean ahead of hurricane isaac.

san francisco today. it's going to be a nice one but windy and cool in spots so we are looking at cooler air all across the bay area. we're going to+ñ bring those temperatures down over the next couple of days. here is a live look outside in emeryville this morning. already busy, but at least we don't have to deal with patches of fog and once again a lot of sunshine, improved air quality today. as you make your way out the door for the morning commute from pittsburgh, we're going to see those temperatures in the upper 50s by 6:00 and then going from the upper 50s to 68 degrees at 10:00. if you will be heading out a little bit later it's still going to be nice and clear. the high temperature for today san francisco will reach up to 67 degrees. 73 in oakland, and in martinez today 85. also 85 in santa rosa, and in morgan hill today, reaching 83 degrees. as you are getting dressed this morning it's still a day for a t-shirt and shorts and trying to keep cool, but of course, this morning, you might need a jacket to start and it's going to get

cooler in the forecast. here is the reason why. we have this trough, this elongated area of low pressure, you can see the clouds and then here is the center of low pressure here, the swirls of clouds up near vancouver. this will start to make its way farther to the south, as we head into the day tomorrow, bringing in a change in our temperatures, some cooler air, and also more cloud cover. by tomorrow morning we'll start to see clouds moving again and it will be partly to mostly cloudy for tomorrow, with our high temperatures for some of our warmer spots only reaching the upper 70s. and it will be breezy because of those winds shifting and then coming in from the north it's going to bring in some cooler temperatures from wednesday through friday, and then it starts to warm up a little bit, but not by much. we're in for some very nice weather over the next few days. san francisco staying cool, and windy, a little bit more sunshine as we get some drier air moving in, kind of mixing out that marine layer and we're going to see the temperatures continuing in the low to mid- s mid-60s.

mike, now you're tracking a new issue in walnut creek. >> i am, kari, and i'm concerned because that's the portion of contra costa county which feeds down out of concord and antioch and pittsburg bay point, that whole stretch where we see the first commute. looking around the bay it's an easy drive for the speed sensors. over here southbound 680 right around the truck scales report of a vehicle but it's not pulled over to the truck scales, it's in the middle of the freeway, reported a few minutes ago and i haven't seen any slowing develop south of the 242 merge with south 6 of 80. oh there it just showed up, we saw turn from green to yellow approaching. we'll track that, so far out of antioch, pittsburg bay point traffic flows smoothly. new issue on 880 in oakland, i'll check that, around the oak exit there, i don't see any but it did just appear and more traffic in the area, the cash lane starting with a small backup right now at the bay bridge toll plaza and we'll follow this as they open all cash lanes over the next few minutes. back to you. >> thanks, mike.

happening today, leaders from around the world gathering in san francisco for the global action summit, which officially kicks off tomorrow at the mosconi center. today governor brown will attend with climate experts. they plan to announce global funding efforts to combat climate change. al gore will attend a symposium on how to improve global climate. some of the focus will include the definitesation in california from recent wildfires. 4:49 right now. today a flight over once south bay group's solution to help the homeless takes a new step. >> they set up a new type of encampment. the problem officials are telling them to get out. san jose hope village formed on this parking lot over the weekend just south of the airport. it's safe, clean, proper fencing, toilet and community area as well. on monday, authorities gave them an eviction notice, since the site is on state property. organizers point out no one uses

the lot. it's away from neighborhoods and there's another encampment ten feet away. >> because we don't see any alternative. somebody has got to press the city and the county to do something about thousands of people that are living in encampments in horrible conditions. >> the homeless advocates are holding a rally today at 5:00 p.m. on the parking lot on rough drive. one city councilman says he's riding state leaders to ask if the group can stay. this morning, san jose families still looking for answers after an area showed someone shot their cat with a pellet gun. >> the family says if there's evidence, it happened more than once. nbc bay area's marianne favro tells us what happened and what they're doing to one another. >> reporter: potter loves to climb trees but now his family says he may not be able to walk again. on saturday, their 6-year-old pet was shot by a pellet gun. neighbor found him bleeding. >> it's pretty disturbing to find out there's people around

here that would do something like that to an animal. these are loving pets. >> reporter: even more disturbing, when the buyers took potter to emergency care saturday, x-rays showed their cat had been shot before. you can see the two pellets still lodged in potter's body. the family says they saw a small scan on their cat about a month ago but didn't realize potter had been shot. it's not the first time animals had been hurt in the neighborhood. >> one of our neighbors told us one of their kittens is missing and also a hawk was shot down and landed in their yard. >> reporter: chelsea byar says when she posted what happened on social media another neighbor responded saying her cat had been shot by a pellet gun just last week. neighbor thomas estrada plans to check his home surveillance video. >> there's someone somebody and

a teenager in the back - in morgan hill! you )re looking at two of the suspects... the 3rd flee men face charges of stabbing a teenager in the back, this is in morgan hill. you are looking at two of the suspects. the third only 17 years old. so police did not release his picture. this happened friday. the 16-year-old victim went to the hospital and is critically hurt. officers took all three suspects into custody on saturday. they face attempted homicide charges. new this morning, a law signed by governor brown will make flying drones over state prisons illegal. the ban comes after several drones were found dropping drugs and cell phones into california prisons. senator jerry hill pushed the bill saying there was no previous law specifically banning the use of drones as a smuggling method. the new law does not apply to correctional workers who may have to use drones on the job. it will all take effect in january. if this is the raiders last season in oakland, it didn't get

ground zero on the national moment of silence. it's coming up in about 45 minutes to you. we will never forget. good morning to you. thanks for joining us. i'm laura garcia-cannon. >> i'm marcus washington. mike has a look at traffic in a moment. first a check of the temperatures this morning before we head outside, kari and a cool start again today. >> a cool start and we'll see temperatures starting to warm up today for those inland areas, and we do start out with some clear skies. we are going to get a lot of sunshine as we go into the afternoon. here is a live look outside in san francisco this morning, from our sutros tower, such a beautiful shot of the golden gate bridge with no fog this morning. we head inland to the plez around hill b.a.r.t. station with upper 50s to start and some low 70s by later this morning. high temperature still going to be warm in antioch, reaching 87, martinez 85 and 79 in san jose. here is an update on hurricane florence, now a category 4 hurricane, this may briefly strengthen a little bit more, as we go into the afternoon, as it

makes its way closer to the north carolina coast. we'll have more updates on that throughout the morning. kari, we have a traffic alert right now. the bay bridge that's okay and this issue in oakland around oak 5th on the shoulder. the one in walnut creek the big rig turns out, not just a smaller truck, a big rig stuck in the middle of the freeway, left three lanes are blocking your commute direction south 680 coming toward tree and the truck scales and you see the traffic is quickly building up from the 242 merge so that will be an issue. the first commute off the start is coming out of antioch for highway 4 and traveling westbound over in through bay point, concord, and again through pleasant hill and that's where things really jam up as you're down to just about two lanes traveling south toward the walnut creek interchange. there's been no expected time for the lanes to open. chp is trying to figure out what to do because the truck has locked up brakes. we'll figure out when they can
