let's get a look at the forecast coming off a nice weekend in the bay area. >> it was beautiful. temperatures were comfortable. we'll see the same thing today. we have a couple more days before it heats up. as we take a live look at the temperatures now. it's cool now at 58 degrees. 50 now in morgan hill. you can see a spread of the temperatures. as you make your way out the door to the pleasant hill bart station, 56 degrees at 6:00. at noon, we are 69. we'll talk about the high temperatures coming up. back to the chp alert on 580. >> we got video in the newsroom a few minutes ago. you see the chp officers on the freeway. this is 580. there was an overnight shooting. there was one car shooting at another car and not somebody from the other side of the road. you see the lights jammed up

here. the closure cleared a few minutes ago. we'll take you to the maps. all lanes clear for 580. we had all the recovery. traffic is so light coming in at the castro valley. the big commute starts out of tracy. there is flowing out of the altamont pass. the south bay up into oakland. a smooth drive, a disabled vehicle off 580 and 13. not a major concern. the freeway re-opening, more traffic in toward the mays area as well without problems for contra costa county. chp not reporting any issues. back to you. >> new this morning, a new response from the bay area woman accusing supreme court nominee brett kavanaugh of sexual assault. >> she's stepping out of the shadows telling a story that may

cost him the vote. she's been following the details of the story. >> we tried to talk with a woman at her home, but a friend says she and her family will not be back for a while. christine ford is a research psychologist but lived in maryland and found herself at a house party with brett kavanaugh who she claims was stumbling drunk when he pinned her to a bed and grobe hpe her. he covered her mouth and she thought he might inadvertently kill her. she gave the account to the washington post. her lawyer had this to add to the description within the last hour on the "today" show. >> she clearly considers this attempted rape. she believes if it were not for the severe intoxication of brett kavanaugh she would have been raped. >> senator dianne feinstein tweeted i agree with senator

flake we should delay the vote on brett kavanaugh. there is a lot of information we don't know and the fbi should have the time it needs to review the new material. staff calls aren't the appropriate way to handle this. senator flake is one of two republicans who now say they don't have the information to go forward with a vote at this point. this is a quickly developing story. >> thank you very much. we'll continue to follow it. >> a live look in the carolinas in the last few minutes. we learned president trump has approved disaster declarations for south carolina due to damage from hurricane florence. he approved north carolina's over the weekend. >> florence is now a tropical depression. still wreaking havoc. now responsible for the bests of 17 people. many still facing grave danger.

>> reporter: three days later, florence will not loosen her grip on the carolinas. >> see the water coming up further than it does in a normal storm. >> reporter: her relentless rain, almost two and a half feet in some places causing dangerous flooding. >> when you open the door, that's when we saw all of the water like, oh, my god. it's like, you know, it was just water everywhere. >> reporter: water swallowing homes and communities. >> just evacuating people who can't get out by any other means than boat. >> reporter: heroes helping those escape swollen rivers whose water has nowhere else to go. >> this storm has never been more dangerous than it is right now. >> reporter: sadly in gaston county, a rain-soaked tree fell on a mobile home, killing a 3-month-old infant inside. >> if you live close to trees, go out and inspect your property.

if you feel a tree will fall, move to a safer location. >> reporter: a tragic reminder of how dangerous florence is. >> as we continue to track florence, a big announcement. fema teaming up with the fcc for a nationwide test of wireless emergency alerts. on thursday, all cell phones connected to providers that participate in emergency alerts will receive a text message with the title presidential alert. this is the first test ever conducted using the national wireless alert system. the agencies will go a test for radio broadcasters a few minutes after the wireless alert. >> happening today, heading to the state capitol in sacramento. >> they are launching an investigation into alleged abuse. pete, what exactly are they asking for?

>> reporter: good morning to you. they are calling for a statewide probe similar to the one we saw in pennsylvania. they are going to do so in front of the state attorney general's office this morning. about two dozen victims and supporters in this issue. they are not only calling for a probe into alleged sexual abuse in catholic churches across the state but calling for local law enforcement and prosecutors to be more aggressive when it comes to dealing with these cases. we did get to speak to a member of s.n.a.p., the survivors network of those abused by priests. they tell us the number of priests accused is much higher than what's being reported. they say more needs to be done to expose abusers. >> we want to protect kids. the way is to open up the files and sort out who did what to whom when. you have to publish the names, publish what they did so parents and advocates can look out for

the children. >> the diocese of san jose launched its own investigation. they'll report the names of accused priests who have credible accusations. as far as today's presser and protest it's set for today around 11:00 a.m. >> to a developing story in the north bay. police asking for help. finding a hit-and-run driver who killed a man. calls came in about a car that struck and hit a man in the street and then drove off. they are looking for possible surveillance video to track down that driver. the car is a white, compact sedan. >> happening today, cal trans

will discuss its up coming electric project. over the past year representatives traveled to each city on the tracks to educate people about what to expect and possible impacts. tonight's meeting in sunnyvale takes place at washington park at 6:00. >> who's the first mystery moon tourist? we could find out tonight. the holder of a ticket aboard the spacex rocket headed to the moon. spacex signed the world's first private passenger to travel beyond space. it won't be the first private passenger. but plans to reveal who it is tonight. people are speculating who the mystery person is. one person asked if it's elon musk himself. he tweeted a japanese flag hinting the lucky passenger may be from japan. nobody's been there since the last apollo mission in 1972.

>> he's going to send a japanese car. >> i don't know. >> let's look outside. in dublin with mostly clear skies and temperatures are nice and cool. as we head to noon we'll make it into the upper 60s with a lot of sunshine. if you are planning to go out hiking in the south bay the hiking trails will start out with temperatures around 53 degrees at 7:00. by 10:00, we are at 61 degrees. some low 70s for today. we'll get a look at the micro climate and what to expect as we go through the week. mike is saying the commute is good. >> after they re-opened 580 for the investigation at the castro valley. everything calmed down. look at the bay looking fine now. >> we have a little slowing.

>> i'm bertha coombs at cnbc headquarters. wall street looking to start slightly in the red. the futures are just slightly down. investors are playing it cautious on report that is the trump administration could impose another round of tariffs on $200 billion worth of chinese imports today. markets are coming off a positive week. the dow, nasdaq are up in four of the past five weeks. look for economic data this week on housing. the dow closing up eight points on friday to 26154. the nasdaq flipping three to 8010. if president trump does put more tariffs on chinese goods u.s. consumers will likely see higher prices but not immediately. items include goods like seafood, housewears and consumer electronics. apple warned this month tariffs could impact the apple watch and

the air pod wireless head phones. they could act ahead of the holiday shopping season. time magazine will soon have a new home and new high profile owner. the news magazine is being sold by meredith corp., the publisher of better homes & gardens and family circle to mark benioff and his wife for about $200 million. meredith put time up for sale along with money, fortune and sports illustrated. the benioffs will own it privately and won't have control over the day to day operations or editorial decisions. a big year for him. that big tower and now this. >> not bad at all. bertha coombs, thank you very much. time to start thinking about the holidays. at least it is for retailers like target. the company said it's looking to hire 120,000 workers. most will not be added to checkout lines in stores.

50s. 52 degrees at 7:00. as we go through the morning, we go from the low 50s to the low 60s, then the low 70s today. still going to be really nice and cooler than normal. as you make it out to the fruitvale bart station, much of the morning the clouds lingering. then the sun breaks out. temperatures in the mid 60s for the middle of the day. it's time to get up and start to get the kids ready for school in the tri valley. livermore looking good. as you walk to school, 51 degrees. then at lunchtime, in the mid to upper 60s. 73 degrees today. here is a look at the highs. still reaching the mid to upper 70s today. this is the kind of weather we had last week throughout the weekend. it continues today. we are going to see changes headed through the the forecast. going from 76 today to slightly cooler weather tomorrow and then a big jump in temperatures by wednesday. we'll see our temperatures peaking on thursday, going up to

88 degrees for some of the warmer spots inland. coming back down for the weekend. so we'll have a little bit of a taste of late summer. we have had some nice fall-like weather from the past few days that will continue into the start of the workweek. once again for the middle of the week, temperatures will head back up for the end of the week. over to mike, you are checking in with what's happening in palo alto. >> we showed this before the commercial. this side, southbound 101, i saw a set of flashing lights, just one cruiser flying down the freeway. chp doesn't use the speeds unless there is a reason to get somewhere in a hurry. no reports of problems. no crashes. 101 itself was not affected. we'll continue to track it. i'll let you know if anything was going on in the area. maybe they got a call. that often happens overnight hours.

dogs who were dodging cars along 580 in oakland yesterday. officers say the dogs were tired and hungry. you can see they curled up in the back of that patrol car on dogs were dodging cars yesterday on 580. police said they were tired on the ride to the nearby animal shelter. hopefully they can go home soon. >> all that running on the freeway makes you tired. >> a mystery involving the disappearance of china's best

known actress fan bingbing. >> best known for her role in the x-men franchise. the actress hasn't been seen publically since june. speculation is her disappearance is tied to an alleged tax evasion scandal. she's accused of underreporting earnings. the scandal comes as the chinese government cuts back on bloated budgets of the state-controlled film industry. >> message that the authorities here want to send is no one is above the communist party. the government has said it doesn't like celebrity worship. what she's doing is running counter a bit. >> so far the chinese government isn't responding to requests about the 36-year-old actress. for years, doctors advised older adults to take a baby aspirin to help prevent heart attacks. evidence shows it might be doing more harm than good. researchers say people over 70 should not take low dose aspirin daily. it studied thousands of patients

good morning and thank you good morning. thanks for joining us for "today in the bay." our crews are scattered across the bay area. our photographer ethan is in fremont at the main library. this just in, literally. good morning and thanks for joining us. i'm laura garcia. >> i'm scott mcgrue in for marcus washington this morning. let's look at the monday morning weather with kari. >> right now it's 45 degrees in santa rosa. let's head over to walnut creek to see how temperatures shape up. we'll see crowds through about 9:00. everything clearing from the mid 50s to the low 70s by 1:00 today. look at all of the micro climates. it will be a breezy and cooler than normal day. only reaching up to 78 degrees at antioch and santa rosa. we'll talk about the weekend -- never too early.

the city of san jose. chp says it must enforce the no trespassing laws which is why chp ordered the people who live here to move off the land by 8:00 this morning. if you are not familiar with the area, hope village sits on an empty parking lot just south of norman international on rough drive near heading located near the old traffic court and the guadeloupe river creek where a number of people lived. the nonprofit group called san jose catholic worker established hope village at a cost of around $10,000. the area is fenced off. there are port apotties, showers, solar. there are ground rules to keep the site secure. one man said it is the difference between night and day living here versus in the creek area. the worker organization hopes that hope village can be a model for other rls encampments. next week the supervisors for the county will consider possible solutions including moving hope village to a nearby

property owned by san jose, moving it to scity-owned land o convincing the state to lease the property that the village is on now. as mentioned, the plan is today according to chp to have people out by 8:00. reporting live here in san jose, bob riddell for "today in the bay." >> thank you, bob. >> in washington the bay area woman accusing president trump's supreme court nominee of sexual misconduct goes public. her attorney spoke to nbc this morning. chris sanchez will look closer at that part of the story later. >> right now in washington, some republican republicans saying they should slow down the confirmation of brett kavanaugh. tracie potts has the latest. >> reporter: good morning, everyone. the latest is the vote that's supposed to happen on thursday oy m may or may not happen. some republicans are saying they

want to hear from ford before they vote. >> reporter: judge brett kavanaugh categorically and unequivocally denied groping a young woman at a house party in the '80s. that claim from a california professor of the washington post identified as christine ford. nbc has not verified the claims. her story only revealed once before during therapy six years ago. critics ask why now. >> you had your opportunity to come forward. you failed to do that year after year after year. >> she didn't tell anybody else in realtime about this incident which will weaken her account, but not discredit it. >> reporter: democrats learned about it in july but said the accuser didn't want to come forward. now they want the fbi to investigate. >> if this was material to the confirmation process, why over the past four to six weeks has it not been discussed among

committee members. >> reporter: hundreds of women support kavanaugh but at least two republicans and others want to hear from his accuser before they vote. >> there is this arbitrary deadline of the end of september which frankly doesn't relate to anything in particular. why not slow down? >> reporter: ford tells the post she decided to come forward now because parts of her story had already leaked out. and new this morning her attorney says she's willing to come to capitol hill to testify. white house adviser kellyanne conway is adding that they think at the white house she should be heard and should have a chance to tell the story. back to you. >> thank you. it's 5:33. people in the carolina are still facing dangerous conditions. florence is now a tropical depression. it's dumped almost two and a half feet of rain in some

places. >> the storm responsible for the deaths of at least 17 people. at least a million remain without power this morning. three days of relentless rain caused dangerous flooding. overflowing rivers led to water swallowing homes and communities. >> when you open the door, that's when we saw the water. we were like, oh, my god. it's like, you know, it was just water everywhere. >> the storm has never been more dangerous than it is right now. >> sadly, in gaston county, a rain-soaked tree fell on a mobile home killing a 3-month-old infant inside. with rain in the forecast through tomorrow, the danger is far from over. new this morning, a team of bay area firefighters in the middle of an active rescue in the disaster zone in north carolina. our newsroom just got off the phone with chief jason solak who promised more details after a safe evacuation. the tax force four is made of 16 firefighters from oakland,

almeida county, fremont, santa rosa and contra costa fire department. they hit the ground running in newburn, north carolina, where the water was about chest high. >> 5:35 now. in massachusetts, thousands of people were allowed to return home after a gas leak set off dozens of fires. the explosions and fires north of boston killed an 18-year-old man and injured 25 others. yesterday, the all-clear was given for residents to come home. some do not have much of a home to come back to. about 80 homes destroyed or damaged. ntsb investigators are looking at pressure sensors which were connected to a gas line taken out of service shortly before that blast. catholic church sexual abuse survivors from the bay area head to sacramento today with a big goal in mind. they want california's attorney general to launch a statewide probe into the alleged abuse

before turning himself in. according to the east bay times, terrence dixon told concord police he fled to the small town of bandon, oregon, to hug his wife one more time. he's charged with the murder of michael downy, a 64-year-old, in late july. investigators say he was beaten to death with a fire poker. dixon turned himself in to police. he's now in a contra costa county jail. in a few hours state leaders expect to give a clearer picture on the angel island ferry to take passengers to and from tiberon. the state looking at taking over the service has been running it for 59 years. state leaders say the change of scenery. the blue and gold fleet submitted a proposal to take over. they say they would continue to ferry passengers. >> we're going to continue to operate to angel island. we'll continue to take care of the communities just like they have taken care of us.

that's who we are. that's what we do. >> the family didn't submit a proposal saying the expensive dock repairs required by the state were too expensive. a news conference scheduled for 11:00 a.m. in tiberon. >> in the nfl, things are looking good for the raiders in denver yesterday until they weren't. a late third quarter touchdown gave the silver and black the 19-7 lead. after that it was downhill. the broncos scored the find 13 points including a last-second field goal to pull off the comeback win. john gruden will have to wait at least another week to get his first win since returning to the raiders. 49ers jumped out to a big lead against the detroit lions. then it got dicey. >> jimmy garoppolo threw two touchdowns including one to seleck. the niners led in the fourth, but the lions started to storm back late falling just short in

one car's passenger fired at another car. no one was hurt. the freeway was shut down as we told you when we started at 4:30 in the morning. the chp looked for evidence. fema's top official supporting president trump's claim about the number of deaths in puerto rico from hurricane maria. >> what happens, even in this event, you may see more deaths indirectly occur as time goes on because people have heart attacks due to stress. they fall off their house trying to fix the roof. >> he agrees that the official number of deaths from maria is inflat inflated. according to an independent study, nearly 3,000 people died as a result of the storm. many exactly in the way that long was describing. unexpected deaths after, but resulting from the storm.

last week the president tweeted 3,000 people didn't die. when he left the island there were anywhere from 6 to 18 deaths. >> he said democrats did it to make him look bad. do you believe these studies were done to make the president look bad? >> i don't think the -- i don't know why the studies were done. what we are trying to do in my opinion, we have to fwigure out why people die from the direct deaths of wind, water and waves. >> fema is one of the largest employers on puerto rico helping to rebuild the territory. >> we are learning details about a texas border patrol agenda charged with numurdering four people. this is a mug shot of juan david ortiz, a ten-year veteran supervisor and a navy veteran. according to court documents he admitted to filling four sex workers over the past two weeks

and kidnapping a fifth. the victim was able to help state troopers track him down. investigators don't believe there are more victims and ortiz was acting alone. >> how about something happier? a new world record set for an 11-year-old girl. her mission was to get as many hugs as possible. )phony ) .. even if they look like welcome back. ride share users beware. your driver could be a phony even if they look real. our investigative unit uncovered a new scheme. >> it lets anyone behind the wheel and passengers may never know the difference. liz wagner explains the scam putting passengers at risk. >> reporter: it all started at this computer online in a chat room where we found dozens of people advertising rideshare driver accounts for rent. so we rented one. we never drove, but the account history shows cars giving rides to plenty of passengers throughout the dbay area. we found a passenger and she said her driver took her on a white knuckle ride. >> he starts backing up on the one-way street. this is interesting. on the highway, he's backing up.
