>> reporter: in the middle of cal berkeley's famed plaza, a banner statement from students, not just backing the accusations of dr. christine ford, but indicting an entire political system. >> this is concerning for where we're going in our nation, and it's even more terrifying for survivors of sexual assault. we cannot allow someone who is a predator into our government. >> reporter: from a now pitch black bay area neighborhood, a palo alto university professor penned a letter that could derail brett kavanaugh's high court nomination, at the very least, it's prompted a congressional hearing. >> i wish the democrats could have done this a lot sooner because they had this information for many months. >> reporter: president trump and many republicans wondered aloud why the ranking member of the senate judiciary committee dianne feinstein sat on ford's letter for six weeks before revealing its existence. >> but now, now that accusation

of 36-year-old misconduct dating back to high school has been brought forward at the last minute. >> reporter: ford's supporters say whenever it happened, her actions took guts. >> we know this must not have been a decision that she took lightly at all, because the stakes could not be higher. >> reporter: sam brock, "nbc bay area news." >> 4:33 for you right now. new this morning, police on the peninsula say a quick response from officers helped capture an attempted rapist. now the victim called 911 last night saying she had just been attacked in menlo park near woodland avenue and oak court. she managed to fight off that attacker because officers were nearby and that woman provided a good description. police tracked the 19-year-old suspect down in minutes. he is facing multiple charges. >> 4:33. today jury selection begins for a man accused of murdering his parents in san jose. police say hasib golambrabe shot

and killed both his mother and father at their home in so he's evergreen neighborhood in 2016. as we reported earlier this month, he recent decided to represent himself. authorities initially charged his younger brother, but later cleared him due to insufficient evidence. a 6-month-old oakland boy is in a coma at stanford hospital in a case now reviving a debate over life support. his name kingston holmes, and he's been in an irreversible coma for the past month since suffering cardiac arrest. he was moved to stanford after his parents and community members begged oakland's children's hospital to allow more time before pulling the plug. the holmes family says that doctors are recommending taking him off life support but they are still holding out fortoes. is he is moving his feet as well as his hands. >> and this case reminding some of jahad mcmath.

in that case doctors sought to end the life support and she was declared brain dead. family members won the right to move her to another facility where doctors took her off life support in june. some mcdonald's workers in san francisco will take part in the first of its kind protest against workplace sexual harassment. organizers are calling i it #metoomcdonalds. they're accusing the fast food giant not taking the serious enough. workers in nine other cities also taking part. finding a parking spot may soon become a little moreampbel least if you don't live there. city council members vote on a pilot program, a parking pilot program for rosemary neighborhood. that's near camel pony baseball field bordering san jose. neighbors from some 145 homes there complained to the city that drivers from outside of the neighborhood are parking there

good morning, i'm kate rodgers at cnbc global headquarters. wall street is indicated to open higher despite the new round of u.s. tariffs on chinese imports announced by president trump late yesterday. asian markets rebounded overnight on hopes china would offset the impact of with government spending on infrastructure. u.s. markets fell yesterday after president trump announced the trade action was coming. the dow snapped a four-day winning streak and the nasdaq fell 114 to 7895. fedex sounding the alarm on tariffs on the earnings call ceo fred smith said the tariffs has hit 10% of fedex's business in china but any expected further action from washington and retaliation from beijing is causing jitders and a slowwn in economic activity. fedex is considered a bellwether of the deployable economy

we'll see a few patches of clouds and fog around but all of that starts to clear out by 9:00 to 10:00 this morning and looking really good as the temperatures start to rise. also as you are making your way out the door to the fruit veil b.a.r.t. station mostly cloudy skies and temperatures holding steady at 57 degrees. at noon 61 degrees and the warm upslow. have you been sneezing a lot? you might be allergic to elm trees, wag ragweed or weed pollen. it's moderate and may get higher as the winds pick up over the next couple of days. as you get dressed this morning you need a jacket because of most of us starting out in the 40s and 50s. don't forget the sunglasses. we'll get a lot of sunshine for today. as we check out our high temperatures for the south bay, morgan hill will reach 77 degrees and 76 degre in downtown san jose. all these temperatures cooler than normal, as we enjoy a little bit of a taste of fall.

martinez and walnut creek reaching 74 and hayward 71 degrees. san mateo reaching 68 degrees today and in san francisco, we're still looking at some low to mid-60s there, and 75 today in napa with santa rosa reaching 78 degrees. so we go from the mid-70s today to the mid 80s tomorrow and then up to 92 degrees on thursday, with some of our hotter inland temperatures. it will feel like summer before , with mostlyto fall officially 60s and the rest has a few folk. >> a few more than a couple minutes ago, on the left, approach to the bay es typicall this time one, possibly two of those cash takers weren't open for a short period of time but we see that one the last cash lane there fast track that's the one folks are avoiding. we have to open that last one.

when you get into an uber or lyft, how do you kno is behind the wheel. the nbc bay area investigative unit has uncovered an underground market that lets people rent ride share accounts. >> which allows them to drive without being vetted. investigative reporter liz wagner shows us the scam that's putting a lot of passengers at risk. >> reporter: a few groups we saw dozens of ads to rent ride share driver accounts so we put down 150 bucks for a lift account. we never drove but the account history shows cars giving rides to plenty of passengers. the scheme allows renters to swap in their own selfie and car information and drive as someone else. it's all phony but the name and driver's license number on the account belongs to a real person, this guy. turns out his identity was stolen and used to create the account. lyft says what's being described is extremely concerning. we have a dedicated team that investigates fraudulent behavior which may result in immediate deactivation from the platform.

peninsula couple whose door dash account was hac . well come back everyone. it's 4:55 right now. nbc bay area responds to a peninsula couple whose door dash account was hacked. >> apparently hungry thief 2400 miles away run up a huge tab. the couple asked chris chmura to investigate. >> reporter: they live here but all of the sudden door dash started charging their credit card for lots of food deliveries around cleveland, 59 different orders over the next 14 days, a total of $4,500 in unauthorized charges. they say they reported the hack to door dash and the company said it was investigating but the charges continued multiple times a day. so they wrote us. we contacted door dash and the

very same day they got an email from door dash that apologized, reversed the $4,500 in charges and froze their account so the unauthorized orders would stop. door dash sent a statement saying "thank you for bringing this matter to our attention. door dash takes the security of its platform seriously and we have investigated and taken action to address this issue." morgan and rishton said the banks alerted them to the fraud when the thieves spent $57 at mcdonald's proof setting up alerts on your accounts especially your credit and debit accounts is vital to cut off fraudsters as early as possible. rushton works in tech and will be offering door dash ideas for improving its security. do you have a complaint, tell us about it, 888-996-tips or nbcbayarea.com/responds. >> chris chmura does it again. >> i want to knock on that door and see the person who is doing it. >> all that food.
