we have two reports starting with nbc correspondent kristen welker. >> reporter: good morning. the senate judiciary committee chairman is giving christine blasey ford a deadline. but ford isn't backing down. her attorneys say there should be an fbi investigation and ultimately a hearing that includes multiple witnesses. >> reporter: this morning, will she or won't she? that's the critical question after christine blasey ford said she wants the fbi to investigate her sexual assault allegation against judge brett kavanaugh has a first step before she testifies before the senate judiciary committee monday. president trump urging her to speak publicly. >> i really want to see her. i really would want to see what she has to say. >> reporter: but does the president believe her? >> i can only say he's such an outstanding man. hard for me to imagine anything happened. >> reporter: and while standing by his nominee, mr. trump is also hinting his support may not

be ironclad. >> if she shows up and makes a credible showing that will be interesting and we'll have to make a decision. >> reporter: overnight the attorney digging in with a statement saying she is unable to go home, receiving ongoing threats. and arguing the rush to a hearing is unnecessary and contrary to the committee discovering the truth. one of blasey ford's long-time friends says she has no reason to doubt her. >> she's not someone who makes things up. this was just a tremendously difficult decision for her, both because of the nature of her experience and how private she's kept that for so many years. >> reporter: kavanaugh has denied the sexual assault allegation for more than three decades ago. for his part the president signaling he has no plans to order an fbi investigation even though he's the only one who can do it since it's a background check for his nominee. >> it would seem that the fbi

really doesn't do that. they've investigated. >> they would if you asked them to, mr. president. >> they've investigated about six times before and it seems they don't do that. >> chuck grassley offering to send people to get testimony. to california, her home state and also insisting there's no need to reopen the fbi investigation or delaying the hearing. writing a letter to blasey ford's lawyers encouraging her to testify either privately or publicly on monday. >> what we're focused on doing right now is everything we can to make dr. ford comfortable with coming before our committee. >> reporter: now, there is precedent for the fbi stepping into a supreme court nomination process late in the game. it's pretty well known. in 1991 former president george hw bush ordered an investigation into anita hill's allegations of sexual harassment against now

justice clarence thomas. hoda and savannah. thank you. >> kasie hunt is on the hill. you talk about deadlines and this monday hearing. it isn't clear that dr. ford has ruled out speaking out before congress. there's a chance it could still happen? >> savannah, there is. i think it's actually very important to underscore that she hasn't in any of these letters or statements through her lawyers, ruled out completely testifying. and instead is highlighting some of the things about the process that may ultimately make her more sympathetic in the event that she does appear. i will say one congressional source told me this is a high stakes game of chicken. i'll also say from my reporting republicans have drawn monday as a line in the sand. they could delay if they wanted but politically it doesn't look like they will. >> it looks like as far as the fbi is concerned, it's case closed. there will not be an investigation. is that right? >> reporter: it does seem that way.

it's agency kristen reported, it's up to the president of the united states. he does not seem to be budging. but one thing i will say from my reporting is that republicans and democrats, everyone behind the scenes is preparing for any scenario including the possibility that there could be more information that comes up about brett kavanaugh's background. somebody else that might come forward. they're all planning for gaming out all of those different types of scenarios, and we still only have a couple days left of this. this is thursday. this is supposed to happen on monday. but that, as both of you know, is a very, very long time in politics. >> thank you very much. also this morning still rising rivers have forced more evacuations in the carolinas. that's nearly a week after hurricane florence made landfall. survivors of the storm also getting a visit from the president on wednesday. tammy lightener is in hard-hit new berth, north carolina.

we did a lot of reporting from there, tammy. good morning. >> reporter: good morning. residents are returning to new bern today finding massive devastation. in this case a 36-foot boat from a marina a mile away crashed into the townhouse next door before slamming into this house. this morning eilene is deciding what to salvage and what to throw away. the swollen noose river that runs through her backyard in north carolina forcing her family to evacuate after hurricane florence. the rushing water devastating the entire neighborhood. >> the debris everywhere. i had my sliding barn doors were up here. chairs had been down the street. it was just stuff everywhere. >> reporter: she returned wednesday, the same day president trump toured the carolinas, passing right in front of her home. >> he went right through her. he drove by, the whole -- i've got it on video.

>> reporter: the president acting as comforter in chief, handing out meals at a nearby baptist church. and embracing a young boy who asked for a hug. the president also visiting conway, south carolina telling people the recovery will be long but everything will be okay. >> washington is with you. trump is with you. we are all with you 100%. >> reporter: some hoping he keeps that promise. >> one of the comments made when they heard he was coming was he's going to throw paper towels. i hope he does more than that. >> reporter: more than 16 rivers in north carolina alone are currently above flood stage. forecasters predicting they could rise even more in the coming days. it may be a while before residents here can even attempt to start over. >> we got a house that's still standing. it's kind of messed up. a lot of people don't have anything right now. >> reporter: drive down just about any street in new bern and this is what it looks like. people's furniture, their clothing and their memories scattered along the side of the

street. back to you, guys. >> all right. tammy, some amazing pictures. thank you. overnight we're hearing from elizabeth smart now that one of her kidnappers has been released from prison, five years earlier than expected. joe fryer has been on the story. good morning. >> reporter: good morning. wanda barzee is a free woman. she's living in temporary housing until her probation officer can approve another home. elizabeth smart and her family believe barzee is a danger to the community, but barzee's attorney says calling her a threat is unfair. >> reporter: these are the first images of wanda barzee, following her release wednesday. she can be seen holding a salad and banana while entering her temporary home in salt lake c y city. she's free after 15 years in custody for her role in the kidnapping of elizabeth smart. >> it certainly has been a roller coaster of emotion, and at the same time i received an outpouring of love, of support, of prayers.

>> reporter: last night smart spoke to students in lock haven, pennsylvania, sharing her survival story, but saying little about the release. >> i'm not going to let these people, this woman stop me from living the life that i want to live. >> reporter: earlier outside of the utah prison, smart's father expressed concerns about barzee's mental health. >> she's still very much on the same page when she was when elizabeth was abducted and that is disturbing to me. >> reporter: barzee is now listed on utah's sex offender registry and will be on federal probation for five years. she must seek mental health treatment and stay away from smart and her family. the lawyer says the client plans to comply. >> to my knowledge, there's no knowledge that she's a danger to the community. >> reporter: in a case that captivated the nation, smart was held captive for nine months by

barzee and her husband mitchell. speaking with dateline, smart returned to the place of her captivity showing where she first met barzee. >> where we're standing there were tarps on the ground. right here would have been where the tent was set up. >> reporter: mitchell is serving a life sentence. barzee was supposed to be released in 2024 but last week utah officials revealed there was a miscalculation and her 15-year state sentence should include the time she spent in federal prison which means her total sentence has now been served. elizabeth smart's attorney says while his client was stunned, she's ready to move on. >> i don't think she'll give a lot of time and attention, but she will have a cautious approach and probably a watchful eye. >> are we learning anything more about the conditions of her release? >> well, savannah, according to a court order, she now has a 9:00 p.m. curfew. her attorney has said she's agreed to stay away from places frequented by smart and

her family. if she violates the terms of her probation, she could go back to prison. >> thank you. craig has another big story we're following. >> good morning. one of the biggest names in the nba is paying up. dallas mavericks owner mark cuban agreeing to give $10 million to women's and domestic violence organizations, after investigations substantiated numerous examples of sexual harassment going on within the organization going back decades. stephanie gosk has more. >> mark cuban says never in his wildest dreams could he have imagined the misconduct detailed in the independent report happening underneath him. but now he's vowing to make things right. this morning billionaire dallas mavericks owner mark cuban taking the blame. >> everybody has every reason to question me. but i just wasn't there. and that was my fault. >> reporter: cuban apologizing after a 7-month independent investigation found sexual harassment and other improper workplace conduct within the mavericks' organization over a period spanning almost 20 years.

>> there were many instances of sexual harassment, physical violence and threats and intimidation against women and threats and intimidation also against male employees. >> reporter: that investigation launched after a bombshell "sports illustrated" report earlier this year that detailed a corporate culture rife with misogyny and predatory sexual behavior. cuban agreeing to give 10 million to groups committed to supporting the leadership and development of women in the sports industry and combatting domestic violence. >> i'm sorry i didn't see it. i'm sorry i didn't recognize it. >> reporter: investigators say cuban was unaware of alleged misconduct by the former president and ceo that ranged from inappropriate comments to touching, to forcible kissing. the report did find cuban engaged in times in sensitive decision making on disciplinary issues. most often without full or accurate information, something the colorful mavs owner --

>> either you're going to make it or not -- >> reporter: also known for his stint on "shark tank" now say he regrets. >> the pain people have shared with me as this happened. the tears that i saw, are just -- it hurt. >> reporter: before the investigation was completed cuban had already made changes within the investigation. bringing in a female ceo. >> we have a speakup culture now. >> reporter: cuban now looking to set an example. >> the goal even more than the money is for me to get out there and teach others from my experiences. >> reporter: others have not responded for the request for comment. investigators say the former ceo denied inappropriate touches instead acknowledged touching knees and complimenting women. mavericks are implementing a training program for staff on domestic violence and sexual harassment. breaking overnight kim jong-un is calling for a second summit with president trump in the near future.

that's according to moon jae-in who just finished up a three-day summit with the north. moon says kim wants to complete denuclearization quickly and focus on economic development. moon says he'll carry a private message when they meet in new york next week at the united nations. all right. it is time for the first check of the weather. dylan has the forecast. >> good morning. we do focus on the river flooding through north and south carolina. there are several rivers still in major flood stage. all of these pink diamonds is where the rivers are in major flood stage. it looks like they'll flood their banks all the way through the weekend into parts of next week. that will remain a story that way. another area is back through southern minnesota. also through eastern south dakota. we have several thunderstorms and torrential downpours moving through northern iowa as well. this has been a slow-moving system that's been in the same area for several days now. we are going to see today the threat of some severe weather. the most notable things we could see today will be large hail,

damaging winds. but we can't rule out an isolated tornado. tomorrow the front slides farther east moving into the interior northeast back through pittsburgh and ohio and into parts of west virginia. large hail, damaging winds. again, a possibility, along with torrential downpours that could lead to some flash flooding. here's the system. temperatures into the 90s ahead of it. behind it, 60s and 70s. it's the clash that's creating the stronger storms. the clash in temperatures. this will move east into friday and again the flash flooding is a possibility along with the stronger storms. that's a look at the weather across the country. we'll get to your local forecast in the next 30 seconds. does this map show the peninsula trail? you won't find that on a map. i'll take you there. take this left. if you listen real hard you can hear the whales. oop. you hear that? crews were dispatched and they found two folks stuck on a cliff. they're in stable condition. they found another victim in the water who was in critical condition. they were able to rescue him. it's still under investigation why they were there in the first place. >> all right. very big mystery. luckily they were rescued. meantime, those are cold waters we're talking about there, kari? >> yeah, the water temperatures only about 60 degrees. as we've seen the air temperatures warm up. san francisco, a lot of sunshine and highs heading up to 75 degrees. our hotter temperatures will be in the inland valleys. mid to upper 90s as we'll reach the peak of the heat and a high fire danger today. let's see how the roads are moving now with mike. >> we have a slower drive west 24. the crash marked is eastbound. may be a distraction or the commute westbound. we're looking across the rest of the bay, north 101 at lawrence

when she sexually assaulted her. when both were teenagers back in the '80s. it's a claim that he strongly denies. there's a monday hearing both kavanaugh and the accuser are invited to attend. it's unclear if she'll show up. president trump urged ford to speak publicly, but as hinted his support of kavanaugh may not be ironclad. >> if she shows up and makes a credible showing, that will be very interesting and we'll have to make a decision. >> the president signalled wednesday he also has no plans to order an fbi investigation into the claims. scary moments in sugarland texas, wednesday, after a plane crashed on to a busy road and slammed into a pair of vehicles. the plane was carrying three federal drug enforcement agents. officials say they were on a training mission when they experienced some engine trouble. one of the pilots was taken to

the hospital. nobody on the ground was hurt. drivers say they feel lucky to be alive. a police officer is being credited for saving the life of a woman after a frightening close call. it happened about 45 miles northeast of dallas. the officer is on the scene of an accident when all of a sudden a truck comes flying around the corner, look at that. well, that was a quick thinking officer. he grabbed the woman. pulled her to safety. the truck slams into the other car. nobody was hurt. police want to tell people slow down when you're rounding a blind curve like that. now to a crime that has residents in washington d.c. on edge. a tech executive attacked and killed while she was on her evening jog. and overnight, an arrest in the case. nbc's garrick haake joins us with the latest. good morning. >> reporter: good evening. police are about to announce the arrest of the death of a young woman. this attack really has not just this neighborhood but all of washington d.c. a bit shaken up. you had a young woman out for a jog in the early evening in a

neighborhood most people think of as perfectly safe. a terrifying crime in the nation's capital. >> i'm pretty scared. >> we believe a single assailant stabbed sher. >> reporter: 35-year-old wendy martinez, a tech executive and avid runner killed while jogging in the logan circle neighborhood. martinez staggering into this chinese takeout restaurant. customers desperately trying to save her life. >> she collapsed. they tried to provide medical assistance to her. she was taken to a local hospital where she was pronounced dead. >> reporter: police release this surveillance footage showing the assailant. >> we have a look out at this time. a single assailant who was wearing a long-sleeve mustard colored shirt that's about thigh length. >> reporter: martinez lived blocks away in the neighborhood. thought to be one of d.c.'s safest. >> i walk by here every day to walk the dog.

never felt uncomfortable. >> reporter: martinez got engaged last week. her family releasing that wendy karina martinez was the light of our lives. not only was she an avid runner, but she was a devout christian. wonderful friend and a driven professional. everything you hope that a daughter and friend could be. the attack leaving other residents stunned and scared. >> as a runner it's pretty terrifying. you think running on lit streets you'd be safe. i mean, that's mind boggling. >> to find out at 8:00 during peak commute someone was stabbed, a random jogger, that's terrifying. it's super scary. >> reporter: this case has drawn an enormous amount of attention both here locally in washington, d.c. and nationally. in part, because the crime does appear to be so random, taking place in the early hours. police say they don't believe the victim knew the suspect. they don't believe it was a robbery attempt. in the logan neighborhood of washington, d.c. only about a mile from the white house.

we want to share a moment for someone we loved. mark koz low passed away earlier this week. mark, or koz was an institution here at nbc. he started as a college intern in the 60s. he was hired as a copy boy in 1979, and most of his years here were spent in our washington bureau. he covered everything. in 2012 he went in search of the sunshine and transferred to our miami bureau. he was a topnotch journalist, great writer and producer. he could tackle any story no matter the subject, and for the "today" show alone he produced more than 2300 stories. his sharp wit and infectious laugh for relegendary. he was a dear friend to all of us. we will miss him. i have to say i feel so lucky because i got to work with him for many years in washington.
