know it's going to be another warm day. here is a look at our transit forecast as we head over to fremont out the door to the b.a.r.t. station, in the upper 50s. you'll need a light jacket to start and upper 70s as we go into the afternoon. later on this evening, our ice cream truck our treat truck will be at the walnut festival from 4:00 to 7:00 at heather farm park. you want to check that out because temperatures there will be warm. we'll talk about our microclimates coming up. mike, you're tracking two slow spots. >> i am, overall the speed spend sores around the bay are in green and for most of the bay that means the two slow spots stick out. we'll focus on the tri valley over here, 84, right typical for the last couple of weeks, focused slowing continuing to work on that side there. widening the roadway but overnight it narrows. over here 880 shows a slower drive toward hayward off of 238 so that still remains with the slower drive still remains that's redundant. we'll move on then.

looking toward contra costa county an easy flow of traffic, backup for the cash lanes starting to ease as they're opening the last two cash lanes at the bay bridge toll plaza. no problems getting through the maze for the upper east shore freeway and toward the bay bridge we have as we talked about the cash lanes off to the right, starting to ease up. they've opened all the cash lanes and we just opened the last one on the left so we see folks kind of moving in toward that toll plaza. back to you. >> thank you, mike. 5:01 right now. palo alto professor accusing brett kavanaugh of sexual assault may end up testifying after all. >> overnight nbc news got a copy of an email from her lawyers and lays out what appears to be negotiations over how and when it might happen. nbc bay area's tracie potts is live on capitol hill with the very latest. good morning, tracie. >> reporter: hi there, kira and marcus. good morning, everyone. here's what we know. they're talking, they're trying to figure out how to get this to happen, but not by monday.

in an email obtained overnight by nbc news, attorneys for christine blasey ford say she's too busy dealing with death threats to prepare for the hearing monday. written testimony by this morning's deadline won't happen. everything else they say is negotiable including her desire for the fbi to investigate her sexual assault claim against supreme court nominee judge brett kavanaugh. >> let them give us an impartial report. what is so difficult to do that? stop the playing games. >> reporter: ford is asking that kavanaugh not be in the room when she testifies and she wants him to go first. they're asking the senate judiciary committee to limit cameras plus she wants the committee to subpoena kavanaugh's friend mark judge who she claims witnessed the assault, that's reportedly been denied. they did agree to guarantee her security. >> we'll let it play out, and i this i everything's going to be just fine. this is a high quality person.

>> reporter: president trump in las vegas last night standing by his nominee. as dozens are arrested on capitol hill, standing by his accuser. one of the other conditions she's asking for, no questions from an outside lawyer. normally the democrats and republicans on the panel ask questions when there's testimony, and that's what they're pushing for. kira and marcus? >> certainly one a lot of people will be following. thank you, tracie. >> it is 5:03. two community meetings are scheduled after multiple threats at one high school. the pittsburg police department and unified school district are teaming up to speak to parents and students focusing on how better to work together to handle social media threats at pittsburg high school. five students were arrested in connection with violent threats posted online. meetings will be held on tuesday

and next saturday. the san jose catholic diocese is calling on anyone who has been victimized by a priest to come forward and talk about it. now it's one part of a reformed plan the bishop announced one week ago. >> "today in the bay's" kris sanchez is live in san jose. what do we know about the listening session that's planned for tomorrow? >> reporter: well we know that these listening sessions are open to anybody who wants to show up at the listening session, and that this is just one of three sessions planned over the next six weeks. but that's about all we know. we did try to get more details from the diocese. i tried all week long, and i failed. they said they just didn't want to add anything to what the letter, the bishop's letter said released last week. the listening sessions will seek input from congregants about the past reform as well as anyone victimized by clerical sexual abuse or one of their family members has. the first planned for tomorrow

at 10:00 in the morning at our lady of the rosary hall in palo alto. i'll put that up on twitter for you. we talked with the ywca which provides services for people who are sexually assaulted. the ceo says any part of any change has to include prosecution. >> sexual assault is a crime so let's start there. it is a crime that ought to be investigated and the system needs to be centered on justice for survivors, not on protecting the powerful. >> reporter: now in addition to the three listening sessions scheduled over the next six weeks, the bishop says the diocese will release the names and status of all priests credibly accused of abusing children or vulnerable adults and the bishop commissioned an independent review of all diocese records to see how allegations have been handled in the past. that review will be done by a former fbi director. the san jose diocese is the first in the bay area to come public with the names and status of any priest that is credibly

accused and that is promised to be out by mid-october. in san jose, kris sanchez, "today in the bay." >> thank you, kris. 5:05 right now. the celebration today for the completion of the replacement dam of the calaveras reservoir. the nearly 100-year-old reservoir saddles santa clara and alameda county provides water to 3 million people. it has a new seismically safe dam. earlier this month, the reservoir was at the epicenter of a 3.4 magnitude quake. engineers inspected that new dam and found no damage. it is 5:06 right now. here is a live look from sfo this morning. wow, completely clear out there. looks beautiful. clear skies will make for a seemingly smooth day of travel. however, last night was a little different. you've heard of snakes on a plane but how about birds? this is video from one passenger on a united airline flight from

sfo to newark, new jersey. a bird got into the main cabin before takeoff. the flight was delayed shortly as crew members tried to shoo the bird from the plane. they captured it with a hat, took it off the plane where it promptly took off. colin kaepernick has now been chosen to receive harvard university's highest honor in african-american studies. kaepernick joins a list of past award winners that include mohammad ali, maya angelou and w.d. u w.b. dubois. earlier this month he was the centerprice of nike's 30th anniversary just do it campaign. could colin kaepernick make a comeback with the raiders or patriots? kaepernick's attorney hinted to tmz that he may soon be signed to one of those two teams.

there today reaching up to 92. we'll be at 91 in livermore and in morgan hill. 90 degrees if you were out there yesterday, and you are in some of the warmer spots. it seemed like you just snapped and suddenly the temperatures were hot, so expect the same thing again today, with a lot of sunshine. now, as we head over to mike, you've got an update on a crash. what's happening? >> rushing in over here, sorry, my fault. my fault i was rushing in because i wanted to tell folks what just came into the traffic center, northbound 880, we're really seeing some slowing just over the last couple of minutes, and we do have a new crash. it was reported just a fender bender, and then it sounds like we may have actually only one lane open right now. north 880 from the coliseum past high street as you make that curve we have a lot of slowing, that's just showed up on our sensors. so watch this. west 580 a great option for you, almost no traffic over there. nimitz freeway an issue out of hayward, san leandro and in past the coliseum. we'll track that as chp arrives

three right lanes right now. i'm checking on the status to let you know about injuries and tell you what we find, coming up. good morning, i'm courtney reagan at cnbc global headquarters. here are today's top business headlines. wall street set to open higher after a record day yesterday. the dow and s&p saw fresh all-time highs during the trading session and the dow notched a record close. also on pace for its best week in more than two months. financials led the sectors this week on track for the best week for the group since may. data on manufacturing and services is on deck this morning. fda chief scott gottlieb telling cnbc the agency could fast-track the review process for ecigarettes. the company plans to prevent teens from using their products by gottlieb says teen use has reached "epidemic levels."

possible prevention include bluetooth features that disable the ecigarettes near schools. they are interested in discussing those types of ideas. facebook is getting less hands on with presidential campaigns according to bloomb g bloomberg. the change comes after the social networking giant came under scrutiny for providing strategic support to the trump campaign in 2016. the company offered identical support to the clinton campaign but clinton's team declined. facebook will provide general campaign advice through its political advertising advice and offering tech support and training to candidates. back over to you. >> thanks, courtney. finally, a new way to weed out those annoying robo calls. it's a program called stir shaken and phone companies can use that program to authenticate every phone number. it would also flag or block robo calls. the problem is stir shaken appears to be on hold. the fcc hopes some companies

will implement it next year, but consumer advocates want to know who will pay for this. one report estimates that half the phone calls on your cell phone received next year will be that of a robo call. we've seen a drill people lining up overnight getting ready to buy apple's newest products. we have the scene from the downtown palo alto store, usually a hot spot, beginning at 8:00 a.m. today, and apple watch will go on sale. the first person in line got there tuesday night. >> i always enjoy meeting people in the line and it's just a fun experience. >> apple unveiled three new iphones last week. the most expensive one starts at $1,100. the company's new watch comes with the first ever over-the-counter ecg which can detect irregular heartbeats, which is so cool, but i just got my husband an apple watch last

high in gilroy reaching 91 degrees. 88 in downtown san jose. coming down just a few degrees from yesterday but still pretty hot, 93 in danville, hayward 85 degrees and 66 in half moon bay. r redwood city 85 degrees. marina district up to 89. up to 79 in mill valley and 93 in yew hiukiah. as you make beach plans enjoy your time. half moon bay highs in the mid-60s and cool and breezy as we go into the afternoon. as we go through the weekend, fall officially begins early tomorrow morning. we're looking at highs in the inland valleys in the upper 80s. and we'll drop back to the mid 80s by sunday, and then heat up again early next week. wednesday is going to be hot, 94 degrees. and for san francisco, we will see the clouds and the fog return tomorrow morning, and that will help cool us off just a bit, but we'll still see those changes headed our way for next tuesday into wednesday.

mike, now you have an update on the crash in oakland? >> i do. we just got information on the phone from chp, they have updated us and let me show you first of all, overall the bay looks great. the focus right now is the nimitz freeway. we talked about oakland, north of the coliseum, and actually just north, actually approaching the coliseum, you'll see the slowing. we have green to red right here around 98th, moving up past just shy of high street and actually the red turns to yellow. chp is on scene. the crash first of all the good news, minor injuries at most and that's good news. there are three cars involved in this crash, and they've scattered across lanes and that's why only your left lane is open. now as tow trucks arife and they have three tow trucks that have been called they may be clearing things quickly once they arrive. this may happen over the next couple of minutes because we see slowing there starting to ease up just north of high street so we'll track that. that is your slow spot. if you have a choice for 580 or

880, 580 is the choice, passing the warren freeway through piedmont and everything else is great toward the bay bridge contra costa county, throughout the north bay no problem in toward san francisco. overnight you might hear people complain being this. last night, getting across the golden gate bridge was a nightmare from the city up into the north bay. remember, overnight roadwork continues there. actually it's off the roadwork, working on the barrier below. they had lane restrictions and eagles concert at at&t and that might have been an issue for a lot of folks having a big delay getting out of the city. in oakland a delay for b.a.r.t. riders you have to use the bus through west oakland. the closure, track replacement work and i'll post a picture and that notice coming up. back to you. >> mike, thanks. i missed don henley last night, i'm sad. 5:20. coming up carolina cleanup, the local help with florence and new pledge of support from a bay area sports superstar. plus a new warning from

5:4 right now. bay area team that helped rescue numerous hurricane survivors in the carolinas is back home this morning. members of the alameda county's urban rescue team arrived last night at oakland airport. they spent nine days there, in the carolinas, helping the neighborhoods hit hard by hurricane florence. many areas are still flooded. >> we were in waist-deep water, walking around with rain coming up from the bottom, rain coming up at 40 miles an hour. >> some of the team members stayed behind for more help. they're supposed to arrive home on monday. 41 deaths are now being blamed for the storm. warriors star steph curry joined the florence relief effort in his home state of north carolina. curry grew up in charlotte. he's been tweeting details about

a new fund-raising website. as of this morning, more than $55,000 have been donated to assist for hurricane florence. the goal is $500,000. in cases of alzheimer's disease are only increasing. medical experts have now a new warning. they say today's youngest generation will likely face the disease even more. >> according to this new study, the rate of alzheimer's will double by the year 2060, that's just about 40 years away. it projects 14 million people will get the disease, and hispanic americans may likely see the greatest increase because of population growth. experts say white people still have the largest total number of alzheimer's cases. when it comes to learning, there's a big difference between girls and boys. >> that is according to a new study at least that also shows a big reading and writing gap. according to researchers, girls in the u.s. tend to read and

blues. i don't think you'll have the blues, thinking that we are looking forward to some cooler temperatures, but not today. as we get a look at those highs in cupertino, we're heading back into the mid 80s today. that morning commute for martinez, it starts out cool, as temperatures drop down there into the upper 50s but it's going to get hot again today, reaching 83 already by noon, as we reach into the low 90s around that area, inland valleys. some low 90s. we'll talk about what's going on. mike, you have a traffic alert for oakland. >> not so cool already for the morning commute. less bad news i guess is chp reports minor injuries at most for this crash northbound 880, just north of high street. now you have all but one lane blocked. only your fast lane is blocked and that's moving slowly past the coliseum because there are three cars that are kind of scattered across the lanes. three separate tow trucks are called and once they get there perhaps through the backup or san leandro street, then they'll

be able to clear this hopefully quickly, what chp anticipates. there's lighter volume of traffic around the rest of the bay. you see all the feeder routes toward the bay bridge, there's a disabled vehicle. i'm going to check, once the bridge crew gets there. sounds like it's out of lanes. we see slowing at the toll plaza. they may turn the metering lights on once that happens. right now there are no metering lights, friday light at the bay bridge. traffic held up north 880 by the coliseum, but the rest of the bay shows a light friday drive and that's what we're expecting and we hope gets back to oakland over the next few. par b.a.r.t. is a good option. over to you guys. b.a.r.t. is under a new investigation "san "san jose mercury news"" claims the crack down on toll payers that b.a.r.t. targets african

who fail to pay. >> reporter: b.a.r.t. says they lose about $25 million a year in lost revenue when riders ride without buying a ticket. b.a.r.t. police have been cracking down and that's where the problems begin. the ""san jose mercury news"" reports between march and july b.a.r.t. issued more than 3,000 tickets to passengers who were riding without a ticket. but 41% of those fines went to african-americans, even though they only make up 12% of ridership, that compared to for example white passengers who totalled about 44% of b.a.r.t. riders yet 23% of the tickets. critics of the findings says this points to bias but b.a.r.t. is criticizing the article saying it looks at a two-week period but those two weeks was the only data that b.a.r.t. gave to "the mercury news" for the story. b.a.r.t. claims they work to remove any bias from their program for protocols. fare inspectors are told to start at one end of a train and

move from one passenger to the next, without skipping those in between. another problem according to the article is b.a.r.t. police are allowed to issue a warning instead of issuing a ticket, another area where bias can become a problem. b.a.r.t. will issue a more thorough response to this report. they hope to have those numbers out later on today. we'll keep an eye out for that. we'll have more coming up at 6:30. reporting live in millbrae, "today in the bay." >> interested to see the numbers, thank you. new this morning, the the california lottery under investigation but not for money. according to "the sacramento bee" the attorney general's office is reviewing an alleged misconduct case after an anonymous letter was sent to the governor's office. it apparently included photos showing an executive putting his head under a woman's shirt. according to the letter writer, it happened at a piano bar while lottery employees were on a work-related trip. some employees are now demanding senior department executives

resign. google has a warning for specific group of people, watch your personal email accounts. the internet giant says that foreign governments are trying to hack the accounts of u.s. senators and their aides and they're likely trying to sell steal passwords as well. oregon senator ron widen sent a letter to leaders notifying everyone that personal email accounts were being targeted and that the hackers may have started their work more than a year ago. google representatives also say there's a chance it may be a false alarm. >> 5:4 right now. a battle over the future of a downtown is heating up in the east bay. today, one side will rally while the other side will continue to collect signatures to overturn a decision by the city council. >> "today in the bay's" bob riddell is live in livermore. bob, you've spoken to both sides. what do they have to say? >> reporter: good morning to you, kira and marcus. the issue is over to you to develop this eight-acre plot of

land here off railroad avenue off the main drag in downtown livermo livermore. last week the council voted 5-0 to approve a plan as could you see in the renderings will include parking, boutique hotel, affordable housing, space for retail and cultural events and stockman's park named in honor of this town's cowboy culture. long established organization called friends of livermore backed by a local independent newspaper and self-proclaimed grassroots activist launched a petition drive outside local stores to reverse the council's decision. if the group can collect 5,000 signatures, voters will get to decide in november on whether or not to force the city council to go back to the drawing board. friends of livermore believes the current plan calls for too much housing at a location of the hotel and parking are misplaced and there needs to be more green space. later this afternoon at 2:30, another group called unify livermore that includes the chamber of commerce and the wine growers association they'll hold a rally to discourage citizens from signing that petition. unify livermore says the

citizens have already spoken, points out the city did conduct months of public outreach and believes a referendum could delay if not destroy this development. do you think the process has been fair? >> do i? no, i don't think the process has been fair. >> reporter: how come? >> in any city government the city council control the message, they control the information. they control the agenda, and it's very clear to us, having been involved since 2000 -- well, two and a half years ago that the city council wants certain things to happen, and they've been guiding the process to allow certain things to happen, and we've been objecting to it. >> it's a well thought out plan. community came together. lots of studies, the city engineer, the traffic studies, the circulation studies. i mean, the process had worked and the whole adage the facts are on your side, tell them the facts if the facts aren't on your side, pound the table. the other side is pounding the table, frankly.

>> reporter: -- how far they love livermore, they want what is best for this town in i would country. both sides obviously have differences of opinion on how to achieve that. reporting live here in livermore, bob riddell, "today in the bay." >> bob, thank you. 5:37 right now. new homes are also coming to the east bay. concord just approved plans for an upscale apartment complex that includes 200 units and some shops. this is what it will look like. it will actually be located on grant street. this is near concord b.a.r.t. station. that project is set to break ground next summer and be ready by the year 2021. move over cars, bikes and scooters are taking over downtown san jose roads this sunday for the third annual viva kayei. this is what it looked like last year. this map shows where it's happening, a six-mile stretch centered along monterey road and

and electric scooters have been banned. this map along monterey road past the fairgrounds, it runs from 10:00 a.m. to 3:00 p.m. on sunday. good opportunity if you're going slow through the area, find out some of the local restaurants, there are places to stop, a nice way to meet the neighborhood. the entire south bay looking good. little slowing typical for 101, even on a friday, right there, about this time. atypical, the big problem is oakland. the traffic alert continues northbound 880 as you pass high street. all but the fast lane is blocked. one lane open north 880 jammed up from 98th, haghaganberg he n northbound toward bay bridge. the crash waiting on three tow trucks. westbound 580 is a good option. san leandro and surface streets more traffic. toward the bay bridge north of there, or otherwise is just

fine. the bay bridge some folks might be avoiding oakland getting there and head south the san mateo bridge, watch for a change in flow right now. looks like it's good over on the right. >> it's always good on a friday, as we look forward to the weekend. key remark the thing you're talking about, a lot of time it's good to have you around because earl whier this week we thought it was going to be cooler. >> it's not going to cool off this weekend unfortunately. only coming down a few more degrees, and as you make plans for the weekend, you'll be able to cool off with some free ice cream this evening, so that's a great week to kick off the weekend. these numbers look at that, 81 degrees in walnut creek, as you enjoy your time out in the sun. it will be very warm one, at least to start, but it will cool off fairly quickly, by 9:00, we're at 66 degrees. so for your forecast for saturday, we'll still have a wide range in temperatures from the coast to the bay to the

inland areas. we'll still be reaching into the upper 80s inland. and then on sunday, still looking at some 80s but it comes down just a few more degrees. as we enjoy the first full day of fall. now, tomorrow i'll be out at the disaster preparedness day in san mateo from 10:00 to 1:00, talking about being prepared for natural disasters and bringing storm ranger so it's like a win/win. the weather will be perfect in the upper 60s at noon and we just talked about, this the route for viva kayei on sunday in san jose and the temperatures start out comfortable. if you get out there early with the family you'll enjoy your time a little bit more because we're looking at some 80s in the forecast for sunday during the afternoon. if your weekend plans include going hiking, it's going to be beautiful. not as much in the way of fog and highs reaching into the upper 60s, with some sunshine. if you're going to heavenly this

during the middle of the afternoon. great day to be outside there but you make your way inland and it was not so nice to be outside. as we look at our numbers this morning, as you get ready to head out the door, we have numbers all over the place. right now the temperature in half moon bay 46 degrees. you head to san francisco, and it's 60 degrees so look at that short distance and the wide range in temperatures there. oakland 55. it is 59 now in hose . to the pleasant hill b.a.r.t. station a cool start with mid-50s and later today, we'll see those temperatures going into the upper 70s by 11:00 and 82 degrees at noon. it will be a hot day so if you're planning to go for a workout in morgan hill, we are definitely recommending that you get out there early, but it's going to be a little bit too cool this morning, around sunrise. 52 degrees. so our high temperature is still going to reach into the low 90s and the south county. 90 in morgan hill. 91 in the tri valley and concord

update from chp north 880, all lanes are cleared at high street, that should improve, traffic flowing past the coliseum. in the backup two other fender benders both moving off to the shoulder. the one at 66th cleared. the one closing to haganberger may be cleared. i'll double check with chp. that's the slow drive. let me get you out and show you the maps, a smoother drive for 580 through the area. how much better is an alternate? let's look at the waze system as we're mapping up the times. if you take the 880 travel through castro valley and over toward the bay bridge, it's about 35, 36 minutes right now. if you take this route, 580 that i've been talking about, that saves you half the time. 15 minutes is a big deal this time of morning, doubling your commute if you go from castro valley on 880, take 580. the nimitz should improve as we get back out to the maps. chp did talk about all lanes clearing. expect more delays, more distraction and bay bridge metering lights were just turned on a few minutes ago as well in

southwest airlines is under scruitny after a former 5:55 right now. new for you this morning, southwest airlines is under scrutiny after a former employee filed a discrimination claim against the airline. >> he says other employees created a whites only break room at a houston airport. jamal parker says the segregated room had been around for years at the airport and its existence was common knowledge. parker was fired in 2017. he said he just wanted equality in the workplace. >> within that is fairness. you know, like you want to be treated like everyone else is being treated. so i wanted to feel like i am in a place where things are equal, and you know, i wanted to go back to work. >> the lawsuit also claims black employees found a knotted rope at a southwest airport gate. southwest airlines says it cannot comment on pending litigation but the airline issued a statement saying it
