"today in the bay" continues right now. >> a lot of news to cover on this tuesday morning but first, want to say good morning to you and thanks for joining us. i'm laura garcia. >> and i'm marcus washington. mike has a look at traffic in a moment but first we start with meteorologist kari hall. you've been telling us, it is going to be a hot day out there, even a spare the air day. >> spare the air day, high fire danger and ten tours are going to be hotter than yesterday in the inland valleys. as we start out this morning, a nice refreshing breeze and temperatures in the mid-50s as you step out. as we head over to east san jose to the neighborhood of evergreen, our temperatures go from the upper 50s at 7:00 or at 8:00 to the mid 80s by early afternoon. let's head over to concord, where it will be hotter today. look at those numbers, at 3:00

we're at 89 degrees. we'll talk about all of our microclimates coming up in a few minutes. mike, you have an update on the wrong-way driver. >> the update say good one. no news is good news in those situations. there hadn't been an update in the last few minutes and chp cleared it from 680 right there between capital and calaveras. it might have been only on the on-ramp, somebody decided that wasn't for them and they were able to clear quickly. you is ayou that map, showed no major delays, in fact no real surprises oyou the there. over here highway 4 shows the biggest change over the last few minutes as far as what stands out, but i want to take you to the north bay. an easy drive down the east shore freeway from once you cross the carquinez bridge. getting there is slower, vallejo westbound 80 and west 37 out of vallejo, those are the two areas that are showing us the north bay commute, the longer drive is really starting to kick in toward novato and down toward the east shore freeway. across the bay the san mateo bridge even though there aren't any sensors other than green across the span, you do see a lot more company for you, folks

the commute is building. back to you. >> all right, mike, thank you. 6:01 right now. new this morning, a fuel leak at sfo is canceling a valeras flight to mexico. a viewer shot this video for us last night. the plane was supposed to take off around 1:00 this morning, but then about ten gallons of fuel leaked. he says that crews are still cleaning up jet fuel off of the tarmac. that flight is canceled and the airline is working to get passengers on to other flights. we're working to find out what caused that leak. no other flights are affected. >> 6:02. >> now to developments with supreme court nominee brett kavanaugh, defending himself ahead of a key thursday hearing over the alleged sexual assault accusation >> now a third woman is accusing him of sexual misconduct. accused of here and wants to make sure his reputation stays intact and gets a fair hearing. third accuser we don't know who she is or details of her alleges but her attorney says she's going public in 48 hours before the hearing. >> i'm not going anywhere. >> reporter: judge brett kavanaugh on fox last night with his wife emphatically denying three allegations of sexual misconduct. >> i've never sexually assaulted anyone, not in high school, not ever. >> reporter: he is set to appear at a hearing thursday with dr. christine blasey ford. she claims kavanaugh attacked her at a house party in high school. a second woman, deborah ramirez, tells "the new yorker" kavanaugh exposed himself in college. >> we have someone on the record who remembers him who describes him as often incoherently intoxicated. >> reporter: now an attorney says he represents a third kavanaugh accuser who will go public before the hearing. >> we've asked the committee to allow her to testify.

we've asked the committee to turn this over to the fbi. >> reporter: president trump is standing by his nominee, blaming democrats for false accusations. >> this is a fine man, and we certainly hope he's going to be confirmed and quickly. >> reporter: republicans are promising a quick vote. >> and it's not untypical for our friends on the other side to pull that kind of crap. >> i think this is exactly why victims of sexual assault and abuse for decades have hesitated to come forward. >> reporter: thursday's hearing, a chance for ford to tell her story, a chance for kavanaugh to clear his name. now we do know that dr. ford plans to come here and testify on thursday. her attorneys have confirmed that. what we don't know are the details of that hearing. her attorneys say they're still being worked out. back to you. >> a lot of people are following this one. tracie, we will continue, thank you. >> exactly. so many people are talking about it. some are saying the controversy surrounding the

kavanaugh allegations is actually a teachable moment, regardless of what really happened. that's the gist of a letter sent out this week by the superintendent of santa clara county schools to all 31 school districts. the letter is urging teachers to "create a culture of open dialogue within our schools and communities about safe and healthy relationships as well as proper conduct, investigations and reporting structures." we spoke with one mother who agrees. >> the more we talk about it, the more it's easier to talk about, and i think the more people have courage to come forward. >> superintendent marianne dylan says the debate is prompting the county to review policies and procedures tied to sexual harassment claims. there's a scandal engulfing a south bay police department. san jose officer is filing a lawsuit against his own department. >> bob riddell is live outside of sjpd. what is that officer alleging, bob? >> reporter: well, good morning

to you there marcus and laura. san jose police officer nabil haidar, who is lebanese-american and muslim accuses some of his fellow officers of taunting him in the years after the 9/11 terrorist attacks. according to officer haidar, he says that he was discriminated at work by some of his officers when they called him things like bin laden and taliban. they allegedly joked he was a suicide bomber or member of isis, among other allegations. you'll recall nbc area broke this story in may when officer haidar filed an administration claim with the city, and he filed another claim with the california fair department of employment and housing in july, after exhausting all of those administrative options he received a right to sue letter from the state and that's what he's doing right now. the lawsuit names the city, the department, police chief eddie garcia and five other officers. the city says it has yet to be served with the lawsuit but the city attorney did respond, i'm quoting, "the city and police department take seriously all

allegations of race or religious discrimination. however, based on the claim filed by mr. haidar with the state department of fair employment and housing and our subsequent investigation, we have not seen a basis for liability against the city." haidar, who is a 21-year veteran of the department, was once suspended for a week after a citizen complained he made several unflattering racial stereotypes related to asians. reporting live outside san jose police department, bob riddell, "today in the bay." >> bob, thank you. 6:07 right now. and developing story for you, this frantic search continues for a 6-year-old boy who was taken from his home in modesto by his father. you may have gotten that amber alert. here is the boy's mother explaining what happened. >> then i went to the car, and i got in the car, and i still couldn't get him, they pulled me out, they hit me. >> now police say that jayce cosso was abducted yesterday by his father, john cosso and five other people.

now the father allegedly used pepper spray to force his way inside and they say he was last seen driving a 2012 black ford fusion. an amber alert has been issued for several counties, including santa clara, contra costa county, and alameda counties here in the bay area. we've posted details on other person of interest on our website, that's nbcbayarea.com. >> hope they find that little boy. berkeley police may soon face new limits in how they post photos of people arrested during protests. tonight councilmembers will vote on banning police from posting the mug shots of those arrested unless they pose an immediate threat to the public. leaders came up with the measure after police released the mug shots of anti-fascist counter protesters arrested in early august. critics argued it reft those people vulnerable to harassment and personal attacks. right now it's 6:08. we are feeling some cool temperatures this morning, as you get ready to head out the

door, and we start out with clear skies, but heads up. it's a spare the air alert day. if you have breathing problems, you do need to limit your time outside. it will be most unhealthy in the inland parts of the east bay, and santa clara valley. now, as we get the kids out the door for school this rng mo, mot will be one where you need a jacket for the walk to school. 51 degrees in pleasanton and at 10:00, 68 degrees. the kids head outside for recess, it will be nicer and warming up as you head back to school. morning commute in morgan hill will start out with some low 50s there as well, and then reaching at noontime 76 degrees, still comfortable but a hot afternoon ahead. we'll talk about our temperature trend for fremont coming up, and mike is tracking a few of those issues out there on this tuesday morning commute. >> kari, we have slowing on the peninsula right now. i want to call this out although it's not because of a crash. we don't have any major crashes. we have a couple of smaller ones and i'm going to make sure they're not presenting any problems for you. there is the south bay, smoothed

out after our first burst but right there, you see the yellow, orange and red, that's what i'm calling your attention over on the peninsula for the stretch between 280 and skyline and the school and cemetery in the area. we have grinding and paving work that's picking up, and so we have a slower drive. westbound is moving smoothly eastbound for the folks coming over the hill from half moon bay and find more slowing for the next few just shouting it out there, they're aware of it. folks in pacifica are aware of this closure we started over the weekend and continues the one stretch as they replace that overhead bridge, the pedestrian bridge and you can use pacifica -- sorry, oceania or francisco as your options. that's for the locals. everyone else 280, 101 moves smoothly. east bay shows your typical pattern. not so bad coming out of the castro valley area, upper east shore moves smoothly but more traffic comes over west 580 toward the richmond to san rafael bridge. the folks headed toward the san rafael side. we'll send it right back to you.

the white house and escalating of trade war between the u.s. and china. oil prices are higher again today as saudi arabia and others resist calls to raise production. on today's watch list, reports on home prices and consumer confidence, plus the fed begins a two-day meeting. new this morning, facebook is reviewing an unusual legal claim reportedly filed in san mateo county by a former contractor. she says she got post traumatic stress on the job. the woman works at a content moderator and says she was required to repeatedly view disturbing images on facebook pages. she claims facebook ignored workplace safety standards by not protecting workers. in a statement to the "l.a. times," facebook says it takes the support of content moderators incredibly seriously. a major shakeup in silicon valley. the two co-founders of instagram are stepping down, and it might

expose a growing rift between instagram and its parent company, facebook. no word on why they're leaving, but they say that they plan to build something new. it's another setback for facebook, which has taken heat the past two years for its handling of user data, and not cracking down on the spread of fake news. it's unclear who will run instagram. the company's c.o.o. also left earlier this month. now you can shop by snapping a picture. snapchat and amazon's new goal. here's how it works. users can open snapchat. they snap a picture of an object or a bar code and amazon price will pop up and when people tap on the price, they'll be sent to amazon, where they can purchase it. the feature is currently available to a small number of u.s. users. pinterest also has a similar camera shopping feature. i tried it out yesterday. snapped a picture of my own purse and it brings up all these other options of things you could buy. >> i get people all the time on

facebook what kind of dress that? >> they're snapping away on that one right now. >> i still want to you reach out to me on facebook, hey, what's going on? >> look, i bought another kari hall. >> the kari hall collection. >> we already have kari's closet now. let's talk about what's going on this morning as you get ready for the day. all clear skies for the inland areas. nice and cool start. here is a live look at san jose as the sun rises. we are still about 40 minutes away from sunrise right now, and as we talk about the concerns of the day, it's red flag warning in effect and that means that we have a lot of dry fuels and some very low humidity and the winds pick up for those hills and we may have some quickly spreading wildfires today. you have to be careful for any of these areas shaded in red or anywhere across the bay area, because we do have such dry conditions, and also the spare

the air alert day so we advise you to carpool or catch public transit as you make your way out the door in san jose, maybe heading to diridon station, we'll be at 55 degrees at 7:00. cool start and then looking at some sunshine and quickly warming temperatures as we go through the day. at noon we're at 78 degrees and 81 at 1:00 today. and taking a live look outside in san francisco, that's where the low clouds are as of now, and as you get ready this morning, as we look at our frizz factor forecast for styling your hair this morning, if you just run through with the flat iron, you are good. you don't need a lot of oils and air sprays. our humidity will be very low today and for the inland areas reaching into the mid 80s and 90s. we're up to 92 in morgan hill today and 96 degrees in concord, and for oakland 77 degrees. the coastal areas reaching into the mid 80s in redwood city and san francisco, 70 on the embarcadero.

we have hot high pressure right now in control, but we have some changes on the way, and that's going to bring in some much cooler temperatures for saturday. this area of low pressure that moves in will cause the air to rise and the winds circulating around that low pressure will give us a stronger ocean breeze. now, this may also tap into some typhoon moisture that could connect all the way across the pacific, and bring the bay area a chance of rain early next week, so look at our temperatures, and a lot of changes here, going from the upper 90s tomorrow in the valleys to the mid-70s, as we go into the weekend, and on monday and of course i'll have more updates on the rain chances. starting to see a lot more folks on the road, mike. >> we are. look at all the companies for you here west 92, that's the san mateo bridge. i will tell you, over the last five minutes i saw someone kind of more aggressively tap on their brakes and so we had traffic kind of ripple back and it's sorting itself back out to a smoother but slower drive

across that westbound 92 commute. eastbound lighter traffic, that's evident from the live shot but when i show you the maps, the speed sensors don't show quite as much. there is some of the yellow that kicks in there just after the toll plaza. your commute also across the dumbarton bridge shows more. you see that pushing from 880, the orange strip pushing to the peninsula standard. on the peninsula we have the slower drive. the overnight grinding and paving work starting to move a little better between 280 and skyline over there in the high school, just keep things in mind things will continue to recover but it will be slow if you're headed from half moon bay toward 280 for the next few and you expect that you know about the project. over here we know about the build, but there's a little bit of a hangup over here out of solano. we have west 80 at the 680 split, crash over there on the shoulder perhaps sounds like a duplicate there, and a crash here which left a busted axle that has just cleared as you get over toward the carquinez bridge. there's a recovery there. the bay bridge toll plaza still has your metering lights on and you know about the slowing.

takes on impound fees. look at this, a tow and a single day storage will cost you more than $600, nearly 50% more than what it cost in l.a., san diego, new york, and chicago. the new audit headed to the city council today recommends slashing towing and impound fees by more than 75%. san francisco recently reducing its towing fees for the first time and low income earners, but for the most part, those fees remain in the $400 range. >> ooh, you're going to drive next time. >> okay, i'll do that for you. nbc bay area responds to a san jose homeowner who wasn't happy with how her house was repainted. >> she called consumer investigator chris chmura's team for helping. >> 18 months later ann says the paint job looked like this.

84 degrees as you're heading home. we'll talk about all of our microclimates and look ahead to the weekend coming up. but mike, you have some not too exciting news for the roads. >> but kari, that's what we want in the morning. we don't want exciting and that's what we have, a nice, smooth, easy build. this hazard symbol i put it there because there was report of a disabled vehicle which i think cleared but i see more slowing that popped up on the last sensor. i'll check west 237 toward 101. the rest of the bay shows a smooth, easy drive. typical trend 84, 680, 880, all moving down and off of 580 and down toward the fremont funnel. 680 and 808 across mission boulevard, a smooth flow of traffic cocoa county toward the east bay and the bay bridge toll plaza, that's the metering lights on, 25 minutes from highway 4 through the slower drive through berkeley and into emeryville and the berkeley curve and a live look shows you

the bay bridge toll plaza, but we do have these lanes off to the left, starting to ease up a little bit. that's good news and so is the movement over here. you see all that volume coming off 880 so there is a bill east bay commute. back to you. >> thanks, mike. >> 6:32 right now. an upcoming change in u.s. immigration policy has a lot of families in silicon valley abuzz. a proposal that could cut incomes in half for some families working in half. >> "today in the bay's" kris sanchez joins us live from menlo park to talk about the h1b visas and another visa that sometimes comes with them. >> reporter: we're talking about the the h4ead visa which allows them to get a job while the visa holder it working here. let's look at the proposed changes by the department of homeland security, a band on h4 employment authorization visas which are available to spaces of

h1b visa holders and children under the age of 21. there were about 125 of these kind of visas issues last year. homeland security cites unfair job competition for americans and in a court filing wrote the ban could come within three months. now unlike h1b visas which tech companies use to bring in that skilled worker, there is no requirement regarding the education or where these spouses can work and there is no cap on the number of visas that could be issued. this could be a lawsuit filed by save jobs usa who say tech workers were replaced by foreign workers holding the h1b visas. the concern if spouses can't earn an income here the tech worker would choose to leave their position and according to one ceo silicon valley needs that talent.

>> h1b really helps us in terms of accessing a global pool of resources. >> reporter: that change could come within the next three months, and then there is usually a public comment period following that anywhere from 30 to 60 days. lot of tech companies are watching for that. i posted this story both on facebook and twitter, in case you want to take it with you as you head out the door. in menlo park, kris sanchez, "today in the bay." >> affects more people than you think. it is 6:34 today. you might see open teachers protesting, locked in bitter contract talks. organizers say the protest will start at the end of the regular school day at 3:30. teachers are planning to rally at oakland international high school and east oakland's encompass academy. people are suffering serious injuries or death crossing railroad tracks. and new this morning, amtrak and the fairfield police department are teaming up to promote railroad safety.

they say the problem is people have a difficult time judging fast-approaching trains. they're launching a program called operation clear track. as part of the program, local police officers will visit amtrak stations and pass out educational materials on railroad safety. if you're not headed to san francisco today, you probably know someone who is. one of the largest tech conferences in the world is set to take over the city yet again. >> we're talking about dream force. pete surratos, what can we expect in. >> reporter: good morning to you, marcus and laura. we're standing in front of the mosconi center where a ma are the jo of the dream conference is taking place. we expect nearly 170,000 people to attend the conference over the next few days not to mention the dream fest concert taking place tomorrow night at the civic center plaza featuring this year metallica. that will be the band performing tomorrow night. as far as what is taking place

here at the conference, we're going to see about 2,700 sessions taking place. talking about the latest product updates as well as content for specific industries. also you'll see expert panels here at the mosconi center covering a range of topics from marketing to health care to artificial intelligence. when we talk about natural traffic impact to the area we're kind of standing in it between howard street between third and fourth, that will be closed, as they're expecting about 60,000 people here at the mosconi center every day for the conference. the list of speakers you see there on your screen, libby schaaf, jeb bush, al gore, as well as andre iguodala are slated to speak. it's going to be a pretty busy days here for the next few days in san francisco with the conference wrapping up on friday. we're live here in san francisco, pete suratos for tod "today in the bay." >> andre iguodala better make it

catering truck from 101. the slow lane is blocked, doesn't sound like a big deal. 237 and 101 push in with that commute toward sunnyvale and mountain view. right now we see the build and where we see the slowing. that will be the issue as folks traveling toward that area and the rest of the bay. everything else looks pretty predictable. the bay bridge metering lights are on, slowing as you get over from hayward across the san mateo bridge toward those tail lights. everybody's trying to get back over to the peninsula, which is moving smoothly right now. >> remember the song "everybody's working for the weekend"? >> yes, loverboy. >> i learn something new every day with you. >> there you go. >> don't make us feel old! >> i didn't moo enmean it like that. >> and records. >> records? those are those new things that are out, right? >> i was saying everybody's working for the weekend, look at the weekend forecast. >> we are going to have some weather making you think i'm glad the weekend is here because it will be hot during the middle of the week. look at the numbers, by tomorrow

we're up to 98 degrees in the valleys, and then a nice cool, refreshing breeze blows in for saturday and sunday, we'll be in the upper 70s and for san francisco, it's going to be warm for the middle of the week and cooling down, more clouds and fog for saturday and sunday. so what do you have planned so far? maybe going hiking in muir woods, it's going to be a nice weekend for that, although at times we will see the clouds and the fog there. our temperatures will reach into the mid-60s and it's going to be really nice, we're goi arefor gg or headed toward yosemite it will cool off as the weekend goes along starting out with friday and highs in the upper 70s and 61 degrees on saturday, lower 60s as well on sunday. if you're going down to l.a., everything's looking good with some low 70s for saturday and sunday. we'll talk about our temperature trend for today, that's coming up in about three minutes. >> looking forward to it, kari. >> coming up next on "today in the bay," marijuana, housing and school speed zones, all on the

permission to sue san jose, the police department, chief eddie garcia and five other officers are named in the lawsuit. in a statement san jose city attorney says the city sees no basis for legal liability. we could see some lively public comment today when local lawmakers meet in communities around the bay. here are some of the highlights. santa clara county supervisors will take up the stanford expansion issue and the potential impact on affordable housing. the los gatos city council will consider increasing its affordable housing requirement for builders from 10% to 15%, this is for developments with 5 or for units. san mateo county supervisors will consider parking changes affecting unincorporated parts of belmont, redwood city and half moon bay and contra costa county supervisors are taking up four speed zones in school zones areas in kensington. how do you picture san francisco? nearly spotless? that's what a public relations

firm wants to you believe, even though complaints about trash and filth are skyrocketing. it turns out san francisco paid that company. >> senior investigative reporter bigad shaban has new information involving your tax dollars and a government contract raising concerns inside city hall and on the streets. >> reporter: guys, good morning. san francisco averages 180 complaints per day about trash. 67 complaints about human feces, which is why you might think it's strange that someone would give the city a near perfect score when it comes to cleanliness, but it turns out a public relations firm did just that, and you may have footed the bill. that's because the city actually paid the company for that research. the public works department hired the firm, so we sat down with the director to find out why. >> that data is being used to make decisions for the city around cleanliness of sidewalks in neighborhoods. >> reporter: so based on what you know now, should jbr lose this contract? >> it obviously sounds like there are concerns from various

east bay, as well as the north bay, and this is where humidity will be very low and small spark could cause a lot of problems today especially as those winds pick up. we could have some gusts up to 35 miles per hour. so all of these areas in red are under a red flag warning until 5:00 today, and then continues should still improve as we go into tomorrow. as we look at our transit forecast, and you make your way out to the dublin b.a.r.t. station, it is going to be a chilly morning, only 51 degrees but look at how fast our temperatures go straight up, as we look at that temperature trend, we'll be at 86 degrees at 1:00 today. live look from at&t park as we get ready for the giants home game tonight at 58 degrees during the first pitch and throughout the game it will be chilly out there. bundle up. you only need a light sweater this morning stepping out. the rest of the day comfortable with a t-shirt, some shorts and also some sandals. you do have to wear summer gear and throw a little bit of the

winter gear in there as well because of our wild range in temperatures. and i'm watching the weather all the way of what's happening in japan. there's a super typhoon and the way the atmosphere is set up, this could connect all the way across the pacific and move into the bay area early next week, and bring us our first chance of rain since april 15th. so we have some extreme heat and really dry conditions right now, i'm so hoping this pans out because look at our temperatures heading throughout the weekend. we're going to keep it dry for the weekend, just a few more clouds and seeing the chances of rain starting to move in here on monday. i'll have more updates on that and mike, now you have a road closure happening in the south bay? >> i do. we have a reporter headed out to the scene in santa clara. listen up, folks, this is a major roadway. overall san jose looks fine. over here in santa clara lawrence expressway, currently a report of a police investigation going on there.

santa clara police department is on scene between monroe and cabrillo. we're looking toward scott boulevard and bowers the two major roadways good alternates. we're getting kicked into the south bay commute and we have a reporter headed out there to find out exactly what's going on. traffic wise you have to aprobably avoid the area northbound i know for sure has been closed off over the last few minutes. we track this on highway 237/highway 101 northbound and westbound as they come together toward sunnyvale and mountain view we have a disabled truck blocking the slow lane continuing to add westbound 237 is now starting to stack up, coming in out of santa clara. that is a problem for folks out of san jose and milpitas and fremont and an issue for west 237. to the north the dumbarton bridge an alternate for some folks who want to head up and across and moving smoothly. the build for the san mateo bridge to be expected.

here are the top stories on today in the bay-- welcome back. before you head out the door, the time now is 6:54. here are the top stories on "today in the bay." new this morning, a fuel leak at sfo is canceling a valeras flight to mexico. a viewer shot this video for us last night. the plane was supposed to take off around 1:00 this morning, but then about ten gallons of fuel leaked. he says that crews are still cleaning up jet fuel off of the tarmac. that flight is canceled and the airline is working to get passengers on to other flights. we're working to find out what caused that leak. no other flights are affected. a lot of people talking about the unprecedented national tv interview by supreme court nominee brett kavanaugh. alongside his wife,' period yesterday on fox news to profess his innocence. kavanaugh says he never sexually assaulted anyone. he just wants a fair process for the upcoming senate hearing scheduled for thursday. president trump stands behind kavanaugh.

santa clara county superintendent of schools is calling on all 3 is districts to make this a lesson of learning. the letter is urging teachers to "create a culture of open dialogue within our schools and communities about safe and healthy relationships as well as proper conduct, investigations and reporting structures." the debate is prompting them to update procedures tied to sexual harassment claims. a 6-year-old boy abducted from modesto last night is still missing. the father broke into the boy's home and pepper sprayed, blocking the mother from fleeing in her car and abducted the boy. the boy was last seen wearing a black transformer t-shirt and camouflage shorts. they believe they took off in a 2012 black ford fusion with a license plate of 8b2y654.

a lot of people in silicon valley expressing concern over potential changes to the federal h1b visa policy allowing tech companies to bring in talent from overseas. the department of homeland security wants to ban the spouses of workers from having jobs. last year more than 100,000 h1b spouses received h4 work permits. there are fears if spouses cannot work h1b tech workers may choose to return to their home countries. eight expensive to live here. maybe you or someone you know does some ride sharing to earn a little bit of cash. turns out it will take extra drives now. >> a new stid study says uber lyft drivers are earning less than they have to, specifically 63% less than 2017 compared to 2013. jpmorgan chase put out that study. these drivers made $783 per month in 2017, versus $1,469 in
