reaching an 11th-hour agreement to reach the trade pact. canadian prime minister justin trudeau called it a great day for canada while leaving a late-night emergency cabinet meeting. officials say the two sides focused on major issues, access to canada's dairy market and a cap on car exports from canada. the u.s. had had threatened to go forward with just mexico if canada didn't come to the table, but looks like it won't come to that. officials say the new trade pact will be dubbed the u.s. nca, shorthand for the for approval this morning the fbi continues its investigation into sexual misconduct allegations against supreme court nominee brett kavanaugh. president trump ordering the probe a christine blasey ford, testified before a senate committee. some democrats now expressing concern that the scope of the fbi's probe is too limited. the president pushing back, tweeting, "democrats are only thinking obstruct and delay, and

for them, it will never be enough." for more, let's go to nbc's tracie potts in washington. tracie, good morning. so, who has the fbi spoken to thus far? >> reporter: philip, according to our sources, they've spoken to kavanaugh's second accuser, deborah ramirez, but based on the information that was only presented at this committee, the attorney that republicans hired said this charge would never fly in court. in a new memo obtained overnight by nbc news, rachel mitchell, the prosecutor republicans hired, called sexual assault allegations against judge brett kavanaugh weak and says, "i don't think that a reasonable prosecutor would bring this cas" that evidence could be growing. a source familiar with the investigation tells nbc the fbi has interviewed deborah ramirez, the woman who claims kavanaugh exposed himself to her in college. our source says she provided a list of people who can back up her story.

the fbi will also reportedly interview kavanaugh's high school friend, mark judge. dr. christine blasey ford testified judge was there during her alleged assault. but sources tell us no interview is scheduled for the third accuser, julie swetnick. >> the allegation that she makes is outrageous. not one democrat mentioned it. >> reporter: democrats say the white house is handicapping this investigation from the start by limiting witnesses. >> i wanted to use the word farce, but that's not the kind of investigation that all of us are expecting the fbi to conduct. >> reporter: president trump tweets "the fbi can interview whoever they want." >> the white house is not micromanaging this process. >> reporter: their investigation is supposed to wrap up in a week. but our sources are also telling us that the fbi is not scheduled, not planning to talk to any of the classmates who disputed kavanaugh'simhat he wasn't a heavy or frequent drinker in college. philip? >> not much time left to get to the bottom of all this.

tracie, thank you. >> and as the fbi probe into the kavanaugh allegations continues, the supreme court opened for its fall session with just eight justices for now instead of the usual nine. with that empty seat, the court is evenly split, four conservatives and four liberals. here's nbc's pete williams with what's at stake. >> reporter: no matter who ends up getting confirmed, any trump nominee would move the court to the right. whoever the new justice is would become the court's fifth dependably conservative vote, and even more importantly, would replace anthony kennedy, the swing justice. he sometimes voted with the liberals, giving them a majority in some of the most high-profile cases of the past few decades. that move to rtr brett kavanaug, he could take his place here on the court immediately, hearing and voting on any cases that are argued after he's sworn in.ur t developing now, the death toll in indonesia continues to rise dramatically after a massive earthquake and tsunami

swept through parts of the island. authorities reported 840 people have been confirmed dead with some reports of up to 1,200 victims, mostly from the coastal city of palu. officials fear that number will rise as rescuers reach more areas that were previously cut off by the storm damage. nbc's sarah harmon joining us now live from london with the latest on these relief efforts. sarah, good morning. what have you learned? >> reporter: good morning, philip. we are four days into the quake striking, and we still don't have a full picture of the devastation, and that's because most of the deado palu in centr the remote villages that are closer to the epicenter, and there are fears that entire towns could be wiped out. new drone footage is giving us an idea of how much o over the weekend, rescuers scrambled to save people who were buried alive in the rubble and screaming for help. at least one woman was pulled

out alive, but they just don't have the kind of heavy machinery you really need to remove debris quickly. the city of palu is now facing a very grim problem -- what to do with all the bodies? there are concerns about the spread of disease and contamination, and so they want to get the victims buried quickly. volunteers have begun digging an enormous mass grave more than 300 feet across. there is a real risk that this natural disaster could soon become a humanitarian crisis. people are absolutely desperate for clean drinking water, for food and for fuel. and as if all of that weren't enough, the justice ministry is now saying that hundreds ofeart. the indonesian government is now asking for international aid as it struggles to cope with this massive disaster. philip, marlie? >> devastation there in e indones indonesia, sarah, thank you.

breaking news out of indiana, where police are searching for a man who opened fire overnight at a walmart, injuring two people. this is in hobart, about an hour south of chicago -- or an hour east of chicago. police say the gunman started shooting from the parking lot into the store. the victims ran inside while the shooter took off. their condition is still unknown this morning. witnesses described a chaotic scene and say they heard at least 12 shots. >> we just started hearing pop, pop, pop, pop, pop, pop. and at first, we thought it was fireworks or whatever, and then we started seeing the bullets, and that was it. >> reporter: investigators released this surveillance photo, calling the man a person of inte. police hav made any arrests. the trump administration is suing california over its new net neutrality law, sting the stage for a high-stakes showdown over the future of the internet. california governor jerry brown signed the measure on sunday, requiring internet providers to treat all websites the same and banning the creation of so-called online fast lanes. in a statement, u.s. attorney

general jeff sessions called it an attempt to, quote, frustrate federal policy. the fcc repealed nationwide protections last year after deeming the rules a regulatory burden for telecommunication companies. the move has sparked protests across the country. california also making history with another new law, becoming the first state to require publicly traded companies to include women on the board of directors. the signed by governor brown mandates that corporations hire at least one female director by the end of the year and three by the end of 2021. under the legislation, companies can be fined $100,000 for the first violation and$300,000 yr a mass shooting in las vegas claimed dozens of lives at an outdoor concert. a year ago, 58 people died after shots rang out over the route 91 harvest festival in the shadow of the mandalay bay hotel. tonight, the vegas strip will go dark as resorts turn off their iconic bright lights in honor of

the victims. survivors of the horrific massacre got a chance to reconnect at a route 91 reunion concert held in clark county, nevada. hundreds of survivors and families of the victims got together for an opportunity to heal ahead of the anniversary of the shooting. the trump administration has reportedly relocated hundreds of migrant children to a tent city in south texas, often moving them in the middle of the night. the "the new york times" reports more than 1,600 children have been moved to the facility in torneo, texas, expanded to house nearly 4,000 children. nbc news first reported on the construction of the tent city over the summer. the "times" says advocates now worry for the children's emotionaltohe foster homes or s where they had been staying. an hhs spokesperson says the facilities are meant to be temporary. all right, we're keeping an eye on the tropical storm with meteorologist bill karins.

kind of an unusual sight for that part of the country. >> it happens every ten years or so. we're not worried about the winds, but the rains came in yesterday around the yuma, arizona, area, and the washes will be the problems. this area of the country doesn't get a lot of heavy rain events. it doesn't take a lot for areas that are typically dry to all of a sudden fill up with water. here's what we're looking at on the map. the heaviest rains are now arriving into areas around yuma and even the phoenix area is in a pretty good trainmoisture, watches up for 11 million people, and as the rain extends northwards, so will the flooding concerns from flagstaff, salt lake city, even the san juan mountains in colorado. rainfall total. the highest totals are shown in areas of red. that's up to 3 inches of rain, mostly north of phoenix as you go up into the rim, the high country, sedona and prescott. that's the area of greatest concern, but even phoenix getting 2 inches of rain is a big deal for the city. areas to the north like vegas could even see an inch. we have a separate storm system that's going to come into california.

university of iowa children's hospital. tibbetts' friends said they organized the run in part to help the community heal. three people are dead after a car explosion in pennsylvania, and now the fbi is investigating. they're still trying to figure out what caused this blt. officials believe it was a criminal incident but say there is no immediate threat to the community. nbc's dan schenamen has more. >> reporter: the explosion could be heard and felt all over allentown. an i heard like some type of my building kind of, like, shook. >> people running, you know, yelling. >> reporter: investigators say the blast happened around 9:30 saturday night. arth was still, you know, it was still, like, it was moving when it blew up, you know what i'm saying, because it was traveling. it was still rolling. and then it just burst into flames, like while it was still going. >> reporter: the scene was quickly blocked off and a shelter in place order was

dollar and mexican peso are at highs against the dollar. the trade agreement rescues the $1.2 trillion three-country trade zone that had been on the verge of collapse after nearly 25 years. under the terms, it's going to make it harder for automakers to produce cheap cars in mexico, but it does aim to bring more jobs to the united states. however, still, it doesn't resolve tariffs on canadian steel and aluminum imports. now, canada made one big concession, opening part of its domestic dairy market to u.s. approved by congress before it can be signed by president trump and his counterparts in canada and mexico. and now that the calendar has flipped over to october, time to start stocking up for halloween. the national retail federnproje will reach $9 billion this year. that's in line with last year's record, which was $9.1 billion. people planning to spend on average $86.79. that's up from $86.13 last year.

overtime. the titans could have tied it at the end to go for the tie, but instead they go for the win and that touchdown to cory davis seals it. titans shocked the eagles, 26-23. next to seattle visiting arizona. this game was capped off by the seahawks' star safety earl thomas. here in the fourth quarter, he trips over a cardinals receiver and injures his left leg. as he's carted off the field, he gives a finger to his team sidelines, part of a contract dispute and one of the many reasons why he held out of camp this year. he was worried he would get reinjured and that's exactly what happened. the seahawks win 20-17. how about another overtime game, raiders/browns. down two touchdowns, but derek carr rallies his team with a couple late scores to send the game into o.t. and that would set up rookie matt mccrane, the third-string kicker who comes through with a 29-yard game-winner for the
