kavanaugh on the court, but cannot be here in person because steve daines is walking his daughter down the aisle. she is getting married today. this allows the margin two votes to remain the same even though he cannot be here in person. sheinelle. peter. >> thank you. casie hunt is on capitol hill for us. casie, what will we see before the day is over in what is an afternoon vote? >> reporter: a tornado, indeed, peter. the squall will continue on the senate floor. kelly showed the senators speaking overnight. mostly democrats. you can expect more of that throughout the day. protests that have been going on all week behind our camera location have dwindled to a handful of people standing out talking. we expect that to continue through the day as well. this vote is not going to be held until 5:00 in the evening

because of the way senate rules are structured. a couple of things will be different from yesterday. kelly mentioned senator lisa murkowski will vote present. she still opposes kavanaugh. you will see the vice president mike pence in the chamber chairing during the vote. we have been warned. don't take that as a sign he needs to be there to break a tie. that is the role of the vice president typically. he just wants to be there because of the significance of the vote. >> casie, there were two major players in the episode. judge kavanaugh and dr. christine blasey ford. as we saw in kelly's piece on friday, you spoke to two of dr. ford's attorneys before the vote happened. >> does she have regrets? >> she felt good what she was called to do. she had a civic duty. >> republicans calling you democratic operatives in some cases. >> there was no effort to leak the letter and have this unfold as it did.

that's an absolute falsehood. >> reporter: what would the witnesses you wanted speak to the fbi have to say? >> we keep hearing no corroborating witnesses. there are and those witnesses can say several years ago well before judge kavanaugh was ever considered for the supreme court she told me that he sexually assaulted her. >> we get the names of others. they cherry picked. >> i don't remember. where was the place? i don't remember. how many years ago was it? i don't know. >> what was her reaction? >> she was upset by it. as any woman would be who is a victim of sexual assault who was mocked and belittled. >> what does dr. ford hope the country takes away from this? >> even if you are terrified, you need to be courageous. the world has changed. need to . the world has changed. that happened to thousands of millions of people. she pulled back the curtain on that.

>> this moment clearly was bigger than kavanaugh. a real moment for the me too movement. do we expect to hear from dr. ford going forward? >> reporter: her lawyers told me when i asked that question. does she intend to be involved in the movement or be political or run for office. she said no. they don't expect that. dr. ford really wants to go back to her normal life and job as a profess professor. she wants to teach. of course, right now, she is still not living at home because of the safety concerns. she is still getting threats. at this point, we don't know when she will do that. peter. >> casie, a heck of a week. thank you very much. >> let's bring in elise jordan. a former aide in the george w. bush white house. >> hi. >> let's put it in terms. for the president who likes to cast himself as the ultimate winner, he would say this is the best week of his presidency. second supreme court justice.

a new trade deal with mexico and canada. also an unemployment rate lowest since 1969. is this the talking point going into the midterms? >> absolutely. there's the accomplishments that donald trump wants to push forward. there was a huge "new york times" report about his family finances. donald trump is happy there were plenty of distractions this week with positive news of his agenda he can put forward. >> i want to get your thoughts on maine senator susan collins. she spoke for 45 minutes announcing voting yes to move forward on the nomination. talk about that moment. how big of a moment was that for her? >> senator collins gave one of the most important floor speeches in recent memory. she spoke for, as you said, about 45 minutes. went through her long and detailed and tortured process as

she deliberated. should she or should she not vote for judge brett kavanaugh. she went through her thought process as regarding to abortion rights. she supports abortion rights. her belief that judge kavanaugh would not do anything to threaten roe v. wade. it was a powerful moment in the senate. certainly eviseral moment. >> the president told me on the south lawn this week, it is become a rallying cry for republicans. a new poll shows that is the case. over the last three months, republican enthusiasm, people who say this midterm is very important. went up by double digits. it is even with democrats. after what happened yesterday, who does have the enthusiasm advantage going forward for the midterms? >> today we are exactly a month away from the mid-term elections. i think as people in the news and people watching politics

closely, a month could be presidential term practically in what news could happen. right now, yes, democrats, i would say have the advantage because you look at how angry their voters are about judge kavanaugh becoming justice kavanaugh. and while republicans got the immediate bump and i talked to a lot of republican strategists this week who are excited about the impact on their races. it mostly is going to help republicans who are already in red states and facing tough fights. >> people vote when they are angry. not to say thanks. >> a lot happens. elise, thank you. in chicago this morning, marchers celebrated after a white police officer found guilty earlier in the day of second-degree murder for shooting a black teenager to death in 2014. this whole episode caught on camera. nbc's ron mott is in chicago this morning with more. ron, good morning. >> reporter: peter, good morning to you. jason van dyke, that police officer who shot and killed

laquan mcdonald, now faces decades in prison over the shooting. the public finally got to see the video more than a year after it happened. >> we the jury find the defendant jason van dyke guilty of second-degree murder. >> reporter: verdict met by silence in the courtroom. jason van dyke expressing no reaction. >> justice. >> reporter: outside, a different emotion. celebrations after a guilty verdict in the killing that shocked and enraged chicago. 17-year-old laquan mcdonald shot 16 times by van dyke in 2014. the dash cam video held from public view for more than a year released only after a court order. >> i'm grateful to god. i'm grateful to brandon. my community that we were able to get justice for laquan mcdonald and it is not done yet. >> reporter: van dyke was convicted on 16 counts of a aggravated battery. one for each bullet. >> 16 shots.

>> reporter: for mcdonald's family. justice. >> laquan mcdonald represents all of the victims that suffered what he suffered. >> reporter: for jurors, a just verdict. >> instead of escalating the situation, he should have deescalated. >> reporter: police responded to a burglary call when mcdonald had a knife. van dyke feared for his life and fellow officers' lives. >> he lowered his knife across his body toward my left shoulder. >> when he did that, what did you do, officer? >> i shot him. >> reporter: prosecutors said the video contradicted his account. van dyke was the only officer who fired. no matter getting the verdict many hoped for, demonstrators took to the streets to demand improvement in police/community relations. >> i think everybody running for office in the city needs to talk about excessive use of violence against black men.

ago. people are excited here. let's get to dylan with a first look at the weather. dylan is a red sox fan. >> great game last night. it is hard with these 8:30 games. i can't stay up late to watch. we have heavy rain that backed through chicago. speaking of chicago. we have heavier thunderstorms. we have the chance of flash flooding today with flash flood warnings across northern illinois. 10 million people at risk for the flooding. there is a frontal system through the midwest. if you watch it today, this area of low pressure rides along it. as we go into tomorrow, the whole system doesn't move all that much. it stays just wavering through the midwest and st. louis and chicago. as we go into monday, the same thing. the front is not moving. as long as that's the case, we have the flood risk because of the rainfall we could through monday, we see a widespread 1 to 3 inches. down across southwestern oklahoma and parts of texas, we

wind. we'll check in with you. this morning police are investigating a shooting that injured at least five people in the east bay. it happened around 12:40 this morning in the area of telegraph avenue and 19th street in oakland. police aren't releasing the current condition of the victims but asking anyone with information to contact the oakland police. an update about the most closely watched repair job. the transit center crews will reinforce a second area under san francisco's brand new transit center. workers are expected to install a shoring system underneath the $2 billion building along fremont street this weekend. then they plan to do the same thing along first street. cracked beams were found on the fremont side but the structure has similar beams along first street, as well. >> they had no cracking. we've been monitoring that.

seahawks sold for $1.4 million but moments in the final sell the art began to self-destruct. passed through a vedder that was hidden in the frame. he is known for provocative style. the artist posted a photo on instagram saying going, going, gone. no word on the buyer has to shell out the cash. let's turn to a story that will touch the heart of any parent. this morning a texas family is in a fight to keep their 9-year-old daughter a live. currently on life support after being declared brain dead two weeks ago. but her parents aren't ready to let go. nbc tammy lightner has their story. >> reporter: this morning a texas mother desperate fight to keep her daughter alive. >> payton is not ready to give up so i'm not. >> reporter: on september 25th, 9-year-old payton was rush today a texas hospital after she went into cardiac arrest. approximately 24 hours later she

was declared brain dead. but her parents argue she is still alive. >> i don't think any parent should be put in a situation where the hospital tells you when it's time to give up on your child. >> reporter: they filed a temporary restraining order against the hospital to keep their daughter on life support to buy her some time and search for another hospital that might take her. on friday a judge assigned an attorney to represent payton's interest and review the case. >> we wanted to come here today to extend her life and that's what we d essentially. >> reporter: payton has been on life support in cook medical center in fort worth for over a week. a larger tumor in her chest shot off her circulatory system. she showed zero brain activity and under texas law, that means payton is considered dead. the hospital has since been ordered not to speak about the case. back at home, pa community united. >> you said god as we pray, we shouldn't doubt. we believe you that you can move
