and clear. cool start to our morning, but i'm hearing maybe shorts by the afternoon, summer hanging on. good morning to you. thanks so much for joining us. i'm laura garcia. >> and i'm marcus washington. mike will have a look at our traffic in a moment. first we want to start out with the weather. kari, what are we expecting today? >> it will be a nice day. we are looking at our temperatures in the upper 50s and headed to the b.a.r.t. station on your way to work, it's a morning for long sleeves or a light jacket but later on today, you'll be rolling up those sleeves as we warm up into the mid-70s by 11:00, and then going out for a workout in the south county, san martin will have a chilly start with light, patchy fog and will only be at about 52 degrees at 6:00, but it will be another really nice day. we'll talk about some slightly cooler temperatures in the forecast for the midweek and then another heat-up. mike, you have some better news for palo alto, right? >> getting better by the second. behind me you see this bright set of lights going backwards

and cones here. they're picking up the cones. by the time you get to the willow off-ramp you have a smooth flow of traffic and you have a backup approaching university. these folks merging on to university are getting by. things will improve over the next five minutes on schedule, clearing the cones. we have the slowdown approaching university up to just shy of willow. you saw the changes. if you're leaving your house even in palo alto, by the time you get there, you should be moving close to the speed limit. good recovery over the next 10 to 15 minutes. the rest of the bay shows a smooth flow of traffic, easy drive south bay. highway 1 may be affected, follow the fire in moss beach, the disabled big rig affecting the marina boulevard on-ramp to 808 and cocoa county across the north bay, benicia, carquinez bridge a little slowing but no surprises. back to the breaking news

along the san mateo county coast, a big emergency responding after a fire reportedly leaves a person badly hurt. >> "today in the bay's" pete suratos just got to the scene in moss beach just north of half moon bay. what are you finding out there in. >> reporter: good morning to you, laura and marcus. as you mentioned, a very active scene on lancaster boulevard in moss beach. take a look behind me. you see this home is a total loss, a two-alarm fire happening roughly around 2:00 a.m. fire crews from multiple agencies, i see pacifica fire department as well as the coastside fire district here on scene to put out that two-alarm fire. here are the new details that i'm getting from the coastside fire department. they're telling me there were three people inside at the time of this fire. they're saying there were two parents and an adult son and they said that the father actually is the one with burn injuries. we were hearing reports of third-degree burns for that father, for that individual but they weren't able to confirm

that at least on scene here. it is a bit foggy in this area, as you can imagine, so they weren't able to air transport that father to a burn center. they had to use a ground ambulance to take him to a nearby burn center. as we take you back out here live, a very active scene with firefighters inside the home, as it is a total loss. they're going to continue their investigation to determine exactly what caused this fire, where the fire originated, all of that is part of the investigation. of course we'll continue to monitor this and have another update for you in the next hour. we're live in moss beach, pete suratos for "today in the bay." >> pete, thank you. 5:03 right now. supreme court justice brett kavanaugh takes the bench this morning with an apology from president trump, this as the president hits the campaign trail. nbc's tracie potts is live from capitol hill. both parties are saying they are ready for this fight. >> and in fact, marcus, both parties are saying the fight that's already happened is going to energize their voters going

into november's election but there's another block of voters not democrats, not republicans, that could have a big influence here. >> on behalf of our nation, i want to apologize -- >> reporter: a rare apology as justice brett kavanaugh takes the ninth seat on the u.s. supreme court. >> what happened to the kavanaugh family violates every notion of fairness, decency and due process. >> the senate confirmation process was contentious and emotional. that process is over. my focus now is to be the best justice i can be. >> reporter: republicans say defending kavanaugh energized their voters. president trump's hitting the road this week to keep the fire hot in four key races. >> we finally discovered the one thing that would fire up the republican base and we didn't think of it. >> there's a lot at stake. >> reporter: democrats were already fired up. >> november is coming! >> reporter: but experts predict gender, not party, will determine this election.

>> the gender gap is on steroids right now. >> we could be surprised as the scale of the turnout among women including younger women in this country. >> reporter: like pop star taylor swift endorsing a democrat. >> let's say that i like taylor's music about 25% less now, okay? >> even republican women were not happy. they think the whole thing was just a forced, you know, moment. >> reporter: the moment that could turn the tide, if that energy holds for four more weeks. tracie potts, nbc news, washington. at 5:05, happening today, we should learn more about the recovery and rebuilding in napa. now more than one year after the wine country wildfires. napa supervisors are set to receive a series of reports at tonight's board meeting and also a test of the wireless emergency alert system. there truly sore many stories to tell from the fire. we've been gathering many of them for you for weeks. we put them all together in a

special called wine country wildfires, it reairs saturday at 3:00 p.m. the fire is still burning in solano, 50% contained this morning. so far flames have scorched close to 5,000 acres. yesterday embers sparked more flames near sassoon city. the fire destroyed one home and another building nearby. luckily no one was hurt. new this morning, auditors are reportedly talking about an incident that left one police officer in trouble. according to "palo alto weekly" the unnamed officer briefly faced criminal charges last year tied to a neighborhood hit-and-run. auditors say he struck his neighbor's car with his personal vehicle then continued home. his problems got worse when he lied to investigators from both the local jurisdiction and his own department. the officer was eventually placed on five-month leave. also pleads guilty to the infraction. the officer is now back on the

force. continuing coverage now, still no sign of a person who shot a man to death inside his own bedroom. we covered this story as breaking news for you overnight yesterday here on "today in the bay." it happened on charleston way near fremont's grimmer elementary school. officers arrived to find a man shot and killed. witnesses say they heard gunshots just after midnight and one witness say they saw someone take off on a bicycle after the shooting. police do not believe the shooting was random. leaders in southern california raising new concerns about an epidemic being spread by fleas. typhus can also be spread by lice. nearly 60 reported cases across l.a. county. experts say most of those patients are homeless. typhus is not the same thing as typhoid, which is a food-borne illness and death from typhus fever is extremely rare.

bay nair innovators are working to make a dent in clearing trash from the ocean. >> they are headed to great pacific garbage pass to collect plastic from the water, halfway between hawaii and california. it's blanketed with discarded junk including plastic bottles and bags. the nonprofit recently build its cleanup system at the former almeida naval station, it was tested in bay area waters. and right now, at 5:08 we'll have a beautiful day, but we are seeing the fog back at the golden gate bridge, and we will see a shallow layer of fog starting out the day, all of this will clear out as we go into the afternoon and we still have these hazy skies. we have the brush fires burning nearby and the north bay as well as the east bay and parts of the south bay will see some of that haze with the air advisory still in effect through tonight. and then as we get a live look outside in san jose, let's head to east san jose to the neighborhood of evergreen, we'll be at 57 degrees at 7:00, as you're heading out to work or

school, and then it's going to be a really nice and comfortable day. going to be slightly above normal but our temperatures are coming down from what we had over the weekend. let's head over toward concord with a morning start at about 64 degrees and then reaching near 80 by 2:00 today. we'll get a look at all of our microclimates coming up and mike gets you out the door. the only issue you see was in palo alto. >> a totally different look for highway 101 since the last report. all the traffic flows at speed past the university and willow. actually approaching university you'll dip in speeds for just about five yards. they have a couple more cones to pick up and there we go, the last of the crews from the overnight striping work cleared. we'll see the speed sensors clearing up along the peninsula. there's where the moss beach fire is, off highway 101, maybe a distraction. pete suratos continues to update us from the scene over there. moving out, no problems for cocoa county, almeida county approaching the bay bridge. little slowdown does show up on

the sensors coming through the area. there's overnight work on either direction and may be slowing you down a bit as crews start to clear but no problems coming into san francisco. in san francisco a reminder again, fremont street is still closed this week as they continue to fix a temporary fix over there and they get that strengthened up underneath for the damaged beam, so the temporary transit center is in place and minor delays for all the agencies that use the transit center over there as an option, and of course, surface street traffic is affected. b.a.r.t. has no effect and no problem for 41 trains. no delays out of the tri valley. here is dublin, easy flow. back to you. >> thank you, mike. 5:10. do you believe this? one man says he's addicted to netflix, and now he's trying to get professional help. how much he actually watches a day. you can compare your own viewing habits. google hides a flaw and gets in a lot of trouble for it. we'll take a look in business

slightly cooler air for tomorrow, before it heats up again. we're not done with summer yet. i'll have a look at that forecast coming up in less than five minutes. all lanes moving very smoothly at the bay bridge, over on the left side you see things start to slow as you approach the toll plaza, that makes 20 minutes, we'll show you the rest of your commute coming up. good morning, happy tuesday to you. glad you're with us. quiet day monday, it was columbus day. google is in the news, it's set to show off new devices in new york city today, but really has run into a pr disaster, after the "wall street journal" revealed google's social network google plus had exposed people's personal data online. now it wasn't hacked as best we know. it just exposed. but google didn't tell anybody about it. google's taken a very extreme step, they're going to shut down google plus permanently. to be fair almost nobody used

google plus. if you signed up for it years ago your information is still out there and could be exposed. i recommend you delete your account. you go into your google account through gmail or youtube, delete google plus. you can do that without deleting your overall going the account. apple says a blockbuster report from bloomberg the chinese added a tiny little secret spy chip to mother boards used by apple simply isn't true. bloomberg stands by its story. in fact, the magazine put it on its cover but apple wrote a letter to congress which it says "bloomberg provided us with no evidence to substantiate their claims and our internal investigation concluded their claims were simply wrong." we'll be keeping an eye out for developments there. and facebook came out with a set of rather mysterious devices on monday. mysterious because it's not clear what they do. other devices do the same thing.

their video conferencing screens, one can follow you around as you move and they have al alexa in them as well so it's like facetime on your phone or alexa and one alexa has a screen, so it's not clear what they are that isn't already out there that is more powerful, but we'll continue to watch it. facebook apparently wanting to get in on the game but they're coming in late. >> sometimes it's too much, at least for me. >> that's what i was going to say. maybe it's a little bit too much. >> i like alexa and alexa is turning out to be the vhs, remember beta max? you don't want to pick the wrong one, blu-ray, whatever the other one was. >> mini disc, the flip camera. we could go on and on. >> pick the market leader, not the trailer. >> also too many people out there, just have a little private life, right? i like that a little bit. >> i do, too.

>> we'll live stream that later. 5:16 for you right now. spacex celebrating another successful launch, and landing, and for falcon 9 rocket there. in case you missed it, sunday's launch lit up the skies in southern california. elon musk also celebrated shortly afterward at a restaurant near vandenberg air force base where the falcon 9 launched. the restaurant is posting photos of musk congratulating the team, even signing an astronaut helmet. most experts believe any luxury can get you hooked. if netflix or binge watching is your weakness, you may want to use this as a cautionary tale. young man in india is receiving treatment for his netflix addiction. he admits he watches more than seven hours a day in part to escape from real life pressures which for him include finding a job. recent cnbc report found the average subscriber streams a

little under one hour every day. maybe if you take some of that energy into looking for a job it would be nice. >> there is an app for that probably. >> yes, i guess so. that's a lot of tv. >> it is. >> if they want to watch nbc bay area, seven hours a day, though, that would be okay. >> it's possible, start at 4:30 in the morning. >> there you go, two and a half right here. >> starting at 4:30, you always have the forecast for us, let us know what we can expect throughout the day. >> it will be a nice day. i think you want to get outside for this one. here is a look at where we're starting, it's going to be in the mid-50s and looking at oakland we're at 55 degrees as you get ready to head out the door. san jose, palo alto is 60 degrees and it's 56 in livermore. let's head toward the fruitvale b.a.r.t. station in the upper 50s as you head to work or school and we are going to see some mostly clear skies for the inland areas, and then as 1:00, we're at 70 degrees. it's going to be so comfortable, so as you're getting ready this morning, let's check out our

frizz factor forecast and with it being a nice day, we will have a slightly higher amount of humidity this morning compared to yesterday, but after we get through these early hours, we will see the humidity dropping, so it will be a dry day with a light wind so i think it will be a smooth hair day, and you won't have to keep going over it over and over and over with the flat iron today. as we look at our high temperatures, it's going to reach into the upper 70s, which is slightly above normal. we're still going to have some warm weather for the inland valleys in concord today, reaching 83 degrees, and 82 in morgan hill, in napa and santa rosa, we're headed up to about 9 degrees. here is an update on hurricane michael, this is going to be making big headlines over the next couple of days because this has been upgraded to a category 2 hurricane. the wind and also the wind speeds and the forward speed of the hurricane sin creasing but it's moving over some very warm gulf water. over the next couple of days, this could possibly make

landfall as a category 3 hurricane over the florida panhandle, and a lot of people are already evacuating as we were expecting a high storm surge that's the water being pushed up out ahead of the hurricane, so we'll be watching that over the next couple of days, and more updates on that. as we bring it back home, we're looking at our inland temperatures cooling off a few more degrees for tomorrow, with some of our warmer spots only reaching 77 degrees, but then look at what happens this weekend, our very warm weather returns with some gusty winds and we may see that fire danger going up once again for the weekend. now mike, as we head over to you, you were saying if you have your eye on a couple of things already? >> a couple of things, early in the commute. we are seeing slowing westbound across the bay bridge. the dealcy don't see backup at the bay bridge toll plaza, but we're right at that critical point where they turn the metering lights on so we'll track that. i'll let you know if there are any problems on the span but so

far none reported. this area of 101, that has cleared from the overnight construction and a big slowdown we saw for about 20 minutes this morning so things are clear there and a new incident 680 over there just south of sunol into fremont, around mission north, disabled vehicle. chp will let us know if it's in the lanes. bottom of the screen at north 880 the on-ramp at marina the big rig that might be affecting the on-ramp but sounds like there may be an issue with the big rig so we're tracking that and i'll let you know what the newsroom turns up as well. no problems through contra costa county and getting toward the bay bridge we talked about a slower drive across westbound 80. to the north of the bay bridge we see that the richmond/san rafael bridge very light traffic flow, folks are waiting to get some attention so we'll give them a second on the screen. it is an easy drive in toward san rafael. no delays for the north bay because of the light traffic flow, just a little slowing out of vallejo, westbound highway 37 out of mayor island. back to you. coming up, saying good-bye

welcome back everyone. it is 5:24. continuing coverage this morning. no real end in sight yet to the bitter hotel strike involving bay area marriott hotel workers. you might have spotted them protesting. workers first walked off the job about six days ago. the union is vowing to stay away until a new labor deal is reached. locally, the strike is affecting more than a half a dozen marriott owned hotels in san francisco, san jose and oakland. the union says workers in seven other cities are also striking, and that the strike has expanded to hawaii. happening today, friends and families remember a san francisco woman considered a pioneer in the city street food movement. >> to many, she'll forever be remembered as the tamale lady. mourner also hold a vigil for virginia ramos.

for decades she served tamales across the mission, castro neighborhoods and she was an institution for late night crowds at local night spots. she was 65, reportedly about to open a new mission district restaurant. if you struggle with a tough decision, try taking a nap. >> a new british study says it may help you weigh the pros and cons of a difficult situation. researchers measured the brain activity of 16 people who were given a challenging task and then took a nap. sleep helped them process information they were not consciously aware of and improved their responses during the task. the study doesn't clarify what happens if the nap is the only sleep you get, like a lot of us on this shift. >> my nap is always my friend in the afternoon. 5:26. breaking news, a person is hurt in a house fire along the san mateo county coast. latest coming up. another dmv disaster.

with us. i'm laura garcia. >> and i'm marcus washington. let's head over to meteorologist kari hall to get a look at what you can expect today weather wise. >> it's going to be a beautiful day for the bay area, and we are going to have a little bit more humidity, as you head out this morning. drying out today and that's going to increase our or rather decrease the threat of wildfires today. let's head over to santa clara, in the upper 50s, a nice cool start and highs reaching the upper 70s for the afternoon. martinez will be a little bit warmer as we go into the latter part of the day. we're looking at some mostly sunny skies, and then reaching into the mid-70s today. here's a look at all of our microclimates, concord reaching 83 degrees. up to 81 in livermore and 80 today in palo alto. we'll talk about what's ahead for the rest of the week and the weekend coming up in about seven minutes. mike, you're seeing what's happening out of oakland. >> that's right, don't make fun of me. i know there's backup at the bay bridge. this is tuesday and it's 5:30 so we look at the backup because

the metering lights turned on just short of ten minutes ago. this is quickly filled and we know that volume of traffic is what we expect. the slowing i was concerned about though is across that bay bridge westbound 80, did start to show some slowing about ten minutes earlier than we typically see but now i see things are starting to ease off and just the incline now where it's sorting itself out after the lights were turned on. we get back into our typical pattern. no incidents reported on the span. contra costa county an easy drive but getting out of the north bay slowing approaching the carquinez bridge westbound 80 shows a burst of traffic. there and san jose north 101. these are the typical times when folks start hitting the road, maybe they have to be at work by 6:00. southbound 680 a number of disabled vehicles southbound approaching mission north so at least a distraction but be careful out of sunol. back to you. >> thank you, mike. breaking news along the san mateo county coast.

fire reportedly leaving a person badly hurt and a home ruined. >> "today in the bay's" pete suratos just arrived to the scene there on moss beach just north of half moon bay. i understand you just talked to some witnesses in the last few minutes? sxwrr we ask. good morning to you, laura and marcus. units from multiple agencies, we're hearing reports they had trouble getting here because of the 92 one-way traffic but i want to show you what we're talking about, this is the home, a total loss as it went up in flames around 2:00 a.m., coast guard, fire district, homa fire, pacifica fire here to put out that fire but you see it's a total loss. the latest information we're hearing the coast side fire district it happened roughly around 2:00 a.m. they were called out for what they were told was a structure fire. when they arrived they saw it was a one-story house fire. they said there were three people inside and two dogs.

the three people were parents, a mom and a dad, and an adult son, and at the time we're hearing it was the father who had injuries that we heard reports earlier over the scanner that it may have been third-degree burn injuries. we're not getting specifics on the burn injuries from fire officials on the ground. they tell us he was taken by ground ambulance to a nearby burn center. as i mentioned or as you mentioned, we did speak with a neighbor who said that he heard screams. he came outside, he heard a loud boom and then he described it as a fire explosion in this area, and then he did his best to try to help out. >> yeah, we tried, but it's just a big explosion, and we couldn't, we just, we just couldn't do it. it's too big, it got big and we tried and we couldn't. it was so bad. very bad. >> reporter: scary moments for that neighbor, as we take you

guys back out here live to the home fire on lancaster boulevard in moss beach. at this time the cause of the fire is still unknown, but we expect firefighters to be here on the scene conducting this investigation for the next several hours. we're live in moss beach, pete suratos for "today in the bay." >> pete, thank you. new this morning, the dmv says improperly registered hundreds of people to vote including some who are not even u.s. citizens. >> bob riddell is live outside the dmv office in concord. how did this happen, bob? >> reporter: marcus and laura, the department of motor vehicles the dmv says this was "a processing error." yesterday the directors of the dmv and the california department of technology they notified the secretary of state to tell him that about 1,500 people were improperly registered to vote between late april and late september, april being when the new motor voter law went into effect. number of those people are

non-citizens including a canadian man who is a green c d cardholder and in the united states illegally, who is just trying to replace his driver's license. the dmv says that none of those improperly registered are in the state illegally, in other words, it sounds like everyone has documentation. again, this is an issue of them not being u.s. citizens and therefore not qualified to register to vote. the secretary of state expressed frustration and disappointment over these persistent errors. he's calling for a new investigation of the dmv and is canceling the incorrect registrations. any absentee ballots that went out have bar codes guarantees those votes won't get tallied. last month the dmv made mistakes on 23,000 other registrations, errors including wrong political party affiliation, wrong language preference and mistaken preference to vote by mail. reporting live here in concord, bob riddell, "today in the bay." >> all right, bob, thank you. it is 5:35 right now.

vaping is largely odorless, which means that parents, you might not know that your teenager is doing it. that's why one santa clara county school district is looking to school parents on what to look for and what the hazards of vaping can be on growing bodies and brains. >> "today in the bay's" kris sanchez is live in morgan hill with what the district is doing and what they're doing could help parents across the bay area. >> reporter: that's the hope, why we're telling but this. we don't know how many kids have been caught vaping in this school or any district because the districts don't track those events separately from the overall tobacco policy and kids aren't going off to smoke cigarettes in the bathrooms as they might have in older days. the head of the fda said last month said vaping is reaching epidemic proportions for teenagers. ordered the makers of ecigarette devices to come one a plan to be less appealing to teenagers.

recent uscf study found cancer-causing chemicals in the bodies of teenagers who admit to vaping and also we know now 2 million u.s. teens say they have used their vape or epens to smoke marijuana. these are some of the school devices confiscated in morgan hill schools. districts are struggling with kids showing up at school with the devices because they are odorless and so harmless looking look like they could be a usb device. the kids are emboldened to vape in bathrooms even in class when the teacher is not looking. this is morgan hill police officer jeff brandon. >> it dissipates so quickly, by the time the teacher turns around, it's gone. there's very little odor. so it's not like a regular cigarette or a marijuana joint, where it's very obvious and the smell lasts for a long time. >> reporter: that morgan hill police officer talked with

teachers and staff back in march, we covered the story then and the district wants to do the same with parents to make sure we know what to look for and parents and students know the legal ramifications if the students are caught on campus. so if you're talking with your teen, anywhere around the bay area, talk about the health impacts and watch purchases online where they can use a prepaid card and lie about their age. don't look for smoke as the officer said because you won't smell it and won't know you're doing it unless you check. many of the vapes use circular port chargers, if they tell you that's for their cell phone we know cell phones don't charge like that. morgan hill school district tonight at 6:00, child care available and spanish translation as well. in morgan hill, kris sanchez, "today in the bay." >> good advice, thank you. the but area is one of the most challenging places to sell in the world, and the oracle founder wants to make sure that

everyone knows it. larry ellison is working to create a new sailing league and there will be events right here in the bay area. so you might remember america's cup was held here in the bay area a couple years ago. >> that video was intense. all right, over here, the waterways are moving nicely, the bridge is also great. no major problems. we're just getting started on your morning commute. i wanted to reference highway 92. pete talked about the fire moss beach over here. 92 did have overnight roadwork restricting lanes, one lane in each direction but that has all cleared. traffic flow is again. that cleared by 5:00. the san mateo bridge looks great, a clear flow, just starting to build the traffic here and chp warned folks about fog at the golden gate bridge, you see a little bit here and kari has been tracking that of

winds pick up. temperatures in the upper 80s and low humidity once again for this weekend. mike, you were saying you spotted something on the san jose camera. >> on the san jose traffic cam here at 101. over here, on the shoulder, on the left shoulder, you see one vehicle and i think they stopped, this person stopped to help out one of the vehicles involved in what sounds like a fender bender that got reported to chp. there is the other vehicle in the center divide so they're out of the lanes, but on either side, so as crews arrived to help this person either with a disabled vehicle situation or to pull this with a tow truck they're going to find slowing northbound 101 just at the 680/280 interchange and starting at tully and story, so we'll track that. we have the volume of traffic building fordramatic but we'll how this affects traffic flow. fremont southbound 680 first that mission north and washington, another crash so we do see some slowing around the bend heading down in toward
