"today in the bay" continues right now. it continues because we've been up and on the air since 4:30 this morning. join the fun even earlier. good morning to you and thanks for joining us. i'm laura garcia. >> and i'm marcus washington. of course we'll get you up to date this friday morning. mike has a look at your traffic coming up in just a bit. he has been here since 4:30. >> even earlier. >> vianey is here for kari this morning. good weather this weekend. >> get ready, there's some fog out on the roads out there. we've got those cameras showing a little fog through golden gate bridge. the temperatures in the 40s and the 50s. here's what it looks like in san francisco. yes, believe me, the golden gate bridge is somewhere behind there. now, the temperatures will climb nicely, but concord will be one of the warmest spots for today, possibly hitting some upper 80s

into the interior valleys as we head into the afternoon, but now i want to see how the folks on the roads are doing, so let's check in with mike. >> well, you showed the fog over at the golden gate bridge and folks who commute there are used to that creeping through the morning. over here south of the golden gate and the bay bridge, we have a little bit of slowing showing up as volume starts to build for 101 and a little slowing south toward san leandro. a smooth drive over here, highway 4 westbound, everything just lighter this friday morning. we do have this police activity in oakland. we'll update you a little later on from pete but we don't have any problems for mass transit. i changed this from yellow to green because you know they're still using the temporary transit center in san francisco. that is not news but you have a big story with big updates over there. outin the open, the san jose diocese releasing the names of 15 priests with credible

allegations of sexual abuse of children. it hasn't been a full day but the instant reaction has been why were some of them reassigned after they were accused and in three cases convicted? kris sanchez joins us from the san jose diocese with that reaction. kris. >> reporter: hi there, marcus. immediately a lot of folks reached out via social media. we even heard folks in the newsroom shocked that some of these priests were in the par h parishes and the catholic schools where they grew up. of the 15 priests on the list, only five of still living. we talked with one of them who maintains he is still innocent and he left the ministry of his own accord, but other priests continued to serve after they were accused. lionel noya was convicted in 1976 and went to jail for three years, but still went on to three different churches in san jose between 1998 and 2002. toro was a registered sex

offender in 1983 and served in several parishes in morgan hill and palo alto for four years following. vicky nguyen pressed bishop patrick mcgraw about whether he personally helped to cover up reports of abuse by priests. >> that's absolutely untrue. absolutely. >> so you're saying the church is not sheltering any other priests? >> absolutely not, no. >> do you think this current bishop, bishop mcgraw, has been involved personally in covering up any reports of abuse? >> yeah. i like him. i consider him a friend. but he knows more than he's letting on. >> reporter: this survivor says that his parents reported abuse by father joseph pritchard at st. martin's church in san jose and no one so much as wrote it down. records do show that pritchard was transferred to st. nicholas in los altos, but up until the day he died, he never faced criminal charges. these are just some of the stories that have come out since this list was posted, and there

are so many more powerful stories. we posted them on nbcbayarea.com. that's where you can also find the list. you can also finding a map of all the parishes linked to these priests who were credibly accused. by the way, we are still continuing to watch what's coming out of oakland. that diocese has agreed to do the same things the diocese of san jose did, which is to release the name of priests that are credibly accused. on the east coast right now, there are subpoenas for secret records for churches there so that investigators can see what they find there. that's what folks want here, a lot of folks wanting here, they want law enforcement to be involved, the attorney general or the district attorney to get involved. in san jose, kris sanchez, "today in the bay." it is 6:04 right now. happening today, president trump's former campaign chairman, paul manafort, returns to court. manafort was convicted on eight counts of financial fraud back in august. at today's hearing, a federal judge should decide whether to retry manafort on ten other counts on which the jury was

dead locked. also this morning on the road, president trump in full campaign mode waking up this morning in arizona. he's in the middle of a three-day swing through states where republicans are in close races. nbc's tracie potts has the very latest and joins us live from washington this morning. good morning, tracie. >> reporter: hey, laura, good morning. president trump not a candidate but acting like one. he's doing a lot of campaigning out there with this election now just over two weeks away and threatening to change the balance of power here in washington. president trump heads to arizona today to push the republican candidate in a bitter fight to replace retiring senator jeff flake. the republican has been criticizing her opponent as out of step with voters. >> they are propping her up as if she is right of center. >> reporter: last night mr. trump was in montana supporting a republican congressional candidate there. >> any guy that can do a body

pipeline sits. things should be back to normal after fears that the pipeline would blow. no doubt if you were following this with us yesterday morning if you were watching "today in the bay." all those homes there in a half-mile radius were evacuated. this is after a grass fire burned into the pipeline vault. authorities lifted those evacuations yesterday afternoon and some families were only returning to their homes late last night having endured a long and difficult 24 hours. >> and we slept there until 4:00 in the morning. my daughter was in her car next to us, and then we said the kids need to lay down. >> as for the exact cause, that is still not known, but firefighters say a smaller pipeline in the vault was punctured. pg&e crews have been repairing a downed power line. investigators are not saying if that may have triggered the grass fire. new this morning at 6:07, san francisco police cracking down on drug dealing. officers focusing patrols on the tenderloin, mid-market area and

south market areas, in the past 158 arrests were made. police seized 125 pounds of narcotics, half a million dollars in drug money, several guns as well as assault rifles. a popular street festival in oakland is being suspended because of crime concerns. the first friday monthly party won't happen next month. in a letter on the event website, the first friday's team says the main reason for the cancellation is a gun battle that took place after the october event. although it happened about three hours after the festival ended and several blocks away, organizers say safety is something they take very seriously. new security measures will be in place when first fridays return in december. 6:08 right now. are you interested in seeing a little soccer history? it's possible it could happen right here in the bay area this weekend. if you're a san jose earthquakes fan, you probably go chris wondo

is just one away from tying the record. the earthquakes take on colorado sunday. it is 6:08. the weather is going to be sunny and the temperatures are going to be warm. san jose 83 degrees. a quick tour of today's bay area temperatures. east san jose 84 degrees. now, the east bay will notice that warmup, especially in areas like walnut creek, danville and concord. upper 80s for today's forecast, believe it or not, along the peninsula temperatures will remain in the 70s. if you're in the city, we are seeing some fog right now and some cloud cover, but as we head in towards the afternoon, we will clear out and welcome plenty of sunshine through the north bay as well. let's get a check of the roads with mike. we're looking over here at a big view of the bay, no major problems. this is a great flow of traffic. it's friday, so it's a later start for most folks. we do have a crash reported west

crash reported somewhere perhaps along this stretch. i'm sorting out the details from chp. we'll show you the bigger view coming up. good morning. i'm jackie deangelis at cnbc global headquarters. here are today's top business headlines. wall street pointed to a higher open ahead of the opening bell. stocks fell sharply yesterday as the market's october struggles continue. among the reasons for the sell-off, worries about the u.s./china trade war, rising interest rates and lingering concerns about whether big tech stocks are overvalued. the dow closed down 327 points, 25,379. the dow has dropped more than 4% this month. the nasdaq falling 157 points to 7,485. it's down nearly 7% in october. meantime, elon musk tweeting last night that tesla is now selling a less expensive version of the model 3 starting at $45,000. it comes with a midrange battery that can go 260 miles per charge. tesla has promised a $35,000 model 3 but that's been shelved

until next year. musk says the actual cost of this car is actually closer to 35k when you factor in federal and state tax credits and 31k when you add in the gas savings. however, you do have to take delivery by the end of the year to get the full federal tax credit. uber is testing an on-demand staffing service. so uber works it's called will let companies recruit temp workers, like security guards and waiters, for special events. it's been working on the project over the past several months in chicago, after a previous trial in los angeles. uber works could help current drivers pick up a few extra bucks when demand for rides is lower than usual. all right, i'll send it back to you, marcus and laura. >> thank you, jackie. >> have a great weekend. so new this morning, kleenex is planning to rebrand man-size tissues after gender complaints. maker kimberly clark says many customers complained the name was sexist. packages for the tissues describe them as confidently

friends as well. my mom is also a big pumpkin spice latte fan. as soon as i get into l.a., i go buy her pumpkin spice. i just went last week and she loves them. san francisco right now definitely showing some of that fog that i said would eventually roll in at the golden gate bridge. we are seeing some cloudy conditions, at least in through the north bay. but take a look at how the rest of the bay area is doing. we're not seeing this cloud cover everywhere, and the patchy fog isn't as dense, which is why we're still creeping in through san francisco, parts of santa rosa and the temperature trend into the afternoon is going to increase quite nicely, but right now in the 40s and 50s. 42 for santa rosa, 45 for napa. 50 degrees for oakland and san jose down to about 53 degrees, for now that is. let's take a look at how the next couple hours will play out. by about 10:00 a.m. we'll be in the 60s, but take a look at 1:00, 2:00, climbing into those 80s through san jose.

i want to show yukou concord. if you're making your way out there i know a lot of folks will head out because it is friday after all. by 1:00 upper 70s and then it will be really warm by 2:00, 3:00, 4:00, mid to upper 80s. throughout the rest of the bay area, expect similar conditions. napa about 85, morgan hill 86. san jose 83. we'll keep those warm temperatures right into the weekend, straight into that weekend. saturday and sunday, 68 degrees. sunday 67. and then we start to see a decrease in those temperatures as a storm system approaches just off the northern coast dropping that very first cold front into tuesday and wednesday. that's going to bring just a slight chance of seeing some showers. i keep saying slight because the models keep showing those rain chances just getting smaller and smaller, even through the inland areas. i'll still keep an eye on that. i just want to make sure you're not caught offguard.

let's get a check of the roads with pumpkin spice mike. over here, westbound 580, the san mateo bridge we had a lot of brake lights tapping and caltrans work reported somewhere on 92. well, this smoothed out itself from the live shot. no incidents reported and i checked caltrans, 92, yeah, over back on highway 35 in the foster city area but that cleared up right around skyline and should be moving in the next few minutes so we don't have a problem on the span. just a lot of folks headed over to the flat section at the same time. so smoothing out, building the volume there. now we're looking at 880 south toward whipple. there is a crash that might be in the fast lane. a motorcycle ran over a cone but that's a little tougher when you only have two wheels and one of them gets tied up with a cone. we're tracking that, but no major injuries. that will be a distraction in the center divide for the next few. over the santa cruz mountains an easy drive. here, highway 92 might be an issue getting toward the beach because vianey talked about the great weather coming up this

hour. across the country, at least two people have been killed in scooter accidents so far. a scooter rider in d.c. was killed when he was hit by an suv and in dallas, a father is mourning the loss of his 24-year-old son. >> they're very dangerous and i wouldn't recommend people being on them. >> in response, almost all of the electric scooter companies have offered to give away free helmets. bird has also publicly offered to help fund new infrastructure. you know by now nbc bay area responds is a great way and they are great at getting you the money you're owed. >> here's chris with a look at some recent cases. >> good morning. so far this yore we responded to more than 3,600 consumer complaints, including wilfredo in san jose. he put down a $1,000 deposit on solar panels. will later changed his mind but couldn't get ahold of anyone at the company to get a refund. we found a manager to help and will got his $1,000 back.

moment. but for you this morning the top story is the commute, the weather as well. thanks for joining us. i'm laura garcia. >> and i'm marcus washington. vianey in for kari this morning. vianey, looking pretty good for us today. >> definitely is a very good friday. temperatures nice and cool. we've been waking up to 40s and 50s where it starts out where it looks like it's going to be a gloomy day, but whatever cloud cover clears out to the mid-afternoon. san jose not dealing with any clouds right now but if you're kicking it in san francisco or heading up towards san francisco or the north bay, you might catch some fog on your drive up there. your transit forecast, you're not going to need any heavy jackets, just a light sweater. by 10:00 a.m. 62 degrees and then we welcome those 70s and 80s as we warm up nicely into the interior valleys. we're talking upper 80s in today's forecast. let's get a check of the roads with mike. >> well, i'm going to point out one spot with two things to note. friday the bay bridge toll plaza, we do have all the lanes filled in. it's not as light as we sometimes see. and also we have this fog

rolling around. you see these clouds and fog drifting around. that will be a factor for some folks, not usually over here at the bay bridge, but we do know that the golden gate bridge travelers are used to that fog. it's actually starting to move throughout the north bay so be prepared for that. slow your speeds a bit. we're looking over towards oakland with police activity watching foothill on 23rd, 22nd. pete will give us an update in a second. we do have some slowing south 880. one new crash cleared at whipple. a second crash maybe in the backup. i'm double checking with chp and i'll let you know if that's a problem as you travel through the east bay. back to you. breaking news to tell you about. several streets are shut down in the east bay. s.w.a.t. teams are out right now and it seems that police are looking for a suspect. >> pete suratos has been on the scene since 5:00 in the morning. what do you know so far, pete? >> reporter: good morning. we are still looking to get an update from police but we know the area is shut down behind me

here on 22nd avenue and foothill right next to garfield elementary. we'll see if that has an impact on the school. we know that this area is shut down. earlier this morning we are on 23rd avenue between foothill and 15th. that area was taped off as well. now, the video you guys are looking at, that's an armored truck. we're being told that was the designated arrest team that was here on site. we no longer see them in the area. as far as the reports that we're hearing, we're hearing reports of a possible barricade in this area following a police chase and shots were fired. of course this information still needs to be confirmed by oakland police. we'll take you back out to the area shut down. we'll continue to monitor this and provide you with any updates as they come in. pete suratos, "today in the bay." 6:32 for you right now. should religious institutions be exempt from america's health care mandate requiring employers to cover the cost of contraceptives for female employees?

that question at the center of a lawsuit being filed today in san francisco. that centers around a group of nuns being fined if they did not provide birth control options in their health care plans. the state attorney general is arguing their case is invalid. it's looking more and more like the foreign-born spouses of people working in the u.s. on h-1b visas were be banned from working themselves. that's been a big priority for the trump administration. "the mercury news" reporting that the white house just put out a notice indicating that the new rule will likely take effect next month. h-1b visa holders work as specialists for u.s. companies. 6:33. tonight hundreds of high school football players throughout the bay area will play under the bright lights of their home fields. but for students at one school in the south bay, friday night lights is still just a pipe dream. new this morning and only on "today in the bay," bob redell joins us live outside of the high school in morgan hill with more on what's stopping the school from installing their own

lights out there. kiejd it's kind of a high school tradition, bob. >> reporter: laura, the sobrato high bulldogs aren't allowed permanent lights because of bobcats, deer, fox and coyotes, even though the front part of the school here is located in morgan hill, the back part where the football field is, is actually located within the city of san jose. it's in a green belt near coyote creek. the city of san jose so far won't allow any permanent structures, including lights, out of concerns for the local wildlife. so this is how sobrato high has hosted football games for the past several years with temporary bleachers and porta-potties with the games being played during the game on saturday unless they bring in temporary lights on a friday which are expensive. when the sobrato family gave the land, the city of san jose sued to keep permanent structures off and the district agreed. the district is now trying to

get the city to change its mind. talks are ongoing. in this letter, local and environmental groups argue that the lights and loud noise from the football games would disrupt the feeding and migratory patterns of wildlife who travel along the coyote creek corridor. >> i don't get the sense that path councilmembers have been willing to explore this. so we are really moving forward in a sincere way to see if anything is possible. i certainly can't make any promises. i'm not quite sure if it will be possible. >> it's hard, because it's very expensive to rent bleachers, portable bleachers. it's very expensive to rent lights. they would love to have friday night lights. >> reporter: talks between the school district, the city and environmental groups continue. city council member sergio jimenez is trying to see if there's a path forward to allow the school to get its permanent structures while still protecting wildlife. as you heard him mention, not sure that's possible. reporting live here, bob redell, "today in the bay."

>> a lot of kids have wanted that. thanks, bob. a follow-up for you now on a story we first reported last month. an arrest in an apparent road rage attacks on an uber driver in the south bay. adam stone is accused of attempted murder. this happened during the morning commute along highway 87 near capital expressway in san jose. stone pulled off the side of the road where the uber driver was, stabbed him and then drove off. stone, who is a parolee, was arrested by chp officers late yesterday. this morning riders heading to the downtown berkeley b.a.r.t. station will be greeted with an entirely new entrance and upgrades to the station itself. the station is back open this morning. it was closed for two years while they got all this done. $13 million in renovations. obviously it's time lapse video of workers taking down the old brick rotunda and putting up the new glass structure. upgrades to the station include a sleek new entrance, bus shelters and l.e.d. lighting to increase safety.

>> i love time lapse videos. >> right? >> we should put benny hill music behind it. over here we're looking toward the south bay where northbound routes are starting to pick up just a bit. it's friday. we have a later and lighter build for the morning commute. things really kick in mid-morning. looking over toward the east bay, southbound 880, there was not a second crash but they updated the location. it's between whipple and alvarado so chp is calling it alvarado niles where there's activity in the center divide. a motorcycle hit a cone. no major injuries but that could be a factor and distraction as it builds south of the san mateo bridge. we'll take a live look westbound 92 over at your right slowing a bit. it's just an issue with the volume of traffic and limited lanes. you have to go slower. >> slow it on down. no, wait a minute, we want to keep on trucking to the weekend. >> we're going to have a nice weekend too to enjoy it. >> very nice. a lot of activities to enjoy

throughout the bay area, so if you had a birthday party planned outside, it's going to be a great weekend for that. you know what else it's a good weekend for? oktoberfest. if you can't been downtown, you have a chance to. it's not just sunday but also tomorrow and sunday. it's in downtown campbell. the event takes place all day. now, to get in it's free, but of course you have to pay for the food and the beer and all the good stuff. so by 1:0078 degrees. temperatures will climb into the 80s into the afternoon because we're keeping that sunshine around for quite some time. saturday's forecast for the coast, bay and inland, 81 for the bay, 84 inland areas, coast 69. we'll keep a couple of those patchy areas overnight into the early morning hours much like what we're seeing this morning in san francisco as well. as we head towards sunday, it will start to feel a little cooler into sunday night because of an incoming cold front as we head towards the start of the workweek. bay 80 degrees, 81 for inland

something that you want to keep your eye on. new for you this morning, new findings showing that a popular e-cigarette maker targeting young people through social media. juul is based in san francisco and that new study by the university of pittsburgh finds that at least one-quarter of their followers there on twitter are underage and retweets are exposing even more teens to those ads. experts believe that more young people are exposed to that kind of marketing and are more likely to use those e-cigarettes. we've told you before how local bay area schools are seeing a huge uptick in students smoking juuls. a court case is alleging harassment and discrimination against a gay couple at a luxury hotel in downtown los angeles. angel de los santos is suing the ritz-carlton. he and his male friend were attempting to enjoy their time at the hotel pool when a staff member approached the two men and criticized them for their

sexual lifestyle. when the two men spoke with the manager of the hotel, they claim the manager turned a blind eye to the mistreatment. >> this person, i would assume, has in her mind she's getting this -- she's able to do this because she's getting this type of mentality from her supervisors and the culture going on at this particular hotel. >> the hotel confirmed that he was indeed a guest. the lawsuit claims the humiliating experience made his kidney condition worse and left him in emotional distress. it is not the first time the ritz-carlton has been accused of discrimination. last year "saturday night live" star leslie jones accused the hotel of discrimination against african-americans. so far the hotel is not commenting on the lawsuit. new for you this morning, a pop star is showing support to former 49er colin kaepernick. "us weekly" reporting that rihanna declined to do the upcoming halftime show at the super bowl. a source told the magazine that she said no because she doesn't agree with the nfl stance on

players kneeling. maroon 5 will instead headline the show. kaepernick was the first player to 23450kneel during the nation anthem in protest of racial inequality. what does this look like? maybe an army helmet or an unusual bowling ball maybe? well, a farmer in central valley discovered this last saturday in their orchard. it turns out that this is from outer space. now, it's space junk that made its way through the atmosphere and then crashed down. deputies contacted vandenberg air force base and they learned that this is a fuel tank from a communications satellite. that satellite went up 20 years ago and recently re-entered the earth's atmosphere. >> pretty interesting. 6:45 for you right now. some things never die. others refuse to die in the process of entertaining millions. >> does the name michael myers ring a bell?

video? it says me around halloween and it's a little girl getting down to that michael myers song. okay, you've got to see it. what else you have to see is the temperatures and the fog in san francisco. we've got the golden gate bridge right now. you can see that the golden gate bridge isn't necessarily visible, but the fog certainly is. that's because we're seeing some fog through that area. look at the south bay, san jose beautiful, clear skies. 53 degrees. temperatures have certainly been waking up on the cooler side with 40s and 50s, but will warm up into the upper 70s for some oakland areas, including in through martinez, 83, concord 88, livermore 87, down through the south bay 83. check out san francisco, a high of about 68 degrees. now, all of this cloud cover that's kind of hanging around parts of the north bay and the coastline will eventually burn off in the afternoon, much like what we've seen the past couple of days. something to make note of on this lovely sunny friday, i know a lot of people will be outside, is that the air quality might be

an issue, especially if you have any type of respiratory problems, which is why there is an advisory that is in effect for today, and this is through about 9:00 p.m. tonight. i have not seen them extending this but we'll keep a close eye on that. but smoke and haze. the reason for that is that there are active wildfires burning in southern oregon and that's drifting their way down to portions of the bay area. be mindful as you make outdoor plans for today. and if you're heading to the beach, which i know a lot of folks will, we're still dealing with dangerous surf today, waves upwards of 4 to 6 feet. into the weekend we'll keep the 60s and keep the sunshine. looking ahead toward next monday, which we don't want to but we have to, we'll see that storm nearing the northern coast and that will bring increasing cloud cover and a drop in temperatures. 76 and a chance for showers, but the best chance is still falling in the north bay. now let's check out what's going on on the road with mike.

>> overall we have your friday lighter traffic, which is great for everywhere. where it's not great because there was an earlier crash in the south bay, there's a little bit of a build. but traffic is flowing smoothly through the area, southbound 880 does show some slowing. as i try to adjust things going on, i can't bring that to you because of a problem with my ipad here. they have a slower drive right here and one of our waze members, they have reported that there is a crash over there. southbound 880. join nbc bay area wazers, that's the team you would join and i'll sort out our profile later on. 92 where traffic may be diverting over to the san mateo bridge where they see slower traffic but stick it out down towards fremont and it's all right for the nimitz. mass transit, no major delays. for cal train, we have the weekend trains stopping. so starting tomorrow and sunday they're stopping at bay shore

oakland police tweeting they're searching for a wanted suspect on the 2300 block of east 17th street. traffic will continue to be impacted for the surrounding streets as well. oakland police haven't given us any additional details on that search so far. stay with nbc bay area and we'll have the very latest and keep digging for facts on this developing story. other top stories for you, catholics this morning reacting to the names of the priests credibly accused and even convicted of sexually abusing children. among them, five still living. three of them convicted of sexual abuse. oakland church leaders are still expected to follow suit and release a list of the names next month. things at bay point should be back to normal after things turned upside down amidst fears a gas pipeline would explode. no doubt you recall following this yesterday morning if you watched "today in the bay." all homes in a half-mile radius were evacuated after a gas fire burned into a chevron pipeline vault. authorities lifted that evacuation yesterday afternoon.

the cause is not yet known and investigators are still trying to determine if a downed power line led to the grass fire. it is 6:55. a popular street festival in oakland is being suspended because of crime concerns. the first friday monthly party won't happen next monday. in a letter on the event website, the first friday team says the main reason for the cancellation is a gun battle that took place after the october event. although it happened about three hours after the festival ended and several blocks away, organizers say safety is something they take very seriously. new security measures will be in place when first fridays return in december. new this morning, san francisco police cracking down on drug dealing. officers focusing patrols on the tenderloin, mid-market and south market areas. in the past week, 158 arrests were made. police have also seized over 125 pounds of narcotics, half a million dollars in drug money and several guns and assault rifles. new this morning, tesla is now selling a less expensive
