in fact we were going to show our viewers the big balls of flame this morning according to oakland fire, the information we're getting is the fire kicked out roughly around 2:00 a.m. at the corner of west grand and filbert. they believe this was a three-story apartment building that was under construction. it looked like they're at about 80% to 80% contained. still a big issue in this area. as far as who's affected we know about 20 to 25 people have been evacuated. currently 2,000 folks are without power. we'll continue to monitor it. it was quite a scene there with that fire taking place this

morning. you could smell the smoke in the air. obviously it will be an issue during the morning commute, but we're going to continue to monitor this and have another update in the next hour. we're live in oakland. glad no one has been reported hurt. thank you so much. >> exactly. hopefully we don't have a lot of wind out there as well. let's check in with kari. >> we do start out with a lot of low clouds across the bay area. anytime you get smoke it gets trapped in the clouds, and we have a light wind from the northwest at about 8 miles per hour this morning, so any of that smoke could be carried just to the east into the hills as we start out this morning. as you get ready to head out the doors, temperatures are in the mid 50s. we have a temperature in san jose of 54, and 51 in livermore. if you're on the way out the

door, it would be in the mid 50s. a cool morning once again with low clouds moving there. that activity may slow down some drivers in the area. >> it probably will. this is over off the east shore freeway. we're looking from the berkeley/emeryville area, there's the tribune tower, downtown oakland's iconic a landmark. lights sometimes we'll see in the spotlight, again the fire is here in the middle of all these freeways. that will big a big distraction. you know what's going on, but others may not. heading into the area is just fine, but south of oak lend, south 880 as the 23rd, you're on and back off the freeway. they have that overnight

wall street is set to open up in the red this morning amid a global sell-off in europe and asia. back here in the u.s., it was a mixed session yesterday with the dow falling on the drop on the bank amid earnings reports and rising geopolitical attentions. earnings from dow compone s components, the dow closing down 128 points to 25,317. nasdaq edging up 19. walmart is expanding holiday perks for online shoppers. beginning next month, millions

temperature at 60 degrees. we'll eventually head to 71 degrees, that's a bit cooler than normally. also milpitas, and walnut creek, expect a high of 75 degrees today. hayward 68, and some upper 60s for parts of the peninsula. 61 in the marina district. for the north bay at 69, and as we start on the this morning with the cool weather, we do need a jacket, maybe some light long sleeves. if you're just wearing some light long sleeves, that will probably keep you comfortable throughout the day. we do have a strong area of high pressure, keeping the rain track farther norse, so more of a summer-like feel. but our temperatures will cool down around halloween, and then rain still looks like it stays

farther to the north. we're tracking hurricane willa right now, with wind speeds at 130 miles per hour. we're keeping an eye on this, because a lot of destinations and vacation spots are in that area. as it moves through mexico, it will quickly weaken as it moves over a mountain out region. at we look at temperatures here, we'll be in the mid 70s, and look at the end of the forecast for the weekend, it will be in the upper 80s. yes, in the valleys very warm, and at francis, it will be heating up with 70s for the weekend. mike? >> we're looking at a smoother drive. you have the overnight road crews. that will be the first issue foss drivers past 23rd, and the overhead work on the overcrossing is going on. they plan to have that planned closure in all those lanes

southbound off and on is what i understand they're going to do, and it should be solve as far as the construction crew in the next few minutes. meanwhile, over here, the entire of the freeways into the maze may be affected by this fire around grand and market. that's where we have the fire activity. it's a big blaze. five alarms from what i understand. you can see it from the emeryville camera. 880 is over here, 24, 13, they all mae possibly see smoke as the sun starts to come up. from time to time i see spotlight right here into the smoke. that really lights it up, making it a big distraction for drivers. so you see the traffic is flowing at a pretty light volume. there's always a lot of activity over here. a smooth drive over north bay and through the north bay, a nice drive down toward the golden gate bridge.

back to you. thank you very much, mike. a san francisco judge has upheld a jury's verdict that found monsanto's weedkiller called a groundskeeper's cancer. he says roundup weedkiller he used for many years made him sick. in denying monsanto's request for a new trial, the judge cut the jury as punitive damage from $250 million to $39 million. the same amount the jury awarded for other damages for a total of $78 million. >> on the issue of whether the product can cause cancer, other courts might be able to use that finding against monsanto, and monsanto would not be able to present more evidence on that -- >> the judge gave dwayne johnson to accept the new amount or

demand on new trial. people are out of their homes in san francisco, after several floors in their high-rise apartment building caught fire. >> it broke out last night, tenants from 30 units still cannot return. >> i'm going to call 911. >> reporter: we have exclusive video of a high-rise apartment fire. as the fire begin on the 12th floor of the gateway apartments. >> we looked up, and i just saw a bit of smoke. before you know it, it just snowba snowball. >> reporter: this video captured the flames spreading floor by floor, shattering windows along the way. >> it was just one after another, surreal at that time, looking at what is happening. >> we're always concerned with a high-rise fire.

breaking right now at 5:00, a massive fire overnight in an east bay construction site. firefighters are fighting those flames there. good morning. >> we've been following this breaking news for hours overnight we've gone at the scene since 4:30. this is a huge response. anything new updated? >> reporter: we are still here, but moved further down to give our viewers a better shot of what's going on. take a look at those flames, guys, that is the apartment building that was under construction that we were talking about that caught fire this morning and caused quite a scene in this area. when i into to the oakland fire chief, he tells me they're about 70%, 80% containment. this isct
