crash in dublin. >> the crash is behind the trees so you can't see it. overall your commute looking good in the south bay, just kicking in for san jose, and the east bay looking at slowing for hayward south 880. the tri valley we have this issue slowing west 580 your commute direction through dublin approaching hacienda. the camera at tasahara is partially blocked by trees, the flashing lights. i see a tow truck on scene as well so hopefully they can clear the two lanes quickly. chp has not called a traffic alert. we see slowing. we'll track that. meanwhile cocoa county more slowing approaching the walnut creek interchange but not a major problem through concord and the bay bridge toll plaza, where the metering lights are on. over to you. from the board room to the courtroom and the drama in the south bay school district. today a superintendent and a school board trustee will face a judge over allegations of

harassment and the fate of a restraining order. kris sanchez is live in san jose's alum rock neighborhood with what will happen in just hours. kris? >> reporter: in three hours the superintendent and that trustee will be in the same room for the first time in more than a month and a half. they are not allowed to be in the same room because of that temporary restraining order, which the superintendent is hoping the judge will make permanent today. this is video of the last time the two were in court. this is hilaria bauer and trusty kan tran, they were in court back in september. at that point the judge extended an existing temporary restraining order that day. bauer asked the protective order after tran allegedly threatened her in a closed door meeting. tran's defense is that his words about alleged financial mismanagement were taken out of context. >> i made a comment, i say you know, anyone breaks the law,

steal money i kick them out of the district and she turned it into a circus. >> there was only one reason why i did this, is because i fear for my physical well-being. >> reporter: now at the very last school board meeting, tran had to appear via teleconference. his seat was empty because he's not allowed to be in the same room as the superintendent during this temporary restraining order. the meeting right after that court date, the september 13th meeting had to be canceled because there was no quorum, there were not enough board members in attendance. this is affecting school board business. we'll have to see what happens today as the two sides head back to court. in san jose, kris sanchez, "today in the bay." >> hopefully they can find a resolution that everyone can agree with. thank you, kris. >> it 6:03 today. quinn boyer was shot and killed five years ago in the oakland hills, it happened during a botched robbery by a

group of juveniles on a day-long crime binge. several are doing time but jurors deadlocked on one defendant named christian burton. his attorneys say he was falsely accused. a warning for you right now if you're about to fill up on your way to work. series of problems reaching contra costa county and the city of richmond. police are telling drivers to be careful using your credit card at the readers at gas stations. richmond police found a skimming device on a pump that thieves used to steal personal financial information. investigators say that all those pumps should have a security seal along any opening of that pump, and if it has been tampered with, police say to report that to the gas station attendant immediately. nbc bay area has been reporting several other similar cases in the past few months. just over two weeks ago in santa clara county, two people were arrested after police found them tampering with credit card readers at a gas station. this is at a station in sunnyvale. officials there were alerted to

that scene after the men triggered an alarm. 6:04, our other top story this morning, new developments following this weekend's horrific mass shooting at a pittsburgh, pennsylvania, synagogue. 11 people were killed. in a moment, more on what investigators found about the suspect overnight. but first, faith communities across the country and right here in the bay area trying to help people manage through the shock and sadness. during a memorial service in tiburon, a rabbi asked each group to stand with their candle and announce themselves one by one. the aim was to show solidarity in the face of such a painful and gruesome attack on a jewish synagogue. one of the speakers said he's not surprised this happened, because so many other minority communities have also been attacked over the last few years. >> regardless of religion, race, sexual orientation, the ability status, we say you are welcome here. you are not alone. do not let yourself keep on being afraid.

>> several memorial events also being held today in san francisco to commemorate and honor the victims. the man accused of opening fire in the synagogue heads to court for the face time, this as a community comes together to mourn the lives lost, along with six others who are still in the hospital recovering this morning. jay gray is live outside the sanctuary in pittsburgh, where so much unfolded overnight. this is such a tragic story, jay. >> reporter: yes, it's overwhelming, laura. let's talk about the investigation first, the synagogue behind me still locked down at this point, and will be for quite some time, according to investigators, who are gathering physical evidence there. overnight for the first time since at tack, we're hearing from the rabbi who was inside the tree of life at the time of the attack, and we also now are getting a better idea of exactly what the accused gunman said to

law enforcement when he was apprehended here. ♪ memorials overnight in this grieving city, pulled together by its pain. >> we needed to be here, because at times like these, we need community. we need the comfort of each other. we need love, not hate. >> reporter: hate, unleashed federal agents say by 46-year-old robert bowers as he burst through the doors of the tree of life synagogue with an assault rifle and three high-powered pistols. >> i heard what sounded like gunshots, smelled gun powder. >> reporter: when the shooting stopped, 11 were dead, six more, including four police officers, wounded. initial court filings show bowers told arresting officers "they're committing genocide to my people. i just want to kill jews." his social media history is littered with anti-semitic hate speech and includes a cryptic post just before the attack that

linked to more fake ads meant to divide us. this time accounts from iran. they're the same ads we saw from russia, designed specifically to divide us using race or politics. the pbs television magazine "frontline" will hold a two-night special tonight on facebook's troubles, that starts at 9:00. facebook also reports profits tomorrow afternoon. that gives us the opportunity as reporters to ask facebook a lot of hard questions about fake ads and right wing propaganda. on a lighter note, a study of scooters show they're taking cars off the road. this is video of scooters in san francisco. the study was done in portland. but it found a significant number of people use scooters instead of cars for short trips. looking ahead, apple reports profits this week and we're going to get the jobs, because we're at the end of the month, jobs report comes friday. right now we're at an incredibly low 3.7% unemployment. the last time unemployment was this small, the new york jets

afternoon, it will be so much more comfortable, but we will still have a few clouds mixing in, some of the higher clouds like what we saw yesterday. as you're getting your hair ready for the day, it's going to be a day for a little bit more hair spray, because it is humid, to start, and then we will start out with some breezy winds, turning windy by this afternoon. so you may have some troubles there, just getting things ready to go. as we start out looking at our south bay temperatures in the highs today los gatos headed up to 73 degrees there, as well as 73 in east san jose. for the east bay, a lot of mid-70s here for the inland valleys, and oakland today expect a high of 70 degrees. we'll be up to 70 in palo alto. in daly city, reaching 63. lot of low 60s in san francisco as well. the embarcadero reaching up to 66 degrees and 72 today in mill valley. santa rosa we're looking at a high of 76 degrees. as we will see our winds picking up, we will have an increased fire danger today, so as of

right now, there is a fire weather watch issue, that means that humidity levels will be very clowlow, only 9% to 19%. the areas shaded in yellow will be under the fire weather watch. elevations above 1,000 feet will have some high wind gusts peaking up to 55 miles per hour. we do still have this dry northerly wind coming in today, and then as we go through the week, we'll start to see high pressure moving in, and that's going to shift our wind. the wind flow around high pressure always clockwise, and for us, that brings in offshore wind flow that's going to give us some low humidity, and some gusty winds, and our temperatures will be going up as a result. we are looking at more dry conditions but a few clouds, we can see that right now, right over the bay area. mike, you were checking back in on the tri valley and the recovery. >> recovery mode there for west 580, we talked about that, i showed you the crash. we showed you west 580 over at hacienda. let's take a second and get a view of everyone's commute south

of san francisco, oakland and looking at the south bay with a little build for san jose and no surprises west across san mateo and the dumbarton bridge, we're starting to see a little slowing, a little more traffic flow. lot more traffic flow, better flow here west 580, look you see the sensors have turned from red to orange and yellow, as you approach hacienda, back toward tasahara, the backup forms around isabel, so that is the zone we're at slow for west 580 and add a couple minutes on to your commute, less than five because this is the recovery at tasahara, only taking 45 seconds for this to move better than the last time i took a live look at the traffic center. once you're past that, a smooth drive south through pleasanton. no problems into the castro valley y. your rich mannmond-san rafael b and babup at the toll plaza and slowing for the upper east shore. >> thanks, mike. next and all new this

:30, i'm laura garcia. >> and i'm whereby. meteorologist kari hall has an update on what we can expect as we get out the door. >> it feels cool out there. we have a lot of 50s around the bay area. at least we don't have to deal with fog this morning. we'll see a few clouds in the mix. if you're out the door to the dublin b.a.r.t. station, it's cool, only in the upper 40s and we'll see a mix of sun and clouds as we reach up to the upper 60s by early afternoon. getting the kids up and out for the start of the school day in san jose, we'll be at 51 degrees, as you go to school, but then coming home, it will be a lot more comfortable, with some upper 60s, and right around 70 degrees today. as we head over to mike, you've been tracking some of the slowdowns we're seeing on this monday. >> i thought we were in recovery mode but we do have a crash and another issue for the tri valley, not a crash. over here south bay we see a little build for san jose, typical pattern. no problems for the peninsula. minor crashes 17 and 280 and 101 approaching cesar chavez.

west 580 was in recovery mode, a crash cleared there, right around hacienda, and things are improving toward tasahara. hearing reports of a box truck stuck in the middle of the freeway in santa rita. we'll track that, but that may force more folks to take 84 as they see that backup hovering right around livermore, north livermore and isabel. nice smooth drive for the tri valley and the rest of the tri valley and 580 and 880. looking over the upper east shore freeway with a build. those are typical patterns. back over to you. >> thank you very much, mike. breaking news this morning, search and rescue mission under way after an indonesia plane crashes moments after takeoff, and new information within the last hour, the associated press just reporting sadly no one expected to survive. we know 189 people were on board when the plane went down off the indonesian coastline. "today in the bay's" bob redell has been monitoring new video coming in to our newsroom along

with the newest information from be nbc news. >> the president of lion air says this boeing 737 max 8 had a technical problem during a previous flight, that was fixed in accordance with a the procedures outlined by the manufacturer. not clear what that problem was. we do know the plane was brand new, less than three months old, when it crashed last night in the sea north of indonesia's java island. rescuers have found a large fuel slick in the water, parts of the fuselage and personal items from the passenger and crew, including a crushed smartphone, books and bags but no bodies so far. lion air flight 610 took off from jakarta around 6:20 monday morning local time, was bound for an island chain off sumatra, about two to three minutes into that flight the pilot requested a return to the airport. about ten minutes after that, the plane that looks like this disappeared from radar and crashed into the sea with 189 people on board. that includes a child, two

babies, seven crew members, also among those passengers about 20 officials with the indonesian finance ministry who were on their way to a business trip. searchers have not found the main wreckage but an indonesian official predicts there will not be any survivors. more than 300 people, including soldiers, police and fishermen, are involved in this search. this crash is a big blow to the indonesian airline industry, the u.s. and europe had both banned indonesian airplanes from flying over their respective air spaces because of safety concerns. the u.s. lifted that ban back in 2016. europe just this past june. reporting live in the newsroom, bob redell, "today in the bay." >> so tlanlgic. they did n tragic, they didn't have a chance. happening today the two men charged in the deadly ghost ship warehouse fire are due back in court. derek almena and max harris original lay greed to a plea deal in the case but a judge shocked everyone by rejecting the deal back in august.

almena rented the warehouse and converted it into a living space. harris was allegedly almena's right-hand man who collected the rent. harris is trying to separate himself now from almena's case. 6:34 for you. nearly one week until the midterm election and a lot is still at staining stake. "today in the bay" pete suratos is live in martinez and pete, i know you are still waiting on the number of those numbers coming from contra costa county. >> reporter: good morning to you, marcus, here in marred nez waiting on the new numbers. hopefully posted to the secretary of state website for the state of california at some point in morning. here are the latest numbers as of september, this was 60 days out from next week's election. you can see on your television screen that in contra costa county, the number of registered voters is just over 603,000.

almeida and santa clara counties the in number is just over 850,000. in san francisco, it's sitting just over 480,000. let's show video from over the weekend in the south bay, where you have seven early voting centers opening in santa clara county. i want to point out they'll remain open through election day and also you can register to vote conditionally if you missed last week's deadline. >> with all this fraud going on and not counting the votes, and they keep saying over and over, vote early so your vote will count. >> reporter: california registered voters have gone up 3% since last midterm. here in contra costa county, you see the largest increase in voters since last midterms, up 81,000 voters. we'll continue to monitor the state's website for the latest numbers and provide any updates as they come in. we're live here in martinez, pete suratos for "today in the bay."

>> as that woman said, pete, if you're registered to vote, get out and vote early. thank you. be sure to tune in to "today in the bay," the morning after the election, for the latest results and analysis of all races locally and nationally. our coverage starts at 4:30 in the morning. it is 6:36 right now. new this morning, styrofoam will soon become a thing of the past in one contra costa county city. all restaurants and other food distributors including schools and hospitals will no longer be allowed to use styrofoam products starting january 1st. more than 100 other cities across the state also have approved similar bans. happening today, the palo alto police department working to add life-saving devices to every patrol car. in a few hours, the city council is expected to approve a plan to allow the department to buy 30 more automated external defibrillators. the total cost there $60,000. to foot the bill, the city will use funds from the citizens options for public safety program and santa clara county.

in silicon valley, a new innovative plan to combine housing and a farm. >> as "the mercury news" reports, the agri-hood development plan would include 361 homes and a small farm. it would be built on vacant land across the street from westville valley fair and down the road from santana road in san jose. it would be open to the public. santa clara city council is expected to vote on that plan next month. as a son and grandson of farmers, i am happy they are keeping agriculture in the south bay. good stuff. we'll watch for developments. over here, we're looking over west 580. i do see a steady stream of headlights and no flashing lights, but through this stretch, i'm worried about that and of course disabled box truck west 580 approaching the santa rita road. we've seen the sensors start to move better. no more red in certain parts of the approach, and so i do think they may have moved that box

except the stock market didn't. it remained closed for many days following 9/11. there are growing criticisms the president's words are fanning violence. you mentioned with sayoc in court and there's bush who told police he tried to break into a black church but couldn't so he shot people in a grocery store, and of course, bowers, the tree of life synagogue, claiming members of the jewish faith were funding the caravan in mexico. there have been a lot of reports, false reports about that caravan. facebook is quashing this one, that claims refugees attacked police. these are fake. we added the blurring because there was a lot of blood. this is fake. this one spread by the wife of a sitting supreme court justice. and watch how news uses language. fox news says the refugees are edging closer to our border, but if you look at the location in the upper left, at the time of this report, they're on the border with guatemala, 1400 miles from our border. the main caravan, when they were in that taped report were

through, go through the day, we'll be in the upper 60s by noon, 70 degrees at 1:00. very nice afternoon. as we reach 74 degrees in antioch and livermore, san jose reaching 72, we'll be up to 67 in san francisco, and 76 in santa rosa. as you're starting out getting dressed this morning, and it's going to be a cool one, we're only seeing the low 50s, even some upper 40s, so you do need a jacket and later on today, because it's going to be so windy, you may just want to wear a hat. the winds will cause some concerns for our east bay and north bay hills. we will have an increased fire danger, so a fire weather watch will be in effect for all of these areas shaded in yellow. most of the hills above 1,000 feet. we could get some gusts over 55 miles per hour, and the humidity will be dropping down to about 19% or less, down to 9% in some areas. we will have the potential of any sparks spreading quickly. be careful out there.

we'll see those highs for the next couple of days inland reaching into the mid to upper 70s and then back into the 80s we go. halloween is looking warm with some low 80s and then 85 on thursday. we'll cool it down a few degrees in time for the weekend with san francisco peaking at 75 on thursday. as we head over to mike, the commute is starting to build through cocoa county. >> and you'd expect it to be building right now. i wanted to assure folks there's nothing else going on. highway 4 was slow starting early this morning, continues out of pittsburg through bay point. concord we see slowing for 242 headed down toward 680, a lot of folks cut through there. it's just fine. walnut creek interchange and west 24 through lafayette the build into orinda toward the caldecott. upper east shore moves nicely, slower san pablo into richmond and berkeley. west 80 showing that slower drive all the way down toward the bay bridge. we're about 35 minutes from highway 4 to the toll plaza. scattered smaller crashes through san jose, not a major issue as far as the impact on your commute. northbound just the general push

11 people were killed and six others wounded. the alleged gunman, 46-year-old robert bowers, is due in court today. bowers is charged with 29 federal crimes related to saturday's massacre. across the nation, many people are shocked and saddened by the attack. ♪ several memorials held overnight for the victims. and in just minutes, savannah guthrie is live in pittsburgh for the "today" show, what nbc news is learning about the people tragically killed. closing arguments begin today in the retrial of a man aus couped in the deadly shooting of a south bay paramedic. quinn boyer was shot and killed five years ago in the oakland hills. it happened during a botched robbery by a group of juveniles on a day-long crime binge. several now are doing time, but jurors deadlocked on one defendant named christian burton. his attorneys say he was falsely accused.

it's an all too common warning these days. the problem reached richmond. police say to be careful using credit card readers at gas pumps. richmond police found a skimming device there at that pump. the thieves actually used that to steal personal information. investigators say all pumps should have a security seal along the opening of that pump. if it has been tampered with, report that to the gas station attendant immediately. "nbc bay area news" has reported several other similar cases in the past few months. just over two weeks ago, two people were arrested after police found them tampering with a credit card reader at a gas station in sunnyvale. officials were alerted to that scene after the men trigger eden ala alarm. halloween going to the dogs. fun day for all yesterday when a strut your mutt party was held in the monterey bay area. there were canine versions of superheroes, you see there, even had scuba divers, and more importantly there were some rescue dogs available for
