good morning and thank you for joining us. i )m marcus washington. right now at 5:00, breaking news, a horrific crash in the east bay. two people are dead, and northbound i-880 is completely shut down. good morning and thank you for jo >> and i'm, go xw laura garcia. that crash is having a major effect on the morning commute. mike, is it expected to be closed for some time? >> that's right. bob redell is on the scene. i want to point out two closures for the nimitz in addition to a b.a.r.t. alashbee station. north 880 at 23rd overnight crews should be clearing from the scheduled construction closure but this is the unexpected jam last night, abou

fremont through union city, forced off the road at alvarado niles to the west and get over to dire and back up to whipple. folks familiar with the area will know that will take you past the union landmarkings. let's get a live look and see how the traffic flow is. folks are getting forced off of the freeway. another landmark is that crowne plaza hotel. from time to time the traffic backs up as the volume increases. bob redell is out there in union city and bob, you said originally they were hoping for 6:00. what do we have as far as chp's mate now? >> reporter: that's still the estimate, mike. chp still shooting to have all lanes reopened in an hour at 6:00. one reason why this is taking so much as a result, they're tryingo happened. that takes time and you also have the issue of separating the wreckage and removing the

bodies, which is also a process. around 10:40 last night, a small tour bus hit stop-and-go traffic northbound 880 near whipple and hayward on the border with union city. that bus failed to stop and it collided with two cars. it ended up on top of a lexus and pushed a ford sedan under a ups big rig. the drivers of the cars, one a man, the other a woman, died on the scene. there were no passengers in the tour bus or big rig. the drivers are cooperating with the investigation. >> at this point, we ort alcop >> that's still under investigation. we're looking into all causes of this collision. >> reporter: the far left lane of this section of northbound 880 was closed last night for construction. chp is looking into what role, if any, that played in this fatal collision. the backup at alvarado niles, northbound 880 is where your

inland areas, and livermore reaching 80 degrees. san jose 79 and san francisco today reaching 68 degrees. we'll talk about our microclimates and warm temperatures coming up in a few minutes. in a developing story we first brought to you last week on "today in the bay," a tennessee woman sits behind bars this morning, arrested in connection to a deadly dui car crash in contra costa county, killing a father and his baby girl. >> "today in the bay's"s. . s is live s. >> today today's pete suratos is live in walnut creek. tragic story here. >> reporter: the tennessee woman sits behind bars at this hour and faces serious charges we'll get into in a moment. this woman is accused of driving drunk and causing all of this. her name is jessica martin and according to police, she's accused of driving drunk and causing a multicar crash near 680 in walnut creek this past thursday. now when it comes to those charges that i mentioned, the

alameda county da's office filing those charges yesterday. the charges are two counts of murder and one count of dui. now this crash did kill a father and his baby girl, a very tragic story here, hector garza was the father, dying on the scene, his 8-month-old camilla was also in the car, she died last night at children's hospital. here's reaction from his neighbors to the news. >> we'd see them coming up and down the street. you know, it's just a horrible thing. >> just makes you realize you should take some time out and spend it with your kids. >> reporter: martin's bail was set at $2.1 million and a go garza family, get that information on our website at nbcbayarea.com. pete suratos for "today in the bay." >> very tragic, hard to see, thank you, pete. 5:06 right now. deputy accused of secretly recording juvenile robbery

suspects is expected to be in a courtroom this morning. four times sergeant james russell illegally recorded young suspects as they spoke with their attorneys in interview rooms. instll luded to doing so in conversations captured by police body cameras. he now faces felony eavesdropping charges. struggling to rebuild, more than two-thirds of homeowners who lost their homes in the wildfires last year still have not had a chance to set well their insurance companies. according to the state, 10,000 structures were destroyed last year, more than the nine previous yearscomb tha. 68,000 claims were filed, totalling $14 billion. now in total, 52% of homeowners have not made agreements and santa rosa alone roughly two-thirds learned they were underinsured by an average of $300,000. we are less than a week out from election day, and voters will be faced with making several decisions on a lot of ballot measures. one of the most divisive

bob's legs. >> from a distance. >> okay. >> from a distance. >> all right, well, let's head out the door this morning. shorts weather, mt. saint helena wind gusts up to 62 miles per hour. the wind was howling diablo -m gusts, which prompted this red flag warning. everything has been quiet and this is allowed to expire at 6:00 this morning, as we start to see those winds calming down. humidity still fairly low, especially compared to yesterday for some of our inland areas, bay and the coast. have some higher humidity and throughout the morning with some breezy winds across the north bay at about 15 to 20 miles per hour, elsewhere very light winds, but because we do have such low humidity, it should be a smooth hair day and looking at low humidity at least for the next couple of days.

looking at our highture for today, it's going to reach up to 78 degrees in milpitas, and gilroy 83 degrees. we have a lot of low 80s for our inland east bay areas and in the valleys and for the mostly some 70s. san francisco up to 64, and the marina district, and for the north bay still dry and very warm for this time of year. we're reaching into the low 80s there, and then we're seeing this high pressure keeping it warm and dry, keeping the rain and the clouds farther to the north, and we are not going to see this budge over the next few days. in fact, as we go into november the cma prediction center showing that pretty much all of california will be expecting some warmer than normal temperatures and equal chance of course as we look at this of r here, and then some very warm temperatures. looks like even to start the month, that will verify, and we're going into the low to mid

hit it's 5:26. in santa rosa, a biker hit and killed by a dump truck. that accident happened on stony point road at highway 12 yesterday afternoon. police say that that woman was struck in the crosswalk before she became pinned under that truck. this is the third traffic related death in the intersection in the last six weeks. and west marin, another bicyclist was hit and killed by a drunk driver on monday afternoon, that happened on sir francis drake boulevard west of railroad avenue. that driver was arrested for a dui. a follow-up now, it appears sales of vaping and flavored tobacco products will be banned in marin county within a matter of months. supervisors unanimously approved the ban yesterday. it will apply to all unincorporated areas including eliminating the sales of menthol cigarettes. stores will also be given a few months to wind down their remaining supplies.

commute. first we want to get a chance to say good morning to you. thanks for joining us. i'm laura garcia. >> and i'm marcus washington. we want to get straight to the crash that might affect your morning commute. mike inouye is standing by. mike, are people going to have a lot of trouble getting around that area? >> right now folks northbound 880, these folks can't continue on the freeway and haven't been able to since about 10:40 last night. this is northbound 880, folks familiar with union city right here, the crowne plaza sign there for the hotel, just off northbound 880 at aarado niles, exiting in the area south of union landing mall. getting out to the maps showing you aside from that closure right here, there is green for the rest of the bay. let me take you out to the traffic system, that is indeedo from this right here with you the distraction for the southbound side as the commute starts to build. north 880 folks were forced off there, alvarado niles. you get toward dire street and whipple road and back on to the

merritt station in oakland. the passenger who recorded the video says she was stunned and couldn't believe her eyes. >> and then he's like trying to start it and he'li chainsaw talking about how he's the b.a.r.t. massacre. >> bingham faces several charges including exhibiting a deadly weapon and threatening to commit a crime with the intent to terrorize. a cupertino community group is saying it has a way to stop development where vallco mall was located. kris sanchez is live in cupertino. >> reporter: they have gathering signatures to put a referendum on the ballot before the voters. you can see the demolition here at vallco is already under way, and the heavy equipment moved in basically the same day that the

city council approved a move to accept that development deal from sand hill property company. the group better cupertino says this is happening too fast. it announced it has enough voters to decide.that issue on this is the same group that sued the city of cupertino over this same issue. but in the time that it will take to qualify those signatures and perhaps get that issue to the voters, construction he affordable housing. it allows projects with a certain level of affordable housing to bypass some local ordinances. so the developer now says that instead of the community plan, which it had been working on with the city, it will now focus on that plan that is fast tracked by sb35. in a statement, the sand hill property company managing director says "this latest obstruction and the two-year delay it causes gives the community plan no chance to catch up with the already approved and underway vallco town center project. we consider ourselves patient people, but our patience has

finally run out." referendum mo, so, too, will the demolition and the construction here at vallco "today in the bay." date with what's going on, kris, thanks. today, san jose mayor sam li liccardo is backing several measures on the midterm ballot that includes proposition 2, homelessness prevention. the measure would allow the state to use funds from county mental health problems to housing for the homeless with mental issues. the approval of the proposal would not increase state taxes. several homeless advocates, social workers, doctors and emergency responders are urging voters to say yes. those against it say it makes n mental health services to build homes. be sure to tune in to "today in the bay" after the election for the latest results and analysis of all races locally and nationally. as those numbers come in, we'll

have them fresh in the morning. our coverage starts at a.m. folks in our coverage, it continues about the ashby b.a.r.t. station which is still closed for police activity. i told you that someone had walked into the station and they helped by a medical team but they have taken from the station. was getting addressed with medical help, and so that will be the delay. for the time being, cket and hed the downtown berkeley station, or macarthur, a little farther down the line, options for you. the roads in the area are just fine. the bay bridge toll plaza, the metering lights are on, as is standard there. the big issue northbound 880, bob redell continues to be at the scene of that crash, where two people were killed last night, north 880 still closed at alvarado niles. folks get off and around the union landing shopping mall, on the western side of the freeway. the rest of the commute is just fine. >> let's hope it half way through the work week. >> yes, we are.

a lot of celebrations tonight, going out trick-or-treating and it's going to be nice ross the halloween forecast. looking a little spooky there. we are going to keep the most of's cro the b area, the sun sets at about 6:10 and it's going to be warm for the inland valleys, in spots like the tri valley and the north bay, we'll be in the low 80s at 5:00 and starting to become more comfortable with some low 70s at sunset for the bay. san jose, oakland and also over toward the peninsula, we'll be in the mid-60s and then dropping back into the upper 50s later on tonight. your saturday forecast is looking great, but still very warm, reaching into the mid 80s. the coast at about the mid-60s and then on sunday 67 degrees will be the coastal high, with the bay reaching at about 71 degrees and 82 for the inland areas. i'll have a look at all of our microclimates and today's temperature trend coming up in about three minutes.
