"today in the bay" continues right now. good morning to you. good tuesday morning. i'm marcus washington. >> and i'm laura garcia. let's get to the forecast. you may be headed out the door right now. another cool start. >> another cold start. some of us are in the 30s again this morning, and we do still have the smoke blanketing the bay area. so unhealthy air quality continues as we get a look at all these little dots here in the bay area. those are actual measurements of the current air quality, and it shows it is unhealthy, and then we are going to still see some smoky skies, another cool morning, as you head out on your way to diridon station in san jose. we'll be at about 44 degrees and reaching into the upper 50s at

10:00, reaching 69 degrees at 1:00 today. so a pretty big warmup. we'll talk about what else is going on in a few minutes, and mike says the commute is starting to build. >> we're seeing the sensors start to slow, indicating more traffic and slower traffic tapping the brakes. here in the tri valley and the south bay, very light but we'll show it to you because this is the first extended period where we've seen 680 slow throughout the entire area, pleasanton and more in toward fremont so you know that traffic is coming in here out of livermore and pleasanton. the castro valley y starts to build as well, south 880 and north 238 coming out of castro valley. two crashes have cleared from vallejo, we don't see a lot of problems. the east shore freeway will feed into the bay bridge where the metering lights are on. there are no problems over there, but more traffic travels from the east bay to the north bay as well, richmond to san rafael bridge. back to you. >> thanks, mike. developing for you right now, from the north to the south, devastation and destruction as three massive wildfires tear across the state.

in butte county, that camp fire is now the deadliest in state history, the death toll now at 42. search and rescue teams are taking on the grim task of searching through the rubble and ash. that fire has burned 117,000 acres and current ly 30% contained. heroic acts are coming to light. >>s. sps live pete suratos is live in chico where strangers are helping strangers. pete? >> reporter: good morning to you, laura and marcus. strangers helping strangers indeed, and we're standing here at a walmart in chico, just off of forest avenue. this is where evacuees can get some help as a way to get more news to see if their homes are even still intact. right here where we're standing, over in the corner there are racks upon racks of clothes there that are available for folks who are of course in need as they had to evacuate the camp fire as quickly as possible, and

as you mentioned, we're hearing stories of people stepping in to help out others during this tough time. the video we want to show you guys that our viewer also look at is of dane cummings. we're told he's a garbage man in paradise and against his manager's wishes, he still did his route on thursday morning, but he did more than just dump garbage cans, guys. he helped evacuate a 93-year-old. the 93-year-old was margaret newsum. her caregiver left for the day. dane was there to help out and get her out of the area as that fire approached the paradise part of town. >> i've been up there eight years and i picked the people that i knew were older, and i tried to stop and help him, and let him know they were coming and make sure they're getting out. >> i got up as usual, went and had some oatmeal as usual, and i turned the tv on, and then they said that there was a fire going into paradise.

>> reporter: take you back out here live to this walmart in chico, where evacuees are getting help during this tough time, and of course, we're hearing scary moments of people trying to escape the camp fire, including one family that had to split ways in order to escape that fire. we'll have more on that in the next half hour. we're live in chico, pete suratos for "today in the bay." >> nice to hear the happy stories of survival there. thanks, pete. hundreds of miles to the south, powerful and dangerous santa ana winds threatening to send flames from two different fires into additional neighborhoods. in los angeles and ventura counties, the air attack swooping in just above fiery ridges are dropping retardant. the hill fire near newbury park is burning on both sides of 101. the woolsey fire spans from thousand oaks all the way to the ocean in malibu. it killed two people so far and burned more than 93,000 acres and 330% contained. the hill fire 4,500 acres and 85% contained. this video is another fire that

broke out near the 118 freeway yesterday. so a lot of threats that they're having there. people actually had to turn around on that freeway. the before and after photos show the extent of the damage, to view them, head to our website nbcbayarea.com. you can also find them on our home page. some think it is a dangerous ride. san francisco-based lime is pulling some of its electric scooters off of local streets over concerns they could break in two. this comes as another city in the east bay considers allowing lime into its neighborhoods. "today in the bay's" bob redell joins us live in fremont, with more on the ongoing controversy that we've seen in communities across the bay. good morning, bob. >> reporter: the city council will decide whether or not to enter a shared services agreement with lime to allow lime to place its shared bicycles and escooters on the city sidewalks here in the east bay. you might recall that these electric scooters operated by lime and other companies, not

just lime, have caused headaches in other towns, especially where the scooters clogged up sidewalks and riders and pedestrians were reportedly getting hurt. now lime had to remove some of its scooters from the bay area and other markets, namely the ones made by the chinese company okai, after reports those okai scooters can break in two. lime sent us a statement saying, "safety is lime's highest priority" adding "okai's scooters were decommissioned immediately and will be replaced with scooters considered best in class for safety." the company is working with the consumer products safety commission because reportedly some okai scooters broke apart under normal riding conditions. contractor for lime tells us that he and his colleagues regularly inspect those scooters for safety. >> everybody on all three of those teams look for defects when they line them up or retrieve them. >> reporter: again, lime has removed all of the okai scooters

off the streets. they've inspected the rest. they'll have the safer replacement scooters in place sometimes next year. reporting live in fremont, bob redell, "today in the bay." >> good to see they have the defective scooters off of the streets there, bob. thank you. 6:07 for you right now. happening today, berkeley will consider cutting ties with i.c.e. the city council is expected to vote on a new sanctuary ordinance. if passed it will prohibit the city giving contractor to vendors to supply the agency with data. three councilmembers support the measure. earlier this year, richmond passed a similar law. happening today, in washington, congress gets back to work, with less than a month to avoid a government shutdown. nbc bay area's tracie potts has the latest from capitol hill. good morning, tracie. >> hi there, laura, good morning. good morning, everyone. as we see districts around the country counting votes to see who will be the next congress, this congress is facing a hard

deadline and they're running out of time to keep the government open. congress is back today with a hard deadline, december 7th, pass a budget or shut down the government. >> we can collaborate if the president wants to come to the table and do deals. >> reporter: lawmakers are promising to work together to improve infrastructure, but two things could derail a budget deal, money for the president's border wall and protecting the job of the russia special counsel, robert mueller. republicans are already accusing democrats of what they call presidential harassment. >> i think it's going to backfire on them, like what happened with the kavanaugh hearing. >> reporter: outside washington, election officials are still counting votes. week after the polls closed, nearly a dozen house races are too close to call. >> do your job, count every vote! >> reporter: florida's senate contest remains undecided. >> bill nelson is clearly a sore

san jose at 101. as you head out the door in santa teresa, it's 46 degrees at 8:00 and a quick warmup into the upper 60s today. still looks like we could have a chance of rain next week. we'll talk about it coming up in less than five minutes. and traffic was stopped up here, the san mateo bridge westbound moving once again. i was checking for crashes, there's one in the area, but it shouldn't be causing this. we'll sort it out. and a very happy tuesday to you. glad you're with us. pg&e is on our board because investors this morning are wondering if the power giant has any responsibility for the fires. drubbing on the markets on monday, the dow fell more than 600, nasdaq was down more than 3%. note this apple number. now, the president says the dip on the markets is because investors think democrats are going to bother him. the president is wrong. democrats may very well give him a hard time, but the markets had been knowing about the results of the election for a week now, so it's not politics.

it's apple. you remember those red numbers, apple fell 5%. apple is a dow component but trades on the nasdaq, so it pulled both indices lower. we expect amazon will announce new headquarters any moment now. amazon set up a contest for cities for the new hq. it will be hqs, two of them. we expect amazon will announce that queens and then arlington, virginia both get the nod. that's a huge disappointment for a lot of people. amazon is seen as not playing fair. neither city will get as many jobs as promised and cities that thought they might be in the running like detroit and boise felt they weren't being dealt with honestly. bloomberg reports that waimo will start an uber service with driverless cars next month in phoenix. next month! people getting rides in autonomous cars. a report from oxford tries to predict what people are going to do in automated cars once

they're common. for instance, will people drink more? how about society change? the report titled autonomous vehicles and the future of urban tourism" expects driverless cars could be used for terrorism, put a bomb in them, send them on their way to the destination. whoever thought of that? that's something that, okay, and this is an important detail, they go into quite a bit of detail, autonomous cars will be used, they predict, by couples the same way that cars have been used by couples since the invention of the car, except the whole car is the back seat. >> hmm. >> didn't think of that either. >> maybe it will cut down on drunk driving. >> for sure. >> let's hope. >> let's think of the positives. let's just move on. 6:16. speaking of cars, if you get locked out of your car, maybe siri can help. new app from volkswagen lets apple users lock and unlock their car, they can set the car temperature or tell electric cars when to start or

stop charging. the app comes at a monthly subscription fee of $18. >> back to that a moment ago, huh? >> all right, get in the car this morning and head to work, and it is cold out there. turn the heater on, and yeah, the heated seats, too. we're going to also still have to deal with this poor air quality, here is a look at the morning start in dublin. you see a few clouds there, also the smoke kind of mixing in, so that's going to make for some colorful hues in the sky, as the sun rises and the seven-day forecast is already up at the bottom of the screen. let's get out the door and head to the dublin b.a.r.t. station. it will be 40 degrees, bundle up and heating up fast, going to be so much more comfortable later on. unfortunately we have to limit our time outside because of the smoke, and then as we head over toward concord, more of the

same. start at about 40 degrees and reaching at about 61 degrees at 11:00, and 64 at 1:00 this afternoon. our high temperatures headed into the upper 60s, the low 70s, all across the bay area. really not much of a variation in temperature, so as you get ready this morning, humidity levels are still very low, and go easy with the brush, static is likely. we're dealing with the northerly wind bringing in the plumes of smoke from the camp fire in butte county, and then as we go into the weekend, there will be some changes. weak area of low pressure develops along the coast that shifts our winds. we'll get more of a southerly wind, which will clear things out just a bit, and then going into next week, looks like we could see a storm system approaching the bay area, that brings in some rain starting late tuesday into wednesday. computer models disagreeing on how much rain we'll see and of course i'll be fine tuning that and keeping you updated over the next few days. also keeping you updated on the

air quality. i'm on facebook and twitter and instagram as well. high temperatures for the inland valleys in the upper 60s and a lot of smoke in the air through the end of the week and for the weekend, highs in the upper 60s, lows in the 40s. mike, you were saying there may be some problems through hayward. >> we're looking at the build through the area for the nimitz freeway but also a crash reported to chp. so the south bay that's good stuff. peninsula also great. tri valley shows the build and southbound 880 slows slowing through hayward. around "a" street willmay be a disabled vehicle or fender bender. past there around tennison we have a crash for southbound 880 reported into our waze system that may be an issue for folks trying to head to the san mateo bridge. first we take to you waze and the reports did come in from our wazers out there. there's one with a ninja icon. you can customize your profile.

solano county man getting a parking problem. >> he's actually getting citations for a car he no longer owned. consumer investigator chris chmura looked into it and found a lesson here for all of us. >> good morning. when armando ramirez contacted us, he was fed up. he had received a dozen parking tickets from the city of san jose totalling more than $2,000. they were for an illegally parked bmw 323i, a car armando used to own, but he sold it two years ago and he had proof, but it seemed no one would listen. so we reached out to the dmv and the city of san jose. the dmv verified the car had been sold but the city of san jose didn't get any paperwork. it turns out the people who bought armando's car never did register it in their own name. once we cleared up ownership, the city agreed to tear up armando's parking tickets, $2,153 in all.

6:27 right now -- 6:29. seconds away from 6:30, in fact. good morning and thanks for joining us. i'm laura garcia. >> and i'm marcus washington. also numbers we're watching, the temperatures out there. >> there was some low ones out there. >> meteorologist kari hall is watching that closely for us. >> it's been cold the past few mornings starting out in the 30s and 40s. still smoky as we can get a look at the background, that's a live camera in san francisco, and the air quality for the next several days, no improvement here through at least the end of the week, and there may be some slight improvement for the weekend. we'll talk about that and also the weekend forecast in about seven minutes. mike gets us out the door and so far, it seems to be flowing fairly smoothly. >> not so bad. we have a couple issues in the east bay. first of all the bay bridge toll plaza, metering lights are on. the approach is great. cocoa county more traffic. down toward the walnut creek interchange, there is your pattern. more traffic down through

danville and alamo, but no problems. we are looking at a new crash, south 880 at stevenson, that may be in lanes. chp has to give me that information but i see slowing starting to pop up, another crash at tennison and a previous one at ""a" street. it continues to build hayward and fremont. no problems, the south bay shows the build though, here is 101 north of the 680 interchange, we're starting to slow. 6:31 right now. the destruction is growing across our state, as wildfires burn out of control. in butte county the death toll is rozzing from the camp fire. it now stands at 42, making this fire the deadliest in state history. this morning, dozens more people are still unaccounted for. coroner search and recovery teams there are really taking on the grim task of searching through that rubble and ash. that fire has burned 117,000 acres and is currently 30% contained. thousands of people remain under evacuation.

emotional stories are emerging as victims share their stories of survival. >> nbc bay area's pete suratos is live in chico. tough time for a lot of people in that area. >> reporter: good morning to you, marcus and laura. very tough times for the evacuees of the camp fire. we see a portion of them here at the walmart in chico you have aof forest avenue. behind me there's clothes available for the evacuees, waking this up morning, that is available to them. there is also food on site to help them during this tough time. of course people are still looking for loved ones as they've evacuated or looking for the loved ones missing as a result of the camp fire. there's a facebook page dedicated to helping people locate loved ones. they can post pictures and descriptions of those loved ones as they try to search for them. as you guys were mentioning, dozens of deaths reported. this is already the deadliest fire in california history. now the "today" show did

interview a family of four in paradise, who were able to drive out safely from that camp fire, but they had to split ways. the mom with her 11-year-old daughter and the father with the 15-year-old son. they split ways and drove out of that area safely. here is the 11-year-old speaking about the skaery moment when the family had to split up. >> i felt like if i didn't make it, then -- i just wanted to say bye or i love them one last time, because i didn't know if i would ever see them again. >> reporter: search and rescue crews will continue this morning, and will be for the next several days. they need to identify and locate any remains through butte county to hopefully provide answers to folks in the area. we'll take you back out here live to this walmart in chico.

"today in the bay's" kris sanchez joins us live from san jose with how the downtown skyline could actually be changing. kris? >> reporter: hi there, laura. you know it, i know it. there is scaffolding, there are cranes all over downtown san jose and as you said, that construction is booming, and the buildings that are going up now are taller than they've ever been, for now. the city may raise the limits further for high-rise construction in an effort to spur economic group near mineta san jose international airport and until recently, san jose kept height restrictions below the requirement of the federal aviation administration. if they change that, there could

be impact to some of the airlines that fly into and out of mineta san jose. "the mercury news" reporting the city is now in negotiations with airlines that would have to fly with perhaps lighter loads in order to accommodate that higher skyline. mayor sam liccardo said mineta is the fastest growing airport in the nation and told the san jose downtown association, " transforming our downtown skyline and maintaining a world class international airport each constitutes important fundamental long-term economic objectives. we've had to manage conflicts between the two." those two are not the only stakeholders, and at 11:00 this morning, the labor group working partnerships usa, is going to have a press conference, making an announcement about some development downtown san jose near google's proposed site near diridon station, and that would be something that would fall under the height restrictions changes, so we'll be watching for that. that story is embargoed, coming

coming to san jose, that's december 14th and she'll be at the s.a.p. center. we'll give the traffic advisory for that as well, going to be a crowd. over here the south bay not really needing an advisory right now, just that build, san jose right on schedule. the area i circled of greatest concern, where we have the crash. everything else is building lightly. southbound 880 at stevenson a crash in lanes. we see a lot of slowing past the dumbarton bridge. you'll be tapping the brakes harder and clearing once you pass by stevenson, a smoother drive into the south bay, everything moves nicely as we talked about but slowing north 101 around capital expressway. no crashes reported but we'll track that and of course there's the north bay with the smoke. >> gosh, it will be nice to have that cleared out of the area. >> hopefully by the weekend. >> i think we'll see improvement by the weekend, but we're still in with the thick of it right now. i wanted to show you this look at the sunrise over fremont this morning. it is beautiful, isn't it? now, we start out with some very

live look at 101 and san jose. as we go through the day, it's going to be a chilly start, but a quick warmup. we'll be in the upper 60s by early afternoon. we'll take a look at all of our microclimates and talk about the chance of rain for early next week, coming up in less than five minutes. we're looking at this crash in fremont, the chp has just issued a special traffic alert. the overturned vehicle may take a while to clear and the traffic feeding in and out of hayward. we'll check that traffic coming up. here is a live look over fremont. the city there currently debating if it should open its streets to lime bikes. the electric scooters are already clogging up sidewalks in other cities like san francisco and many of the scooters have been recalled and removed for faulty boards or batteries. >> everybody on all three of the teams looked for defects when they ride them and place them and line them up or retrieve them. >> fremont city council meets tonight to decide.

12 crosses placed outside borderline bar & grill to honor each of the victims from last week's shooting. it happened wednesday when a former marine opened fire in a bar in thousand oaks before taking his own life. 12 were killed, including a young woman from napa. >> the owner of the bar speaking out about the devastating event and explains how the night really changed the town forever and how the community is working to recover. >> so we will -- yeah, we'll come back stronger. >> authorities are working to figure out what led that shooter to open fire. investigators say that he posted on social media at least twice during the shooting. a few popular birth control pills are being recalled. the reason? wrong instructions. the recall affects three types of orthonovum birth control pills. they were packaged with inaccurate instructions that could lead women to take the pills in the wrong order. the fda says this could lead to

bleeding or pregnancy. women taking the recalled pills should continue taking them but speak with their doctors about any concerns. cnn is now suing the trump administration, it has to do with this interaction at the white house last week. administration suspended cnn correspondent jim acosta's press credentials claiming that he assaulted an intern during a news conference. the video shows acosta not giving up the microphone after the president refused to take any more questions from him. cnn just put out a statement saying that the president is retaliating, because acosta was asking challenging questions. cnn is asking the courts to return acosta's white house press credentials immediately. 6:46, the president meantime watching his party's lead in the senate fall by a single seat. >> a democrat has won in arizona. >> she has, kyrsten sinema defeated republican martha mcsally. it took that long to count the

votes and in a time where counts and recounts have gotten contentious, both women treated the electoral process with trust and respect. >> i just called kyrsten sinema and congratulated her becoming arizo arizona's first female senator after a hard-fought battle. i wish her all success as she represents arizona in the senate. >> i am so honors that arizonians chose our vision of a better arizona, and now it's time to get to work. >> in other races, we still don't know the result of the governor's election in georgia. it could get close enough that they'll have to have a runoff. in florida, florida continues to be florida, no news this morning. congress gets back to work in a lame duck session, where lawmakers who lost their race are still members of congress and can still pass laws. the talk in washington is the department of homeland security head kirsten nielsen will be the next to be fired. she's the protege of chief of staff general john kelly.

if nielsen gets the boot we'll see what kelly does. the president tweeting angrily about france this morning, upset about a report that's been disproven that emmanuel macron wants to create a european army, he was misquoted. he's also making fun of their president's approval rating, touching on the quality of french wine and capping it off with "make france great again." this is a remarkable turn for the relationship. macron was one of the more friendly world leaders to trump. you remember, they went to a parade together which upset a lot of french people. the new attack by trump may make macron more credible in the eyes of his countrymen, as the european anti-trump. we'll continue to watch that develop on twitter. follow me @scottmcgrew. it's said everything in texas is bigger and one woman in the state is celebrating her divorce in a big way, with a big bang. >> new video shows her blowing up her wedding dress.

unhealthy, and we're seeing that pretty much all over the bay area, but take a look at this beautiful sunrise over fremont. i keep picking this fremont camera because it looks more and more amazing, and then as the sun rises, unfortunately we're not going to see very much of the sun today. the rest of my cameras look like this. it is just a miserable view of the smoke that is blanketing all of the bay area. we are one degree above freezing in santa rosa and 30s and lower 40s for most of the bay area. so as you're stepping out the door in antioch, only 40 degrees walking to school. it's hard to get the kids up and ready for school, after that long holiday weekend, and they may be kept inside today because of the smoke. only going to make it into the upper 50s by recess. going up to 67 for our afternoon high. 71 in san jose and 68 degrees in oakland. upper 60s and low 70s for the

north bay. as you are getting dressed, it is a cold start. you need a warm coat. you'll be comfortable today with some pants, slacks or jeans. as we look at our forecast, our northerly wind continues and that's the reason why our poor air quality will stay with us through at least friday, but by the weekend, we get a weak area of low pressure moving closer to the coast that will change our wind direction. southerly wind means that we could see some improvement, and then going into next week major improvement in our weather. it looks like we could see some rain moving in, starting late on tuesday into wednesday and possibly thanksgiving as well. i'll keep you up to date on how much, and then as we look at our near term forecast, it's still going to be warm for this time of year, and smoky with highs in the upper 60s to low 70s for our inland valleys. heading over to mike, now you have a traffic alert in fremont? >> chp called this traffic alert despite the fact that only one lane is blocked for the nimitz, that's southbound 880, but that is a tough place, tough time.

south 808 from hayward down into fremont, passing both bridges. we have traffic jamming up, but overturned vehicle injury crash there, may take a while to clear. no word on when chp expects that to reopen. let's take you to waze and show you what they put as local landmarks, washington, american high school, newark elementary, warwick, newark junior high school and surface street traffic will be an issue. these will be flooded with school traffic over the next 40 minutes as well. as we get back out to our maps and nbc bay area wazers the team that will help you out on surface streets, get across the dumbarton bridge, however, you do have an issue as well once you get to the peninsula side, that crash over at hacker way. cool name but bad place for the crash right by facebook. there is the south bay with the typical build over there and also for the east bay, cocoa county and alameda county operating standard. >> thank you, mike. 6:52. happening now, sacramento police officers changing where they wear their body cameras.

welcome back to tuesday morning on "today in the bay." before you head out the door, here are the top stories we're covering. >> from the north to the south, devastation and destruction, as three massive wildfires tear across the state. in butte county, the camp fire is now the deadliest in state history. the death toll there now at 42. dozens more people are still unaccounted for. the fire burned 117,000 acres and is currently 30% contained. thousands of people remain under evacuation. in chico, donations are pouring in for fire victims, where some evacuees are gathering this morning. we're hearing some amazing stories of people jumping into action to help others.

despite his manager's wishes, this is dane ray cummings. he continued to work his route as a garbage man in paradise on thursday, but he did more than just pick up trash. cummings ended up helping 93-year-old margaret newsum evacuate the area as that fire approached. >> i've been up there eight years and i picked the people that i knew were older and tried to stop and help them and let them know that they were coming and make sure they were getting out. >> what a great thing. newsum says she's thankful for his help. hundreds of miles to the south, powerful and dangerous santa ana winds are threatening to send those flames from two different fires into more neighborhoods. the woolsey fire spans from thousand oaks to the ocean in malibu, and it has killed two people so far. it's burned more than 93,000 acres, and is at 30% containment. the hill fire is much smaller, 4,500 acre, currently 85% contained. in just a moment on the "today" show, another live report from the fire lines, as crews still have thousands of homes to search for those

survivors. happening today, berkeley will consider cutting ties with i.c.e. the city council is expected to vote on a new sanctuary ordinance. if passed it will prohibit the city giving contractor to vendors to supply the federal agency with data. three councilmembers support the measure. earlier this year, richmond passed a similar law. markets opened just about 30 minutes ago. stocks are expected to rebound today. you see it hovering just down 2 points so far. hope of renewed trade talks between the u.s. and china that will help the markets rebound. yesterday the dow actually fell more than 600 points, after a sharp decline in apple share price and worries about the strength of the u.s. dollar. we'll keep monitoring that for you. amazon finally planning on announcing new headquarters and should happen, actually it did happen, because i tweeted out the new information already this morning. amazon picked new york city and
