jose 101 camera as you get ready to head out. a few swipes of the windshield wipers as our visibility is down to a mile and three quarters and oakland we only have a one mile visibility there but elsewhere it's not as widespread as yesterday morning, but still kind of patchy out there and, mike, you to need those wipers as you head out for that drive. >> over in san jose, the mist is on the lens here and i did need to swipe it from time to time. it wasn't enough to keep them on steady. i had to swipe it once, drive for a little while and swipe it again, but just note you will need that and perhaps washer fluid as well. we're registering a construction closure there as you head down toward los gatos. the cameras right there, that mist will be a factor heading down through the south county, but the rest of the bay shows a lighter cloud cover than yesterday. good stuff, guys. back to you. >> breaking news to tell you about, a large water main break

is shutting down a busy intersection on the peninsula. now this is new video just in to our newsroom. you can see that water pouring out on to the road there. this is near brandford and wince lowe. this is near the san mateo government center. this is near where the courthouse and jail are located. here's a live look from that scene as you can see that road shut down and police there on the scene blocking the road. crews work to make that repair. we're not sure how long it will take to fix that. making other news this morning. how many text do you send a day? some california leaders are looking at taxing your messages. >> to have them charge us something else is just dumb. >> reporter: some may think it's dumb but some state regulators

think its necessary, the public utilities commission is floating the idea of taxing texting. >> it's a very complicated and complex proposal they put forward. i think there's a lot of questions -- and one of them is the lettingty of retroactively texting texts going back five years. >> one of the questions this proposal raises. he along with several other business groups are against it. >> the tax presumably would support services that the state provides to low income residents, low income consumers but the fund that they have for that is already flush. >> reporter: state regulators say the program is not flush but instead breaking the bank. they say its budget has increased over $300 million in six years. >> i think it's very unfair and especially for the people that can barely pay for their kroef

plan already. >> reporter: and we all know that californians won't stop texting. >> so much easier. >> reporter: some think no matter how the commission votes, we will have to pay a tax any way. >> if they want us to pay extra in taxes, we'll pay extra in tax taxes. developing this morning, french authorities detained five people in connection with the deadly rampage in one of europe's most famous christmas markets. its near the german border. three people died. 12 others are injured. police know who the attacker is, a man previously tied to some sort of terror group. they believe he was injured during a gun fight with soldiers and he may have actually crossed the border into germany. authorities are not identifying him. the deadly hit and run in fremont, the identity of the victim not yet released. this one happened some time early yesterday morning when a man was struck as he walked across the parkway. officers arrived to find him dead at the scene and no sign of a vehicle.

as we told you all morning long yesterday on "today in the bay," the man was under -- the bay area was under a dense fog advisory at the time. it was pretty thick out there. anyone who may have noticed something suspicious is asked to contact fremont police. right now we're getting more answers from pg & e about the most destructive wildfire in the state's history. the utility now acknowledges that a warm hook on a transition tower apparently fell before the camp fire broke out in butte county. our investigative unit first reported about the issue last week. the hook secures a high voltage power line to a steel transmission tower. the fire began at the base of that tower. the company is also suggesting that gunfire may to be blame for a second, smaller fire nearby. the downed trees on top of power lines were also found in the area. pg & e is promising more widespread inspections of its equipment in those fire prone

areas. and 4:35 for you right now. the death toll is rising in butte county. an 80-year-old man died at the uc davis burn center bringing that number of people killed by the fire to 86. the sheriff says three people still remain unaccounted for. santa suit and alcohol not always a great mix. two women have turned themselves in to police. you may have seen this already. we showed it to you yesterday. people vandalizing a restaurant called shalla mar during saturday night bar crawl. one woman was seen fighting with employees, another smashed the front door. two, 21-year-old women, turned themselves in yesterday after learning about that video. each facing felony vandalism charges. the hotel hack that exposed some 500 million guests' private information has been traced back to the culprit. who is responsible and the other

good morning. here are today's top business headlines. wall street is set to open up higher this morning after a rip saw session yesterday. stocks initially rose amid signs

of improvement among trade talks between the u.s. and china. the dow was up 368 points but that optimism was dampened by reports that the u.s. will condemn china over hacking and espionage. the markets fell to their lows of the day following that contentious fight at the white house between president trump, chuck schumer and nancy pelosi with the president threatening to shut down the government. the dow closing off 53 points. on today's watch list, a report on consumer prices. and the recent cyberattack on marriott that exposed the personal data of about 500 million people has reportedly been traced to chinese hackers. "the new york times" says it was part of the same effort to hack health insurers and the security clearance files of millions more american. the hacking of marriott starwood chain was revealed late last month. marriott the top hotel provider for u.s. government and military personnel and hertz wants to help you get your car and go as fast as possible.

dublin where it's not as foggy as it was yesterday. you'll be happy to know that, that the drive won't be as scary and we're going to see also some patches of fog around the bay area, but still really cool temperatures. take a look at our numbers now. we're in livermore at 45, also 45 in san martin, in san jose, 49 degrees and its 52 in oakland and in palo alto. santa rosa you're walking out the door to about 40 degrees right now. let's head over to martinez where it's going to be cool. grab a jacket. we'll be in the mid-40s. looking at some mostly sunny skies, overall a really nice day. you to still need a warm coat for the early hours and then the rest of the day maybe a hat because it is still very humid out there, big hair day for a lot of people. we're looking at temperatures that will reach into the upper 50s in oakland and in san francisco. we're pretty much back to the temperatures that we had yesterday and it's going to be a

really nice afternoon. one of the things that's helped us out as far as the fog development is some clouds that have moved in and we're going to see those clouds throughout the early morning hours clearing out today. this is ahead of a weak system that moves through and i'm also tracking our next round of rain. we can see the swirls of cloud and all of the rain that's moving out ahead of that going into the day on friday. we're not going to see that rain moving into the north bay until about early friday afternoon and then it weakens as it moves through. so we may not all see those showers, but still a slight chance throughout saturday and then on sunday we'll have a round of some heavier rain moving again but it's not until late in the evening, mostly after sunset when we start to see that second round of the heavier rain moving through. it looks like with the potential of rain and what we may see, maybe up to three inches or close to it in parts of the north bay. that will be a pretty good soaking and that will mostly come between sunday night and

early monday morning and then looking at the sierra, some light snowfall there, anywhere from about three to 11 inches of snow as we go into early next week. we'll be tracking that and fine tuning the details on that. looking at some upper 50s and low 60s for the inland valleys. nice weather today and tomorrow. showers late on friday, saturday looks to be a day of a break, and then more rain moving in late sunday evening. mike, you have a mist alert for drivers. >> i got to call it something. mist on the windshield from time to time, folks make sure you have enough washer fluid in there because a little smear has formed right here on the golden gate bridge camera. as things dried out, you get streaking going on -- you'll get the streaks on the windshield and you'll need to clear it off with fluid. looking at a little sheen on the roadway, from time to time, you'll see that fog/drizzle up here in the north bay. no problem down to the golden gate bridge.

here's patches of fog here and there. low clouds, mist, drizzle. the south bay we encountered that a lot. not enough to keep them on steady. over here we're looking at intermittent traffic flow. no slowing shows up. crash on the showered and it shows you the -- crash on the interchange. we can see all the way over there to the dublin. easy drive. back to you. >> thank you, mike. forget the naughty list, grinch-like behavior being captured on camera. >> "today in the bay's" report, neighbors are reporting christmas crimes on their front lawns all talking the very same thing. >> reporter: new video shows one of the many christmas decorations stole enover a 24-hour period in and around the willow glenn neighborhood. this victim says several disney lawn items were taken from his

home, the thief using clippers to free them from zip ties and he's not alone. >> it seems as if we have a regular christmas -- actual grinch in our neighborhood. >> reporter: early monday morning, someone stole adam martinez's light-up mickey and mini house off his front line. he posted his outrage to facebook and found several others just like him. >> willow glenn residents, i'm sure they're getting a little tired of the whole thing. >> reporter: his life sized disney decorations were smashed too. >> it is frustrating. you don't expect something like this at this time of year. >> you are stealing not only from a house, from a yard, you're stealing from families. >> reporter: police say they haven't seen an increase in these crimes yet but asked the public to report the thieves. victims say the disney decorations are more expensive and harder to find, but they won't let these christmas crooks dampen their spirits. >> to be honest, if somebody really needed it and they would have came to the door and asked

gilroy couple who ran into trouble with their trade-in. 4:54, "nbc bay area responds" to a company who ran into trouble with their trade-in. >> they say the dealer made a mistake paying off their old car and owed them money. chris chmura worked to sort it all out. >> reporter: good morning. when they were ready to buy a new mercedes suv, they traded in their used mercedes sedan. there was still a loan on the car and as part of the deal, the san jose dealership paid it off rolling the balance into the price of the suv. but here's the thing, the dealer over paid the loan by 548 bucks. cindy says she spotted the error and asked them to refund her. well, weeks wenltd by with no check so cindy turned to us. we contacted the mercedes dealer

morning right here with us on "today in the bay." >> let's check the forecast with terry. >> we start out with patches of fog but as you said it's not as widespread and dense as it was yesterday. let's check out the current visibility. we're down to about two miles in san jose and one mile in oakland. as you head out the door in pittsburgh, it's going to be mostly cloudy, misting and drizzling, low 40s, heading up to about 54 as the sun great lake ouz around 11:00 today. we'll talk more about our microclimate and what's ahead and you have a much clearer drive throughout the north bay. >> this spot here, we couldn't see the roadway. we could only see the silhouettes of these trees in the foreground. today a much clearer dry but the road weather index taking that weather data and applying it on to the weather conditions still shows farther north you have that fog and further north from
