ad lib live picture of san jose. a very good tuesday morning. it's december 18th already. taking a live look outside, christmas in the park this morning. it remains all lit up, as we approach christmas, less than a week away, right? one week from today. but who is counting? we should be. good morning to you. thanks so much for joining us. i'm laura garcia. >> and i'm marcus washington. let's talk about the weather out there today. yesterday rain, a little bit different? >> a little bit different. clouds and patchy fog. we'll have live look in fremont 880, everything is rolling well as you get ready to head out the door and it's also chilly with some upper 40s to start out this morning. we'll be in the mid 50s by noon

and as i said, i'm tracking some rain. here is a look at the spotty showers just now entering the far northwestern corner of the state. i'll have more on that in a few minutes. vianey has a look at the morning commute. how is it looking? >> much better, considering the roads are dry this morning, and overall, you could see the bay area is looking pretty good. as i was making my way over to this report i noticed this accident pop up and i took a quick look at the chp report, a crash southbound 880 at dyer street. this was just reported by the chp so we'll monitor that closely. live look outside at the san mateo bridge, we've got a smooth commute through this early tuesda fingers crossed it stays that way. back to you. >> thank you very much. we have breaking news out of the south bay this morning. southbound 101 opened after a chase. this is a look at what is left. all police are telling us right now is that chp officers were

following a corvette, no word why. the driver of the corvette crashed into that pickup truck. the suspect in the corvette ran away then from officers. bob redell is getting to the scene to gather information for us. he'll join us with a live report in about 30 minutes. also developing this morning, a glimmer of hope. bay area congresswoman says she's working to reunite a little boy and his mother. he's on life support at an east bay hospital but his family says that president trump's travel ban is blocking the mother from seeing her son one last time. it's a race against time and congresswoman barbara lee knows that. >> she says as a mother herself her heart aches for the family. cheryl hurd has more. >> reporter: at word spreads, the doctors here at benihoff hospital in oakland are only giving 2-year-old abdullah hassan days to live.

congresswoman barbara lee is calling president trump's travel ban un-american saying in a statement "i'm committed to doing all i can to fight it and restore decency and humanity to our immigration laws." she's written the state department urging the administration to grant the toddler's mother a waiver so she can be reunited with her son. >> please help us, get my family together again. >> reporter: a plea from the 2-year-old's father, ali hassan, who holds his son's hand, while he's hooked up to a ventilator. hassan spends days whispering into his ear. >> tell him your mother's not here with me. it's brain condition. u.s. citizens. bothathe are the boy's mother is from warn torn yemen and is now living in egypt. >> for months, if not years, they've been trying to acquire a visa, obtain a visa for her. >> reporter: when the young boy's health took a turn for the worse, ali could no longer wait

for his wife's visa to go through, so he brought his son to the u.s., where he could receive better medical care. >> he's facing death, and the last wish for the mother is just to see him and hold him, even give him a kiss. >> reporter: cheryl hurd, "today in the bay." we're watching new developments in washington, d.c. president trump's former national security adviser michael flynn faces sentencing today. he pleaded goility why i to lying to the fbi about his communications with russia. he was the first senior white house official to be charged in the special counsel's investigation into moscow's meddling into the 2016 presidential election. mueller's office recommended little to no jail time for flynn saying he in that investigation." coming up at 5:00, president trump already tweeting about flynn. we will have a live possible government shutdown which is only three days away. republicans and democrats are locked in a stalemate over funding for the border wall.

neither side is flinching. the president wants $5 billion for a wall he originally said mexico would pay for. democrats say that they aren't budging. partial shutdown would impact more than a dozen agencies, and could leave more than 400,000 federal workers without a paycheck before the holidays. this morning a staffing shakeup at pg&e after the company calls unacceptable conduct. utilities say top leaders lost their jobs amid a growing scandal involving gas line inspections. state regulators say pg&e management pressured understaffed crews to falsely file thousands of inspection reports. reports claim the crews marked and located gas lines within a three-day required deadline, when in fact, they didn't. an elaborate terror plan outlined on hidden camera. the fbi released video of an oakland man outlining a terrorist plot to kill thousands of people. >> i was thinking about just burning the hills, because

there's a lot of trees and homes over there. >> 23-year-old emer ali alhagogi thought he was laying out his plan with terrorist ties to al qaeda but it was an undercover agent, this happened two summers ago and he talked about planting bombs across the east bay and blowing up a gay bar in san francisco. in court he pleaded guilty to providing material support to a terrorist organization. investigators say he set up social media accounts for isis. his sentencing has been postponed to january 8th. almost one year later a candlelight memorial in honor of a chp officer killed in the line of duty. andrew camalieri was parked on the shoulder at 880 in hayward, where a driver both drunk and high crashed into his patrol car, killing him and injuring his partner on christmas eve. last night, his family, along with chp, honored his life and want to remind drivers not to drive impaired this holiday

season. >> have a designated driver, because i wouldn't want another parent to feel what this feels like to lose a child. it's just, i'm not the same person i was a year ago. >> our crashes have increased significantly because people continue to drive under the influence of marijuana. we don't need a test to detect they're under the influence. they're crashing. over 50% increase at this time compared to 2017. >> investigators say 22-year-old mohammad ali of hayward was driving that car that killed camalieri. he is at the san rita jail in dublin with no bail. his next court date is in march. happening today, the san jose city council may take a big gamble on two tiny home communities. the city has been working on a five-year pilot program to see if the tiny homes can serve as a bridge to get people off the streets while awaiting permanent housing. they are poised to spend $2.1 million on each site. each will have 40 emergency sleeping cabins built by habitat for community. one side is on mayberry road

good morning. i'm kate rogers at cnbc global headquarters. here are today's top business headlines. wall street will look to claw back some of yesterday's big losses. stocks fell sharply again, the dow closing at its lowest level since march, while the nasdaq is now negative for the year. the dow and s&p 500 on pace for their worst december since the great depression. investors remain nervous over rising interest rates with the federal reserve expected to hike again when it meets this week. there's also concerns about slowing global growth and u.s./china trade tensions. on today's watch list, we have a report on housing starts and earnings from fedex. there's not much time left to order and ship your gifts for delivery by christmas eve. monday was the deadline for

they responded to calls about a coyote in the area. they sent out a warning to be careful saying coyotes are less scared of humans than other wild animals. there are countless traffic stories in the bay area, but stop us if you've heard this one. >> a goat traded the farm for 880 in oakland yesterday. number of people called highway patrol when they saw him running across the north and southbound lanes. officers set up a perimeter and closed in on him. they took a few picks with the goat before taking him to an animal shelter there. >> huh. >> probably so scared. >> although he looks pretty comfortable inside of the squad car. >> he's like "i appreciate that." >> exactly. what is the story today >> we'll have a of everything as you get ready to head out. we have had patches of fog and cool temperatures and we'll be watching out for rain in the north bay. as you head out, most of us are in the 40s, but it's a little bit cooler in livermore. now it's 40 degrees.

we may dip into the upper 30s, and it's 48 right now in santa rosa. actually, the warmest in oakland. the warmest is 49 degrees. so still pretty chilly out there, so as you get ready to head out the door in antioch, we're going to be at about 44 degrees over the next couple of hours, and then seeing those temperatures going into the low 50s by 10:00, 56 degrees at 11:00. no major issues but watching out for some patches of fog and then looking at a chance of rain starting to move in from the north, as we watch this system move in that will mostly affect the north bay, and it's also helping to churn up some higher waves, so the high surf advisory continues for today through 5:00, and we are already seeing some of those waves at about 16 feet at a period of about 15 to possibly up to about 19 seconds, so long period swells and high waves continue for today. as you're getting dressed, expect those temperatures to be chilly, so you need a nice, warm jacket and maybe some pants or jeans or some slacks, something like that, will keep you

comfortable today. we're looking at highs that will be reaching into the upper 50s and low 60s once again. kind of the same weather we've seen recently, and then as we track the rain and the chances for the north bay, by 1:00, we're seeing some spotty activity around santa rosa. most of it will be farther to the north around ukiah, and we'll see the waves of rain moving through, even into the afternoon. so still watching out for those rain chances for today, and then going to see it winding down for tonight into early tomorrow. overall, we're looking at some fairly quiet weather, more fog developing tomorrow morning, and the inland areas reaching into the upper 50s, and 60 degrees for the rest of the week. another chance of showers on friday and then again on sunday. so we will still see several weather systems passing by, nothing significant over the next several days. g.ading over to vianey, you'vemn how is everything flowing? >> nothing significant for crashes. we had one fender bender early on and looks like they're working to get that car over to the right-hand shoulder, so not really an issue anymore along

880. if you look at the bay area, we're doing pretty good this morning. here is a live look at the bay bridge toll plaza presidents' sta -- it's starting to get a little busy. quick check of your east bay drive time, southbound 680 to 580, 11 minutes. northbound 238 from 580 to 880 two minutes and southbound 880 from 238 to highway 84 you're looking at ten minutes, so, so far, your morning commute is off to a fairly good start. it's 4:50. the traffic tends to build at about 5:00 a.m. i'll keep a close eye on that for you. i'll send it back to you. >> sounds good. we'll check back with you. han white board tree pointing a gun at then soc. for nebraska fans to notice. the pos w eugh the white board was in stanford's locker room, as they beat nebraska on saturday to win the ncaa championship. stanford's athletics director now apologizing, saying the picture is unacceptable and does

not reflect the school's values. here is the buzz on campus. >> i thought it was ridiculous, like why are people out here doing stuff like that? >> it could be a water pistol. you know, it could be fillingan so i'm okay with it. >> stanford apologized to the university of nebraska. a really bizarre coincidence in the east bay. two officers are under investigation for accidentally firing their weapons in two separate incidents. both of them at the mall. that first happened on saturday, an off-duty oakland officer accidentally shot himself in san leandro. this happened at bay fair mall. he was off-duty at the time. no one was hurt. the second accidental shooting happened sunday in concord. man with the department of corrections dropped his gun, and it went off. no one was hurt there as well. that man called concord police to explain what happened. he legally owns the gun. his superiors are looking into the matter. it was a pretty pricey mess at the ferry building dock. repairs for a crash along san
