and good wednesday morning to you. taking a look outside in dublin, barely can tell it's dublin there. foggy start to our morning here. we're going to get you started with your day. this is 5:00 right now. thanks for starting your morning with "today in the bay." i'm marcus washington. >> and i'm laura garcia. let's get straight to the forecast. will we see clearing skies? >> the fog is patchy, not all seeing patchy fog but we can see the visibility decreased in the tri valley as well as the north bay. south bay looking good as you get ready to head out the door. toward pleasant hill, there will be some patchy fog, and temperatures in the low 50s this morning, as you get ready to head out the door. at noon, it's still mostly cloudy, and we'll be at 58 degrees. we'll take a look at all of our microclimates coming up. mike, it's time for the changes in oakland. >> like brady bunch.

♪ it's time to change looking at southbound 880, a burst of traffic came through, usually that indicates a traffic break that was let loose. the reason i thought maybe that freeway had cleared up was because there's construction going on, blocking two lanes north of there. i have seen some slowing, i've seen speed sensors change so they are starting to move the southbound crews to the northbound side, headed toward 23rd. that won't clear up for maybe a half hour, probably 20 minutes through the area. the rest of the bay shows a nice easy drive but there are pachds of fog drifting around, no the sticking around long enough to show it anywhere except on our north bay road weather index, and that's where you see a caution north of novato. back to you. >> thank you, mike. former national security adviser michael flynn is expected to wake up this morning as a free man, but his fate is still in limbo, after a federal judge threw a wrench in the government's plan. "today in the bay's" tracie potts is live in washington to explain exactly what happened.

gar good morning, tracie. >> hi there, laura, good morning, everyone. the defense team went into court thinking they'd keep flynn out of jail, but the judge did not like that deal so they ended up hitting a pause button on the whole thing. the russia special counsel recommended no jail time for former national security adviser michael flynn, because he's cooperating with their investigation, but judge emmet sullivan disagreed. >> you could see the judge heating up during the course of the hearing. >> reporter: "you sold your country out," the judge told flynn, questioning why he wasn't charged with treason for working as an unregistered lobbyist for the turkish government and lying to the fbi about discussing sanctions with the russian ambassador. >> to talk to the russians and to tell them that, to go easy on us after we had posed sanctions and then to say that you didn't say that, that's serious. >> mike just made a very, very serious mistake.

he realizes it. he's paying for it dearly. >> reporter: the judge almost sentenced him to prison. instead they reset his hearing for march 13th, while he continues to work with the fbi. >> the fbi broke standard protocol in the way that they came in and ambushed general flynn. >> thank you very much. >> will you pardon general flynn? >> reporter: more troubles for president trump, under pressure from new york prosecutors, his foundation has agreed to dissolve. the state's attorney general reports a shocking pattern of illegal use of charitable donations. now a different story coming out of the foundation. their attorney says that, for years, they've given millions of dollars to hundreds of legit charities, despite some of the criticism coming from new york. they also said that this is political, that they've been trying to wind down this foundation for the two years that president trump has been in office now. it's set to happen in 30 days, but the lawsuit that new york has lodged against the

foundation, that moves forward. laura? >> so interesting to follow. tracie potts live from washington, thank you. 5:03, breaking news into our newsroom, facebook admitting overnight, it allowed other big tech companies to read users' private messages. but the social media giant denies it did so without consent. right now, the story is trending around the world. these are live pictures from menlo park this morning. the "new york times" investigation found facebook gave companies including netflix, spotify, among more than 100 others the ability to read, write and delete users' private messages. the deals in turn helped facebook bridge in mong in more. spotify and netflix told the "new york times" they were unaware of the access facebook granted them. facebook has been embroiled in a series of scandals this year. coming up in ten minutes, we'll check in with scott mcgrew. we'll join us with insight into the company's rocky recent past. >> 5:04.

the mother from yemen who fought president trump's travel ban is expected to arrive in the bay area tonight to say good-bye to her terminally ill son. "today in the bay's" bob redell live in oakland, where the boy is being treated and sadly, might only have days to live. bob? >> reporter: marcus, the mother's husband tells us that his wife has been crying in happiness to be able to finally visit her boy, who as you mentioned is sadly dying from a terminal brain condition. the boy's name is abdullah hassan. he's 2 years old. he's clinging to life on a ventila ventilator at ucsf benioff hospital. his dad has been trying to convince the u.s. state department to grant his wife a visa to visit, about you she's from the country of yemen, one of seven countries under president trump's travel ban. u.s. representatives who include congressman jerry mcinerney and

congresswoman bar rah lee wrote a letter to secretary of state mike pompeo urging him to give the mother a waiver, which was finally granted this week. >> the policy has become a problem. we need to attack those, but for now, the urgency was to get this woman to this country, so she could be with her son. >> it was the best day ever. i'm glad my wife got her visa. >> reporter: hassan's wife's visa is called a spousal visa. she'll have permanent residency here in the united states. her plane is scheduled to arrive sometime tonight. reporting live here in oakland, bob redell, "today in the bay." >> very sad story there, thank you, bob. it is 5:06 right now. students in palo alto high school had a difficult december. one of their students reportedly killed in a deadly east palo alto shooting last thursday. popular teacher also died suddenly on monday. the district tonight is hosting an open meeting for teachers and parents to talk about helping young people in the grieving process.

the meeting is scheduled for 6:00. 5:06 right now. this morning, a san jose man is behind bars after allegedly trying to kick in a homeowner's door, claiming to be a police officer. the 66-year-old charles whitington is facing multiple charges, including attempted burglary, impersonating police and possession of methamphetamine. the incident happened early this morning on eade lane in milpitas, when the homeowners confronted whitington, he took off. he was arrested at a nearby complex. san francisco district attorney believe drug makers are contributing to the opioid epidemic. dennis herrera announced a lawsuit against a large group of drug makers accusing them of misleading doctors and patients about the misuse of opioids and accuses drug makers of creating a public nuisance. it asks for money to cover addiction treatment costs and change in business practices. it is likely the claim will eventually be rolled into a class action lawsuit.

milpitas leaders recently approved a permanent ban on all businesses tied to marijuana, but they still need to hash out the fine print on a permanent ordinance. happening today, city council members will hold a special session. the new law will also regulate growing pot for personal use. new this morning, rvs will be banned from certain san francisco streets as "the examiner" report sf mta is preparing signage saying no to oversized vehicles. dewolf street is included and signs are starting to go off, this comes as those living in, are vs were cleared out last friday. with the growing cost of living, the issue of homeless living in oversized vehicle has become a problem as kro the bay area. it is 5:06. proposal aimed at college students going to school for free is moving forward. voter also make a decision on the college fund in november. if passed, the measure would require the city to subsidize

the cost of tuition at city college of san francisco. this comes after the city board of supervisors voted to place the issue on the ballot. the pilot program was set to expire next year. the chp golden gate division is giving back this holiday season and the agency needs your help. today is the last day that you can actually donate to the annual toy drive. you can bring new unwrapped toys to any walgreens in oakland or berkeley. you can also drop off items at oakland chp office on telegraph avenue. sacred heart of san jose working to give back to kids in time for christmas. volunteers are wrapping toys and books for those in need. the gifts will be given out later this morning. the non-profit group says over 6,000 kids will be given two toys and one book each. i love to see all the giving this season, kari. don't you? >> absolutely, and hopefully as you head out the door this morning, you're kind of in that holiday spirit, feeling a little bit better, even though we have to drive through this fog. this is a look at highway 101 in

we'll talk about what's ahead, as we are tracking some rain in that seven-day forecast, for the holiday weekend, that's coming up in less than five minutes. >> these travel times looking great. you're in the green zone headed toward the bay bridge, good stuff through the north bay, despite the patchy, dense fog, farther north from highway 37, no problem.golden gate bridge coming up. happy wednesday. big day today. the if ed will announce its decision on interest rates today, and that has the white house on edge. before we get to that, i want to point out these numbers on blue apron, that's the meal delivery company. it's now a penny stock. blue apron falling below $1 a share doesn't ing cha anybody's life, it's not earth-shattering unless you bought it at $10 a share on the ipo. it's a strange event to see that become a penny stock. i wanted to pass that on to you. stuff that matters, interest rate hike. the fed wraps up its two-day meeting today. it will announce its decision on

interest rates around 11:00 a.m. our time. the president does not want the feds to hike rates because that slows the economy down. he tells the fed, feel the market, don't just go by meaningless numbers. good luck. now, a couple thoughts here. first of all, the stock market is not the fed's responsibility, the xh he is, and those are two different things. second, president trump was very big into numbers when the market was rallying, tweeting the dow often. the other irony here is that the previous chair of the fed, janet yellen, was reluctant to raise rates, but trump replaced her with the guy on the right, jerome powell, who is a hawk. he raises rates. live pictures of facebook this morning, it's managed to get into a third crisis in the past six days. the latest? a "new york times" report that facebook shared private messages, your private messages with outside companies like spotify and netflix. facebook issued a statement this morning, said yeah, we did that,

explaining at one time facebook offered messaging through those services. you could recommend a song through spotify or a movie through netflix without leaving those services, and of course, they'd be able to access your messages to make that happen. facebook says it had user permission. but at this point, it is hard to sort out the shocking controversies at facebook with sort of a whoops, users got confused about that, controversies. late last week, facebook said it accidentally allowed third parties to see your private photos. yesterday, the senate intelligence committee said russians used facebook to convince african-americans not to vote. this morning, the controversy over private messages. at this point, there's very little trust in facebook, even in stuff where, when you look at it carefully, you say all right, well i guess i could see why that would happen. at this int point, there's no t. >> it's interesting to hear people talk about leaving it. lot of talk about that.

>> remember the reason for the season. >> i mean to help santa's list. >> right? >> all right, so yeah, we're in those last days, and a lot of parents are in a mad dash to get a lot of those last-minute gifts, and here is a live look outside in dublin this morning, as you head on out to work. you do need to slow down. we have some patches of dense fog, and we're seeing that right now on our camera, as you drive on 580. and the visibility there down to about a mile and three-quarters and napa, a mile and a quarter there, and santa rosa about two miles, but it has been very patchy, so maybe clear in some spots and suddenly you hit a wall of fog. as you get ready to head out for school this morning, pleasanton school day forecast will be in the mid forecasts, so -- 40s, and we're going to reach into the upper 50s and low 60s today, so style your hair, maybe a little bit tricky because of all of the humidity and it is very damp. humid start, so it's a good day

for a pony tail and go, and we'll see the sun as we go into the afternoon, after the morning fog, and then reaching into the low 60s today, another nice day. we've enjoyed a lot of these very mild afternoons after these chilly starts and also the patchy fog, and then i'm tracking the next storm system. here is the way it looks on the satellite imagery, as it moves across the pacific, and reaches towards the coast. it will arrive here on friday, and this one will be fairly weak. here is a look at the rain as it moves in, between thursday night and friday morning. looking at some spotty showers moving through, and much of the area south of the golden gate bridge won't see much of the rain. the north bay reaching a tenth of an inch in accumulation and we're looking at a dry saturday. sunday is when a stronger storm system moves in that could bring in more widespread rain, and it does linger into your christmas eve throughout the day. so we're looking at the potential once again of that first round of rain, bringing about a tenth of an inch of rain to parts of the north bay. elsewhere, barely measuring

anything. once that second wave of rain comes in sunday into monday, it is going to bring some higher rainfall totals, but still about a tenth of an inch for parts of the south bay, east bay, and the peninsula. here is a look at your seven-day forecast. we are watching out for king tides this weekend on saturday and sunday, as the showers move in on sunday, also some choppy conditions and possible some coastal flooding, and then next week, yes, it is christmas, and we do have more unsettled weather. mike, you have another crash on the peninsula? >> i do. not a gift. this was a third for the morning over here on this side of the bay. this time, we're going to zoom in, we saw the green overall. we're looking toward the woodside on-ramp from are eastbound woodside on to northbound 101, coming over this direction, and onto north 101, there's a crash reported right there at the on-ramp. it sounds like one of the lanes might be open very shortly but right now, the chp is saying just for the next few minutes, be careful. they may have to keep that closed for a bit. we'll watch that, and folks, if you're on local streets, you can

travel north along the area. el camino is a great option, go north of that on-ramp. toward contra costa county, it's a smooth, easy drive. highway 4 behind me no slowing through antioch. notice the yellow highlighting, that's the fog that registers on our road weather index for the north bay and patches north of novato. the golden gate bridge you can see the lights across the bridge. notice that the north tower there disappears into blackness. we can't see any of the glow that we often do see. that's low clouds hovering right there above the deck. over there on the deck, this is the bay bridge, the last five minutes we saw a buildup over here. there's slowing on the incline. they'll turn the metering lights on, perhaps they turned it on right now. they often do right about 5:22, you see that below me. back to you. >> thanks, mike. coming up next on "today in the bay," requesting answers. california lawmaker pushing for an investigation, after a migrant girl died while in the custody of u.s. border patrol agents. plus, devastation and destruction. after a tornado touches down in washington state, the total

tornado ripped through new video shows the damage left mind after a tornado ripped through northern washington state. it happened about 50 miles west

of seattle. roofs were ripped off of homes, buildings completely destroyed. debris was scattered everywhere, as you see in these pictures. today, the national weather service will be on the ground to determine what the strength of that tornado was. so far, no reports of injuries. this morning, attorney for the family of a migrant girl who died while in custody of u.s. customs and border patrol agents is calling for further investigation. hospital officials say jakelin maquin likely died of accept sis shock. she was picked up by border patrol agents in the remote stretch of the mexico desert. she died two days later. 11 democratic members of congress, including california representative raul rodriguez are calling for the independent investigation. >> there are things that we need to learn and the systemic problem that exists here. >> cbp and the department of

homeland security officials deny that the agency is responsible for what happened to the girl. the trump administration is also denying responsibility for her death. vatican leaders are offering a hint of what to expect when the catholic church hosts its first ever summit on sex abuse. >> the meeting is going to focus on three main themes, which are responsibility, accountability and transparency, that is for all bishops really. that's the message. >> the church wants leaders to meet with victims personally before that summit takes place. bay area church leaders are now going so far as to name the names of priests tied to sex abuse. the four-day summit starts february 21st. 5:27. counties across the bay area fear they may lose out on millions of dollars in federal funding, not to mention congressional and legislative seats. the fear is undocumented immigrants will avoid being counted for the 2020 census. contra costa county is the latest to project a financial hit.

a tesla model s erupts up in flames----not once but twice. the car burst into flames in los gatos and was towed to campbell around eight last night. this is video of the car burning at dicks automotive transport. less than two hours later it was in flames again. this is new video of santa clara county fire crews working into the night hoping to keep the battery cool and prevent a third fire. the first fire happened around two yesterday afternoon. the cars owner took this video minutes after his car was towed to a repair shop in los gatos to fix a flat tire. he says he heard a hissing noise and then saw smoke and

flames coming from under the car. in a statement tesla says the fire is under investigation and it is glad to hear everyone is safe. police in fremont are not identifying the person struck and killed by a car last night. the driver remained at the scene. it happened at fremont and grimmer boulevards. we )ve added last night )s location .. to a map of 12 pedestrian deaths across silicon valley since the start of november. the mercury news mapped the locations. at least 5 are being called hit-and-runs. new this morning: an accused thief is caught red handed in antioch. police say a neighbor called 9-1-1 after he spotted a man stealing packages off a nearby house. an officer was nearby and able to arrest the suspect. he was also able to return the packages. antioch police are now warning you to require signatures for

your package or sign up for a drop box. and new video -- caught on camera in campbell. a special delivery, but not in a good way. a fed-ex worker threw a package toward the front door of a home. it hit the roof first, then fell to the ground before he placed it on the porch. amazingly, the homeowner says the package wasn )t damaged. fed-ex offered an apology, and says it will talk to the delivery man. the south bay will reportedly get a boost in affordable housing. the mercury news reports supervisors yesterday approved plans to build 6 new, low-cost housing projects. you )re looking at design sketches. supervisors also approved plans to renovate 3 other these are some of the design sketches. supervisors also approved plans to renovate three other properties. total cost for the project $123 million. with the latest developments the county is committed to funding close to 2,000 new housing units. san jose city council is

taking a big gamble on two tiny home communities. the city is approving a afive-year pilot program to see if the tiny homes can serve as a bridge to get off the streets with permanent housing. one site is on marbury road across from the san jose flea market which is currently a vta construction yard. the other is a caltrans site at the intersection of highways 101 and 680. a live look at mineta airport in san jose, where happening today, they're celebrating a milestone, and one lucky traveler will be a part of it. sjc this year leapfrogged oakland airport to become the bay area's second busiest airport of course behind sfo. sjc expects to serve a record 14.3 million passengers this year. to celebrate, one arriving passenger will be selected this morning as a symbolic

record-breaker. still don't know if the winner will receive anything besides the surprise and delight and maybe some embarrassment. >> hmm. all right. you know, the recent closures and longer than normal delays are reportedly taking a toll on muni's public image. the summer shutdown of san francisco's twin peaks tunnel was one of muni's lowlights this year. the shortage of operators compounds the problem. now, according to "the examiner" rider satisfaction is taking a hit. the new muni survey finds approval ratings dipped to the lowest level in six years. the survey also found riders were 10% more likely this year to resort to ride share services instead. mike, a lot of people doing that, a lot of people say that's causing more backups. >> exactly, ride share puts more cars on the road and takes those folks off of muni so we'll see how things balance out. always looking forward to those studies. we're looking here toward the study of the north bay, where we had the orange highlighting. now to the top of the screen, that fog is drifting around.

that does not mean the areas are completely cleared. that fog continues to drift around in many patches. contra costa county moves smoothly at the speed limit but south of there, we had 580 showing a lot of patchy, dense fog at times. our dublin camera shows some low clouds. this is a rooftop camera, so on the deck where you're driving, it might be clear but we're showing clouds hovering around that rooftop level. we'll also have some rain chances in the forecast going into the weekend, and headed into christmas as well. saturday is your day to get out there, go shopping, travel, hit the road if you can, and we'll see mostly sunny skies. upper 50s and low 60s will be our high temperatures and sunday the rain arrives during the afternoon to evening hours and that may continue into your christmas eve. our temperatures will be slightly cooler in some spots, some mid-50s for the coast, and then if you're making plans to head out, maybe going ice skating in union square on saturday, it's going to be nice and cool, some mid-50s during

the middle of the day, and then if you're going to half moon bay, heads up, there will be some king tides, and we'll have to also watch out for coastal flooding and some upper 50s for our high temperatures throughout the weekend. napa will be really nice, 60 degrees, pretty much all weekend long but the showers will be returning on sunday during the day. if you're heading to the sierra, kirkwood is going to have some great conditions, but some snow showers coming down on friday, once again saturday is your best travel day. by sunday, we'll see some more clouds moving in, cooler temperatures, and those snow flurries starting to fall again on sunday evening. i'll keep track of all of our destinations and also our local plans, have a look at today's temperature trend coming up in about three minutes. >> we'll look forward to it. 5:40. coming up on "today in the bay," a new year ahead means new laws. the big changes coming statewide when it comes to pot deliveries. and signs of compromise this morning in washington. we'll bring you the latest, as

midnight. we're getting hints the democrats would be willing to create a temporary extension and the white house won't insist on 5 billion for the wall. that's a huge turnaround from this meeting just a few days ago. here is the president's press secretary, after a reporter said hey, wait, i thought mexico was paying for the wall, not the u.s. taxpayer. >> we're not asking american taxpayers for that. we are looking at existing funding through other agencies right now that we can draw on to do that immediately. >> of course, the money that other agencies might use also came from taxpayers. this was a first daily briefing this month, and it lasted just 14 minutes. sanders said she had other things to do, and that evoked an angry reaction from reporters. >> the president that -- we'll talk to you soon. thank you, guys. >> this is your job, sarah!

>> i think so. this time of year we can get a mixed bag of weather and that's what we're seeing. right now, a live look outside in san rafael southbound highway 101. we can see the tail lights headed into san francisco. it will be at times foggy and we've seen some of the fog drifting around, especially the north bay as well as the tri valley. elsewhere, it is fairly clear and we'll see the fog lifting and also some peeks of sunshine, martinez will also see some patches of fog, and starting out in the low 50s, heading up to 58 degrees at noon. we'll go up a few degrees from there. live look in san jose, christmas in the park, great day to head out there. make sure you're wearing a jacket or warm coat to start and some dress shoes because we don't have to worry about the rain. we don't need the rain boots, a little bit too cool for the sandals. we'll see high temperatures reaching into the upper 50s and low 60s today. this weather pretty much like what we've seen the past few days. there are some changes ahead.

storm system is moving in from the pacific. we can see the widespread clouds in the area of low pressure starting to approach parts of the pacific northwest with some showers there. this won't arrive into the bay area until about friday, mostly thursday night/friday morning, and it's going to be a fairly light system, moving in, bringing some rain to the north bay, and then as we take a look at how much rain we may see, trace amounts, very light amounts, and then up to about a tenth of an inch for ukiah. there will be another round of rain moving in by the end of the weekend and that will bring us slightly higher rainfall totals with the south bay getting about a tenth of an inch of rain and are the quarter of an inch for napa, up to ukiah, close to an inch of rain. our seven-day forecast shows we have the unsettled weather and it's a big travel weekend so just a heads up that saturday will be your best day to travel, shop, do whatever you have to do outside and then the showers start to move in on sunday into monday. by tuesday, still some scattered

showers and of course that's christmas day, so hopefully you're settled where you need to go. heading over to mike, a couple of notes for northbound commuters. >> we havelooking at most of thy and green sensors are great for the commuters. san jose shows slowing in the south bay of course. if we move our map to the south county, one crash highway 9 at 35, no update, a minor crash. northbound 17 approaching the summit, another crash reported there. that will cause some slowing. you see a little blip there below the speed limit. be careful, it's getting toward the narrow shoulder and right here northbound 101, started to build as well coming out of san martin and up in toward morgan hill. north of concord, you're just fine, headed up toward the rest of silicon valley. travel times toward the bay bridge as well, the inle million are on. we now have 18 minutes, so we're building a bit for the upper east shore freeway. some minor slowing through richmond, not a surprise toward golden gate field. if we get to the waze system, our partners timed out the drive from antioch along highway 4 and

major, busy roads. we're talking about stevens creek and foothill blfz oulevarn cupertino. there's been an increase in mining trucks going back and forth between a cement plant and quarry in the area. tonight, city leader also address the issue in a public meeting. we're also expecting to find out how long the increased truck traffic will last. today's meeting is at the monte vista community center. take a look at this new video of a neighborhood in northern brazil going up in flames here. this happened yesterday, nearly 600 wooden homes burned. luckily, there are no reports of injuries nor deaths. investigators suspect a pressure cooker exploded and started that fire. and more dramatic video for you now. this time two deputies in texas rushed to pull a man out of a burning car. we have to warn you, these images might be tough to watch. >> pull him out! can you pull him out? >> just scary there.

you can see those deputies run to pull that driver out from that car. it flipped over, which was involved in a rollover crash. that man unresponsive when deputies got there. they got him out quickly. this happened last week but the body camera video was just released. at this time, that driver's condition is stable. >> they had to use a nearby pud to puddle to put out the fire. a woman is accused of collecting donations for fire victims and used them for herself. she went as far as posting fake pictures of herself and her fictitious husband. she collected and kept cash and goods worth thousands of dollars. local firefighter discovered her fraud and tipped off authorities. 5:57 right now. staying in southern california, a doctor from irvine is in jail, charged with illegally giving opioids in exchange for money.
