tracking the morning commutes with lots of green sensors. >> green immediate there's no heavy delays. notice no slowing. we have had just a couple of fender-benders cause some slowing. let's take you to your south bay drive times. northbound 101 from highway 85 you're looking at 19 minutes. northbound 280 from highway 101 to highway 85, eight minutes. northbound 101 you're looking at 20 minutes. a quickic look at palo alto cam, you can see we have some cars out on the roads but it looks like everybody is driving safe and no one is in a hurry to get to work. they're probably dreading coming back from vacation. back to you. >> thank you, vianey. 6:02 right now. breaking news in the north bay where authorities are looking for an escaped inmate at this hour who managed to find a way to walk out of san quentin prison. >> "today in the bay's" pete suratos is in marin county with the latest on this search. do we know yet how that convict

was able to just walk out? >> reporter: good morning to you, marcus and kris. we know they're searching for 21-year-old shalom mendoza. he was reported missing during their head count at san quentin state prison. we'll show you a mug shot of mendoza, the man they're searching for at this hour. he was reported missing at 9:30 p.m. during that head count. that's what activated the prison's emergency operations plan, which is what they do when they're trying to find an escaped inmate. we're told by prison officials that mendoza carjacked someone after escaping. he carjacked someone driving a toyota rav4 with license plate number of 6stz502. now, as far as mendoza's height, he's described as being 5'5" with brown hair, brown eyes and roughly about 177 pounds. now, he was sentenced to five years in prison back in december of 2007 for using a deadly

weapon to carjack someone. this took place in l.a. county. when he carjacked that person, he tried to evade police that led to sentencing to five years in prison. he's been in san quentin since april. if you seme mendoza, contact authorities as soon as possible. live outside san quentin state prison, pete suratos for "today in the bay." we'll check in with pete in the next half hour as well. 6:04 right now. happening today, a man charged in connection to the killing of a woman at a b.a.r.t. station is due in court. john lee cowell is charged with murder and attempted murder. police say he stabbed knee whnin and injured her sister. cowell's lawyer told a judge he may not be fit to stand trial. they want doctors to evaluate cowell before the case moves forward. a judge is expected to announce

his decision this morning. a deadly christmas eve fire in san francisco, we now know who those two people are who died in the fire. michael and connie hooker were both killed in the fire that happened early monday morning at a home on clay street in the presidio heights neighborhood. the flames broke out on the second floor and quickly spread to the third floor. one firefighter was hurt but is doing okay. the cause of that fire is still under investigation. also new this morning at 6:05, we're learning about two robberies at two different east bay b.a.r.t. stations this week. the east bay times reports a man with a rifle tried to rob a b.a.r.t. rider at the oakland coliseum station yesterday morning around 9:00. that suspect took off but then christmas day another one at the del norta station where another man took a man's bike at knife-point. the country wondering when the government shutdown will end.

"today in the bay's" scott mc r mcfarlane. >> reporter: hundreds of thousands of federal workers remain off the job because of the standoff. there's no end in sight because both sides seem unwilling to budge. cheers, photos and autographs during president trump's surprise visit to u.s. troops in iraq. >> first of all, at ease. let's have a good time. >> reporter: speaking with reporters, the president acknowledged the outlook is less cheery in washington. he says there's no timetable for ending the partial government shutdown. >> how long do you think the shutdown will last, mr. president? >> whatever it takes. i mean, we're going to have a wall. we're going to have safety. we need safety for our country. >> reporter: as national parks and federal buildings remain closed for a sixth day, neither the president nor democratic leaders are budging in their fight over whether to spend $5 billion on a southern border

wall. >> it tpz to be in the president's lap. the president has the ability to open government. all he has to do is tell speaker ryan that he'll sign the very same bill the senate originally passed. >> reporter: meanwhile, democrats are promising hearings into the second death of a migrant child near the southern border. an 8-year-old boy died christmas eve after falling unconscious on his way to a new mexico hospital. the homeland security secretary calls that death heartbreaking. customs and border protection says it's ordering medical checks of all migrant children in u.s. custody. about the shutdown, congressional leaders have told their members they'll give them 24 hours' notice before any vote to reopen the government. there's been no notice, so this sixth day of the shutdown will likely move to a seventh day tomorrow. live in washington, now back to you. >> another day and another day people are wondering. thank you, scott. the trump administration is signaling it will appeal a

federal court ruling that blocked the white house from restricting asylum claims at the u.s./mexico border. last week a federal judge blocked president trump's november proclamation and fast tracked to bar migrants from seeking asiylum at ports of entry. prop 13, the property tax, incoming governor gavin newsom says nothing is off the table including that 1978 voter-approved measure. as you likely know, prop 13 caps taxes at 1% of the purchase price even if that property is transferred from parent to their children decades later. commercial property has similar protections. but in 2020, state voters will decide whether to change some of that measure to require fair tax collecting, which is expected to bring in billions of dollars for local governments and local schools. 6:08. pot sales are in and they

indicate the billion dollar industry is budding. in total, legal marijuana industry racked up more than $10 billion this year. california became the largest legal marketplace for pot in the u.s. meanwhile, utah and oklahoma recently voted to allow medical marijuana. about two-thirds of states have legalized pot and democrats in the house say they're working to overturn the federal ban on pot. and happening today, san francisco is saying good-bye to all of those christmas trees out there. recyclers will run the old trees through a wood chipper. by the end, sf says it is expected to have tons of fresh mulch. this year marks the 32nd year of free chipping. kari knows i'm april sentimental fool and that makes me sad. >> it's better than having them lay somewhere -- >> like in my living room? >> starting out this morning in los gatos, it will be in the

we'll have another update coming up. good morning. i'm frank holland at cnbc global headquarters. here are today's top business headlines. wall street looks like it will open lower this morning as the recent volatility we've seen in the markets continues. yesterday stocks surged following that big selloff from christmas eve. the dow, the nasdaq and the s&p all posting their best day since 2009. really boosted by reports of strong holiday retail sales and a rise in oil prices. concerns about the fate of federal reserve chairman jay powell also easing up as the white house says his job is safe. the dow jumping nearly 1100 points or about 5%. its biggest one-day point gain ever and big egest percentage gain. the dow is still down 10% this month, on pace for its worst december since 1931. verizon is warning fios customers they may loose access to espn, disney channels and

other networks if it can't reach a distribution deal by december 31st. it's the latest fight over media companies. hbo and cinemax have been blacked out for two months on dish networks for the same dispute. if you're returning gifts, you want to read the policy carefully before you head back to the mall. many stores have mid to late deadlines. am sfwlon will accept holiday returns through january 31st. some retailers have different guidelines based on the brand or category of the item. those are your cnbc business headlines. amazon says more items were ordered worldwide than ever before. they say small and medium sized businesses had their best season ever. in fact, more than 50% of those items sold came from small and medium sized businesses. i want you to listen to this. amazon says the last prime

to just let fate take its course. >> they say their baby girl is due in july and will be named for her sister, jillian, who died two years ago. i'm all for celebrating one thing at a time. >> at least it was their celebration so they didn't have to share -- >> the maid of honor was like -- >> not today, sister. not today. >> that is too funny. we won't let vianey steal the shine off the weather with traffic. >> i don't have anything. >> one thing that may impact traffic because of the weather. we'll get a look at all of our microclimates as we start out this morning. let's get a live look outside in san francisco. where it's all clear and we're starting out with calm winds. it will be a windy day. we head over towards dublin where that's our view. you can't see anything. that's because a thick layer of fog has rolled in. visibility down to a quarter of a mile.

that's the only place we're seeing fog. heads up about that if you're driving through the tri-valley. it's looking pretty tough there. throughout the rest of the morning, these winds picking up will cause other problems for drivers. we're going to see the wind advisory in effect for all these areas shaded in the tan color at 7:00 a.m. and continues through tomorrow morning at 4:00. our winds may gust up to 50 miles an hour. even in some of the valleys we may have gusts up to 30 miles an hour today. this is the way it shapes up. our winds increase coming in from the north. that means those east-to-west roads and bridges will have the biggest impact for drivers. and then our winds picking up to 25 to possibly 35 miles per hour in solano county. we're looking at still some gusty winds into the evening commute. and later on tonight the winds will start to calm down and we'll start out tomorrow morning back to our normal conditions. with it being humid we have patches of fog and the strong winds.

just forget it today. don't do too much styling of your hair today. you'll step outside and the wind does whatever it wants to. we'll see in martinez our temperatures start out at 40 degrees this morning. heading up into the upper 50s by early afternoon. shape willing up to be a nice day after a cool start. most reaching into the upper 50s across the bay area. still nice and quiet conditions. no big storms out there in the pacific. we will have cold air settling in over the next few days. that's the way it looks as our seven-day forecast for the inland valleys shows by saturday morning we may have some freezing temperatures. by sunlight chance of showers, mostly in the north bay. by the end of the year we're in the mid-50s. starting out the new year with upper 50s as well. and no significant rain chances over the next seven days. vianey, you've been tracking the roads. any issues out there right now? >> no issues. i don't have much to report, which is always good.

indonesian authorities are telling people to avoid the coast whe 6:24. new this morning, indonesian authorities are telling people to avoid the coast where a tsunami struck killing at least 430 people over the weekend. this warning comes on the anniversary of the catastrophic 2004 asian earthquake where thousands of people died. the volcano that triggered the tsunami could erupt again. listen to a red cross official describing why indonesian coastal regions are so vulnerable. >> an eruption or volcanic activity close to shore, you're not going to get much warning at all. >> in the meantime, a search

still continues for the victims of the tsunami which has displaced more than 20,000 people. all medical checks are released after a second migrant child died in u.s. custody. this time was an 8-year-old boy who was crossing the border with his father. border patrol agents said agents first noticed the little boy was coughing and had glassy eyes. turns out he had a 103-degree fever. he was taken back to the holding facility and died later that day on christmas eve. >> we responded by doing secondary medical checks. that means paramedics who are also border patrol agents checking each child in our custody. >> border patrol says they are still holding that boy's father and currently there is a court order that is supposed to prevent border patrol from keeping children in custody for more than 72 hours. right now a blizzard warning is out for north dakota. be glad you're not there. up to 15 inches of snow and a windchill of 20 degrees below

looking for this man. the suspect who they say shot and killed a police officer. that officer was a husband and just became a father five months ago. "today in the bay's" bob redell is live in newman. bob, we're hoping to get some more answers in a few hours. at this point we don't know who this guy is. >> reporter: law enforcement has not publicly identified him as of yet. there's a news conference at newman police department around 11:00 this morning where you can see people have been memorializing corporal singh. law enforcement continue to look for this man you see on your tv screen. they have not publicly identified him yet. he's suspected of shooting and killing corporal singh during a traffic stop at 1:00 yesterday morning. singh pulled over the man for reasons that are still unknown, radioed in the vehicle description. moments later radioed shots fired. singh's partner arrived to find

him on the ground, suffering from gunshot wounds. he sadly died later at the hospital. deputies did locate the suspect's pickup truck at a mobile home park less than five miles away from the scene. neighbors say that that man lived there for about a year with a woman and young boy. in the moments before the shooting a surveillance camera captured the suspect buying beer at a nearby convenience store. just a few blocks away from the shooting. a clerk says once he left, she saw officer singh go after him, then heard the gunshots. she recognizes the suspect and says he's bought beer there before. >> he's been aggressive in the past before, like burglary. he was a good officer. like, people really liked him. >> he was really chill, really cool guy. >> he posted on christmas eve that he was -- you know, it sucks i'm working out here and i commented and said, thank you for keeping newman safe. two days later this happened to him.

>> reporter: this is corporal singh with his wife on christmas eve. he emigrated from fiji, having worked with newman police for seven years. he was a canine officer. his dog was locked inside his suv during the shooting. newman police department is small, just 13 sworn officers. corporal singh is the first officer to be killed in the line of duty in the department's history. this is a painful truth we suspect the police chief will address during that news conference scheduled to take place here at police headquarters at 11:00 this morning. reporting live in newman, bob redell, "today in the bay." >> tragic story here. 6:36. hamg tod happening today in the south bay. we expect to learn more about a christmas morning police shooting that left a woman dead. eddie garcia plans to hold a news conference on this case. the family of the woman killed is demanding answers.

her family says she and a friend were out celebrating the holidays. they believe police mistook them for someone else and open fire on that car. but police say they were in a car that looked a lot look the one involved in the shooting earlier that morning. officers say they were forced to open fire when the woman tried to ram them with her car. the family plans to hold a vigil tonight. days after the giants announced they are talking with the raiders about having the silver and black play at at&t park, san francisco city leaders say this is not in their game plan. supervisor-elect matt haney has his ways, the giants would call a time-out on the talks. haney says the raiders and the city of oakland really should work out their own differences. >> really the raiders have done this out of retaliation because the city of oakland wants to get some money they believe the raiders owe them. that's between the raiders and oakland. >> haney says he doesn't think there is support for hosting the raiders at san francisco city

hall mainly because he says eight football games would require a lot of city services. however, near the ballpark, we talked with restaurant managers who say, bring on those game day crowds. we'll keep you posted as plans for the raiders' final bay area season continues to develop. i love that song. i do. the challenge is on for how many days die-hard football fans can live on top of a billboard. >> on top of a billboard. the four cleeblg football fans are set to climb a four-story billboard in downtown san jose today. this is part of the espn challenge to get attention for the national championship game. it's being hosted at levi stadium. for the next 12 days a fan from each of the final fourl college teams will participate. espn spokesperson says the company will give them snacks, a sleeping bag, and don't worry, those fans will also have a shower up there as well. somewhere around there. we'll actually see how many days they will last. we'll be following this one closely. >> what do we care?

there and everywhere else it's ten miles. just a random patch of fog. microclimate, hashtag that. let's go into the weekend. our forecast will be cooler with highs reaching into the mid-50s. starting out that morning in the mid-30s. as we make our way into sunday, more of the same. only a slight chance of north bay showers. other than that, we will have nice and quiet weather. san francisco, this is going on. throughout the middle of the day, our temperatures will reach into the mid-50s. you want to make sure you're bundled up as the night goes on. we'll be in the lower 50s. if you're heading out of town, maybe going to yosemite, it is going to be cold when you get there on friday. the rest of the weekend is looking much nicer and travel continues should be pretty good as you head up to napa this weekend, great weather with highs in the upper 50s. and near 60 degrees. in the tri-valley, great weather there as well as we reach up to 55 on friday. by sunday we're up to 58 degrees.

in day six of the government shutdown. live look in washington, d.c. where hundreds of thousands of federal workers remain off the job this morning. no breakthrough is expected today on either side as they don't appear to -- ready to budge at all. president trump is back at the white house to deal with that issue. this follows his surprise trip to the u.s. -- visit u.s. troops in germany and iraq. speaking of reporters -- speaking with them, the president actually acknowledged the outlook is not as cheery in washington. >> how long do you think the shutdown will last, mr. president? >> whatever it takes. i mean, we're going to have a wall. we'll have safety. we need safety for our country. >> neither the president nor democratic leaders are budging on funding the border wall. the government shutdown continues to affect locals and tourists in the bay area. in san francisco ft. funston is

closed. the parking lot is off limits but folks are still bringing their dogs for walks on the beach although they're parking on skyline boulevard. where do san franciscans want to live? apparently they're headed to sacramento. red fin real estate says 7,000 people moved from san francisco to sacramento this year. they say 22% of residents are looking for another place to live. that's a number that's gone up from last year. california looking to steal the limelight in the 2020 presidential primaries. the golden state has moved up its primary date from june to march in hopes of getting more attention from candidates. our state is home to several democratic presidential hopefuls, including senator harr harris. it's unclear how she'll do here in the golden state. for example, in the republican primary in 2016, senator rubio lost to then-candidate candidate

trump in his home state of florida. the me too movement is ushering a new wave of laws here in california for next year. companies can no longer force employees to settle sexual harassment complaints and they can't force employees to sign those nondisclosure agreements either. workers will also be required to undergo sexual harassment training twice a year and now victims have up to ten years to seek civil damages from a sexual assault. now to new laws surrounding the legalization of marijuana. starting next tuesday, people can petition to overturn or reduce old convictions for possessing, growing and distributing marijuana. more than 2,000 -- or 200,000 cases could be affected here. also a pair of laws limits the prosecution of minors for marijuana possession. you now have to be 12 years old or older to be prosecuted in juvenile court. while the billion dollar shasta dam project could be slowed by salamanders. a group of environmentalists

filed a lawsuit in response to the project. they're asking the judge to rule whether those salamanders should be protected. they say the project would destroy the creatures' habitat and put them at risk of extincti extinction. happening this morning, a bay area sea lion is going home for the holidays. actually getting ready to be released back into the ocean. you can see right here, spruce, are the sea lion, the marine mammal center rescued the sick animal earlier this month in monterey and now he's all better and ready to return home, back to the waters. looks like he's smiling. >> so photogenic. >> i get to go home! >> he's got that little tag. hopefully we won't see him back. if he comes back, we'll know because of that tag. hopefully he'll be gone and happy. >> good luck, little guy. >> take a look at the weather. >> the wind is going to cause a lot of issues today as we start

out, we're mostly seeing calm conditions except for our highest peaks. as you step out the door this morning in oakland, you're not feeling those gusty winds. head up to the hills and it's starting to get a little more breezy there. getting ready for that warriors game later on today. it's still a wide range in temperatures as we look at our currents right now. we're at 35 in ukiah. 40 in santa rosa. 48 in san francisco and oakland. 50 in half moon bay. it depends on where you are. we've only seen one patch of fog drifting through the tri-valley. there visibility down to a quarter of a mile. once you get out of that, you're looking at a nice, easy drive. heeding out the door in antioch, temperatures in the mid-40s. you may have to crank up the heater starting out today. later on today it's going to start to feel much nicer. the wind advisory that we've been talking about mostly for our bay area hills, all these areas shaded in brown that will go into effect 7:00 a.m. tomorrow.

for the east bay, this is where the winds may pick up to 50 miles per hour or more and could bring down some trees or have power impacts. throughout the day, our winds start to come in from the north at about 10:00 to 11:00. mostly at about 25 to even 30 miles per hour, even in some of our valleys today. it's going to be breezy. the winds stay up throughout the rest of the afternoon and gradually start to subside tonight into the day tomorrow. as you get dressed, you'll need something to keep you warm. maybe a scarf and a good day to rock the boots. we'll see temperatures reaching into the upper 50s and even reaching 60 degrees in a few spots. all quiet weather. no big storms out there in the pacific. we are looking at more quiet conditions except for a weak disturbance that could bring in north bay showers on sunday. other than that it's going to be cold during those mornings and mild during the afternoons into the afternoon. heading over to vianey, you're tracking the roads and everything looks like it's

flowing well. >> it's flowed very well. so far we've seen pretty smooth commute with the exception of one hot spot right now. it's certainly showing up on our speed sensors. so much so, look at our east bay drive times. northbound 880, you're looking at 30 minutes. back to you. happening right now, new data shows monthly auto loan payments are higher than ever with a growing number of people borrowing at least $50,000 to buy a new vehicle. the average monthly payment for a new vehicle is also climbing to an all-time high of $530. the average used loan vehicle payment is record high at $381. auto sales, though, are on pace to top 17 million vehicles for the fourth straight year which is the best stretch of sales ever in the u.s.

here are the top stories on today in the bay-- welcome back. before you head out the door, here are the top stories on "today in the bay." >> we continue to follow breaking news in the north bay this morning. authorities are looking for this escaped inmate at this hour, who found a way to walk out of san quentin. now, this is -- take a look at this photo. this is the mug shot of 21-year-old shalom mendoza. officials say he got away just before 10:00 last night. here's a live look outside of the prison there. you can see nbc bay area sky ranger up above. police say after he got away, he carjacked a motorist driving a toyota rav4. here's the information on that car. it's a toy oat it that rav4 with license plate of 6stz502. mendoza was sentenced to five years in prison in 2017 after being convicted of carjacks in

los angeles county. he arrived in san quentin in april. developing right now, the manhunt is continuing and intensifying for the suspect accused of shooting and killing a police officer in the central valley just south of modesto. fear and sadness is spreading across that small town of newman where this tragedy is unfolding. this is a live look outside the police station where bob redell has been reporting the memorial there is growing in honor of officer ronil singh. he was married and just became a father five months ago. the gray dodge pickup truck they believe the suspected gunman was driving was hauled away from a nearby mobile home park. officer singh made a traffic stop around 1:00 in the morning yesterday. then moments later called for help saying, shots fired. singh died of several gunshot wounds. happening today, a man charged in connection to the killing of a woman at a b.a.r.t. station is it is due in court.

john lee cowell is charged with murder and attempted murder. officers say he stabbed nia wilson to death and injured her sister at the macarthur station in july. cowell was set to enter a plea last week but his lawyers said he may not be mentally fit to stand trial. the judge is expected to announce a decision later this morning. turning to new details about a deadly christmas eve fire in san francisco, we now know who died there. they are michael and connie hooker who were in that fire early monday morning on clay street in presidio heights. the fire started on the second floor and quickly spread to the third floor. one fighter was hurt. the cause of the fire is under investigation. we're learning about two robberies at two different east bay b.a.r.t. stations. the east bay times reports a man with a rifle tried to rob a man

at the oakland coliseum station around 9:00. the suspect took off. on christmas day a man stole another rider's bike at knife point but that suspect was arrested just a few blocks away. happening today, san francisco is saying good-bye to all of those christmas trees. recyclers will run those old trees through the wood chipper part of the annual chipping of trees event. by the end sf is expected to have tons of fresh mulch there. this is the 32nd year of this event. we're saying good-bye to this christmas tree as well. christmas in the park, of course, is over a little early this year because of the college football championship. as we said, though, you can still go ice skating there under the palms not far from the fairmont hotel. the game, by the way f you're waiting for the national championship, will be played a levi stadium on january 7th. we've been talking about the weather this morning, the wind.

>> the wind advisory may cause issues as the wind picks up starting in the next few minutes and continues through early tomorrow morning. in the bay area hills the winds may gust over 50 miles an hour and then starts to calm down tomorrow. that's when the cold air settles in. saturday morning we may start out with freezing temperatures in the valleys. slight chance of rain on sunday in the north bay. and then we still continue on with some dry weather for the rest of the bay area into the new year. >> well, you've had an easy, breezy day today. >> not bad at all. great day to show up to work. now, here's what the fog looks like. we have one random patch. you can see the yellow square. this is what it looks like if you're driving through that random patch of fog in dublin. we're down to about a quarter of a mile up ahead which means, slow down, folks. aside from that, we have a couple fender-benders on the roads. the bridges look fantastic. no metering lights at the bay bridge. we'll take you out to sky ranger as we say good morning and see you a little later on.
