below freezing right now, 31 degrees and we have some upper 40s in livermore, so it's still kind of ranre in temperatures, some of the more gusty winds are dovta as well a the tri valley. i'll be tracking those wind speeds and what else is ahead as we head throughout the last weekend of the year, that's coming up in a few minutes. vianey is tracking the morning drive for you. >> the chp issued their own wind advisory for the altamont pass and portions of the dumbarton bridge. if you're driving on the bridges, keep both hands on the wheel, until the winds tame down a bit. i did notice this crash pop up on my way over to do this report so i'm going to check out what that's all about. overall, to start our morning it's fairly quiet with the exception of the bay bridge toll plaza. bit. back to you. >> thanks, vianey. the developing news for you, newly released photos of the man considered armed and dangerous, the suspect at the center of an

intense manhunt. >> he is accused of shooting and killing a police officer and he's still on the run. >> as sergio quintana reports, investigators aren't releasing his name but the sheriff says that suspect is in the country illegally. >> stanislas county investigators confirm this is the suspected gunman but would not confirm his name. in the small community of elnito south of merced, a s.w.a.t. team drives away from aner off but the man suspected of killing officer n him to justice. i hope he's watching today and he does the right thing and turns himself in. >> reporter: his grief seems to be shared by plenty of newman

good morning. i'm frank holland at cnbc global headquarters. here are teed's top business headlines. wall street looks like it will open higher this morning after the market staged a stunning turnaround yesterday, erasing heavy losses with the dow swinging 870 points from low to high with most of that in the last hour of trading. the dow had its biggest rc in a decade. light holiday volume and computer-driven trades are blamed for a the choppy action we've seen recently. overall, stocks are still down for the month and for the year. some big retail news, the fate of sears could be determined today. the chairman of the iconic retailer eddie lampert has until

4:00 p.m. eastern time to submit a proposal of more than $4 billion to buy the company through a hedge fund in an effort to keep stores open. advisers for sears would have until next thursday to decide whether that offer is a qualified bid. if it's not or no offer is made, the retailer could start liquidating its assets which would let creditors get back some of their financial losses. sears filed for bankruptcy in october. it has 500 stores and 68,000 workers. social media news, instagram rolled out a new feature yesterday but people weren't facebook, very briefly switched to a horizontal down. meaning you swipe left and instagram previously tested the change in october in the explore section of the app. it says the feature wasn't meant to be rolled out to everybody. the bug has been fixed. those are your cnbc business headlines and man, people were upset on social media.

63-mile-per-hour wind gust, mt. diablo 50-mile-per-hour wind gust, chrissy field really gusty there also in san jose with wind speeds at about 30 miles per hour. now things are starting to calm down, and for the north bay, we have some very cool temperatures, it's only 34 in degree below freezing in ukiah, so watch out there for the potential of some icy roads. we're at 50 in oakland and 42 right now in san martin. heading out the door mid-40s are your temperature to start out the day. still kind of breezy and we'll see winds calming down with temperatures heading up to the mid-50s. here is a live look outside in san jose this morning. as you get dressed, you take a look out the window, it's chilly out there, grab a hat, maybe a coat, as we try to fight off some of that cool air that greets us this morning. in concord, it's even cooler with a morning start in the low 40s, right around sunrise and we'll start to work on some

warmer air, headed by late morning into the mid-50s, and as you check out the seven-day forecast at the bottom of the screen, we have a lot more sunshine and seasonable weather over the next days. gilroy expect a high of 62 degrees, one of the warmer so its in the south bay. for the east bay reaching up to 60 in pleasanton but mostly upper 50s around the east bay and the peninsula, still go u.s. why i in half moon bay. highs reaching 57 degrees and 59 today in the mission district. north bay also 59 in novato and sonoma. and then we're still with some very clear air, some dry as r o we areoi some partly cloudy skies headed into sunday, cool temperatures in the morning hours, with a lot of 30s over the next few days, and highs in the upper 50s to lower 60s. and as we check in with vianey, any issues? you said there was a couple of minor crashes. >> we have a couple of minor fender benders through 680. let's get started up here,

actually let's go to 680, that will pop up first. we have this crash, minor along northbound 680 at capitol avenue. chp reporting it as a crash, not a major accident. you could senrs aren't showing any major slowing in through the area. if you encounter it on your morning commute, just they're working to clear that out to the right-hand shoulder. we have another crash along eastbound 580 at coolidge avenue. the left-hand shoulder is blocked, you can see it through this area. we're not seeing any major slowing from this either and chp was reporting they had tow trucks on the way so this shouldn't be a big issue impacting your morning commute. checking the bridge drive times, westbound 880 to the eight minutes, and westbound 84 toward the dumbarton bridge ten minutes. by the way, chp has issued their own high wind advisory for the dumbarton bridge and also the altamont pass, so just keep that in mind as you head out the door this morning and bundle up, because it is chilly out there. i don't have the proper coat for

this type of weather just yet. i'll send it back to you. accused of murdering a woman at a b.a.r.t. station is due pack in court today. john cowell's attorney claims he is not competent to stand trial. the 27-year-old transient is accused of stabbing nia wilson and her sister in july. nia died. over six years he has been put on a psychiatric hold 22 times. the judge ordered t-appointed d. wilson's family and friends packed the courtroom. >> if this guy could could whdo did and change his clothes so smoothly, i think that's pretty competent. >> he knew what he was doing when he did it, and we're not done. >> now the doctors will determine if cowell is competent to stand trial. new video shows a water rescue in the north bay, after a

boat capsized. it happened yesterday afternoon at spring lake in santa rosa. if you look behind the tree, you can see a man pulled out of the lake by a helicopter. firefighters say the man wasn't hurt. he just got stuck. a local farm is in trouble, accused of polluting a waterway, mo i facing a lawsuitor directlo fisher creek, it joins coyote creek which flows into the san francisco bay. the santa clara county d.a. filed a $67 mvermigation claims pumped toxic water from holder ponds and tanks into the bay eventually for at least a year. coyote creek is home to several endangered species. if you're waiting for your new tesla to arrive, we might know where it is. take a look at these trailers at tesla in fremont this week. this is video from nbc bay area sky ranger. this could be a sign of a rush to deliver these cars before the deadline of the tax credit on

>> all right, that was chris chmura for us. a san jose family is unt cou counting their blessings because their young daughter received a new kidney. you'd never guess 4-year-old penelope suffered from a lethal liver disease. she was placed on a liver transplant wait list and her family was told to expect a long wait, but amazingly, a liver became available in a week. >> very shocked, because they had given us such a long time frame, but we were happy, because our baby was going to be saved but at the same time, we knew that somebody else had lost a family member, and it was really sad. >> penelope's family says they are grateful to the oregon donor and their family. there are 1600 people, by the way, still waiting for an organ transplant in santa clara county alone. anyone can register as a donor at the dmv. coming up here on "today in the bay,"ing kari has a look at our forecast. >> it starts out clear and cool,
