living with garza, he promised them a better life but when they got here, the immigrants say they were abused and sexually assaulted. officers say his sister helped his victims cross the border and used threats to keep them from going to the police. we have surveillance video out this morning that may show a fugitive carjacked a driver in the minutes after he slipped away from san quentin state prison. we brought you live breaking coverage of the search yesterday on "today in the bay." the video was taken from the home depot in san rafael wednesday night around 9:00. in it, you can see a man crossing the parking lot, and then carjacking a silver suv. right now, a manhunt is under way for 21-year-old shalom mendoza. he was convicted of carjacking in l.a. he's the first person to escape from san quentin in nearly 20 years. prison officials say he was on a job assignment outside the prison walls wednesday night when he escaped. people who live next to san

quentin say they are concerned that an inmate escaped. >> i do see people coming out here to clean the garbage cans and stuff and they're under guard, you know, and the guards seem like they have everything under control so i just never really think about it, but yeah, that does concern me. >> police are looking for a silver toyota rav 4. mendoza was last seen in a white t-shirt and tan shorts. if you see him, call 9 11. a sheriff's deputy is in a lot of trouble. investigators say lieutenant mandy hen henderson, who you see right here, faked an injury and received paid administrative leave, but she was caught doing "strenuous workouts" at a gym in las vegas. he w she was arrested for fraud. now to a wild traffic stop in contra costa county. concord police say a san jose man stole this infinity suv.

officers tracked down the stolen car but the suspect rammed the car into a police vehicle, side-swiped two other cars and got onto 680, crashed into two more vehicles and took off on foot but he was later arrested. tsunamis, click and report, that's what the san jose fire department wants people to do this new year's eve, part of their online program to catch fireworks violators. firefighters say neighbors can easily take pictures or videos of illegal fireworks and report it online. chp crews across the state also will be out this new year's eve catching drunk drivers. they want you to get a ride from someone sober, call a cab, or get a ride share. one option, you can take a ride from aaa, if you drink too much this new year's eve. the company says the driver can take you home. the first ten miles are free and people can call for the service at 1-800-aaa-help. rv parking issue also drive yet another sf mta meeting.

today officials will consider banning overnight parking on napoleon street, a short street near cesar chavez and highway 101. there are concerns rvs and buses are parking there long-term. this is an ongoing problem in many bay area cities including mountain view and berkeley. east palo alto is testing out the pilot program allowing rvs on a government-owned piece of land. there is another tree fight growing in san francisco. "the examiner" rompz 1,700 people signed a petition to stop the removal of 19 ficus trees around the plain library at civic center. they say removing the trees would create health problems and lead to "local climate change." the city says the trees have grown too big and pose a danger. there is a hearing on the tree fight late next month. >> 5:06. good news for workers in the bay area and possible bad news for small businesses. minimum wages are rising this year. starting next week, mountain view is increasing wages to

$15.65, that's 65 cents more an hour. san jose, palo alto, cupertino, los altos, santa clara and milpitas are climbing to $15 an hour, this comes as a blow to some local businesses. the portuguese bakery in santa clara says it's going to close because it can't afford to stay open. now to a rescue to save a pug and a parrot. according to "the mercury news" the two were trapped in a house fire in san leandro wednesday. alameda county firefighters say a durn burning candle sparked the fire and the owners weren't home. in the end, they got the flames out and the pets out. good news there. brewing of beer for local fire victims is done and now you can try it. >> today, santa clara firefighters are distributing the batch of rock bottom brewery in campbell. the the sierra nevada brewing company started brewing the beer in chico. it's called resilient butte county proud ipa.

issues on the road. i wanted to show you this camera. yesterday morning these commuters in dublin had a tough time driving through the fog. i'll have an update on how your drive times along the bridges are looking, coming up. good morning. i'm frank holland at cnbc global headquarters. here are today's top business headlines. wall street looks like it will open higher this morning after the market staged a stunning turnaround yesterday, erasing heavy losses with the dow swinging 870 points from low to high with most of that in the last hour of trading. the dow had its biggest percentage comeback in a decade. light holiday volume and computer-driven trades are blame for a lot of the recent choppy action. overall, stocks are still down for the month and for the year. some big retail news, the fate of sears could be determined today. the chairman of the iconic retailer eddie lampert has until 4:00 p.m. eastern time to submit a proposal of more than $4 billion to buy the company through a hedge fund in an effort to keep stores open.

advisers for sears would have until next thursday to decide whether that offer is a qualified bid. if it's not or no offer is made, the retailer could start liquidating its assets which would let creditors get back some of their financial losses. sears, which also owns kmart, filed for bankruptcy in october. it has 500 stores and 68,000 workers. social media news, instagram rolled out a new feature yesterday but people weren't happy about it. the app, owned by facebook, very briefly switched to a horizontal feed, meaning you swipe left and right instead of the traditional up and down. instagram previously tested the change in october in the explore section of the app. it says the feature wasn't meant to be rolled out to everybody. facebook explaining a bug, which has since been fixed. lot of outrage out there. those are your cnbc business headlines back to you. >> a lot of outrage. i was confused. i wasn't mad. >> was it really that serious, though? >> no.

helena had combust gusts up to her per hour, mt. diablo of 53. chrissy field 30 miles per hour, and in san jose, we almost got to 30 as well. it was very breezy throughout the day, and now we have some cold air in the north bay, but it just depends on where you are, because we do have some milder air in san francisco, and imagine headed out the door in santa rosa it's 33 and you're feeling a big difference in temperatures. in antioch, starting out with mid-40s, mostly clear skies, no issues with fog. everything is clear, and by noon up to 55 degrees. we'll go up a few more degrees from there. as you get ready this morning, the frizz factor is low. i think you'll have some smooth hair today. humidity starts out only at 37%, and will be dropping as we go throughout the day. now, our high temperatures headed into the upper 50s for the south bay, san jose reaching

59 degrees. we'll see a high in martinez of 58 degrees and also 58 in san mateo, daly city 55, 58 degrees in the marina district and north bay and mill valley reaching 56 degrees. it's a cool start, but if you still have the day off and want to head to the beach, santa cruz is looking nice and by noon, we're at 54 degrees. it will be in the upper 50s today, still a cool one, but a lot of sunshine. we're going to see more sun over the next few days, just some cool air continuing, and the possibility of some more freezing temperatures, as we go into tomorrow morning especially and then again early next week. high also reach into the upper 50s and low 60s, but the rest of the year, looking great new year's day, starts out nice and quiet, no issues with any storms moving in. as we head over to vianey, you've been tracking the commute and we've seen a fairly good drive. >> we have, considering the fact i notice more volume in terms of traffic, i think more folks had to head back to work on a friday, out of all days, but a

the world, from canada to sweden this year, in 2018. more cities like athens were unusually hit according to meteorologists, and climate experts say it's because of more hot, dry months. experts add major evacuations because of fires could become the new normal in 2019. a blizzard in the midwest is making traveling difficult. freezing roads, gusty winds and heavy snow shutting down roads and canceling a lot of flights. north dakota issued a no travel advisory for people in the eastern part of the state. up to 16 inches of snow along with 50-mile-per-hour winds making travel dangerous there. parts of minnesota are also getting hit. the "today" show is tracking the storm and will have a live report at 7:00 this morning, after "today in the bay." former president obama and first lady michelle obama are the most admired man and woman in america for the 11th year in a row, that's according to the

metering lights. hopefully we get another great day of non-traffic bump bumper-to-bumper commute on the bay bridge but reminder, chp issued a high wind advisory for the bay bridge toll plaza, the altamont pass and the it dumbar bridge bridge. no now to our nation's capitol, it is day seven of the partial federal government shutdown. live look for you, still no end in site. hundreds of thousands of workers are he main home this morning and the key negotiators and members of congress are staying home as well. the shutdown seemed destined to last until 2019, and potentially until the new congress is sworn in thursday. president trump has tweeted about the shutdown stating "this is only about the dems not letting donald trump and republicans have a win." some lawmakers say it's time for the president to give in. >> the president has nancy and chuck in the oval office and negotiated against himself and now he's in a corner.

>> neither side is willing to budge over funding for a border wall. the man accused of murdering a woman at a b.a.r.t. station is due pack in court today. john cowell's attorney claims he is not competent to stand trial. a judge in oakland suspended the criminal proceedings for cowell now. the 27-year-old transient is accused of stabbing nia wilson and her sister in july. nia died. cowell's attorney says over six years he has been put on a psychiatric hold 22 times. the judge ordered court-appointed doctors to evaluate him yesterday. the doctors will determine if cowell is competent to stand trial. the mother of a woman shot to death by san jose police is speaking out. candlelight vigil for 24-year-old jennifer vasquez. friends and family expressed sadness but also anger. she was allegedly driving a stolen car when she was shot and killed by police early christmas. the officers thought she was a suspect in a shooting.

vasquez's friends believe the shooting could have been avoided. >> they could have pepper sprayed her, they could have tasered her or shot out the tires. they could have brought the k9 unit out. >> had the deceased not been driving a stolen vehicle, had not led police on a dangerous high-speed chase, crashed the vehicle and did not attempt to get away, at all costs, ramming officers and endangering their lives, that this shooting and this tragedy would not have occurred on christmas morning. >> i am announcing an investigation at a federal level. >> right there, you heard from people at the vigil and from san jose police chief eddie garcia. he is defending his officers' actions. v vasquez's family wants to meet with a district attorney. >> stanislas county investigators confirm this is

the suspected gunman but would not confirm his name. in the small community of elnito south of merced, a s.w.a.t. team drives away from an afternoon search. >> the manhunt and search for clues isn't stopping. good morning, bob. >> reporter: kira and marcus, the newman city police chief says the man who shot and killed corporal ron singh is a coward and asking you and the rest of the public to help find this person and bring him to justice. i want to you look at your tv screen, the stanislas county sheriff's department released new pictures obtained from social media and confirm these are those of the suspect, but they have not yet confirmed his name. yesterday, law enforcement thought they might have found him. deputies and officers cordoned off a farmhouse in a small community of elnito, south of merced. they issued a search warrant but no luck. marquee in newman with a message honoring the fallen officer. many people in newton knew corporal singh. this is from being here the past couple days and talking to people. they remember him being a very

friendly and professional officer. during yesterday's news conference with the sheriff and police chief, we learned that corporal singh pulled the suspect over early wednesday morning as part of a dui investigation. he radioed in the vehicle description and a few minutes later radioed back "shots fired." >> is it wt was a gunfight. corporal singh absolutely tried to defend himself and stop this credible threat. >> please, help us find this man and bring him to justice. i hope he's watching today and he does the right thing and turns himself in. >> this suspect is in our country illegally. he doesn't belong here. he's a criminal. >> reporter: after that information came out, president donald trump tweeted about the search for singh's killer and immigration stat us of the suspect writing in part "time to get tough on border security. build the wall." i want you to look at this video, this is video of an

alameda city police officer who drove about 90 minutes to get out here yesterday last night to leave flowers out here in front of the newman city police department, and back out live, as you look behind me, you can see there are a number of balloons, flowers, candles of that sort of thing. there will be a public vigil for officer singh, corporal singh tonight at 6:00 a couple blocks down from me, in the main town square. reporting live from newman, bob redell, "today in the bay." >> thanks for that update. we have video of a water rescue in the north bay after a boat capsized at spring lake in santa rosa. if you look behind that tree you can see a man being pulled out of the lake by a suspect. firefighters say the man wasn't hurt. he just got stuck. someone might start the new year a millionaire. the mega millions jackpot happens in about 16 hours. the jackpot is up $348 million

>> the drivers are as well. right now, we want to look at the weather for this weekend. lot of people have plans. >> big weekend, and a lot of people will be staying here in the bay area, or hitting the road, maybe even have family coming in town, so our saturday forecast looking great. it will start out chilly, with some freezing temperatures, and some of the inland valleys, highs reaching up to 55 degrees, mostly sunny skies, and it won't be as windy. your sunday forecast also looking great, with some mostly sunny skies, and then our highs reaching about 55 to 56 degrees. so where are you going? maybe half moon bay, that's where we'll see the highs reaching into the upper 50s, and just a few clouds here and there, but overall, it will be a great place to take in the sunshine. if you're headed to the sierra, heavenly is going to be cold today. we've had the morning temperatures in the teens. today's high will be up to 28 degrees. it will get warmer as we go throughout the weekend, with some highs in the lower 40s.

either. the bay bridge toll plaza we have a good commute this friday morning. i'll look at how the rest of the bay area is doing, coming up in a bit. we are tracking this morning more on the 8-year-old ghw guatemalan boy who died in u.s. immigration custody, he had the flu, that's what new mexico authorities are saying the autopsy showed. he was coughing, vomiting and had a fever. the news of his death reached his home in guatemala, some 2,000 miles away. we spoke with his mother. >> she says the family was desperate to escape poverty in guatemala when philippe and his father started their trek to america. >> now the mother says that the family was hoping for a better life for philippe. he is the second child to die in u.s. custody. both deaths are under investigation and as we reported earlier, homeland security

krista nielsen will visit the border today. a popular los angeles news anchor is found dead. now an investigation is under way. this is chris burroughs, it was found unconscious in a motel room yesterday afternoon in the l.a. area. take a look at the scene. glendale police say they were called there by a man in the hotel room, told the anchor was passioned out and not breathing. firefighters rushed to the scene, administered cpr and hurried to the hospital. burroughs died later at that hospital. he was just 43. >> we're waiting for a toxicology report to come back from the coroner's office. it is currently being investigated as a possible overdose. >> burroughs had connections to the bay area. he was a producer for nbc bay area back in 1996. he worked at ktla for nearly eight years. he is survived by his wife and

9-year-old daughter. the man who investigators say started this fire in southern california is going to trial. judge just made that ruling. forrest clark is facing arson charges for the holy fire which destroyed dozens of homes in orange and riverside counties back in august. clark pleaded not guilty. investigators say clark was feuding with a neighbor and set fire to his cabin, which got out of control. a new study conducted by state lawmakers puts a damper on the hopes of creating a state-backed bank for the marijuana industry. those in favor of the bank believe it will bring more transparency. >> but the report indicates that it could be too costly for the state. "today in the bay's" pete suratos joins us live from hayward to explain how this all happened. pete? >> reporter: good morning to you, marcus and kira. banks are hesitant to work with those in the recreational marijuana industry, since it's still illegal on the federal level, but according to this

study, it looks like a state-backed bank for the industry isn't that feasible either. the study was done by the california state treasurer's office and says the state bank would hopefully take the industry out of the shadows, put it in more of a regulated economy with other businesses. in fact, it mentions the industry could generate from $1 billion to $3 billion annually in california, but ultimately, the banks could be too costly with $35 million in startup costs and about $1 billion in capital and the potential loss of money for the state for the next 12 years, but the federal laws will be a key enactor in all factor in all of it. if they change the regulation they can't compete with services from the regular banks and if the laws become too aggressive the state banks would close and deposits could be confiscated. the city recommends creation of an agency to encourage banks to work with the marijuana industry. this appears to be an uphill

hearing them. people have been told to stay out of their homes for ten days, while the building is being evaluated. and developing right now, a rare type of knew meania is spreading through the waters of a michigan hospital, happening in hastings in the center of the state. according to health officials, the water tested positive for legionnaire's bacteria, after two people died. the state's health department says all patients at the hospital are now being tested. new for you this morning, san francisco's ecigarette maker juul could soon be meeting with federal officials as more and more teenagers are vaping. the head of the fda is calling for a meeting with executives from ecigarette companies and juul is on the top of that list. the meeting is to see if the companies are keeping up with the comments, and they've already made commitments they've already made to address the epidemic. the fda says some companies are backing away from their promises. nearly 4 million teens reported

using ecigarettes this year, nearly double the amount in 2017. and switching gears now, a spectacular site that caused a lot of commotion on social media, the eerie, blue light flooded new york city skyline, video and pictures like this one that you see right here filled the skies there, and on instagram and twitter, people were posting them on their time lines. the reason for that strange hue is a transformer explosion at a substation in queens. no one was hurt in that fire, and there is an investigation under way, but look at the sky and the shades of blue right there. it could be seen as far as man hat th manmattan and new jersey. >> i see a crazy blue light out of nowhere and after that blue light turned to red, blue, and then after like five minutes, it just went away. >> it went from nighttime to instantly like the sun is up, it's a beautiful day.

i'm like, whoa! >> the explosions temporarily closed laguardia airport in queens. all terminals were impacted by the loss of power, causing the faa to issue a ground flight for about an hour about. the airport is back to normal. another bright light had people flocking to social media last week. you may remember seeing this strange streak in the sky there. it turns out it was a meteor. so nothing like new york, except that it left people trying to figure out what it was. now to tesla's, c eo elon musk. he wants a judge to toss out a lawsuit against him. you may remember back in july, musk tweeted about a british diver who helped with the thai cave rescue, calling him a pedophile. the diver later filed a defamation lawsuit against musk in a los angeles court but musk claims the comment was meant as an insult, no the a statement of fact and says the comment was

"imaginative attack protected by the first amendment" so musk wants the judge to dismiss the suit. >> that's a baby. >> right there, singer chris brown's daughter cuddle with their new pet monkey. you heard me right. that monkey business could put hip-hop singer chris brown behind bars. the los angeles district attorney's office says it is charging brown with two misdemeanors. turns out owning a monkey without a permit is illegal in california, and the ap reports that california fish and wildlife agents took the monkey away. brown is scheduled to be arraigned in february. right now at 6:00, that manhunt is still under way in the shooting death of a newman police officer that as a small central valley community comes together to mourn. >> to lose an officer that just had a baby that obviously just gotten married, too, and i mean, it's so sad.
