back and it's also cold. >> it is. >> that's when we need a little light jog to the car to keep that temperature up. 30s right now, it is so cold in santa rosa, 30 degrees. san jose 34. mountain view 30 degrees and that's why it's important you bring in your pets, protect your pipes and your plants, because those temperatures are not suitable for anybody or any living thing. so our temperature trend into the afternoon, we'll keep the clear skies and look at the temperatures. we're going to remain in the 30s at least through 8:00 a.m. and we'll top out in the 50s. let's get a check of the roads with mike. >> pets, pipes and plants, except for the traffic. we have traffic after a quick traffic break. southbound 880, you see this flood of lights, these folks were held up southbound 880, we have an issue here, approaching 16th, that's where that disabled car was, it's moved over to the shoulder after a quick break. there is another issue approaching high street, as you get down toward the bottom of the screen, where that live camera was. you see traffic flowing once

again. i believe they've cleared lanes at high street. the off-ramp sounds like it's cleared but i'll double check with chp. everything else looking light. there is an incident near the san mateo bridge. we'll follow up, back to you. breaking news, a san jose police officer's cruiser was left mangled this morning after he was involved in a crash. >> bob redell is at king and tully roads. have you heard anything that led up to this? >> reporter: the police officer was driving through the intersection at king and tully, when he was t-boned by an suv around 2:00 this morning. you could see this video here on your tv screen, it shows you the aftermath, that police squad car ended up on a nearby sidewalk, crashed into a light pole, knocking it down. you could see the damage to his car there is fairly severe. paramedics transported the officer to the hospital. he was conscious. he was breathing. he is hurt, but does not appear to have life-threatening

injuries. the drivers and passengers in the suv are okay. it's not clear who is at fault in this collision. we do know that the officer did not have lights and sirens on as he entered this intersection. the investigation will be looking into who had the green light and the rooiight of way. reporting in san jose, bob redell, "today in the bay." we mentioned the holidays are over. 800,000 government employees are either still sitting at home or working without pay, because this is day 12 of the federal government shutdown. "today in the bay's" tracie potts is live on capitol hill to explain what's happening today maybe to end it. good morning. >> hey, scott, good morning. we just heard from the white house saying that the president's made a serious good faith offer and has not heard back from democrats. they will head over, along with republicans today, to talk about the border wall that's at the center of this shutdown dispute. smithsonian museums and the

national zoo closed for the first time today, as a partial government shutdown continues. it's a showdown over president trump's border wall with mexico. democrats refuse to give him $5 billion to build it. >> this is all a crisis that the president has manufactured, and he's dragging republicans into it. >> reporter: today, he's inviting top republicans and democrats to the white house for a briefing on the wall. democrats fear it's a stunt and doubt the president is ready to negotiate. they're planning a vote, as soon as they take over the house tomorrow. >> the house will be in order. >> reporter: they have two plans, both would reopen the government. neither would fund the wall. >> then the burden will be on the republicans, because the democrats will have acted. >> reporter: but the senate still controlled by republicans is unlikely to send president trump something he won't sign. >> the only thing that the maermaer matters is what president trump and leader schumer can agree to. >> reporter: that's chuck schumer, the senate's top

"let's make a deal" the president tweets to nancy pelosi. it's not clear what that deal might be. now, we're also looking at a "washington post" op-ed from mitt romney. romney saying that he is an incoming senator from utah, and he is criticizing the president's character saying president trump in two years has not risen to the mantle of this office. he will be one of those sworn in here tomorrow, who will be responsible for trying to find some way out of this shutdown. scott? >> tracie potts, thank you much. other news today, the first day of the work week for acting defense secretary patrick shanahan, the former boeing executive arrives in arlington to take on the pentagon's top job. former secretary of defense james mattis resigned last month, citing disagreements with president trump over his foreign relations policies. mattis had planned to stay on until february 28th but was ordered by the president to step

down december 31st. later this morning, two men in charge in oakland's deadly ghostship warehouse fire are due back in court. derek almen and max harris pleaded no contest. the lawyer for one of the men is expected to present a motion against oakland which accuses the city of destroying evidence, but that has been pushed back, because of a change in judges. alameda county superior court judge johnson will be assigned the trial this morning. initially a retired judge was set to take the case because of staffing issues. in north san jose, sheriff's deputies are investigating a reported home invasion we told you about this story on our 11:00 newscast last night, it happened about 8:30 on minuet drive. several men had broken into a home while the family was inside. we're working to find out more. a police officer and a young girl were both hurt yesterday in santa rosa. police say the girl was

threatening to kill her neighbor with a knife, so officers stepped in. officers tackled the girl, detained her, but she resisted. the officer suffered cuts and an injured finger. the girl had cuts on her hands and face. police say she was treated at a hospital and taken to juvenile hall. body camera footage can show what happened during violent situations. now the napa police department will talk about the new technology at a community meeting tonight. the topic rose after an officer-involved shooting in december. body cameras were used to help answer questions about the officer's conduct. for those interested, the meeting starts tonight at 6:00. happening today, people in the east bay could see their water prices rise. it's only if the contra costa water board approves a measure. if adopted, water rates in concord will start rising in february. the board will discuss exactly how much that will cost customers. some on the board floated the idea generating a 6% revenue increase. san francisco's new tobacco laws appear to be leaving an

unwanted haze on hookah bars. the city is set to start enforcing a ban on flavored knick seen products. voters passed that measure in june aimed at trying to keep teenagers away from candy-flavored ecigarettes. several hookah bars are confused by the language in the ban. some have closed down. others are trying to adapt to new rules. this is something for bay area commuters, it be cheaper to drive rather than take ac transit, because the costs to take the bus across the bay bridge just dumped to nearly $6 because of new increases. passengers will be paying more than people who drive at certain times of the day. it's the first of three increases over five years. fares shot up by $1 tuesday. >> and it is 5:07. as you head out the door, bundle up, we're in the 30s. eventually we'll climb into the 50s, but it won't be too warm out there. it will be rather cool.

our winds are lighter but breezy. expect to see that throughout the afternoon. let's give you a look at your overall daytime highs. san jose 57 degrees for today. morgan hill 58, los gatos 53, in through the east bay. oakland 54 degrees and we'll top out in the upper 50s threw the interior valleys. 56 for san mateo, if you're headed into the city, it will still be cold, topping out only in the low 40s. up through the north bay, look at santa rosa 59 degrees and this is going to set us up for another dry, mostly clear day. it should be beautiful out there to be outside if you need to, but it will still be rather cold. let's get a check of traffic with mike >> pretty clear out there, but we see more traffic flowing. the patterns starting to develop as if there will be a bigger commute. right now, all green, a little slowing over in the altamont pass, and cleared by the time you get to north flynn. this is now closed, not clear, this is the cesar chavez off-ramp from southbound 101. the trailer getting detached

i'm frank holland at cnbc global headquarters. here are today's top business headlines. wall street could start out this new year on a down note. the markets look like they'll open up lower this morning, following red arrows in asia and europe. investors are reacting to some disappointing economic data out of china showing growth of the country's manufacturing sector slowed for the first time in a year and a half, that's only adding to concerns about the health of the global economy. back here in the u.s., markets are coming off their worst year since the financial crisis in 2008, and that's despite a passipas positive session. for the year, the dow dropping more than 5.5%, while the nasdaq lost 6%. the partial u.s. government shutdown is now in day 12, with more agencies set to close their doors that now includes the fcc. it will wind down nearly all of its operations if there's no resolution by tomorrow, and that could impact businesses and even consumers. there will be a pause in the testing and approval of new electronic devices, complaint lines won't be answered,

consumer protection and local competition enforcement will cease and licensing services for broadcasters and wireless companies will end as long as the shutdown lasts. some good news here, it may be cheaper to fill up your car this year. for the first time in three years, prices at the pump are expected to decrease from the previous year. gasbuddy.com says gas will average $2.70 a gallon, three cents less than 2018 but 2019 will the second most expensive year to fill up since 2015. i know, a lot of numbers. here is the good news, again. you'll enjoy the lowest price of the year in january, with gas expected to average $2.35 a gallon. the typical family will spend $1,991 on gas this year, that's down 25 bucks from last year. so those are your cnbc business hez lines. back over to you. >> thank you, frank, happy new year. >> maybe with some of that money you're headed to the mall. here is a list of some of the hot items that are selling, winter clothing and sports gear,

our morning. >> it was colder here new year's eve than it was in new york. >> what? >> yes, it was, it's crazy but it's colder right now. we're in the 30s. in fact, we are so cold, this is possibly one of the coldest nights that we've seen so far. 30 degrees in santa rosa. oakland 36. san jose 34. san francisco 38 degrees. santa cruz 30. we might dip down to some 20s over the next hour. so here is a look at your 24-hour temperature change. it's drastic, up to the north bay, santa rosa looking at seven degrees colder at this hour than the same hour we were at yesterday, so at the same time yesterday, we were running 17 degrees warmer. napa 13 degrees colder. oakland 10 degrees colder and there are a couple of freeze warnings for southern salinas valley, monterey counties. remember that you need to bring your pets inside, protect the pipes and this will remain in effect through 9:00 a.m. today. they're also dealing with cold 20s and low 30s, so something to

kind of look out for. live look at satellite, you could see we're not tracking much through the bay area, but we do have some developing systems coastal systems that are going to bring some big changes to the bay area, but before i get to that, let me take you through a look at your daytime highs. we're topping out in the upper 50s. 57 for san jose, 55 for san francisco. your bay area skies mostly sunshine, and here's that long range outlook as we head in towards the weekend. late friday and through next weekend or through next week is when our rain chance also move in. we have this testimony that's going to tricken oin overnight friday into early saturday morning and the kaecold front w sweep in saturday, widespread rain saturday through sunday and another system just behind that, that's going to bring in more rain and we've got another one likely to develop that will continue that rain through the start of the work week into possibly monday and tuesday, and beyond that, so we're definitely tracking big changes ahead into the weekend. as far as estimated rain totals,

this is your three-day rain totals from saturday through monday, the higher elevations will likely get over an inch of rain, and near san jose, just over a half an inch of rain over the next seven days. we have low 50s on the map. here comes the rain, mike, that will never be good for commuters. >> folks, make sure you have that washer fluid in there as well in case it's a light rain, you can help it out there. looking at a light commute so far but we see the early indicators forming. highway 4, no slowing, antioch all the way toward pittsburg, bay point, contra costa county, the west of it, walnut creek interchange, the upper east shore freeway all at speeds. we have slowing getting into san francisco, though. the tail end of the bay bridge down the skyway and in toward south 101 off of westbound 80. now, just south of there, we have the off-ramp still closed, south 101, eastbound cesar clah advi chavez toward 280, that is the direction that is closed right now. rig got detached from its

trailer and so they have a heavyduty rig trying to help clear that. chp got five units on scene so there's a lot of flashing lights but that's the only issue for the city. the crash near the san mateo toll plaza looks like it cleared without any further problems. we'll keep our eyes on things, green sensors around the south bay. south county no problems, westbound 580 slowing out of the altamont pass. the volume builds. no problem for the transit routes, great stuff and regular service again back after the holiday service. you don't have any more holidays as scott pointed out. westbound 580, folks are getting out of the altamont without any problems. live look there and the bay bridge lighter than a half hour ago, we'll see how this changes over the next ten. pack to you. >> thanks a lot, mike. coming up on "today in the bay," outrage as the vatican lost bishops dealing with the sex abuse crisis. plus what happened the moments after a deadly lion attack, in newly released 911 calls. a look at how mike inouye

wildlife center to close, calling it a roadside zoo. a 2-year-old is hospitalized after falling into a rhino cage, it happened at an exhibit at a florida zoo. the director says the girl fell out of her father's arms, went through some steel poles and landed inside the enclosure. that is when the rhino hit the girl with its snout. the mother quickly pulled the 2-year-old back through the bars, and then a helicopter air-lifted the toddler to the hospital. her father says she's doing well. in the meantime, the zoo has suspended the rhino exhibit. 5:23, a conference in chicago for u.s. bishops begins today, just as the vatican blocked them from addressing the satisfaction bus cri sex abuse crisis. in a letter obtained by the associated press, the vatican says it made the move because conference leaders didn't give the congregation of bishops enough time to review the proposals. the proposals received just four days before a conference held last month, outlined recommendations to establish an

investigative body and a code of conduct for bishops. in a letter, the vatican asked the group not to vote or take action on the proposals. over 200 clergy have been accused of sex abuse here in the bay area. this morning, we're learning the head of global security for a michigan-based auto parts supplier was arrested in russia on friday. the 48-year-old former u.s. marine has been charged with espionage. paul whelan's twin brother says he has no doubt the charges were made up. spying charges carry a prison sentence of up to 20 years in russia. new this morning, six passengers on a frontier airlines flight from cleveland to tampa fell ill during the flight. the passengers who were not traveling together are held for observation. the passengers who didn't get sick were stuck on the plane for about an hour after landing. many people say it made for an uncomfortable flight >> they were coming out of

>> i've fallen off the same box at one point, laura. san francisco, we have clear skies, and we have some 30s. in fact, santa rosa right now 30 degrees, one of our coldest spots in the north bay. palo alto also in the 30s. you look at the spread of temperatures, it makes you cold from your living room as you are watching it. as you are making your breakfast, be prepared because even though we will warm up by just a little bit, it will still be another cool day. santa rosa is running 17 degrees cooler at this hour than where we were yesterday at the same time. napa 13 degrees cooler and again, we are expecting mostly clear skies. as far as our temperatures, it's going to be another cool afternoon, folks. i hope that you had a lot of time to go check out and bring out the jackets. mike, how are the roads? >> vianey, they are much heavier than when you had to cover for me. my gosh, look at the bay bridge. there's some cars here at the bay bridge toll plaza, which we haven't seen for a few days. fast track and cash lanes are

been in the 30s all morning long. i have my gloves and coat but i'm always cold doing the morning live reports. we talked to folks in concord at the starbucks off of willow pass road. here is their take on the cold weather this week. >> it hasn't been too bad today. the windows weren't too iced over. that's the only thing i care about. >> trying to keep it together and staying warm, got the heater blasting. it's rough today. i don't know. >> reporter: you got this reporter asking to you keep the door open to see how cold it is. >> man, yep. it's freezing today. i don't know why. >> it's cold, just get some blankets and sweatshirts, try not to spend money on the heater, but yeah, leave early, so turn on my heater and once i get to work, i drink my coffee and get ready. i work outside, so it's pretty cold. >> reporter: those morning reporters, i tell you. here's the look at the weather right now we've been talking about all morning, about 32 degrees in concord so we're still in the 30s.

witness tells us the driver of an suv was on salt lake crossing busy mayberry road when he struck liccardo. >> said he didn't see him, he didn't see him. >> liccardo was taken to regional medical center. his spokesperson says the mayor had several mine fractures and admitted for observation. the driver stuck around after the crash. in a couple of hours the accused killer of a central valley police officer will appear before a judge. gustavo arriaga is expected to be arraigned on murder charges, he is accused of gunning down police corporal ronil singh during a traffic stop in newman last week. singh joined the newman police force in 2011. he's the first officer on the newman police force to die in the line of duty. arriaga was arrested friday at a home in bakersfield. he's an undocumented immigrants who was trying to go back to mexico. several other people were also arrested, accused of helping arriaga run from the law. a 6-year-old girl is in the hospital, she was hit in the

head by a stray bullet on new year's day. police say someone fired bullets into the air near this east oakland neighborhood to celebrate the beginning of 2019. one of the bullets nearly killed the little girl, who was outside playing just outside a party. her father thought she had fallen and hit her head, didn't know she was struck by a bullet, until the doctor examined her. one neighbor says she heard gunfire when the clock struck midnight. >> i heard five rapid guns, boom, boom, boom, boom, boom, and i looked at my husband, and i said, "we need to get our butts inside. i'm not getting hit by a stray bullet." >> the 6-year-old is in stable condition at benihoff children's hospital. oakland police took the child a teddy bear yesterday. there is a $5,000 reward leading to the arrest of the person responsible. the man accused of sexual assault is off the streets. san francisco police sent us these sur violence pictures of the suspect. officers say he attacked an elderly person in chinatown, it happened about noon monday near the corner of pacific and stockton. last night, police announced

they found and arrested the suspect in the tenderloin. new this morning, accusations of pregnancy discrimination against ac transit. a former driver accused or told "the chronicle" -- this isn't written very well, they say they accuse the transit of not accommodating her during and after pregnancies. in a lawsuit, she claims they refused to provide lactation space or adjust her work assignments. in a statement to "the chronicle" ac transit says in part, "we ask the public to withhold judgment as we work to uncover the circumstances giving rise to this issue." a spokesperson says the suit only represents one side of the case. the elderly and poor might have less access to bay area emergency rooms in the future that is according to a new uc berkeley report. it comes after word of a medical center closing. the closure could cause longer wait times at surrounding hospitals. berkeley city officials say they

thanks so much. it's 5:44. recovery work is under way in butte county following the deadly camp fire. the question is where to put all of the rubble. fema and state officials are running into pushback over plans to open a large temporary scrap yard to sort and process truckloads of rubble from burned out paradise. first it was chico, where many pushed the government to abandon a 100-acre site next to a residential neighborhood. oroville are speaking in opposition to the second choice, a former superfund site near highway 70 on the south side of town. the state capitol, governor jerry brown's last week on the job and gavin newsom will take the oath of office on monday. not clear what brown will do in the future but the "l.a. times" reports he mentioned setting his sights on trying to stop a 2020 ballot initiative that would undo some of his efforts to overhaul state prisons by providing new parole opportunities for some convicted of lower-level felonies.

it's equally cold, right now in san jose, 34 degrees. at least the wind speeds aren't gusting right now, because that windchill factor would have made it more like upper 20s. the clear skies will remain throughout the day, but look at the temperature drop, within the past 24 hours as you wake up this morning, santa rosa' really feeling that biting cold, and napa and fairfield. down 17 degrees since where we were at this hour yesterday. right now current temps santa rosa 30 degrees, napa 30. concord and livermore also in the 30s. we're seeing 30s across half moon bay, 41 along the bay there. this prompted freeze warnings in southern salinas valley, monterey county and this will remain in effect through 9:00 a.m. today, so the freeze warning is expected to affect a lot of your plants and pipes and your pets, bring them inside. satellite radar, we have calm conditions but we've got some systems developing off in the

coast but overall today's forecast is expected to be very calm and clear. temperatures will top out into the upper 50s. oakland 54 degrees, san jose 57. yesterday was still a little breezy. we could expect to see light breezes again but not as windy as what we've seen so far. futurecast, that first system is on tap right now to make its move in late friday into early saturday morning. look at how widespread the models are showing this out so far. it will be widespread, lasting all day saturday and yes, that is lake tahoe, that sierra snow expected with this system, and look at sunday, we get some pretty good pockets as that cold front moves through. as far as estimated rain totals, three-day rain totals show higher elevations getting the most out of the system but a little under an inch for most of the bay area, but that's their monday and another storm system set to make its way monday and that will head to our rainfall totals. mike, how are the roads, aside from the metering lights at the bay bridge toll plaza? >> the metering lights haven't been on for a while at the bay
