it's been so long, i feel like i haven't seen you since last year. >> happy new year to you, 2019. a shutdown in washington, d.c. could there be movement towards a possible solution? this is the eve that democrats take back control of the house. we've got two reports for you. we start with nbc's chief white house correspondent hallie jackson. good morning to you. >> reporter: hi, savannah. good morning. this meeting would be the first time that the president comes face-to-face with democratic lawmakers since the shutdown started, as he invites them over for what is a briefing on border security. a the that has been this president's focus through this shoutdown so far. now, another clash at the border is drawing attention. just hours into the new year, a new altercation at the mexican border. u.s. agents firing tear gas at 150 migrants tried to cross a fence near tijuana. border officials say they were targeting rock-throwers, not

those entering the country. it's the same area where a similar incident involving a caravan of migrants faced the same thing at the border. the government shutdown in its 12th day. but there may be movement. the president inviting eight top lawmakers from both parties to the white house today. it's expected to be a briefing on the border wall. the president wants more money for it than democrats are willing to give. >> we are not giving up. we have to have border security. the wall is a big part of border security, the biggest part. >> reporter: so far, it's been less about talk and more about tweets between the two sides. like this one from president trump, border security and the wall thing and shutdown is not where nancy pelosi wanted to begin her tenure as speaker. the response from pelosi, the president has given the democrats a chance to show how we will govern responsibly and quickly pass our plan to end the irresponsible trump shutdown. tomorrow, when democrats take control of the house, pelosi will make a move to reopen

government. it's not expected to go anywhere in the senate much less get to the president's desk as democrats dare republicans to keep the government closed. both sides stuck, with hundreds of thousands of workers stuck in the middle and visitors stuck request with this. as volunteers are picking up the slack by picking up the trash. >> i started to clean toilets. it became a 150-person movement to keep the park clean. >> reporter: but in washington, the smithsonian museums and national zoo today, yet all of the animals will still be cared for. elsewhere, some governors are stepping in to keep the federal parks open on the state's dime. that's a nonstarter because it doesn't do enough for border security.

still, democrats do plan to go through with this tomorrow, in fact, putting the ball in republicans' court essentially saying hey, we did our part, now you do yours. if nobody gives in, yeah, we're looking at a shutdown stretching even longer. >> welcome to divided government. meantime, a lot of buzz about this op-ed written by senator-elect mitt romney who is coming to washington. >> reporter: yeah, savannah. mitt romney will be sworn into the senate tomorrow. on his way into town, he's firing off a kind of greeting that donald trump doesn't like. and he has a blistering new op-ed taking on the president's character. writing in "the washington post," on balance, donald trump's conduct over the past two years, particularly his actions this month, is evidence that the president has not risen to the mantle of the office. romney continues, with the nation so divided, resentful and falls short of that.

this morning, the calendar may say 2019, but the 2020 race is under way. senator elizabeth warren becoming the biggest name in the democratic field to signal she is running for president. >> america's middle class is getting hollowed out. and opportunity for too many of our young people is shrinking. so i'm in this fight all the way. >> reporter: warren is set to hit the trail in iowa over a year before the state's caucuses. the liberal firebrand is already a familiar foil to president trump. the president responding to her announcement on fox news. >> she says she's in the fight all the way, mr. president. do you really think she believes she can win? >> i don't know. you have to ask her psychiatrist. >> reporter: mr. trump has repeatedly ridiculed warren over her claims of native american ancestry, using language that's widely viewed as racially insensitive.

>> pocahontas, pocahontas. . >> reporter: warren getting mixed reviews in october. releasing a dna test, reporting strong evidence she had a native american relative, dating back six to ten generations. warren hasn't been shy about punching back at the president. >> that's what donald trump and his republican enablers stand for, hatefulness, ugliness and cruelty. >> reporter: now, looking to reintroduce herself to democrats, connecting with supporters on instagram. >> hold on a sec. i'm going to get me a beer. >> reporter: but for some, the moment falling flat. online critics calling her awkward attempt at drinking beer inauthentic pandering to young voters. one thing is certain, democrats will have a competitive field with dozens expected to enter the race, including bernie sanders. establishment figures like former vice president joe biden leading the field in a recent iowa poll. and newcomers, from senators kamla harris to beto o'rourke, the congressman topping the list of fresh faces, after

electrifying democrats during hisz failed texas senate bid and already attracting president trump's attention. >> beto o'rourke is overrated. the what i heard about him, i figured he must be something a little special. he's not. >> kristen, you mentioned joe biden. people say he's out in front. how ready is he to run? >> in some senses, he's had a campaign in waiting. he's been visible, out on the 2018 campaign trail. and he's worked to build up a network of nonprofits and outlets headed by some of his top advisers. if he does run, it would be his third presidential bid. he considered it seriously in 2016 and decided not to do it because of the tragic death of his son, beau, to cancer. >> exciting. thank you. now, to the deepening mystery surrounding the arrest of an american in russia for alleged spying. this morning, the former u.s. marine's family is speaking out.

nbc chief foreign correspondent, andrea mitchell, with the latest for this. >> reporter: good morning. happy any year to you. secretary of state mike pompeo saying, he is hoping that russia will permit u.s. officials to meet with the man jailed in moscow and accused of spying under international law. it's a deepening mystery at a time of escalating senses. who is paul whelan and why is he in custody? he served multiple tours of iraq, as part of the marine corps reserve. he was discharged in 2008, after being convicted of several charges relating to larceny. >> there's no way that paul is a spy. >> reporter: whelan's twin, david, denies that his brother committed espionage. saying paul was in moscow for a friend's wedding. >> he wouldn't do anything to break the laws. i can't imagine he would have broken spy laws, in any country, let alone russia.

>> reporter: it's a country that whelan visited a dozen times since at least 2006, maintaining an account on a russian social media site where he posted messages like, god save president trump. at the time of his arrest friday, he worked as the director of global security for the central auto parts company borg warner. questions are being raised about the timing of his arrest, one month after operative mariia butina pleaded guilty in the u.s. to acting as an unregistered foreign agent after forging connections with the nra and leading republicans. two weeks ago, vladimir putin promised he would not retaliate for butina's arrest. >> translator: we're not going to detain any people in order to exchange them for anyone. >> we just want him to come home. >> reporter: secretary of state pompeo said he wants to know more about the charges.

and he says, if it is appropriate, the u.s. will demand his immediate return. savannah. >> andrea, thank you. we have a lot more to get to this morning, including a toddler's frightening fall into the rhino exhibit at a zoo in florida. this happened just days after a deadly lion attack at the north carolina zoo. >> reporter: this wildlife sanctuary in inconorth carolina closed as new questions are being raised about animal park safety. now after another separate incident at a rhino exhibit in florida. a family trip to a zoo turned terrifying, when a 2-year-old girl toppled into a rhinoceros exhibit. >> she is conscious at this time. >> reporter: a witness posting this picture of a small shoe in the enclosure, believed to belong to the toddler. she and her family were participating in a hands-on experience with rhinos, an experience led by a zoo keeper, able to touch the animals,

separated by steel poles. >> while the father was kneeling down holding the child, according to witnesses, the child stumbled backwards. at least one, if not two of the rhinos made contact with their snout. >> reporter: the toddler was pulled to safety by her mow mother and i've-lifted to the hospital. and the mother was treated for an injury to her arm. this comes just after a rhino escaped killing an intern. this morning, the chilling 911 call. made right after the attack. >> this is the conservative center on east hughes mill road. we have had a lion attack. >> alexandra black mauled while having a staff employee clean a lion enclosure. the conservator center says this lion somehow broke free. >> the person that was attacked, how bad are they hurt? >> they are incapacitated. >> they're incapacitated. >> reporter: first responder says the lion was agitated. when repeated attempts to tranquilize the animal failed,

deputies shot and killed it. >> it took several shots to bring him down. he was amped up. >> reporter: the conservative center says they follow safety protocol when cleaning big cat enclosures. >> this is not a situation we've ever had before. working with wild animals like this, this is a highly-skilled profession and it's something we take very seriously. so any sort of incident like this is devastating to everyone. >> reporter: this morning, the lion exhibit in north carolina and the rhino exhibit in florida remain closed, as officials investigate what went wrong and try to make sure incidents like these never happen again. here in north carolina, the animal rights group, peta, is urging lawmakers to make it illegal for nonaccredited facilities to house wilder exotic animals. for its part, this wildlife sanctuary has passed two recent inspections by the usda and has

coaching run with ohio state football with a win over washington in the rose bowl on tuesday. he is stepping aside and will become the assistant athletic director. he said he was stepping aside and is widely considered one of the best of all-time. we are learning more about the disappearance and alleged murder of the colorado mom who vanished more than a month ago. joe fryer has more on that this morning. >> reporter: patrick frazee has been charged with first-degree in the alleged killing of his fiance kelsey berreth. she has been missing since thanksgiving. her body has not been found. there are two possible theories for how ber rest died. patrick frazee said nothing after being charged with five

felonies. each murder count is a different theory. one alleges his fiancee was killed deliberately. others say she died during a robbery. but prosecutors are not elaborating. most facts remain sealed from the public. >> there's ongoing criminal investigations. there's leads that law enforcement needs to follow up on. it's extensive. >> reporter: according to the court documents, frazee could have been plotting the murder for months. three counts of solicitation of murder in the first degree. seem to suggest on three separate occasions between september 1st and november 1st, frazee attempted to convince someone or multiple people to kill berreth. last montecito police said it was possible another person could be arrested in this case, so far that has not happened. but court documents don't say who was solicited or why prosecutors think that frazee is responsible for his fiance's death. >> all facts are under seal. i can't talk about any potential motives in this case. >> reporter: while berreth's body has not been found, investigators believe she was found inside her townhouse.

she was seen shopping on thanksgiving, shopping with her 1-year-old daughter. her mother did not report her missing until ten days later. last month, investigators executed a search warrant on frazee's property, and arrested him a week later.azee's propert him a week later. this morning, frazee remains behind bars without bond. he and his attorneys have not commented since his arrest. as for the couple's daughter, she is in the temporary custody of berreth's parents, with another custody hearing scheduled for thursday. frazee has not entered a plea. that's expected to happen at his pretrial hearing january 29th, when prosecutors will submit the evidence against him. they will then decide whether to pursue the death penalty. >> thank you. now, to a glimmer of hope after a suspected gas explosion leveled an apartment building in russia. a baby was found alive in the

rubble, 36 hours later. lucy cal lucy kafanov has this amazing story. >> reporter: good morning, savannah. rescuers are racing against the clock to find survivors in that blast. they nearly gave up hope on tuesday when it was too dangerous to continue digging but all of that changed in an intaui insta instant, when they heard the sound of a baby crying. the moment stunning rescue workers and the world. a baby boy, pulled from the rubble, alive in serious condition, surviving in freezing temperatures. after the new year's eve tragedy, a gas explosion ripping through this apartment. the deadly blast captured on camera, aired on russian television. with the mercury plunging below zero, rescue teams have been

working around the clock to find survivors. they heard a baby cry. they were cutting through debris to reach him. we cut through the linoleum. the baby likely survived because he was swaddled in a blanket and warm bedding, some protection against the elements. last night, he was air-lifted to moscow 1,000 miles away, where he is being treated for frostbite, a head injury and fractures. his parents are distraught. we were all sleeping in the same room. my oldest son and i fell through and were able to crawl out. but the youngest was alone in his crib. dozens are unaccounted for. grieving friends and relatives left flowers and candles for the victims, praying for more miracles. an update on baby ivan this
