6:00 am
but we start "today in the bay" with a traffic alert, a deadly hit-and-run crash involving a pedestrian shutting down 880. good morning, i'm kira klapper in for laura garcia. >> and i'm marcus washington. mike inouye is getting us up to speed on that problem there happening in fremont, mike. what is the latest? >> marcus and kira, we have still the full closure of the northbound side of 880, and as dametrujillo told us he's on scene there and saw chp close the off-ramp at fremont cushing providing the only equity for folks backed up, for only a mile approaching the tesla plant on the right side, that's how you know that'sed northbound direction of the nimitz. if that's what you take, do not take it this morning. looking at northbound 880, it is jammed up from dixon landing road, the build out of the south bay now, approaching mission. some folks were feeding off of mission. it stopped for a while, and then it looked like traffic was again allowed on mission, feeding into the backup. now, i've seen in the last few minutes some folks start to move in the area.
6:01 am
warm springs boulevard, fremont boulevard on the other side, the western side, those will be options for you. the distraction causing a slow down southbound coming out of union city, fremont and milpit s milpitas. the other scene in san jose, they cleared the lanes in the last three minutes. all vehicles northbound 87 at 101 are cleared to the shoulder. that was an earlier overturned vehicle as well. the two scenes are the only slow spots for the bay. in fremont, the deadly crash, a curious situation. lot of investigation going on, damian trujillo is providing the live updates for me and my information. damian, you're out there right now. what is the latest? >> reporter: mike, the scene is in front of me but that's not something you might want to see at home. there's evidence scattered all over the highway, so the coroner is being meticulous gathering that evidence. this backup is cushing boulevard. the off-ramp to cushing was actually opened earlier this
6:02 am
morning so cars could get off on quu cushing and back on 880, but there was also evidence on this off-ramp and so they had to close it again. it's been closed for approximately 20 minutes now. the coroner, the fact that they're here, chp says that's good news as far as traffic goes because it means that they'll be able to open the highway shortly. but again, as there's so much evidence throughout the highway, that it's taken them a little longer to process all that evidence and get them into their evidence van right now. this is reported as a hit-and-run, apparently the driver, the initial driver who struck the victim here was apparently walking on highway 880, fled the scene. secondary driver also apparently hit the victim, that driver has pulled over and chp is talking to that driver right now. they told us about 6:30, looks like coroners wrapping up. they should be right on time 6:30 to reopen highway 880. we'll keep you posted. live along highway 808 in fremont, i'm damian trujillo, "today in the bay." >> thanks for the update.
6:03 am
we sent out this push alert right before 4:30 this morning. be sure to download our nbc bay area app to get all the breaking news you need to know overnight. right now, we go to vianey arana in for kari hall this morning, tracking the temperatures for this morning, which are cold. >> oh, yeah. very cold. headlines for to you get out the door. cold in the 30s. we'll see a dry day. you won't need your umbrella today, except if you live in the north bay. getting out of work tonight super late, you might catch rain. we show an increase in high clouds, the first round of rain expected overnight into early tomorrow morning. i'll take you through that hour-by-hour outlook and estimated rain totals coming up shortly. back to you. 6:03 right now. in washington it's a new day with an historic new congress facing the same old problems. leaders head back to the white house to negotiate a solution to the partial government shutdown now entering week three. "today in the bay's" tracie potts is live on capitol hill with the latest.
6:04 am
tracie? >> hi marcus. we have new tweets from the president in the last hour in advance of meeting arguing he's unimpeachable. there's discussion of about that since nancy pelosi left that door open. also arguing that the fluctuation in the markets right now, the new democrats majority he says is to blame for that. he says things are going to smooth out after a while, but the question is, as they meet today, with no one backing off whether or not they want to pay for this wall, is there really a point to start negotiating? today's white house meeting is the latest attempt to break the gridlock over president trump's demand for taxpayers to put a downpayment on the border wall he said mexico would pay for. >> i have never had so much support as i have in the last week over my stance for border security. >> reporter: he's going head to head with new house speaker nancy pelosi, who refuses to pay
6:05 am
for the wall. she says it's immoral. >> this is not a wall between mexico and the united states that the president is creating here. it's a wall between reality and his constituents. >> the deal is passed. >> reporter: last night, the new democratic house of representatives approved a plan to reopen the government, but with no money for the wall, republicans in the senate, who passed something similar last fall, now refuse to consider it. >> i would call it political theater, not productive lawmaking. >> reporter: right now, that wall is the only thing standing between 800,000 federal employees and their pay. >> 800,000 people who have been put at risk, who are worrying about whether they get a paycheck next week. >> reporter: president trump tweets, "this is strictly politics by democrats, hoping to get an edge on the 2020 election." tracie potts, nbc news, washington. more details on the impact of the shutdown right here in

the bay area. san francisco is fed up with trash at nearby landmarks. crews from the public works department are now picking up that garbage at national parks. waste has been piling up in places like land's end for the past two weeks. that's when the national park service stopped clearing them and cleaning up that area because of the government shutdown. although the city is now stepping in to help, public works spokeswoman wants to remind visitors to pick up after yourselves. happening today, relatives of a man shot and killed by hayward police officers are planning to gather today to remember him. in mid-november, police shot augustin gonzalez after a neighbor called 911. officers thought he was armed with a knife but later determined it was a razor blade. police say gonzalez did not follow their orders and challenged them to kill him. family members plan to file a civil claim, arguing officers made mistakes handling the situation. they say they will hold a vigil outside hayward city hall.
6:07 am
starting today, san francisco's search for a new fire chief ramps up even though the rank and file issues with the selection process. now, the question is, who will replace chief white, who stepped down in october? today the commission holds a pivotal meeting. "the examiner" reports tensions from the firefighters union which believes an experienced replacement can be found from within. the union believes the most worthy internal candidates are being ignored. new this morning, about a third of b.a.r.t. workers have a lot of explaining to do. they did not show up to work on christmas eve, nor on christmas day, according to "the san francisco chronicle." train agents and operators left stations unstaffed and unsecured because of this b.a.r.t. manager said police officers had to fill in. the managers warn a crackdown on worker attendance is on its way. happening today, steph curry celebrates ten years wearing the warriors jersey, and to celebrate, he's throwing a big bash at the fox theater in oakland tonight.
6:08 am
fans stood in line for hours, not one but two days to get their hands on the tickets for the big party. they say it was well worth it. we'll get a chance to watch e40 and p. lo perform and see curry globally launch his curry 6 shoes. we have new video of work crews putting the finishing touches on what will be an epic college clash at levi's stadium. the college football championship game on monday night between alabama and clemson. our sky ranger was overhead as crews painted the field late last night. santa clara and san jose this weekend are rolling out the red carpets. caltrans crews already are sprucing up roadways for the expected traffic, and the hype really kicks in later today, with the opening of playoff fan central at the mcenery center. >> i also saw the cool setup they have at san pedro square market in downtown san jose. pretty neat out there. if you are checking out some of the setup, you don't have to worry about the rain today but notice the high clouds roll on
6:09 am
in especially once the sun comes up, you start to notice them. as far as temperatures for today, topping out into those upper 50s. half moon bay 59 degrees. san jose 58. in through oakland 58 degrees, and our temperatures are fairly seasonable for this time of year but it's not really the temperatures that we're worried about. we're worried about the changing weather pattern, and satellite radar showcasing the incoming high clouds, could you see covering the bay area. we have been so clear the past couple of days, it's been incredible to see the views, but now, we've got that rain moving in, and this is going to affect you as early as tonight, if you live in the north bay, but as early as tomorrow, for the entire bay area. we're talking about widespread rain, gusty conditions as our first winter storm of the season. let's get the latest on how the roads are doing. it's been a tough commute out there, mike. >> it has, spreye has, vianey. we are showing you traffic funneled off the top of your screen, the exit lane for
6:10 am
fremont cushing boulevard up until a few minutes ago, close, as damian trujillo reported at the scene. we're not zooming in too close because it say gruesome scene from what i understand. northbound 808 has been closed since early this morning because a person was hit over there, a pedestrian on the freeway. not sure exactly why that person was on the freeway, so we'll track that. we'll show you this while i talk about it more because i'm having a problem with my map system. we are showing the slowdown from about dixon landing road. the traffic is building up toward the scene. traffic is flowing off of there. if you're coming over and you usually use mission boulevard over to 880 northbound, do not do that right now, folks. that is not an option for you, not a viable solution. you'll have to take a warm springs boulevard to get past this, or perhaps fremont boulevard over on the west side of the freeway. i'm going to take you i think to my maps system and we'll show you what's going on from our fremont cemont camera. if we can't take the map system, let me know, folks, and we'll move on. okay, no maps. we're still working.
6:11 am
we'll show you the backup. san jose the crash north 87 at 101 has cleared. there we go, back to the map system, i apologize for that, folks. we're looking at the scene, there is tesla as the landmark and the slowdown starting to look better as folks have been advised do not take 880 northbound. use warm springs over here or fremont boulevard. zooming back out, crash northbound 87 cleared from 101 the approach to the airport. the rest of the bay shows a nice flow of traffic as well. we're following that deadly crash investigation over in fremont but if you are headed to the bay bridge, that is clear. back to you. >> all right, mike, thanks. next and all new at this hour, saved by netflix. >> i was supposed to fall asleep at 10:00 but i stayed up and watched netflix. >> he ignored his bedtime but saved his family's life. what happened and whether his mom says if he's still in trouble. plus blockbuster jobs numbers, breaking news. i'll walk you through it all
6:14 am
all right, we're looking from sky ranger over 880, the nimitz freeway, those red lights, those are flares forcing traffic off northbound 880 at fremont cushing, right next to the tesla plant. right now, the freeway is closed. damian trujillo is on scene. he tells us chp and caltrans are hoping for 15 minutes until they can start reopening the lanes.
6:15 am
we'll wait for the confirmation. we won't wait, we'll watch this and give you the latest. north 880 is jammed out of mill tee pass, headed toward fremont. i'll give you the alternates and the forecast from what we hear from chp. and a very happy friday to you. i want to have you look at these absolutely terrible numbers. these are awful. i would love to talk about it, apple is a train wreck, but holy cats, do we need to talk about the jobs number. nobody saw this coming. labor department said the american economy added 312,000 jobs in the month of december, the best economists were expecting was something in the range of 170,000. the labor department said also its estimates for previous months had to be adjusted upwards. this news is so good, even in great economic times, it caught all of us off guard. this number was measured before the government shutdown, but let's assume the government's going to reopen someday, so this
6:16 am
is nothing but good news, even accounting for the holiday hiring. unemployment rate ticks up to 3.9%, that's okay. 419,000 people entered the workforce last month, so read nothing into the rise in the unemployment rate. the only thing investors might worry about is interest rates. we thought the fed was wrapping up interest rate hikes. this number throws gas on the economic fire, and it's the fed's job to keep the economy from raging out of control. they do that with raising interest rates. other news, general motors has just announced it will soon reduce the tax credit that customers get for buying an electric car. they joined tesla, which made that announcement before christmas. they have to do this. the law caps the credit at 200,000 cars, so they're victims of their own success. car companies and others are calling for washington to extend that credit to encourage more electric car sales. this sunday morning, i'll talk
6:17 am
with industry serexperts about law. >> there isn't a u.s. manufacturer right now, ford, gm, obviously tesla, that isn't supportive of this. >> so that's pascal romano. marcus and kira, reporter emmy hall is the latest to join our team of reporters. she is an automotive reporter bringing expertise about cars to the table so i'm excited to have her but she's also a race car driver, which makes her way cooler than anyone else on my show. they have this video of her racing through the desert. none of those tires are on the ground. i'm not a race car driver but i'm pretty sure you're supposed to keep the tires on the ground. >> that's what we're taught. >> tune in sunday morning, we'll talk about tax policy but as long as you can get through that, we'll talk about race cars. little bonus. >> yes. >> something we could stay tuned for. she'll be a great addition to the show, scott, thanks. well, as all parents in our
6:18 am
newsroom, along with myself, can agree, you should always listen to your parents. wumpb boy is called a life saver for disobeying his mom's orders. this is in delaware. the boy stayed awake, secretly binge watching netflix. at 1:00 in the morning, he heard a fire start when a power strip blew in his family's trailer. >> i saw smoke in my hallway and saw the fire. i started yelling for my mom, because she was asleep at the time. >> if he wasn't on the tv, if he was not awake, i don't know the outcome. oh, yeah, he didn't get grounded this time. >> firefighters say the fire started from a breaker box malfunction. the family is okay, as you heard, however, sadly, the family pets did not make it out alive. good on that boy. i still have a problem with the fact he stayed awake three hours past his bedtime, but it was a good deal in this situation.
6:19 am
>> and you can stay inside today and watch movies. >> yes. >> it's going to be raining this weekend. it will be a great day to head out and watch one of my favorite movies recently, "aquaman" for obvious reasons. our current temperature trend right now, we're in the 30s, the 40s, and then we'll eventually top out in the 50s throughout the bay area. we'll get a nice increase in the cloud cover, thanks to this. we've got our first winter storm of the year. satellite radar showing the increase in the high clouds rolling on through. you'll be able to enjoy those a little bit better as the sun comes up. storm ranger up and scanning, not tracking anything just yet but let me show you what it will be tracking shortly. futurecast showing that first storm moving into portions of the north bay, possibly as early as tonight, so the north bay anything north of the golden gate bridge might see some showers but early tomorrow morning, the cold front will really sweep through, bringing widespread rain. could you see the yellows and the oranges and reds, those are heavier pockets of rain, along with sierra snow.
6:20 am
it's a winter storm so cold enough to bring us good accumulations to the sierra. plenty of moisture is off the coast. saturday we're expecting rain pretty much all day and at about 10:00, you notice we'll get the lighter pockets of rain, along with early sunday morning, we'll get a little bit of a break in terms of the heavy rainfall, but again, we've got so much moisture just off the coast that by about 4:00, 5:00, we'll get another round of heavier pockets of rain push in through the north bay, becoming widespread overnight into early monday morning, which will mean a very wet commute for monday morning, as people head back to work and a rough commute through the sierra. in fact, we could be starting to see the possibility of some gusty conditions, upwards of 35, even 60 for the higher elevations and we get our second storm system moving on monday and a third storm system bringing in the chance of rain for wednesday, so those are a lot of days of rain during the work week. mike, how is everything? >> we're still following this one major crash, this deadly crash and investigation. let me talk you through this, folks. we currently have 880, the
6:21 am
nimitz freeway closed, all northbound lanes. you're looking at it right now. i'll step in, sky ranger the overhead view, these flares here and in the last two minutes, seeing traffic stop exiting the freeway at fremont and cushing. i've also seen from sky ranger the chp vehicles are starting to move around. you see them now in the exit lanes. we still have the coroner's van on scene. that may be the coroner's van, truck there exiting the area. they are starting to pick up the scene that had the closure there. the person who was hit on the freeway, they have addressed by the coroner, and the investigation continues by chp not at the scene but it looks like off the scene, as we zoom in, there is cleanup work going on. someone was hit on the freeway so there is that last-minute detail to go on there by the fire crew and their hoses. we'll show you that. as we get back to the maps we'll show you the backup that extends. my concern is the folks as well coming off of mission boulevard, we have in the last 20 minutes scene this jam up coming over from 680.
6:22 am
first of all, let's look at this picture, north 880 here, this is mission boulevard. folks, tesla and the parking lot will be over on your right for all of these drivers. getting up through the area at the scene, traffic is starting to exit at fremont cushing but approaching the area coming up from dixon landing road is where the focus is, because of folks coming in from the south bay. so far, that's the only thing really going on as far as any warnings for folks. everything else around the bay is moving smoothly. damian trujillo is on the scene following that investigation, and again, north 880 still closed but they're hoping to have lanes reopened by 6:30, just another few minutes. guys, back to you. >> thanks, mike. still ahead at 6:30, one of the big stories the bay area is talking about, the search for a woman who bit a jogger over a confrontation with a dog. he spends about three grand on a refrigerator and then spends almost three years just to make it work. i'm consumer investigator chris chmura, "nbc bay area responds," next. nbc bay area responds to a

east ba 6:25 for you on this friday morning. nbc bay area responds to an east bay home opener who was fed up with his fridge. >> said the manufacturer's frosty reception deserved our attention, so he contacted consumer investigator chris chmura for help. >> robert kimball in brentwood mailed us a half inch envelope, all about that refrigerator
6:26 am
right there, and a three-year-long back-and-forth with samsung over it. robert says he bought the refrigerator in 2014 but the ice maker was useless, producing slush, not cubes. robert says he logged more than 20 repair appointments under his warranty, 20 of them. he figured a new refrigerator was the solution but samsung said no, so he mailed his case to us. we contacted samsung and robert says it offered him a full refund, more than three grand, so he could go out and buy a new refrigerator. the company didn't explain what happened with those 20-plus service calls, but samsung told us it will "carefully review mr. kimball's experience in an effort to constantly improve our processes." we think that's a key part of the resolution here. yes, speaking up about a problem can be awkward, and time-consuming, but companies that have kinks to work out, might not even know unless customers like us speak up.
6:27 am
we encourage you to, with photos and documents just like robert did. should you hit a brick wall, you're trying to solve a consumer problem, maybe we can offer a boost. the number is 888-996-tips or online at nbcbayarea.com/responds. >> thanks, chris. it 16:27. next and new on "today in the bay," did non-citizens vote in california? the new report out this morning, and questions california can't answer. latest on the breaking news in fremont, a deadly hit-and-run crash on the freeway overnight. the problems it's causing this morning. plus -- >> there's a flipside. the flip side is to any attack. >> kevin hart talking with ellen in a conversation she calls incredible and honest. at 6:45, the move she says she made to reinstate him as the host of the os cars. 6:30 for you this friday morning. breaking news we've been tra tracking, traffic northbound 880 completely shut down. nbc bay area sky ranger live above overhead. you can see it here as well. >> thanks for joining us. i'm kira klapper in for laura. >> i'm marcus washington. right now we get to mike inouye. you have an idea when this might
6:31 am
reopen. >> chp thought it might take longer but updated this in the last few minutes. damian trujillo is on scene. this is sky ranger and that's our news van. here is the fire crew and they washed down the roadway to clean up any of the debris that remains northbound 880, still closed. sky ranger zooms out the view, you see that hotel over there, the north side, sorry, on the southbound side, let me switch the view. we had a camera above that hotel there, and there you can see the tesla parking lot, that's the landmark. if you travel north with tesla on your right, this is where the crash has lanes blocked. you see the fire crew continuing the cleanup, should be a couple more minutes. chp hopes to open this freeway in just a few. we are moving our crew so we are not going to take the live report from damian, because he's packing up the van, trying to assist the situation, and there are the flashing lights. hopefully for just a few more minutes, until they can reopen northbound 880, but right now, it is jammed from just north of dixon landing road, all the way
6:32 am
up to the scene. again, it's the jam before they reopen the freeway, north 880, for that deadly crash investigation to just about be complete on the roadway. much more mystery regarding why that pedestrian was on the freeway so we'll continue to follow that in the newsroom there. that circle, that's the jam for the bay area. everything else moves very smoothly. there is a crash reported on the peninsula, just off the san mateo bridge, but it looks like it's on the shoulder. i'll track that as well and i'll show you the bay bridge coming up. for now, back to you. >> thanks, mike. we sent out this push alert to our app users right before 4:30 this morning. download it, it's free, our nbc bay area app, so you can get all the breaking news you need to know while you're sleeping. right now we go to vianey arana in for kari hall this morning to talk about the friday morning weather. a cool start to the morning. >> oh, yeah. we have so many changes ahead. shot of san jose, noticing a couple of clouds but the north
6:33 am
bay seeing most of the clouds. we have the high clouds settling in and the high clouds are letting us know that we've got big changes ahead. so we've got a few hours into the morning hours, and we're still seeing 30s on the map we're cold, 44 degrees around 9:00 a.m. and it will top out into the upper 50s throughout the bay area. the temperatures are similar to what we've seen all week long. the skies not as clear. we can thank this for that. satellite radar, we've got that increase in high clouds because we are tracking our very first storm of the new year, and it's going to bring with it rain, wind, and snow for the sierra. i'll break down all of that for you coming up shortly. >> thanks, vianey. 6:33. a viewing for the stanislas officer there who died, killed in the line of duty. the funeral services happening
6:34 am
several funeral services will be held tomorrow for newman police corporal ronil singh. he was shot and killed nine days ago during a traffic stop. suspect is now in custody, and authorities arrested paulo mendoza three days after the shooting in central calical. investigators believe he is here illegally, and was trying to get back to his native mexico. we follow a developing story in the east bay, police are looking for a woman who attacked another woman jogging on a popular trail. "today in the bay's" pete suratos joins us live from oakland, where it happened ned morning. pete, the victim says the attacker bit her. >> reporter: that's right, kira. the attacker apparently bit the victim on the forearm. in fact, we want to show ours t bite, which she showed police. now i want to show you video of the cell phone video of the attacker walking away from the area. it happened roughly around 10:30 a.m. yesterday. the jogger wrapping up a run
6:35 am
here on the goldenrod trail off of skyline boulevard in oakland near the khabeau riding stables. she noticed the female attacker with two dogs. she claims one of the dogs tried to bite her, and that's when she pepper sprayed the dog. apparently that stopped the dog, but it nt ddidn't stop the dog per >> it's obvious those were not canine bites but rather human teeth. there was a certain amount of punching and kicking when the dog owner, stopped here on the track on the trail. >> reporter: as far as the description of the attacker, she's described as being between the ages of 18 to 25, about 5'6", medium build with blond or auburn colored hair and the two dogs were a rottweiler mix and a yellow and tan dog. the attacker could face aggravated assault charges. if you have any information, contact police. we're live here in oakland, pete suratos for "today in the bay."
6:36 am
>> pete, thank you. 6:35 right now. new for you this morning, california can't say if non-citizens voted in the june 2018 primary. this is coming from the "sacramento bee." the dmv gave a confusing voter eligibility questionnaire. in it people could decline to answer why they cannot vote, so now investigators are trying to determine if some people voted illegally. according to "the bee" the dmv made about 105,000 processing errors. a skateboarder accused of beating a san francisco security guard is expected in court later this morning. we have exclusive video of the november attack in the financial district in the city. security guard dan janson was putting up was putting up

barricades in place to block the state borders, as janson works, the group attacks him, knocking the 57-year-old to the ground. janson's family says a blow to the head with the skateboard has changed the avid fisherman's life forever. he needed emergency brain surgery and is now in a rehab facility where he's learning how to talk and walk once again. >> he can't walk yet. he can feed himself. he started to brush his own teeth, so that was a huge accomplishment. >> the san francisco district attorney's office says 24-year-old jesse vieira is in custody for assault with a deadly weapon. his attorney says he has video to prove vieira was not the aggressor. more snow is forecast for the sierra this weekend. there's hope it will raise californias awater leve s california's water levels. according to the first snowpack survey of 2019, levels are below average. the department of water resources is blaming global warming. however, it did say the snowpack is higher than last year at this same time. the increased amount is crucial, because that snow supplies about 30% of the water here in california. all right, kira, we're going to change again the tone as we head over toward fremont, we still see the closure for
6:38 am
northbound 880. this is our sky ranger view. let me talk you through what they're showing right here. right now northbound 880 is still closed at fremont cushing. this parking lot here, that's the tesla parking lot. if you travel to work or travel through the area, and tesla's on your right in the morning, that would be the direction that is currently closed, but we've seen chp and other emergency vehicles and news crews including ours clearing from the scene as that is getting ready to clear. we're hoping another ten minutes until they can reopen northbound 880, but right now as we look at our map system, it is jammed up. i've been watching the situation, the investigation, and i don't want to show you too close of a scene, because it was a gruesome one as a pedestrian was hit overnight this morning. the traffic report as the scene starts to clear shows you the traffic continuing to build north from dixon landing road. that is the only backup for the bay. everything else is moving smoothly. look at the green sensors all around, because it is friday, of a vacation week for a lot of schools. folks, that is the bay bridge. it's clearing out and it's dry
6:39 am
right now. >> wow. not for long apparently. vianey is in for kari and says three ws, wet weekend weather. >> and windy. >> and windy, okay, four. you're just overachieving now. >> the winter storm is definitely the first one of the year and this is going to help our snowpack levels, but let's look at how it's going to affect your weekend plans. yes, it's going to move on and just in time for your saturday forecast overnight tonight and coast, bay and inland can all expect to see rain. right now, it looks like the heaviest of the rain, that cold front will come in early morning, which means those windy conditions will be right when you're waking up. if you typically wake up around 5:00/6:00 a.m. to get an early start to the day, you'll hear the gusty conditions outside of your window, which means we could see some advisories as early as tonight. we'll monitor that closely. temperatures in the 50s. 57 degrees for inland areas, and then into sunday, sunday is going to be interesting. so sunday we might catch some breaks in the rain, but later
6:40 am
